Abstract

Akta autentik ialah instrumen bukti tertulis untuk menjamin adanya kepastian hukum dalam melakukan perbuatan hukum. Secara khusus, Notaris memiliki kewenangan pada pembuatan akta autentik sebagaimana telah diatur pada undang-undang. Pentingnya implementasi prinsip kehati-hatian oleh notaris pada pembuatan akta autentik selaku bentuk pelayanan hukum yang memberi kepastian maupun perlindungan hukum untuk masyarakat. Tujuan penelitian ini untuk mengetahui bagaimana penerapan prinsip kehati-hatian oleh notaris dalam memberikan pelayanan hukum pembuatan akta autentik dan apa akibat hukum jika notaris tidak menerapkan prinsip tersebut. Penulisan ini mempergunakan metode observasi juga wawancara bersama staf Kantor Notaris & PPAT Basuki Juni Nugraha, SH. Hasil penelitian ini, menjelaskan bahwasanya penerapan prinsip kehati-hatian oleh notaris dimulai dari melakukan pengenalan terhadap penghadap, mengecek data yang diajukan penghadap sesuai dengan pernyataan yang diberikan dan memastikan semua teknik administratif telah lengkap untuk mencegah timbulnya permasalahan hukum di kemudian hari. Kemudian untuk akibat hukum dapat dilihat dari perbuatan hukumnya terlebih dahulu. Terhadap akta yang cacat, maka bisa batal demi hukum maupun bisa dibatalkan dan notaris yang terbukti berbuat kesalahan haruslah bertanggungjawab secara hukum baik secara perdata, administratif maupun pidana. Pada kegiatan pengabdian berlangsung, penulis ikut berkontribusi dalam pemenuhan penerapan prinsip kehati-hatian pembuatan akta autentik.

Abstract

Disabilitas merupakan keterbatasan fisik maupun mental yang dimiliki oleh orang – orang istimewa. Cukup banyak penyandang disabilitas yang belum memiliki kesempatan yang sama selayaknya khalayak umum dalam memperoleh edukasi terkait keuangan, inofrmasi keuangan, maupun pelayanan publik. Berdasarkan observasi yang dilakukan secara mandiri, didukung dengan fakta nyata di lapangan bahwa penyandang disabilitas memiliki kesempatan yang sedikit untuk merasakan pelayanan publik dan edukasi digital, maka muncul lah usulan inovasi sistem informasi keuangan ramah disabilitas yang dikenal dengan aplikasi SRIKANDI. Aplikasi SRIKANDI merupakan aplikasi yang dirancang khusus dengan fitur – fitur terbaik bagi penyandang disabilitas agar dapat merasakan pengalaman menggunakan aplikasi guna mendapatkan edukasi seputar ekonomi terkhusus keuangan, kemudian informasi seputar keuangan, dan layanan administrasi. Tujuan adanya usulan aplikasi SRIKANDI adalah guna memberikan kesempatan bagi penyandang disabilitas untuk turut menggunakan fasilitas penunjang pengetahuan seputar keuangan dan layanan publlk dengan nyaman tanpa terhalang oleh keterbatasan yang dimilikinya. Metode yang digunakan dalam penelitian ini adalah metode observasi melalui survey terhadap orang – orang dengan disabilitas, dan melakukan analisis aksesibilitas. Berdasarkan penelitian, ditemukan bahwa masih banyak penyandang disabilitas tidak dapat mengakses layanan informasi keuangan maupun pelayanan publik yang memadai. Maka dari itu, diusulkan sstem informasi keuangan berbasis aplikasi yang ramah disabilitas dengan fitur – fitur pendukung seperti pembaca layar, interpretasi bahasa isyarat, hingga asisten virtual yang dapat mempermudah para penyandang disabilitas dalam memperoleh edukasi hingga layanan publik.

