Abstract

This research discusses the Implementation and Inhibiting Factors of Rehabilitation of Children as Drug Users at the Gorontalo Children's Special Development Institution. The method used in the research is empirical with qualitative descriptive data analysis which describes and describes data and facts in the field. Based on the results of the research, the implementation of rehabilitation for children as drug users at the Gorontalo Province Special Child Development Institute is carried out through several stages, namely medical rehabilitation which begins with assessments and interviews as well as observations to examine the body and psychology in order to obtain information and history of narcotics addicts as supporting material for subsequent therapy. After the assessment, the next step is a routine examination process every 2 weeks by a health team or doctor, and administering medication according to the type of drug and the severity of the symptoms caused; Non-medical rehabilitation by carrying out a mental (spiritual) development process which is carried out routinely every day, in collaboration with religious foundations; and Social Rehabilitation by creating groups consisting of several people who have the same problem, then training in their skills to make work or crafts that have (economic) value. The Inhibiting Factors for Implementing Rehabilitation for Children who Use Drugs at the Gorontalo Province Special Development Institution for Children are limited human resources for officers; Limited Operational Funds; limited facilities and infrastructure, and lack of community support.Therefore, LKPA should continue to increase efforts to develop children so that they do not do similar things again in the future, by preparing rehabilitation infrastructure, including increasing competent and professional assistant staff. The community, especially families, must continue to provide full support for the process of coaching their children who are dealing with legal processes such as drugs, for the sake of the future of the nation and state.

Abstract

The problems that occur in the world of education do not only revolve around the socio-economic sector, but have also penetrated the legal realm, as can be seen from the many cases that have arisen in the school environment related to violence perpetrated by unscrupulous teachers against their students. Teachers who should be at the forefront in fortifying and protecting children at school actually do the opposite. The problem raised in this research is: what is the impact of physical violence by teachers on children in the school environment. This research is directed at empirical legal research and the approach used in this research uses a statutory regulation approach and a case approach. This research was carried out at Gorontalo Police. The results of the research and discussion explain that the impacts felt by students as a result of physical violence committed by teachers are divided into 3 (three), namely physical, psychological and social impacts.

Abstract

The problem of land ownership in Buntulia Village is influenced by the lack of knowledge and awareness of the community about land ownership rights because of the total population of 549 families, 463 people have not registered their own land. This of course raises a fairly basic problem by the village government to be resolved. Therefore, in this downstreaming, the service team provides understanding and legal knowledge to the community about the importance of registering property rights and providing assistance to the community together with the Land Agency through the Border Marks Post Community Movement (GEMA PATAS) in order to increase community participation in installing boundary markings, making it easier for BPN officers to take measurements, as well as being able to accelerate the government program on Complete Systematic Land Registration. Thus the community could see the importance of legalizing property rights to the land in order to avoid disputes and thereby give legal certainty to the parties.

Abstract

This research aims to find out how the crime of raping minors is handled. This research is empirical legal research by presenting field facts as the main data, which are then analyzed descriptively qualitatively. The research results show that the handling of criminal acts, especially those related to sexual intercourse, is usually left to the parents of the victim or perpetrator. The sexual intercourse referred to is when the perpetrator and victim have sexual relations on the basis of mutual consent and it is disputed by the victim's family. What is the PPA unit of the Gorontalo City Police doing in terms of making peace efforts, because considering that the perpetrators of this crime are still children, protection measures must also be taken so that the children can grow and develop and return to normal activities in society. This handling includes receiving complaint reports, the investigation and case investigation stage, the file transfer stage and providing protection for victims. Law enforcers need to consider implementing the concept of restorative justice in minor cases in accordance with existing provisions, but not in cases of rape or sexual violence, especially against children. Apart from that, the community, especially parents and families, are as far as possible against peace efforts to marry the victim to the perpetrator, because it can trigger other problems and prevent repetition of criminal acts and other violence that the victim will receive.

