Abstract

Fenomena penggunaan akal yang terkadang melampaui batas dalam istinbat hukum Islam menjadi kegelisahan Ramadhan al-Buthi. Mashlahah dalam pandangan Ramadhan al-Buthi bukan merupakan dalil yang sifatnya independen, melainkan harus didukung dengan dalil lainnya. Oleh karenanya, menanggapi fenomena tersebut Ramadhan al-Buthi membuat batasan dalam konsep maslahah. Menurut Ramadhan al-Buthi dalam bukunya Dhawabith al-Mashlahah fi as-Syari’ah al-Islamiyyah, mashlahah dapat diakomodir menjadi hukum syara’ apabila memenuhi beberapa kriteria sebagai berikut: Pertama, bahwa mashlahah masih dalam ruang lingkup tujuan syari’ (maqashid as-syar’iyyah). Kedua, tidak bertentangan dengan al-Qur’an. Ketiga, tidak bertentangan dengan sunnah. Keempat, tidak bertentangan qiyas, dan kelima tidak bertentangan dengan kemashlahatan yang lebih tinggi. Dalam pandangan Ramadhan al-Buthi konsep mashlahah meliputi hifdz addin, hifdz an-nafs, hifdz al-aql, hifdz an-nasl, hifdz al-mal. Implementasinya tentunya berdasarkan urutannya. Kemaslahatan yang lebih tinggi harus didahulukan terhadap kemaslahatan yang lebih rendah. Sedangkan pandangan at-Thufi tentang mashlahah merupakan dalil tersendiri dan mandiri di luar teks, sehingga akal bebas menentukan kemaslahatan dan kemafsadatan. Dengan demikian secara epistemologis, at-Thufi lebih menempatkan posisi akal dari pada wahyu dalam menentukan kemashlahatan dan kemafsadatan hukum.

Abstract

This study analyzes the application of maqāshid sharī’a (objectives of shari'a) regarding substitute heirs as outlined in article 185 paragraphs 1 and 2 of the Compilation of Islamic Laws the research aims to find out the philosophical basis of maqāshid sharī’a regarding the importance of giving inheritance to substitute heirs. This research is a normative legal research that uses a philosophical approach. Data were collected using literature techniques, then analyzed descriptively qualitatively through maqāshid sharī’a theories. This study shows that the determination of inheritance for substitute heirs in Article 185 is important to realize because it contains many maslahah (benefits) both sociologically and psychologically. The philosophical foundation of maqāshid sharī’a in inheritance for substitute heirs is not only limited to protecting assets (hifzd al-māl) but also to improving their quality of life (tanmiyah al-nasl wa al-māl). Substitute heirs are not enough just to be given assets, they also need care and affection from their extended family. Viewed from the maslahah position, giving inheritance to substitute heirs to improve their quality of life is included as maslahah dharūriyah (urgent needs).

Abstract

This study aims to examine the level of accuracy of the direction of the Qibla in several mosques in Serdang Bedagai Regency which is determined using a compass, by comparing it to the direction of the Qibla calculated astronomically using geographic coordinate data and the help of GPS-based digital applications (such as Google Earth). The scholars agree that people who can see the Kaaba directly must face the Kaaba building ('ainul Kaaba). However, for people who are outside the Grand Mosque, especially far from Mecca, it is sufficient to face the Kaaba (Jihah Kaaba). Determining the accurate direction of the Qibla is important in carrying out Islamic prayers. In various regions, including Serdang Bedagai Regency, the method commonly used by people to determine the direction of the Qibla is using a compass. However, the accuracy of the compass is often influenced by environmental factors such as local magnetic fields and inaccuracy in use. This study uses an empirical Islamic legal research method (non-doctrinal research), a legal research method that functions to see how the law works in society. The object of the study is the direction of the Qibla from mosques in Serdang Bedagai Regency, totaling 665 mosques which are the research population. The sample in this study was 17 mosques from several sub-districts using the Purposive Sample technique which is a non-random sampling technique, with the vastness of Serdang Bedagai Regency and the large number of mosques requiring researchers to conduct non-probability sampling. In addition, researchers also conducted interviews. The results of the study showed that there was a deviation in the direction of the Qibla in most mosques with an average difference of 2° to 25° from the actual direction. This shows that the use of a compass manually without calibration and consideration of local factors can cause inaccuracy in determining the direction of the Qibla. This study recommends the use of more precise methods such as GPS devices, digital applications, or observations of the position of the sun during Rashdul Qiblah, especially for the construction of new mosques.