Abstract

Perkembangan digitalisasi yang pesat pada era teknologi dan informasi telah membawa perubahan signifikan dalam proses bisnis, termasuk dalam prosedur audit perusahaan. Penelitian ini bertujuan untuk menilai efektivitas penggunaan aplikasi ATLAS berbasis Excel dalam proses audit untuk menilai kewajaran laporan keuangan perusahaan. Metode penelitian yang digunakan adalah kualitatif deskriptif, yang mencakup kajian teori, observasi lapangan, dan analisis data. Hasil penelitian menunjukkan bahwa aplikasi ATLAS mempermudah auditor dengan mengotomatisasi proses dokumentasi kertas kerja, yang sesuai dengan standar dan ketentuan audit yang berlaku di Indonesia. Temuan penting dari penelitian ini adalah bahwa penggunaan ATLAS meningkatkan efisiensi dan akurasi proses audit, yang pada akhirnya meningkatkan kualitas hasil audit. Kesimpulannya, ATLAS terbukti menjadi alat yang bermanfaat dan efisien dalam mendukung pelaksanaan prosedur audit laporan keuangan, serta membantu auditor memenuhi standar audit yang telah ditetapkan.

Abstract

The legal certainty regarding the requirement of gross negligence as one of the elements of criminalization for medical personnel has become a debated issue due to the absence of clear boundaries in the laws and regulations, resulting in difficulties for judges in determining the criteria for gross negligence and potentially leading to legal uncertainty and injustice. This research aims to analyze the legal certainty regarding the requirement of gross negligence as one of the elements of criminalization for medical personnel in the applicable laws and regulations in Indonesia, as well as to examine the implications of this legal uncertainty on law enforcement and public trust in the medical profession. This research utilizes a normative legal research method with a statutory and conceptual approach, and collects data through library research on relevant primary, secondary, and tertiary legal materials. The analysis is carried out using content analysis techniques and legal interpretation. The research results reveal that the legal certainty regarding the requirement of gross negligence as one of the elements of criminalization for medical personnel is still unclear in the applicable laws and regulations in Indonesia. The lack of a clear definition and criteria regarding gross negligence in the Criminal Code and the Health Law leads to legal uncertainty and difficulties for judges in determining whether a case can be categorized as gross negligence, which has the potential to cause disparities in court decisions. This condition has significant implications for fair and consistent law enforcement, public trust in the medical profession, and the evidentiary process, which becomes more difficult. Therefore, efforts are needed to clarify the legal certainty regarding the requirement of gross negligence to ensure justice and legal certainty for all parties.

Abstract

Health criminal law in Indonesia is part of the legal system which aims to protect the public from medical practices that violate the law or endanger health, as well as an effort to maintain professionalism in health.  Several examples of cases that violate health criminal law in Indonesia often occur, such as medical malpractice, illegal abortion, and illegal organ and drug trafficking. Therefore, medical personnel are expected to act in accordance with professional ethical standards and respect patient rights, as well as be responsible for medical decision making. Overall, health criminal law in Indonesia has an important role in ensuring protection for patients and maintaining professional standards for medical personnel. However, regulatory challenges and the intersection between medical ethics and social morality often become obstacles to its implementation, requiring policies that are more responsive and balanced to the needs of society and medical personnel.

Abstract

The convergence of legal realist theory and Islamic legal philosophy offers opportunities to harmonize substantive justice principles with ethical values in modern business law, addressing the challenges of globalization and the complexity of contemporary economic practices. This study aims to analyze the application of legal realist theory and Islamic legal philosophy in modern business law practices. It employs normative legal methods with a conceptual approach, examining the application of legal realist theory and Islamic legal philosophy in modern business law through the analysis of primary, secondary, and tertiary legal materials, as well as descriptive and normative analytical techniques to produce comprehensive practical recommendations. The findings reveal that the application of legal realist theory in value-based Islamic business law emphasizes adaptation to social realities while upholding Sharia principles such as justice, transparency, and balance, implemented in Islamic financial systems through contracts like mudharabah and murabahah. This is regulated under laws such as Law No. 21 of 2008 and supported by DSN-MUI fatwas. Furthermore, Islamic legal philosophy significantly impacts modern economic practices by integrating principles of justice and sustainability through wealth redistribution using zakat, waqf, and infaq, and promoting green economics based on the concept of al-‘imarah. With its ethics-based and socially responsible approach, Islamic legal philosophy supports long-term economic stability and the relevance of business law in a global context.