Abstract

This study aims to determine the police's efforts to prevent criminal acts of abuse by school children in Gorontalo. The type of research used is empirical law with a qualitative approach which will be analyzed descriptively. The results of this study indicate that the role of the police in preventing criminal acts of maltreatment by students is by pre-emptive efforts by conducting counseling and outreach. Furthermore, preventive efforts are carried out by way of patrols and evaluating the performance of the police. Meanwhile, repressive efforts are carried out by fostering and applying the principles of Restorative Justice. As for the efforts of the school, namely preventive efforts are activities carried out to prevent violations committed by students, curative efforts are efforts to anticipate violations committed by students, and coaching efforts are efforts to foster students who commit violations and have received punishments or sanctions that have been given by the school.

Abstract

Program dalam kegiatan ini berupa Penyuluhan Hukum Terkait Pengelolaan Badan Usaha Milik Desa (BUMDes) dari perspektif Peraturan Perundang-undangan, Pendampingan Terhadap Masyarakat Dalam Penelusuran Potensi Desa dan Pendampingan terhadap masyarakat dan Aparat Desa dalam penyusunan rencana Pengelolaan Potensi Desa. Tujuannya adalah memberikan manfaat khususnya terhadap pengurus dan aparat pemerintah desa dalam pengelolaan BUMDes berdasarkan peraturan perundang-undangan maupun regulasi yang berlaku. Selain itu, memberikan manfaat dalam pengembangan kehidupan perekonomian masyarakat ke arah yang lebih baik, melalui penguatan tata kelola dan pemahaman pengurus terhadap pengelolaan baik secara administrasi maupun teknis BUMDes di Biluhu Timur, serta terjalinya kemitraan Desa dengan Perguruan Tinggi khususnya Fakultas Hukum, dengan menetapkan Biluhu Timur Sebagai Desa Binaan FH UNG. Hasil pelaksanaan kegiatan yakni terdapat masukan dalam hal kolaborasi dan pendampingan Perdes serta penyusunan AD/ART oleh Fakultas Hukum, tindak lanjut pelatihan aplikasi BUMDES serta masukan terkait data potensi yang dapat dikelola melalui Usaha BUMDes yaitu Pasar Ikan yang dibentuk melalui Perdes termasuk masukan terhadap litigasi bencana di desa dan Perdes Pencegahan Stunting. Pengelolaan Potensi Ikan menjadi salah satu usaha BUMDes dapat dilakukan dengan membentuk Perdes terlebih dahulu sehingga menjadi wadah Desa untuk melakukan usaha khususnya bidang ekspor ikan.

Abstract

ABSTRAK Mewujudkan ketahanan masyarakat dan desa dibidang kesehatan, dilakukan dengan beberapa Program yaitu berupa Pembentukan Gugus Tugas dan Sosialisasi Pencegahan Stunting serta Penyuluhan Hukum Kesehatan Lingkungan. Hal ini berkaitan dengan pengembangan Desa Sehat, dimana pemerintah setempat perlu mengupayakan dan memaksimalkan usaha, khususnya yang berdampak pada kondisi kesehatan masyarakat dan lingkungan di era pandemik maupun new normal. Olehnya, pembentukan Gugus Tugas Pencegahan Stunting merupakan unit khusus yang keberadaanya di desa, berfungsi mencatat riwayat penyakit yang diderita masyarakat terutama bagi kaum perempuan dan anak, agar memudahkan untuk melakukan pengobatan dan tindakan lanjut medis, serta meningkatkan peran warga dalam menolong dirinya khususnya pada era pandemi maupun non pandemi. Selain itu, gugus tugas ini paling tidak bisa membantu mengurangi masalah prosedur pelayanan kesehatan, memudahkan koordinasi dengan pemerintah desa dan daerah dalam upaya meningkatkan penanggulangannya. Unit ini juga dapat mengontrol masyarakat secara rutin khususnya bagi para ibu hamil dan persiapan kelahiran bayi, serta pengawasan terhadap gizi dengan bekerjasama Pusat Kesehatan Masyarakat (Puskemas) setempat. Sebagai tugas utama dari Gugus ini ialah melaksanakan sosialisasi dan kampanye mengenai pencegahan stunting agar warga desa terhindar dari penyakit tersebut.            Berkenaan dengan kondisi pandemi covid 19 yang melanda negara sampai ke pelosok daerah, maka perlu pemahaman nilai-nilai hukum baik lingkungan maupun hukum kesehatan. Oleh karena itu, peningkatan kesadaran masyarakat dalam menjaga masyarakat desa agar senantiasa sehat, maka penyuluhan hukum tentang kesehatan dan lingkungan menjadi sangat diperlukan untuk menjaga aktivitas yang dilakukan demi menjaga kelestarian dan sebagai pengembangan desa sehat di Buntulia Tengah. Kegiatan lainnya juga adalah mengaplikasikan program Desa Sehat dengan melaksanakan kegiatan olahraga dan bersih lingkungan bersama masyarakat, untuk mewujudkan ketahanan desa. Kata Kunci : Desa, Kesehatan Masyarakat, Gugus Tugas, Stunting

