Abstract

The legal system in Indonesia has seen significant developments in handling healthcare disputes between patients and hospitals through the introduction of the concept of Restorative Justice. The principles of Restorative Justice and inclusive law can be integrated to create a fair, inclusive resolution of conflicts and repair damaged relationships resulting from these disputes. The objective of this research is to analyze the implementation of Restorative Justice in enhancing the resolution of healthcare disputes between patients and hospitals, considering an inclusive legal framework, and identifying potential major obstacles. The research method used is normative research with a focus on legislative analysis and legal literature to explore the concept of Restorative Justice within an inclusive legal framework for resolving healthcare disputes between patients and hospitals. The researcher employs literature review and document analysis techniques to gather and analyze the legal data required for this research. Implementing Restorative Justice for resolving healthcare disputes between patients and hospitals within an inclusive legal framework is an effective approach for resolving healthcare conflicts. Restorative justice emphasizes relationship restoration and mutual understanding over punishment and can be applied in cases of malpractice, patient dissatisfaction, or violations of medical ethics. To be successful, relevant regulations such as the Arbitration Law in Indonesia, trained mediators, and the involvement of all relevant parties are necessary. Protecting patients' rights, transparency, accountability, and effective communication should also be a focus. By implementing restorative justice and an inclusive legal framework, the resolution of healthcare disputes can be more effective, fair, and can improve the relationship between patients and hospitals

Abstract

Health criminal law in Indonesia has developed significantly since the colonial era until now, marked by the birth of various laws and regulations governing criminal aspects in the health sector. This research aims to analyze the development of health criminal law in Indonesia from the perspective of dignified justice, as well as identify challenges and formulate efforts needed in developing health criminal law in line with the principles of dignified justice. This research uses a normative legal research method with a statutory and conceptual approach, examining primary, secondary, and tertiary legal materials through literature studies. Data analysis was conducted qualitatively with a descriptive-analytical approach, involving the process of data reduction, data presentation, and conclusion drawing. The results of the study explain that the development of health criminal law in Indonesia shows a significant evolution, from limited arrangements in the Criminal Code of colonial heritage to comprehensive laws such as Law No. 36/2009 on Health. The perspective of dignified justice is reflected in efforts to balance the protection of patient rights, the professionalism of health workers, and the interests of society. Although there has been progress, there are still challenges such as the application of the ultimum remedium principle, the balance of rights protection, and adaptation to the development of health technology. Efforts to develop health criminal law in line with the principles of dignified justice require a thorough evaluation of criminal provisions, capacity building of law enforcement officers, development of regulations that are sensitive to the diversity of health practices, and collaboration between stakeholders to deal with the complexity of contemporary health issues.

Abstract

The rapid progress of our time is evident in various aspects of life, including the realm of technology. This progress can have both positive and negative effects on users, especially children who are more susceptible to influence. There is a concern that when children come across news or false information in the media, they may unknowingly spread it without verifying its accuracy. Furthermore, there is a possibility that they may engage in Hate Speech without realizing that it is against the law. This raises a research question: How effective is the implementation of Restorative Justice at the investigator level through juvenile diversion in cases involving criminal Hate Speech? To answer this question, the research follows an empirical method and adopts a case-based approach with supporting facts. The research location for the study is the Bali Regional Police (Polda Bali). The research object focuses on hate speech cases involving child suspects and the effectiveness of Restorative Justice through diversion at the investigator level. Data is collected through interviews and documentary studies. In addressing the research problem, the author focuses on the theory of legal effectiveness, which emphasizes prevention rather than punishment by investigators. Investigators base their actions on Article 1 Paragraph 6 and 7 of Law Number 11 of 2012, which prioritizes Restorative Justice and diversion in handling juvenile cases. The use of Restorative Justice and diversion plays a crucial role in protecting the rights of children and preventing discrimination.

