Abstract

Violence against children is a serious problem that has a detrimental impact on the physical, mental and emotional development of children throughout the world. This research aims to conduct an in-depth analysis of legal regulations related to child violence from a criminological and victimological perspective. Through a normative and descriptive legal research approach, this research reveals that, although there have been efforts to regulate and protect children's rights, there are still weaknesses in the legal system that require further improvement. The results of this study highlight the need to improve the implementation of existing laws and the important role of understanding criminological factors and victim protection from a victimology perspective in handling child abuse cases. It is hoped that this research can provide guidance for improving policies, more effective implementation, and better protection for children who are victims of violence, creating a safer society and caring for children's welfare.Keywords: Child Violence, Criminology, Victimology

Abstract

Looking at the development of technology that is so fast and also used in all fields to provide convenience. This also includes electronic transactions on online loan applications (pinjol), given the current economic conditions that are not in a good condition due to Covid-19, many people choose loan applications to meet their needs without seeing the overall consequences of their actions. The case of a pinjol application that attacks the personal data of its users is of course a prohibited act because it is related to someone's personal data. This study aims to find out how the legal protection for illegal loan service users in Indonesia is and what are the obstacles to law enforcement in dealing with loan lending cases in Indonesia. This research uses normative legal research methods. And it is known that in Indonesia, about criminal law policies that can be used to punish debtors for their actions, they can use UUPK because of the position of borrowing users as consumers and use the ITE Law because transactions are carried out using electronic media. The obstacles that occur are the lack of experts in the field of electronics in law enforcement and also the ITE Law is not strong enough to ensnare borrowers.

Abstract

Trademarks have played a significant role in safeguarding intellectual property within the fashion industry and have been instrumental in upholding the reputation of various companies, particularly those aspiring to adopt sustainability concepts. This research aims to delineate the legal challenges and potential solutions for protecting intellectual property rights related to trademarks and the integrity of claims for sustainability implementation in Indonesia, employing normative research methods and comparative analysis with Italy's legal framework. The analysis reveals several structural differences between Indonesia and Italy's trademark legal frameworks despite sharing similar objectives. Italy has already been able to foster the integrity of sustainable claims in the fashion industry through regulations from the European Union although no direct connection to trademarks exists. On the other hand, Indonesia has yet to regulate the integrity of sustainable claims in the fashion industry although it possesses a sufficient foundational framework that could be further developed through its connection to the communal intellectual property protection system. Secara tradisional, merek memiliki peran penting dalam melindungi kekayaan intelektual di dalam industri fesyen dan telah menjadi kunci dalam menjaga reputasi berbagai perusahaan, terutama yang berkeinginan menerapkan konsep keberlanjutan. Penelitian ini bertujuan untuk menguraikan tantangan hukum dan solusi potensial dalam melindungi hak kekayaan intelektual yang terkait dengan merek serta menjaga integritas klaim implementasi keberlanjutan di Indonesia, dengan menggunakan metode penelitian normatif dan analisis perbandingan dengan kerangka hukum Italia. Analisis ini mengungkapkan beberapa perbedaan struktural antara kerangka hukum merek di Indonesia dan Italia, meskipun memiliki tujuan yang serupa. Italia telah berhasil menggalang integritas klaim keberlanjutan di industri fesyen melalui regulasi dari Uni Eropa, meskipun tidak ada keterkaitan langsung dengan merek. Di sisi lain, Indonesia masih harus mengatur integritas klaim keberlanjutan di industri fesyen, meskipun memiliki landasan kerangka kerja yang memadai yang bisa lebih dikembangkan melalui keterhubungannya dengan sistem perlindungan kekayaan intelektual komunal.

Abstract

Restorative justice yaitu langkah lain atas peradilan pidana dengan berfokus pada metode yang mengintegrasi pelaku disatu sisi dengan korban, juga publik yang menjadi sebuah kesatuan dalam menemukan solusi dan kembali terhadap bentuk hubungan yang baik dalam masyarakatnya. Tujuan dalam tulisan ini akan membahas tentang aturan terkait Restorative Justice pada undang-undang serta efektivitas implementasi Restorative Justice pada penanganan masalah pidana pelecehan seksual yang di lakukan oleh anak di kota Batam. Metode dalam penulisan ini menggunakan metode normatif-Empiris. Implementasi keadilan restoratif timbul dalam perjanjian diantara pihak yang ikut pada perkara pidananya, tanpa terdapat paksaan pihak kepolisian. Penggunaan metode keadilan restoratif untuk mengatasi masalah pidana dikawasan hukum Polresta Barelang Batam dinyatakan sangatlah efektif, sebab dapat mengendalikan kehendak seluruh pihak yang ikut pada perkara pidananya. Hal ini akan menghindari kemunculan masalah yang umumnya dapat timbul ketika sebuah pihak keinginannya tak terakomodir.

Abstract

Assault crimes are violent by nature and are often perceived as a serious threat to public safety. However, the complexity of each crime needs to be analyzed thoroughly in a legal procedure to make sure that important values and principles are applied. This is particularly important among juvenile offenders, where the enforcement of justice needs to be upheld without sacrificing the future of youth. This research is done to analyze the challenges in ensuring procedural rights for juvenile assault offenders in Indonesia. Through the normative legal research method combined with a statutory approach, this research uncovers the legal challenges that juveniles face in accessing their procedural rights in Indonesia’s juvenile justice system and how these challenges can be improved. Analysis of this research finds that the Indonesian legal framework is still lacking in many ways, particularly in ensuring the right to ease of access to information regarding the case and the protection of privacy. The analysisThe analysis also shows that these issues cause conflicts with other laws, constitutional principles, and international standards. This research not only highlights the gaps in Indonesia’s juvenile justice system but also lays a theoretical foundation for developing a more holistic and rights-based approach to juvenile justice reform.

Abstract

Public procurement corruption is one of the most prevalent forms of corruption, with one of the most dangerous and potentially catastrophic impacts on public interests. Despite the continuous efforts to battle corrupt in Indonesia, Malaysia, and Thailand, the three countries are still haunted by the possibility of public procurement corruption, which can significantly stunt their economic growth and overall prosperity. Employing the normative legal research method, this study aims to assess the legal implications of corruption in public procurement and make a case for the acknowledgement of aggravating factors in the relevant criminalization. For this objective, this study analyzes elements of mens rea and causal nexus in the countries’ relevant anti-corruption frameworks. Analysis conclusively reveals that the three countries are not equipped to tie mens rea and causal nexus due to the lack of distinction between them in the relevant frameworks. The study therefore recommends possible amendment by adding a provision that would enable a dual-layered culpability approach, tying mens rea and the actual evidence of corrupt act to the knowledge of possible harm that the perpetrators have, to potentially build a case for a stronger punishment, or provide better normative foundation for future legal developments with the explicit acknowledgement of the broader harms caused by public procurement corruption. The significance of this study lies in its effort to increase the awareness on corruption, particularly by assessing the impacts of public procurement corruption and the mental state behind it, to ultimately make the legal case for harsher punishments against this enduring crime that has stunted growth in Indonesia, Malaysia, and Thailand