Abstract

Illegal mining itself is a mining activity or extracting agricultural products carried out by the community or a business entity or we can call it a company where this activity does not have a business permit and also does not use the principles regarding how to mine in accordance with existing regulations or not. use mining methods properly and correctly. The basic mining laws that apply in Indonesia are stated in the Mining UlUl Number 3 of 2020 concerning amendments to UlUl Number 4 of 2009 concerning Mineral and Coal Mining, mining excavation itself consists of several types. Starting from strategic minerals or group a minerals, vital minerals or group c, and finally, group c minerals. In Indonesia itself we can certainly find cases of illegal mining in various regions, that is why enforcement efforts should be carried out as best as possible in order to reduce the growth rate of existing illegal mining which of course is to guarantee or increase state income through existing mining businesses. certainly legal in the eyes of the law.

Abstract

The research results show that perpetrators of criminal acts of dating violence in the jurisdiction of the Gorontalo City Police are subject to criminal liability as regulated in Article 351 of the Criminal Code as simple assault or Article 466 of the Law of the Republic of Indonesia Number 1 of 2023 concerning the Code of Laws. Criminal law as the latest Criminal Code. So the perpetrator commits a violation of norms that is against the law. Factors that cause violence in dating in the Gorontalo City Police jurisdiction are: personality factors, violence in dating can be caused by the personality of the perpetrator himself; the factor of the victim being dependent on his partner, the victim being dependent on the perpetrator, the perpetrator naturally feels that whatever the perpetrator does will still be forgiven by the victim even if it is an act of violence; the influence of the family environment, when children witness aggression perpetrated by their parents, this can increase the likelihood of dating violence perpetrated by that individual; social influence, that being friends with friends who are often involved in violence can increase the risk of being involved in violence because there is the influence of social characteristics and motivation to commit violence itself; The influence of the place where violence occurs, the environment where violence occurs, which is mostly carried out in closed and quiet places, is a driving factor for this violence to continue to occur because the situation and conditions allow for violence to occur and the factor of gender inequality, violence in dating where the victims are more women, this is related to socio-cultural aspects that instill gender roles that differentiate men and women.

Abstract

This research aims to determine the factors that hinder law enforcement against criminal acts of misuse of dangerous food production in Gorontalo Province. The type of research used is empirical legal research with a qualitative approach. The results of this research show that the problems of law enforcement regarding criminal acts of misuse of dangerous food production in Gorontalo Province include: first, internal factors caused by facilities and facilities, the personality and mentality of personnel, the quality of operational funding personnel, and the difficulty of uncovering evidence. Second, external factors caused by leaking information about raids to perpetrators, lack of awareness in fulfilling their rights and responsibilities as business actors, limited employment opportunities, lack of community participation, and public legal awareness