Abstract

Pemberantasan korupsi telah menjadi prioritas utama di Indonesia, dengan Kejaksaan Negeri Denpasar mememgang peran kunci dalam Upaya ini. Penelitian ini bermaksud guna mengkaji optimalisasi peran Kejaksaan Negeri Denpasar pada pemberantasan korupsi melalui sosialisasi hukum di masyarakat. Melalui pendekatan kualitatif, data dikumpulkan melalui keterlibatan secara langsung pada saat sosialisasi terjadi juga melalui wawancara dengan petugas kejaksaan dan analisis dokumen terkait. Hasilnya menunjukkan bahwa sosialisasi hukum di masyarakat menjadi instrumen vital dalam upaya pencegahan dan penindakan korupsi. Dalam konsteks ini, jurnal ini menyoroti strategi, tantangan, dan upaya meningkatkan kesadaran hukum dan memperkuat peran mereka dalam pemberantasan korupsi. Temuan dari penelitian ini dapat menjadi landasan bagi upaya lebih lanjut dalam memperkuat peran Kejaksaan dalam memerangi korupsi di tingkat lokal maupun nasional.Optimizing the Role of the Denpasar District Attorney's Office in Corruption Eradication through Legal Socialization in the CommunityAbstract: Eliminating corruption has become a foremost priority in Indonesia with the Denpasar District Attorney playing a key role in this effort. This research aims to examine the optimization of the role of the Denpasar District Prosecutor's Office in eradicating corruption through legal outreach in the community. Using a qualitative approach, data was gathered through direct participation during socialization, interviews with prosecutors, and analysis of relevant documents. The findings show that legal dissemination in society is a vital instrument in efforts to prevent and suppress corruption. In this context, this journal highlights strategies, challenges and efforts to increase legal awareness and strengthen their role in eradicating corruption. The findings from this research can become the basis for further efforts to strengthen the role of the Prosecutor's Office in fighting corruption at the local and national level.

Abstract

Health criminal law policies are important in maintaining community welfare. Complex issues involve law enforcement against illegal drugs, alcohol, smoking, and mental health problems, with ethical considerations regarding the use of punishment versus rehabilitation. The aim of this research is to analyze the integration of a restorative justice orientation in health criminal law policy and evaluate its impact on the effectiveness of law enforcement in protecting public health, as well as identifying obstacles and challenges in its implementation in Indonesia. This research uses a document analysis approach to examine legislation related to health criminal law and the concept of restorative justice, as well as a qualitative approach in data analysis to formulate health criminal law policies based on restorative justice from various legal documents and relevant literature. The research results show that the Restorative Justice Orientation can be integrated into health criminal law policies with various positive impacts, including recovery in dealing with public health violations, rehabilitation without unnecessary criminalization, community involvement, victim recovery, community safety, public education, and cross-border cooperation. sector. Evaluation and revision of policies is important to create a fairer and more sustainable legal system. However, the implementation of this policy in Indonesia has complex challenges such as low public awareness of the concept of restorative justice, limited resources, unequal access to health services, changes in legal culture, injustice, and the role of legal institutions that must be changed

Abstract

Purpose: This research aims to analyze strategies that can be implemented to increase political participation in regional head elections in Bali. In addition, this research was conducted to identify the strengths and weaknesses of each strategy to increase political participation in regional head elections (pilkada/pemilukada) in Bali. Research methods: This research uses a qualitative approach because the aim of this research is not to measure, but to elaborate effective and efficient strategies in increasing political participation in regional head general elections. This research collects secondary data by collecting journal articles that discuss steps to increase political participation in regional head elections. Results and discussion: Community political participation can be increased in the regional head elections in Bali through five strategies, namely implementing dialogical methods through face-to-face forums, using conventional and/or digital media as political communication media, forming democratic volunteers, and providing friendly facilities disadvantaged group. Each of these strategies has advantages and disadvantages. Implication: By implementing this combination of strategies, community participation in the Bali regional head elections can be maximized so as to increase the legitimacy of the elected leaders.

Abstract

Tujuan dari di adakannya pengabdian masyarakat ini ialah untuk memberikan pemahaman yang lebih mendalam dan detail kepada masyarakat tentang apa itu perjudian online, bahaya perjudian online, dan upaya yang dilakukan untuk memberantas perjudian online, kurangnya pemahaman masyarakat awam di bidang hukum mengakibatkan  mereka tidak paham akan akibat hukum apa saja yang bisa timbul akibat tindakan mereka, bukan hanya itu saja pengabdian ini bertujuan untuk menanggulangi masalah hukum ketika apa yang di harapkan tidak sesuai dengan kenyataan, misakan pemerintah dan penegak hukum mengharapkan masyarakat tidak melakukan kejahatan seperti contoh judi online namun nyatanya hal ini masih dilakukan sampai saat ini,yang mengakibatkan permasalahan ekonomi di masyaraka, dengan berkembangnya zaman masyarakat harus di beri pemahaman terkait judi online agar tidak terbawa arus.Adapun metode penelitian yang digunakan pada pengabdian ini yaitu metode pendidikan masyarakat, dimana masyarakat yang di maksud disini adalah warga yang berada di wilayah hukum kejaksaan Denpasar dan mahasiswa sebagai pemberi materi.adapun hasil dari abdi pm ini adalah para masyarakat di wilayah hukum kejaksaan negri denpasar mendapat pemahaman lebih mendalam terkait bahaya dan akibat hukum judi online, yang dimana akan memberikan kesadaran dan taat hukum agar tidak melakukan judi online.

