Abstract

Permasalahan mengenai penyusunan dan pembentukan regulasi sampai saat ini menjadi hal yang penting agar menghasilkan suatu regulasi berkualitas. Oleh karena itu, sebelum dibentuk atau direvisi suatu peraturan perundang-undangan, sebaiknya diketahui terlebih dahulu tujuan dan kebutuhan pembentukan suatu peraturan perundang-undangan. Permasalahannya adalah bagaimana pembentukan regulasi sehingga menghasilkan suatu regulasi berkualitas? Dalam penyusunan suatu regulasi yang dapat memberikan kepastian hukum kepada masyarakat, perlu diwujudkan regulasi yang sederhana dan tertib. DPR dan Pemerintah sebagai lembaga perancang dan pembentuk regulasi tidak boleh mempunyai kepentingan, baik kepentingan pribadi, kelompok, atau golongan, tetapi harus bersifat netral dan bebas dari kepentingan-kepentingan. Pembentukan suatu regulasi juga harus mendasarkan kepada asas pembentukan peraturan perundang-undangan dan materi muatannya juga harus jelas asas tujuannya sesuai dengan UU 12/2011. Selain itu, sebelum diumumkan, perlu dilakukan pengujian atau evaluasi sehingga kualitas regulasi yang akan ditetapkan meningkat.

Abstract

The development of digital technology and Artificial Intelligence (AI) has brought significant changes to the process of creating, distributing and utilizing intellectual works in Indonesia. These technological advances encourage increased innovation and the creative economy, but on the other hand, they create new challenges in the protection of Intellectual Property Rights (IPR), especially regarding ownership of Artificial Intelligence-based works, digital copyright infringement, and the distribution of content without permission via online platforms. This research aims to analyze the form of IPR legal protection in facing the development of digital technology and Artificial Intelligence in Indonesia and identify the need for updating national legal regulations. The research method used is normative legal research with statutory, conceptual and comparative analysis approaches. The research results show that the IPR legal framework in Indonesia has provided basic protection through the Copyright, Patent and Trademark Law, but has not optimally accommodated the development of Artificial Intelligence technology. The main problems lie in the unclear legal subject of creators of AI works, weak monitoring of digital violations, and low IPR literacy in society. Therefore, it is necessary to reformulate legal policies that are adaptive to technology, strengthen digital law enforcement, and collaborate between the government, technology industry and society to create an effective and sustainable IPR protection system in the era of digital transformation.

Abstract

Penelitian ini mengkaji dinamika penafsiran konstitusi dalam perspektif living constitution serta batasan kewenangan Mahkamah Konstitusi dalam sistem ketatanegaraan Indonesia. Penelitian ini bertujuan untuk menganalisis konsep living constitution, mengidentifikasi batasan penafsiran konstitusi, serta merumuskan indikator over-interpretation dalam praktik peradilan konstitusi. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan kasus melalui analisis beberapa putusan Mahkamah Konstitusi. Hasil penelitian menunjukkan bahwa penafsiran konstitusi cenderung bersifat progresif dan dalam beberapa putusan memenuhi indikator over-interpretation, yaitu penciptaan norma baru, perubahan substansi norma, dan intervensi terhadap ranah kebijakan publik. Kesimpulannya, diperlukan penerapan prinsip judicial restraint untuk menjaga keseimbangan kekuasaan dalam sistem ketatanegaraan Indonesia.

Abstract

General Background: National defense capacity is a core legal concern amid increasingly complex conventional and non-conventional threats. Specific Background: The study examines Law Number 3 of 2025, which amends Law Number 34 of 2004 on the National Armed Forces, including changes concerning non-war military operations, civilian offices, retirement age, and coordination with defense authorities. Knowledge Gap: Legal debate remains over whether the revised framework can strengthen defense readiness while remaining aligned with constitutional principles, civilian supremacy, the rule of law, and human rights protection. Aims: This study analyzes the legal implications of the amended Armed Forces Law for national defense capacity and explains how constitutional legitimacy is shaped through formal and substantive judicial review before the Constitutional Court. Results: The findings show that the amended statute reinforces defense capacity through clearer institutional coordination, expanded non-war operations including cyber defense and overseas citizen protection, regulated access to certain civilian positions, and adjusted retirement provisions. Constitutional Court decisions rejected or did not accept formal and substantive challenges, confirming that the statute does not contradict the 1945 Constitution. Novelty: The study offers an integrated constitutional law reading of defense reform by linking amended military governance norms with judicial review outcomes and national defense capacity. Implications: The statute can function as a valid legal instrument for defense strengthening, provided that implementation remains subject to strict oversight, checks and balances, civilian supremacy, legality, and human rights safeguards. Highlights: Judicial review outcomes preserved the revised TNI framework. Non-war operational scope includes cyber defense and overseas citizen protection.
