Abstract

Abstract: This research aims to detail the application of the nemo plus iuris principle in the land registration process through the electronic system at the Makassar City Land Office, as well as the implementation of land registration through the electronic system at the Makassar City Land Office. In this research, legal regulations and field realities will be detailed to answer this thesis. This research uses the empirical legal research method, with the research location at the Makassar City Land Office. Data collected through interview techniques and literature study, which were then analyzed descriptively and analytically. The research results show that the application of the nemo plus yuris principle has been well implemented, and is reinforced by the principle of prudence and strict system oversight. The application ensures that the data inputted matches the original documents at the online file verification stage, and automatic rejection occurs if there are discrepancies. In this case, the implementation of land registration through the electronic system has shown significant progress in improving the efficiency of land services to the community. Research recommendation, the Makassar City Land Office should enhance land registration through an electronic system to reduce the risk of land disputes. And strengthen cooperation with PPAT to ensure that every deed made is in accordance with the field conditions and applicable legal regulations. Keywords: Land Registration, Electronic Certificates, Nemo Plus Yuris Abstrak: Penelitian ini bertujuan untuk merinci penerapan asas nemo plus yuris dalam proses pendaftaran tanah melalui sistem elektronik, serta pelaksanaan pendaftaran tanah melalui sistem eletronik di Kantor Pertanahan Kota Makassar. Di dalam penelitian ini peraturan hukum dan kenyataan di lapangan akan di rinci dalam menjawab skripsi ini. Penelitian ini menggunakan metode penelitian hukum empiris, dengan lokasi penelitian di Kantor Pertanahan Kota Makassar. Data yang dikumpulkan melalui teknik wawancara dan studi pustaka, yang kemudian dianalisis secara deskriptif analitis. Hasil penelitian menunjukkan bahwa penerapan asas nemo plus yuris telah diterapkan dengan baik, dan diperkuat oleh prinsip kehati-hatian serta pengawasan sistem yang ketat. Aplikasi memastikan data yang diinput sesuai dengan dokumen asli pada tahapan verifikasi berkas secara online dan penolakan otomatis terjadi jika terdapat ketidaksesuaian. Dalam hal ini dalam pelaksanaan pendaftaran tanah melalui sistem elektronik telah menunjukkan kemajuan yang signifikan baik dalam meningkatkan efisiensi pelayanan pertanahan kepada masyarakat. Rekomendasi penelitian, Kantor Pertanahan Kota Makassar meningkatkan pendaftaran tanah melalui sistem elektronik untuk mengurangi resiko sengketa tanah. Dan memperkuat kerja sama dengan PPAT untuk memastikan setiap akta yang dibuat telah sesuai dengan kondisi lapangan dan aturan hukum yang berlaku. Abstract

Tujuan penelitian menganalisis penerapan pidana mati di Indonesia dari perspektif Hak Asasi Manusia (HAM), dengan menyoroti dilema antara upaya penegakan hukum dan perlindungan hak hidup sebagai hak dasar yang tidak dapat dikurangi dalam keadaan apa pun. Metode penelitian yang digunakan adalah pendekatan normatif-yuridis Hasil penelitian menunjukkan bahwa (KUHP) baru telah mengadopsi moderasi dalam penerapan pidana mati, dengan menetapkan masa percobaan selama 10 tahun sebelum eksekusi dilaksanakan. Penelitian Penelitian ini menemukan bahwa penerapan pidana mati di Indonesia masih menimbulkan kontroversi dalam perspektif HAM, terutama terkait hak hidup. KUHP baru memberikan masa percobaan 10 tahun sebelum eksekusi sebagai bentuk moderasi hukum. Selain itu, kepastian hukum dianggap penting agar pidana mati diterapkan secara adil, tidak diskriminatif, dan tetap menjamin perlindungan hak asasi manusia. The research objective is to analyse the implementation of the death penalty in Indonesia from a Human Rights (HAM) perspective, by highlighting the dilemma between law enforcement efforts and the protection of the right to life as a basic right that cannot be reduced under any circumstances. The research method used is a normative-juridical approach. The results of the study indicate that the new Criminal Code (KUHP) has adopted moderation in the implementation of the death penalty, by setting a 10-year probationary period before execution. This study found that the implementation of the death penalty in Indonesia still causes controversy from a human rights perspective, especially regarding the right to life. The new Criminal Code provides a 10-year probationary period before execution as a form of legal moderation. In addition, legal certainty is considered important so that the death penalty is implemented fairly, non-discriminatory, and still guarantees the protection of human rights