Abstract

Penelitian ini berjudul “Penguatan Soft Skill bagi Mahasiswa Calon Guru PAI Generasi Z di Prodi Pendidikan Agama Islam Fakultas Ilmu Tarbiyah dan Keguruan Universitas Islam Negeri Sumatera Utara Medan.” Tujuan penelitian ini adalah untuk memahami karakteristik soft skill, tantangan pengembangannya, serta implementasi penguatan soft skill mahasiswa calon guru PAI generasi Z. Pendekatan yang digunakan adalah kualitatif deskriptif dengan metode fenomenologi. Teknik pengumpulan data mencakup wawancara, observasi, dan dokumentasi, dengan triangulasi sebagai teknik keabsahan data. Hasil penelitian menunjukkan bahwa kemampuan soft skill mahasiswa, seperti komunikasi, empati, kepemimpinan, manajemen waktu, dan penyelesaian masalah cukup berkembang, namun belum merata. Tantangan yang dihadapi antara lain minimnya partisipasi organisasi, kelelahan akademik, serta kecanduan teknologi. Strategi penguatan dilakukan melalui metode pembelajaran aktif dan pengalaman lapangan seperti PPL dan KKN. Mahasiswa menunjukkan perkembangan dalam aspek growth mindset, literasi emosional digital, dan fleksibilitas kognitif, meskipun masih memerlukan pembinaan berkelanjutan. Dukungan dosen dan program prodi berkontribusi penting dalam membentuk kompetensi interpersonal mahasiswa. Penguatan soft skill secara menyeluruh dinilai esensial untuk mencetak calon guru PAI yang tidak hanya unggul akademis, tetapi juga adaptif secara sosial dan emosional.

Abstract

The issue of land use by PT. Kereta Api Indonesia (Persero) in Langkat Regency from the perspective of positive law and Islamic law. The main problem lies in the widespread use of land owned by PT. KAI by the community without legal permission, which has led to conflicts over land ownership and control. From the perspective of positive law, this study examines the legal basis for PT. KAI's ownership of the land under Law No. 5 of 1960 on the Basic Principles of Agrarian Law (UUPA), Law No. 23 of 2007 on Railways, and Ministry of State-Owned Enterprises Regulation No.PER-13/MBU/09/2014 on Guidelines for the Management of State-Owned Enterprises' Fixed Assets. These provisions affirm that land assets owned by PT. KAI are part of the state's wealth, managed professionally, and protected by law. This study employs a normative and empirical approach. The normative approach is used to analyze the legal provisions governing the status and management of land, while the empirical approach is conducted through field studies and interviews to uncover the social dynamics and actual practices of land utilization. The analysis revealed that weak supervision and the absence of an effective social approach have led to many residents unlawfully occupying or utilizing land. From an Islamic legal perspective, such actions From an Islamic legal perspective, such actions contradict the principles of al-amanah (trust), al-milkiyyah (property rights), and ‘adalah (justice), and are inconsistent with the concept of tasarruf which requires that the right to utilize land be exercised lawfully and without harming others. This study recommends the enforcement of strict yet humane laws by PT. KAI, accompanied by mediation and consultation with the community. Abstract

The relationship between teachers and students is an educational bond grounded in specific norms to achieve learning objectives. KH. Hasyim Asy’ari, as a prominent figure in Islamic education in Indonesia, devoted significant attention to this aspect, particularly through his work Adab al-‘Alim wa al-Muta‘alim. This study aims to describe the teacher–student relationship from KH. Hasyim Asy’ari’s perspective, focusing on his thoughts regarding the role of teachers, the role of students, the nature of their relationship, and its relevance to contemporary education. The research employs a library research method by examining primary literature as well as previous studies. The findings reveal that KH. Hasyim Asy’ari emphasized the importance of moral and spiritual cultivation, teachers’ exemplary conduct, students’ respect for their teachers, and the control of one’s desires. The teacher–student relationship must always be directed toward devotion to Allah, making the learning process not merely a transfer of knowledge but also the cultivation of character. The implications of this research highlight that KH. Hasyim Asy’ari’s moral and spiritual principles remain highly relevant to modern education, particularly in addressing the challenges posed by the rapid development of technology and information.

Abstract

This study aims to determine the implementation of Islamic religious education for the elderly community at Persulukan Syekh Muhammad Thoib, Barumun District, Padang Lawas Regency; the pattern of Islamic religious education in strengthening worship education for the elderly community at Persulukan Syekh Muhammad Thoib; and the impact of implementing Islamic religious education patterns in strengthening worship education for the elderly community at the same institution.This research employs a field research design with a qualitative approach. Data were collected through observation, interviews, and documentation. Data analysis techniques include data reduction, data presentation, and conclusion drawing. The techniques used to ensure data validity were extended participation, persistent observation, triangulation, and negative case analysis. The results of the study show that the implementation of Islamic religious education for the elderly community at Persulukan Syekh Muhammad Thoib, Barumun District, Padang Lawas Regency, includes worship guidance (congregational prayers), majelis taklim (religious study groups), tawajjuh (spiritual reflection), and suluk mentoring. The pattern of Islamic education in strengthening worship among the elderly is carried out through elderly-friendly da’wah approaches, interactive and collaborative learning, motivational and spiritual reinforcement, and individual assistance.

