Abstract

This article explores how married Muslim women navigate the boundaries of gendered roles, as they combine professional careers and religious activism, and the implications of this negotiation about family welfare in contemporary Islamic law. Using a normative empirical methodology, it is an amalgamation of doctrine analysis of Islamic legal norms and field data on concrete career women practicing as activists in Islamic organizations in West Java, Indonesia. The conceptual framework is guided by Muhammad Shahrur’s Limit Theory (hadd al-adnâ and hadd al-a‘lâ) pursued alongside maqâṣid al-syarîʿah in order to determine demarcations between domestic duties as against public participation. To evaluate the substantive impact of women’s dual roles on family well-being, this study develops a maslahah-Based Family Welfare Index, incorporating core maqâṣid domains religion, life, intellect, progeny, and wealth alongside psychosocial indicators. The findings reveal that women’s participation in public and religious spheres does not inherently undermine Islamic family norms when conducted within flexible yet principled limits. Instead, optimal family welfare emerges when role negotiation is supported by spousal cooperation, institutional flexibility, and contextual legal interpretation. This study contributes to contemporary Islamic legal discourse by offering a measurable framework for assessing gendered role balance and by proposing a normative model that reconciles Islamic legal principles with evolving gender realities. It advances Islamic family law beyond rigid dichotomies by foregrounding substantive justice and contextual maslahah as central evaluative standards.

Abstract

Islamic law that is of particular concern in positive law is the law of marriage. A marriage carried out by a person will give rise to inheritance laws for their children if the marriage is carried out with a valid contract and is justified by Islamic law. Inheritance law itself is a law that regulates the transfer of wealth from a deceased person to a living person because the existence of these rules is justified by Islamic law, although in practice this inheritance can be seen from several angles, because of marriage, because of kinship and so on, the question is how is the position of children in an incestuous marriage, and whether the status of the child's inheritance incest is the same as the position of the Muslim inheritance in an incestuous marriage. That the position of children in an incestuous marriage is the same as the position of children in a legal marriage, because an incestuous marriage itself is a legal marriage as long as there is no annulment, and when an annulment occurs against a marriage, it does not apply retroactively to the status of the child's position, because the annulment of a marriage does not immediately result in the annulment of a child who has been born, an incestuous marriage has been in accordance with the provisions at the beginning. It can be understood that the distribution of inheritance to children of incestuous marriages is the same as the distribution of inheritance to legitimate children, because incestuous children are legitimate children and not children born from adultery or interfaith marriages, so that the position of incestuous children is the same as the position of legitimate children in receiving inheritance and can inherit from both parents, both from the mother and father. Abstract

This study explores the responsibility of the Tasikmalaya Police Resort in ensuring public safety and order, based on Law Number 2 of 2002 concerning the Indonesian National Police, and viewed through the lens of Siyasah Dusturiyah (Islamic constitutional politics). The main issue addressed is the rising crime rate including motorcycle theft, gang violence, and street crimes that has caused public unrest. Employing a juridical-empirical approach with descriptive qualitative methods, data were gathered through observation, interviews, and documentation. The findings indicate that the Tasikmalaya Police have implemented both preventive (patrols, legal counseling, public education) and repressive (investigation and law enforcement) strategies. Community-based programs such as "Police, Friends of the People" and "Friday Dialogues" have also enhanced public-police cooperation. From a Siyasah Dusturiyah perspective, the police embody the role of muḥtasib, enforcers of amar ma’ruf nahi munkar, tasked with maintaining public welfare and order. Thus, police responsibility is both legally mandated and spiritually driven as a divine trust

Abstract

The rapid growth of financial technology (fintech) in Indonesia has intensified the need to ensure compliance with Sharia principles within digital financial services. This study examines the extent of regulatory compliance of Sharia fintech in Indonesia and identifies the main legal and operational challenges in implementing Islamic economic law. Using a qualitative normative approach based on regulatory analysis and literature review, this research analyzes OJK regulations, DSN-MUI fatwas, and the operational practices of Sharia fintech platforms. The findings reveal that despite the availability of a formal regulatory framework, the implementation of Sharia principles remains uneven. Significant gaps are identified in transparency of profit-sharing mechanisms, Sharia-based risk management, and the effectiveness of supervision by Sharia supervisory bodies. In addition, inconsistencies between regulatory provisions and operational interpretations contribute to varying levels of Sharia compliance among fintech platforms. These findings imply the need for stronger regulatory coordination between OJK and DSN-MUI, clearer technical guidelines for Sharia contract implementation in digital platforms, and the enhancement of supervisory mechanisms to ensure consistent Sharia compliance. Strengthening these aspects is essential to support the sustainable development of Sharia fintech and to enhance public trust in Indonesia’s digital Islamic financial ecosystem.

