Abstract

Era digital telah membawa transformasi signifikan dalam berbagai aspek kehidupan, termasuk dalam sektor ekonomi. Perkembangan teknologi informasi dan komunikasi telah menciptakan model ekonomi baru yang lebih dinamis, terbuka, dan terintegrasi secara global. Dalam konteks ini, hukum memainkan peran strategis sebagai instrumen pengendali dan pengarah pembangunan ekonomi agar tetap berada dalam koridor kepastian, keadilan, dan keberlanjutan. Artikel ini mengkaji bagaimana hukum dapat berfungsi sebagai landasan normatif dalam mengatur aktivitas ekonomi digital, mencegah praktik yang merugikan kepentingan publik, serta mendorong inovasi dan investasi yang sehat. Pendekatan yang digunakan adalah yuridis-normatif dengan analisis terhadap berbagai regulasi terkait ekonomi digital, perlindungan data, hak kekayaan intelektual, serta transaksi elektronik. Hasil kajian menunjukkan bahwa keberadaan sistem hukum yang adaptif dan responsif menjadi kunci dalam menciptakan ekosistem ekonomi digital yang inklusif dan kompetitif. Oleh karena itu, reformasi hukum yang progresif dan penguatan kelembagaan menjadi langkah strategis dalam mengoptimalkan peran hukum sebagai penggerak pembangunan ekonomi nasional di era digital

Abstract

The omnibus law approach in Indonesia was introduced as a solution to overlapping and conflicting regulations. However, its application in the Job Creation Law has generated significant issues, particularly in the area of legal drafting. This article critically examines the drafting failures of the law based on the principles of proper regulatory formation as outlined in Law No. 12 of 2011 in conjunction with Law No. 13 of 2022. Through case analysis, theoretical perspectives, and comparative reviews of international practices in the United States, Canada, and the Philippines, the article argues that the core problem of the omnibus law lies not in its concept, but in its poor drafting structure, legal ambiguity, excessive delegation of authority, and lack of public participation. The article concludes by offering five key recommendations to reform Indonesia’s legal drafting process so that the omnibus law can serve as a legitimate, effective, and democratic instrument of regulatory harmonization

Abstract

Intellectual Property Rights (IPR) serve as an essential legal instrument for fostering innovation, creativity, and economic growth within a nation. In Indonesia, the IPR legal framework has evolved over time, encompassing various aspects such as copyrights, patents, trademarks, and industrial designs. Nevertheless, the implementation and enforcement of IPR in Indonesia still face several challenges, including a high rate of infringement and a lack of public awareness. This article analyzes the IPR legal framework in Indonesia, identifies the main challenges in its implementation, and discusses the prospects for future development and strengthening of the IPR system
