Abstract

This study aims to analyze the legal protection for wives in murder cases from the perspectives of Islamic law and positive law. In the context of Islamic law, the principle of justice governs the rights of wives, including protection against domestic violence. However, the implementation of this principle in judicial practice still faces various challenges. On the other hand, Indonesia's positive law, despite regulating women's protection through the Law on the Elimination of Domestic Violence (UU PKDRT), also encounters obstacles in effective law enforcement, particularly in cases of violence resulting in murder. This study also discusses the comparison of sanctions imposed on perpetrators of wife murder in both legal systems, highlighting significant differences in the determination and implementation of penalties. Additionally, this research identifies major challenges in law enforcement, such as the lack of gender sensitivity among law enforcers and the limited access victims have to effective protection. The proposed policy recommendations include strengthening regulations on wife protection, enhancing the capacity of law enforcement officers, and expanding access to legal and psychological services for victims. This study contributes to the development of a more responsive legal policy for women's protection.

Abstract

Zuhud is not merely understood as physical detachment from worldly possessions but rather as an inner release from excessive dependence on material pleasures. In the context of modern life, which is dominated by materialism and consumerism, zuhud provides an alternative conscious lifestyle that balances worldly needs with ultimate spiritual goals. This article aims to examine the concept of zuhud within classical Sufi traditions and to explore its relevance to sustainable living in contemporary society. The study employs a library research method with Sufi and Islamic psychological (nafsiyological) approaches. The findings reveal that zuhud encompasses significant spiritual, psychological, and social dimensions. Spiritually, zuhud fosters transcendental awareness; psychologically, it contributes to self-control and mental well-being; and socially, it promotes simplicity, solidarity, and sustainability in resource utilization. Thus, zuhud can be recontextualized as an ethical and spiritual framework to address the value crisis, psychological pressures, and ecological challenges of modern society.ABSTRAKZuhud tidak sekadar dimaknai sebagai sikap menjauhi dunia secara fisik, tetapi lebih pada pelepasan ketergantungan batin terhadap kenikmatan materi yang berlebihan. Dalam konteks kehidupan modern yang sarat dengan materialisme dan konsumerisme, nilai-nilai zuhud menghadirkan alternatif gaya hidup berkesadaran yang mampu menyeimbangkan kebutuhan duniawi dan ukhrawi. Artikel ini bertujuan untuk mengkaji konsep zuhud dalam tradisi tasawuf klasik serta mengeksplorasi relevansinya terhadap gaya hidup berkelanjutan di era kontemporer. Penelitian menggunakan metode studi pustaka dengan pendekatan sufistik dan psikologi Islam (nafsiyologis). Hasil kajian menunjukkan bahwa zuhud memiliki dimensi spiritual, psikologis, dan sosial yang signifikan. Pada dimensi spiritual, zuhud menumbuhkan kesadaran transendental; pada dimensi psikologis, ia berkontribusi dalam pengendalian nafsu serta kesehatan mental; dan pada dimensi sosial, ia mendorong pola hidup sederhana, solidaritas, serta keberlanjutan dalam pemanfaatan sumber daya. Dengan demikian, zuhud dapat direkontekstualisasikan sebagai kerangka etis dan spiritual untuk menghadapi krisis nilai, tekanan psikologis, dan tantangan ekologis masyarakat modern.