Abstract

This research examines the gap between legal norms and the reality of protecting the rights of Indonesian Migrant Workers (TKI) and their impact on families in the perspective of Islamic family law. Although Indonesia has comprehensive regulations such as Law No. 18/2017 on the Protection of Indonesian Migrant Workers, its implementation is still far from expectations. Structural problems cause violations of migrant workers' rights that have an impact on family disintegration, neglect of maintenance obligations, and marital conflict. This research uses a juridical-normative method with statutory, conceptual, and shar'i approaches. Data were collected through a literature study of primary and secondary legal materials, then analyzed descriptively-qualitatively and comparatively. The results show that there is a significant gap between legal guarantees and actual protection of migrant workers, which results in the neglect of family rights as regulated in Islamic law. The perspective of Islamic family law offers solutions through the principles of justice (al-'is), benefit (maslahah), and protection (hifzh). The research recommends the integration of Islamic law values in migrant worker protection policies, strengthening the role of the family as a protection unit, and harmonizing positive law with sharia principles to realize family-based holistic protection.

Abstract

This article examines radicalism as a socio-religious phenomenon in constructing ideological and political struggles. This study aims to determine the perceptions of Indonesian-Malaysian students regarding radicalism based on religious understanding obtained at the university. This research uses qualitative methods through online interview data collection, focus group discussions (FGD), and a descriptive-interpretative analysis literature study. This study found several findings, namely: students' perceptions of the level of radicalism were divided into three levels: 1) high (extremism, socio-political movement for political purposes); 2) medium (intolerance); 3) low (exclusive, does not accept differences of opinion). However, it should be noted that the perception of Indonesian students is more diverse regarding the level of radicalism, in contrast to the perception of Malaysian students who view the level of radicalism as narrower. This is due to the political influence of each country. Furthermore, the power of religious understanding at universities regarding the level of radicalism on Indonesian and Malaysian students is different due to the reception of information in class, discussions in communities/organizations, and information from social media. This article contributes to increasing the discussion on youth's response to religious-based radicalism so that various parties, including the government and academics, can carry out a more comprehensive anti-radicalism campaign.

Abstract

This study examines productive zakat not merely as a managerial instrument for economic empowerment, but as a manifestation of contemporary Islamic legal ijtihād (independent legal reasoning) shaped by divergent jurisprudential paradigms. Situated within the framework of comparative madhhab studies, this research analyzes how differences in legal reasoning between LAZISNU—rooted in the Shāfiʿī legal tradition—and LAZISMU—characterized by a reformist approach grounded in tajdīd (renewal) and tarjīḥ (legal preference)—influence the formulation and implementation of productive zakat practices in Indonesia. Employing a qualitative juridical-empirical method, the study draws on in-depth interviews with zakat administrators and institutional documents from LAZISNU and LAZISMU operating in Java and Bali. The findings reveal that the transformation of zakat from consumptive distribution to productive utilization is legitimized through distinct modes of istidlāl (legal reasoning or inferential deduction), wherein LAZISNU emphasizes adherence to authoritative Shāfiʿī doctrines, particularly concerning the principle of tamlīk (transfer of ownership to beneficiaries), while LAZISMU adopts a more flexible form of ijtihād that prioritizes maqāṣid al-sharīʿah (the higher objectives of Islamic law) and socio-economic outcomes. This divergence reflects an ongoing dialectic within contemporary Islamic legal thought regarding the boundaries of zakat utilization. By integrating empirical practices with cross-madhhab legal analysis, this study contributes to the development of comparative fiqh al-zakāt (Islamic jurisprudence of zakat) and demonstrates how modern philanthropic institutions negotiate classical legal doctrines within heterogeneous socio-legal contexts such as Java and Bali.

Abstract

The practice of nikah sirri in Indonesia often results in the husband’s absolute authority, which is detrimental to women due to the lack of state legal protection. This study aims to analyze the impact of such authority on women’s rights through the perspective of Maqāṣid al-Syarī’ah and to propose a reconstruction of family law. The method employed is normative legal research with an ecosentric approach, examining laws, legal concepts, and court rulings. The results of the study indicate that absolute authority in secret marriages disrupts the family justice ecosystem and violates the principles of Maqāṣid, particularly the protection of life (ḥifẓ al-nafs), lineage (ḥifẓ al-nasl), and property (ḥifẓ al-māl). Women face structural vulnerabilities in the form of the loss of maintenance rights, shared property, and the legal status of their children. In conclusion, this practice contradicts the spirit of substantive Islamic justice. A legal reconstruction is needed to strengthen the role of the state and judges as guardians of the balance of the justice ecosystem, as well as a reinterpretation of the concept of qiwamah based on consultation and gender justice. Marriage registration must be viewed as a Sharia instrument to guarantee human dignity, not merely an administrative formality.