Abstract

This study aims to analyze the differences in legal treatment of hoax and defamation dissemination on social media compared to conventional media and to understand the role of social media in preventing the spread of false information. The research adopts an empirical juridical approach by conducting interviews with South Sulawesi Regional Police Crime Investigation Unit . The findings indicate differences in legal treatment based on the characteristics of both types of media, including variations in the sanctions imposed on perpetrators. On social media, preventive measures are carried out through public education, particularly targeting social media users, about the legal risks of spreading hoaxes. South Sulawesi Regional Police Crime Investigation Unit established the Cyber Patrol Task Force as part of its preventive and repressive strategies to tackle the issue

Abstract

This research aims to determine and analyze the fulfillment of the application of proficiency requirements by payment service providers when purchasing online game items. To find out and analyze the efforts that online game service users can take to deal with the losses they experience. The research method used is the Normative research method, namely a legal research method that is sourced from regulatory and secondary document data in the form of collection from library and tertiary materials which are documents that contain concepts and information such as dictionaries. The results of this research show that the sale and purchase agreement for payment services for buyers of online game items does not fulfill the subjective and objective requirements which are the legal requirements for an agreement. The condition that is not fulfilled is that those who bind themselves agree to a certain thing and a lawful cause. for consumers for losses received due to irresponsibility of business actors in paying off transactions is clearly regulated in article 19 UUPK. However, if the business actor's number can be contacted, the perpetrator can be held responsible for compensation. Recommendations for this research: The government should also have more awareness and supervision of legal issues that arise in society, so that it can quickly act against negative elements that endanger society.

Abstract

This study aims to determine the legal validity of information technology-based loan agreements. The research method used is normative legal research, which utilizes secondary data sources. These sources include the opinions of experts or specialists who study books, journals, and literature on the legal basis of contracts and laws and regulations. The research findings indicate that Information Technology-Based Lending Services (Fintech Lending) are an innovation in the financial sector that enables online lending and borrowing transactions using electronic systems. Online loan agreements are regulated by Financial Services Authority Regulation Number 10/POJK.05/2022. These agreements are legally valid and enforceable as long as they meet the legal requirements as stipulated in Article 1320 of the Civil Code, namely agreement, capacity, a specific matter, and a lawful cause. Dispute resolution in information technology-based loan agreements in the event of default can be carried out through litigation or non-litigation. Litigation is commonly referred to as the path taken in court, while non-litigation is through Alternative Dispute Resolution Institutions (LAPS), which include mediation, arbitration, and binding opinions. This research recommends educating users about the terms and conditions of agreements, focusing on legal validity and certainty, and strengthening regulations on personal data security and dispute resolution mechanisms.

Abstract

The introduction of the Indonesian Perseroan Perseorangan (Single-Member Company/SMC) under the Job Creation Law is intended to improve the ease of doing business. Allowing a company to be established and managed by a single individual, the SMC signifies a transformation from traditional corporate law principles. While existing studies emphasize economic deregulation and business formalization, limited attention has been paid to whether this simplified corporate model is compatible with the emerging paradigm of Sustainable Corporate Governance (SCG). This study addresses that gap by evaluating the Indonesian SMC framework through an SCG perspective and comparing it with the European Union’s regulatory approach. Its principal contribution is the development of an SCG-based comparative evaluative framework for assessing simplified corporate entities, demonstrating that the compatibility of Single-Member Company regimes should be measured not only by ease of doing business but also by their capacity to ensure long-term governance accountability, stakeholder protection, and environmental responsibility. Employing normative legal research and a comparative legal approach, this study examines Indonesia's regulatory framework in comparison with the European Union's SMC regime using four dimensions of SCG: governance accountability, transparency and sustainability disclosure, stakeholder and creditor protection, and corporate environmental responsibility. The findings reveal that although Indonesia's regulatory model significantly improves business accessibility and administrative efficiency, it provides limited institutional safeguards to support sustainable governance. By contrast, the European Union adopts a more balanced regulatory approach that combines business flexibility with governance safeguards. Therefore, the study proposes a proportionate governance model capable of reconciling business simplification with sustainable corporate governance.
