Abstract

The phenomenon of marriages that are only carried out religiously without state registration still occurs a lot in Way Kenanga District, West Tulang Bawang Regency, causing unclear legal status of families and limited access to civil rights. This study aims to analyze the impact of the practice of marriage confirmation on family status from the perspective of Maslahah mursalah in Islamic law. The study used a qualitative method with case studies, data collection techniques through interviews, observations, and documentation, and was analyzed using a deductive approach using the theory of Maslahah mursalah as the main foundation. The results of the study indicate that marriage confirmation is effective in providing formal legality, strengthening family civil rights, and increasing the social legitimacy of married couples. This practice also fulfills the principles of maqashid al-syari’ah, especially in maintaining offspring and protecting individual rights. The study recommends the need to increase legal socialization programs, simplify marriage confirmation procedures, and provide financial support from the government for low-income communities, in order to expand the benefits of marriage confirmation for the welfare of society in a sustainable manner.

Abstract

Community service through Social Work Lectures (KKS) is one form of student contribution in overcoming problems in society. This research aims to examine the role of KKS in increasing public awareness and providing education to the community in Trimorjo Village, Metro. The method used in this research is observation. KKS students participated in activities to create public awareness of the importance of science, to create quality, character, creative and innovative human resources. The research results show that through KKS, public awareness in Trimorjo Metro Subdistrict has increased significantly. The public is starting to understand how important it is to learn to deepen Islamic knowledge, especially in the field of reading the Al-Qur'an properly and correctly, also showing increased knowledge about the importance of learning to read the Al-Quran using methods that have been socialized through educational activities carried out by female students. KKS to the Trimurjo community.

Abstract

This research aims to explore and analyze the reconstruction of nyentana marriage in Balinese society from a gender equality perspective. Nyentana marriage, which involves the groom living with the bride's family, is a unique tradition that has the potential to elevate the status of women and promote gender equality. However, negative stigma towards this type of marriage still exists in certain segments of Balinese society, as it is considered to conflict with the dominant patrilineal customary norms. This study uses a qualitative approach with a case study method in several regions of Bali, including Tabanan, Gianyar, and Badung. Data were collected through in-depth interviews with couples practicing nyentana marriage, customary leaders, and religious figures, as well as participatory observations during nyentana wedding ceremonies. Thematic analysis was employed to identify the factors influencing the acceptance or rejection of this tradition and its impact on gender equality. The research findings indicate that despite challenges posed by negative stigma, nyentana marriage has the potential to alter social structures and strengthen the position of women in Balinese society. Therefore, the role of customary institutions and religious leaders is crucial in supporting a better understanding of gender equality through this tradition. This research is expected to provide new insights into how the nyentana marriage tradition can contribute to achieving gender equality goals and support sustainable development in Bali.

Abstract

This study examines the social conflict dynamics in interethnic marriages between Javanese and Lampung communities, the factors triggering conflicts, and the adaptation and resolution strategies employed by couples. The research aims to understand how differences in culture, customs, and daily habits affect couples’ relationships and extended families, as well as how conflicts are managed. The study employs a qualitative approach with a case study design, collecting data through in-depth interviews, participatory observation, and documentation of the respective ethnic customs. The findings indicate that conflicts arise from differences in gender roles, family hierarchy, expressions of respect, and traditional ceremony practices, exacerbated by limited social tolerance and subjective judgments from the surrounding community. Adaptation strategies include open discussions, mutual understanding of each other’s culture, seeking guidance from family members, and adjusting habits to achieve harmony. Properly managed conflicts strengthen the relationship, enhance mutual understanding, and increase couples’ commitment.

Abstract

The maintenance crisis in early marriage in Sukadana shows that there are serious problems in family relations that have an impact on the increase in divorce lawsuits. Most previous studies have focused more on common factors of divorce such as the economy and household disharmony, while studies that specifically link the maintenance crisis in early marriage to a socio-legal perspective have been limited. This article analyzes how the husband's inability to fulfill alimony obligations transforms into a juridical reason in a divorce lawsuit and how these dynamics reflect the interaction between structural, cultural, and normative factors. This research uses a qualitative method with an exploratory-analytical design through a socio-legal approach. Data were obtained from in-depth interviews with six informants as well as an analysis of court decisions and related regulations. The results of the study show that the maintenance crisis is influenced by economic unpreparedness due to early marriage, low education, and weak internalization of family law norms. In addition, there is a shift in the meaning of alimony from a normative obligation to a structural burden and a change in power relations in the household that trigger conflicts. These findings confirm that divorce serves as a socio-legal mechanism to provide legal protection and certainty for women and reflects the need for a family justice model that is more responsive to social realities.

Abstract

The phenomenon of child births outside of legal marriage is increasing and causing legal and social problems, especially related to legal status, societal stigma, and the fulfillment of children's rights. The difference in regulation between the Compilation of Islamic Law (KHI) and positive law also affects the effectiveness of legal protection for children out of wedlock. This study aims to analyze the legal protection of children out of wedlock from the perspective of KHI and the Child Protection Law, as well as assess its implementation and effectiveness in Sukajadi Village, Punggur District, Central Lampung Regency. This study uses a qualitative method with an empirical and juridical-sociological approach. Data were obtained through observation, interviews, and documentation, then analyzed using Miles and Huberman's interactive model. The results of the study show that legal protection for children out of wedlock is not optimal. Administratively, the registration of children's identities is still oriented towards formal provisions so that the name of the biological father cannot be included without legal determination. In the perspective of Islamic law, children only have a nasab relationship with the mother, while positive law provides space for the recognition of civil relations with the biological father. However, its implementation is constrained by economic factors, complex legal procedures, and low public understanding, creating a gap between legal norms and practices in the field.