Abstract

A mortgage aims to provide protection and legal certainty for stakeholders, one of which is the mortgage-holding creditor. However, in practice, this goal has not been fully realized, as existing mortgages can still be annulled by the court. Debtors must still be held accountable if the collateral bound by the mortgage is annulled by the court, such as for expenses already incurred by the creditors and for the loss of expected profits from the loan. Another effort creditors can make to reclaim their prioritized rights from the debtor is to require the debtor to replace the collateral annulled by the court with another asset of equal nominal value, and then impose a new mortgage on the replacement asset, such as in the form of a mortgage, fiduciary, hypothec, or pledge.

Abstract

Cigarettes pose a significant global health threat, resulting in millions of related deaths annually. Consequently, governments worldwide, including Indonesia, have implemented smoke-free area policies in an effort to mitigate these health concerns. This study analyzes the effectiveness of criminal sanctions imposed on violators of smoke-free areas in Indonesia, while identifying legal challenges in enforcing these regulations and proposing normative solutions within the framework of responsive law. Utilizing a normative legal approach, this study combines both statutory and conceptual methodologies to analyze primary, secondary, and tertiary legal materials through literature studies. It employs a qualitative descriptive analysis method to examine the efficacy of criminal sanctions against violators of smoke-free areas in the context of responsive law. The results indicate that the effectiveness of criminal sanctions to enforce smoke-free areas in Indonesia is hindered by various constraints, including weak law enforcement, limited public awareness, economic conflicts of interest, and inadequate smoking facilities. This study recommends adopting a responsive law approach. This entails strengthening law enforcement, conducting continuous socialization and education programs, establishing special smoking facilities, involving the tobacco industry in health policy-making, and reformulating policies through a participatory approach. By implementing these responsive law solutions, it is anticipated that smoke-free area regulations can be more effectively enforced, garner the support of all parties involved, and contribute to enhanced public health protection from the risks associated with cigarette smoke.

Abstract

Penyuluhan hukum merupakan suatu kewenangan seorang notaris dalam melayani masyarakat yang memerlukan jasa hukumnya dalam hal pembuatan akta autentik sehingga memiliki kekuatan hukum. Penyuluhan hukum bertujuan untuk mewujudkan kepastian hukum terkait akta yang akan dibuatnya. Persoalan yang muncul adalah bagaimana penerapan penyuluhan hukum yang dikerjakan atas seorang notaris kepada klien pada hal pembuatan akta autentik? Serta apa saja akibat apabila notaris tak menerapkan penyuluhan hukum tersebut? Penulisan ini bertujuan untuk meneliti bagaimana penerapan penyuluhan hukum tersebut agar dapat memberikan edukasi kepada masyarakat yang memerlukan jasa notaris. Metode yang dipergunakan ialah pendekatan kualitatif beserta teknik pengumpulan data dalam bentuk hasil wawancara beserta seluruh staff dan pimpinan Kantor Notaris & PPAT Basuki Juni Nugraha, SH yang merupakan lokasi PKL penulis. Selain teknik wawancara, dengan adanya observasi langsung pada lokasi PKL, penulis dapat menganalisis terkait fenomena yang diangkat serta sejauh mana penerapan penyuluhan hukum tersebut dilakukan oleh notaris. Hasil penelitian ini adalah telah diterapkannya penyuluhan hukum atas notaris terkait beserta proses pembuatan akta autentik. Pada kegiatan PKL ini, penulis dapat berkontribusi secara langsung dalam menerapkan etika profesi notaris terkait proses awal hingga akhir pembuatan akta autentik.
