Abstract

The reform of criminal investigation procedures has become a crucial aspect of Indonesia’s criminal justice system renewal, particularly following the enactment of the new Criminal Code, which introduces significant shifts regarding the rights of suspects, investigative authority, and the implementation of due process of law. In an era of rapid digital development, investigative practices must also incorporate the principles of good governance and human rights protection to ensure that state authority is exercised proportionally. This study aims to analyze the relevance of the principles of good governance in modern investigative processes, assess the adequacy of due process guarantees under the current Code of Criminal Procedureand the new Criminal Code, and identify practical challenges in application. Using a normative legal research method through statutory, conceptual, and comparative approaches, the study finds that criminal investigations in Indonesia continue to face issues such as normative inconsistency, regulatory disharmony, and weak accountability mechanisms. The integration of the principles of good governance has the potential to strengthen the quality and fairness of investigations, yet requires clearer normative foundations and consistent implementation. Moreover, the new Criminal Code does not fully resolve harmonization issues with Code of Criminal Procedure, making procedural reform an urgent necessity. The findings contribute to the enhancement of suspect protection, professionalism among investigators, and the overall improvement of Indonesia’s criminal justice system.

Abstract

The issue of legal certainty and trademark protection for relevant parties arises from the inconsistency between the decisions of the Judex Facti and Judex Juris in trademark cancellation cases. This study aims to identify the nature of this inconsistency and its implications for trademark legal protection in Indonesia. Drawing on statutory regulations, Medan Commercial Court Decision No. 6/Pdt.Sus-HKI/Merek/2022, and Supreme Court Decision No. 989 K/Pdt.Sus-HKI/2024, this normative legal research employs both case-based and conceptual approaches. The findings indicate that the Commercial Court adopts a narrow interpretation of “interested parties” and does not recognize first use as a legal basis, resulting in the dismissal of the trademark cancellation claim. In contrast, the Supreme Court applies a broader and more progressive interpretation by acknowledging historical use and identifying indications of bad faith in the trademark registration process. These divergent interpretations generate legal uncertainty, underscoring the need for harmonization between courts to ensure equitable trademark protection.

Abstract

Perkembangan pelayanan publik berbasis digital telah mengubah cara pemerintah membuat keputusan, mulai dari sistem informasi kependudukan, seleksi ASN, penyaluran bantuan sosial, hingga sistem perizinan otomatis. Penggunaan artificial intelligence (AI), algoritma, dan big data menghadirkan efisiensi baru, tetapi juga melahirkan bentuk-bentuk maladministrasi yang tidak terakomodasi dalam kerangka hukum Ombudsman saat ini. Penelitian ini bertujuan untuk mengidentifikasi bentuk maladministrasi digital, mengevaluasi kecukupan norma dalam UU No.37/2008 tentang Ombudsman, serta menawarkan model pengawasan baru yang relevan dengan era digital governance. Menggunakan metode yuridis-normatif dengan pendekatan konseptual dan studi literatur mutakhir, penelitian ini menemukan bahwa maladministrasi di era digital memiliki karakteristik baru seperti bias algoritmik, ketidaktransparanan logika sistem (algorithmic opacity), kesalahan otomatis (automated error), dan diskriminasi berbasis data. Hasil penelitian menunjukkan bahwa Ombudsman perlu mengembangkan standar baru berupa Algorithmic Transparency Standard, Digital Audit Framework, dan unit khusus untuk pengawasan sistem AI dalam pelayanan publik. Penelitian ini menegaskan bahwa reformulasi kewenangan Ombudsman merupakan urgensi untuk memastikan akuntabilitas, keadilan, dan kepastian hukum dalam pelayanan publik berbasis digital.

Abstract

A notarial deed is a perfect form of evidence and must therefore be prepared to serve as a strong evidentiary basis in the event of a breach of contract. Thus, a notary in carrying out his/her duties must act trustworthy, honest, thorough, independent, impartial, and safeguard the interests of the parties involved in legal actions. In fact, the notary's duty is basically to express the wishes or actions explained by various parties which will be included in the deed. Thus, the interesting problem in this study is how the notary's position in the investigation related to alleged violations. This study uses a normative legal approach or doctrinal research. For notaries suspected of committing violations in the investigation, the notary can be positioned as a witness or suspect or co-defendant, depending on the notary's involvement in the alleged violation. In the process of examining a notary, investigators are required to obtain approval from the Notary Honorary Council, both for examination as a witness and for confiscation of documents. Therefore, regarding the approval of the Notary Honorary Council, it is not intended to complicate the investigation process or the need for examination of the notary, because this has been anticipated by the provisions of Article 66 paragraph (3) and paragraph (4) of Law 2/2014. Where investigators can obtain an answer no later than 30 (thirty) days. Therefore, there are no issues related to the request for approval from the Notary Honorary Council. If the 30-day deadline is exceeded, the request is deemed approved

Abstract

Democracy is a system of governance that places the people as the ultimate holders of political authority. One of its primary manifestations is the mechanism of general elections, including local elections (Pilkada). Pilkada represents a concrete form of democracy at the regional level, allowing citizens to determine their local leaders. In practice, however, election administrators may confront circumstances that are not clearly regulated. In such situations, discretionary right becomes relevant to enable decision-making in the face of legal gaps or ambiguities, provided that it aligns with the general principles of good governance. This study aims to analyze the use of discretion by the Banjarbaru City General Election Commission (KPU Kota Banjarbaru) as the election management body in the 2024 mayoral and vice-mayoral election. The research method was used normative (doctrinal). The novelty in this research is the need to address specific situations, such as those encountered during the Pilkada implementation phase, by examining the 2024 simultaneous Pilkada in Banjarbaru City. Based on the research concluded that KPU’s decision to continue using the original ballotlisting two candidate pairs despite the disqualification of one pair and to classify votes for the disqualified candidate as invalid without clear differentiation constitutes an improper exercise of discretion. This decision neglected the principles of public interest, legal certainty, justice, and the protection of citizens’ electoral rights. The KPU’s inaccurate use of outdated ballots resulted in ambiguity regarding vote status, violations of fairness and electoral validity, and a decline in public trust in the integrity of the election process.

Abstract

Permasalahan mengenai penyusunan dan pembentukan regulasi sampai saat ini menjadi hal yang penting agar menghasilkan suatu regulasi berkualitas. Oleh karena itu, sebelum dibentuk atau direvisi suatu peraturan perundang-undangan, sebaiknya diketahui terlebih dahulu tujuan dan kebutuhan pembentukan suatu peraturan perundang-undangan. Permasalahannya adalah bagaimana pembentukan regulasi sehingga menghasilkan suatu regulasi berkualitas? Dalam penyusunan suatu regulasi yang dapat memberikan kepastian hukum kepada masyarakat, perlu diwujudkan regulasi yang sederhana dan tertib. DPR dan Pemerintah sebagai lembaga perancang dan pembentuk regulasi tidak boleh mempunyai kepentingan, baik kepentingan pribadi, kelompok, atau golongan, tetapi harus bersifat netral dan bebas dari kepentingan-kepentingan. Pembentukan suatu regulasi juga harus mendasarkan kepada asas pembentukan peraturan perundang-undangan dan materi muatannya juga harus jelas asas tujuannya sesuai dengan UU 12/2011. Selain itu, sebelum diumumkan, perlu dilakukan pengujian atau evaluasi sehingga kualitas regulasi yang akan ditetapkan meningkat.