Abstract

In a marriage, a parent is the primary party that fulfills children's rights, but in reality, not all marriages end in ideal conditions. In many divorces, children's rights are jeopardized. This paper aims to study how children's rights are fulfilled at the hands of the Padangsidimpuan Religious Courts. Data for this study were collected through in-depth interviews, while secondary data was obtained from the case register files at the Padangsidimpuan Religious Court. After conducting research, it was found that the majority of wives who filed for divorce at the Padangsidimpuan Religious Court mostly did not include the rights of the children in their petition. In deciding this case, the judge at the Padangsidimpuan Religious Court followed existing regulations. The verdict always refers to the posita. However, apart from that, many judges also advise the litigants to include children's rights in the posita lawsuit therefore their rights can be protected by a judge's decision.[Dalam sebuah perkawinan, orang tua seharusnya menjadi pihak utama yang memenuhi hak-hak anak, tetapi ternyata tidak semua pernikahan baik-baik saja. Banyak terjadi perceraian yang mengancam hak anak. Tulisan ini bertujuan untuk mengkaji bagaimana terpenuhinya hak-hak anak di Pengadilan Agama. Data dalam penelitian ini dikumpulkan dengan cara melakukan wawancra mendalam, sedangkan data sekunder diperoleh dari berkas-berkar register perkara di Pengadilan Agama Padangsidimpuan.  Setelah melakukan penelitian didapatkan fakta  bahwa mayoritas istri yang mengajukan gugatan cerai di Pengadilan Agama Padangsidimpuan hanya mengajukan gugat cerai belaka tanpa turut menyertakan hak anak yang di bawah pengasuhannya.Hakim Pengadilan Agama Padangsidimpuan dalam memutuskan hal tersebut konsisten dengan regulasi yang ada. Putusan selalu merujuk posita. Namun ternyata selain itu, banyak juga hakim yang menyarankan kepada pihak yang berperkara untuk memasukkan hak-hak anak dalam posita gugatan agar dapat dilindungi haknya oleh putusan hakim.]

Abstract

Proses penelitian yang telah dilaksanakan berjudul terkait model pembelajaran Pendidikan Agama Islam bagi anak pada keluarga wanita karir di Kompleks juara 1 Desa sei Mencirim. Pernyataan tersebut memiliki tujuan agar dapat mengetahui terkait model pembelajaran yang digunakan hasil yang didapatkan dari model pembelajaran yang digunakan serta faktor pendukung dan penghambat dari penggunaan model yang digunakan. Penelitian ini menggunakan teknik analisis berdasarkan teori Miles dan huberman yakni teknik penelitian yang menggunakan terkait aktivitas untuk dapat menganalisis data yang bersifat kualitatif dan dilaksanakan secara terus-menerus sampai kepada tahap yang ditentukan. Hasil yang didapatkan dari penelitian yang telah dilaksanakan model pembelajaran yang digunakan ialah model pembelajaran langsung dari learning dan model pembelajaran kooperatif dengan hasil anak dapat menunjukkan pelaksanaan dari pembelajaran Pendidikan Agama Islam melalui keagamaan dan keikutsertaan dalam masyarakat.

Abstract

As the only province in Indonesia implementing Islamic Sharia law, Aceh has a rich historical and cultural context rooted in Islamic traditions. In the modern era, understanding how Sharia law interacts with diverse community demands is crucial. This study examines the actualization of diyah (compensation) in Aceh's Qānūn Jināyah (Crimes) using a sociological approach to Islamic law. The qualitative research method employed involves descriptive data collection. The findings reveal that the diyah law in Aceh’s Qānūn Jināyah illustrates the intricate interaction between social, cultural, legal, and religious aspects in the application and acceptance of Islamic law. Diyah serves not only as a formal legal instrument for justice but also as a reflection of the strong cultural values, religious traditions, and social norms within Acehnese society. Through sociological analysis, the study highlights how the mechanism for implementing diyah in the Qānūn Jināyah embodies the integration of Islamic law with the socio-cultural values of Acehnese society, offering insights into how Sharia law adapts to contemporary social challenges and changes.