Abstract

Necrophilia, the act of engaging in sexual activities with corpses, remains an unregulated legal and ethical issue in Indonesia. The absence of specific legal provisions creates challenges in law enforcement and societal protection. This study analyzes the legal gaps in handling necrophilia cases and proposes reforms to ensure proper criminalization and deterrence. Using a normative legal research method, this study relies on library resources, including books, journals, and legal documents. Case studies help examine the legal and social implications of necrophilia. The findings reveal that necrophilia is not explicitly regulated under the Indonesia’s Criminal Code, leading to inconsistent legal responses and unclear punitive measures. While such acts violate societal norms and laws, their legal categorization remains ambiguous. A comparative analysis of international legal frameworks highlights the need for Indonesia to strengthen its laws. Countries like the UK and the U.S. classify necrophilia as a sexual crime, ensuring stricter penalties. The absence of similar provisions in Indonesia underscores a critical gap in the country’s criminal law, requiring urgent reform. Addressing this gap will reinforce legal protections and uphold societal values regarding the dignity of the deceased. It is recommended that Indonesia incorporate specific laws against necrophilia, drawing from international best practices, to ensure comprehensive legal enforcement and deterrence.

Abstract

Health criminal law in the Indonesian context is actually regulated in Article 427 to Article 448 in Law 17 of 2023 concerning Health (Health Law). This is a major change in the health sector and covers various aspects that regulate public health, health services, and criminal law related to violations in the health sector. This study aims to analyze two important aspects, namely: (i) the regulation of health criminal law between Indonesia and Algeria and its relation to the protection of human rights, and (ii) the future regulation of health criminal law in Indonesia in realizing the protection of health rights for the community. This research is a normative legal research with conceptual, comparative and legislative approaches. The result of the research confirms that health criminal law can be said to be the main instrument to maintain and ensure health rights for the community. The findings of this research confirm that the main difference between Indonesia and Algeria lies in the way health criminal law is organized and applied. Indonesia has more detailed and specific regulations that address malpractice, medical negligence and the health sector more holistically. Whereas Algeria tends to regulate this in a more general framework, following the existing criminal code. The recommendation from this study is that there is a need for legal harmonization between health criminal sanctions in Articles 427 to 448 in Law 17 of 2023 on Health (Health Law) and the New Criminal Code including more detailed special regulations on malpractice, including investigation procedures, evidence, and criminal sanctions against medical personnel who are proven to be negligent or deliberately commit medical errors. This will provide legal certainty for patients and medical personnel.

Abstract

The Attempt in criminal law, often referred to as "poging," refers to the effort to commit a crime that has not been completed. In this case, even though there are no casualties, the perpetrator can still be subjected to legal sanctions because they have attempted a crime. This research aims to analyze the theory of attempt or "poging" from an ethical perspective in relation to the imposition of penalties for failed crimes. This research is a normative legal study with a conceptual, legislative, and philosophical approach. The research results affirm that from an ethical perspective, attempted crimes are intended as a preventive measure to ensure that the consequences of a crime do not occur, so that even in the preliminary process, criminal sanctions can already be imposed. This is also intended to ensure that every member of society can be protected from the consequences of a crime occurring, so that even in the preliminary process, criminal sanctions can already be imposed. The theory of attempt (poging) and its application in Indonesian criminal law has indeed caused several issues in the Old Penal Code, such as the unclear definition of when an act can be considered as the "beginning of execution" and the potential for disparities in judges' rulings due to the lack of clear regulations. Nevertheless, this has been regulated and improved in the New Penal Code

Abstract

This research aims to analyze two legal issues, namely the development of concepts related to restorative justice in Indonesia and South Africa, and a legal comparison regarding the policies and implementation of restorative justice in Indonesia and South Africa. This research is a normative legal study with a conceptual, legislative, and conceptual approach. The research findings affirm that the development of *restorative justice* in Indonesia and South Africa is influenced by post-conflict conditions and authoritarianism: in Indonesia after the 1998 reform and in South Africa post-apartheid 1994. In Indonesia, restorative justice was initially focused on juvenile justice, while in South Africa it was more on post-apartheid reconciliation and addressing human rights violations. Policies in Indonesia prioritize the application of restorative justice (RJ) for juvenile cases and minor offenses through mediation, while in South Africa, RJ is used for post-apartheid reconciliation, with the Truth and Reconciliation Commission (TRC) as a key element, despite criticisms regarding its application to major crimes
