Abstract

Based on Minister of Home Affairs regulations No. 108 and No. 109 of 2019, unregistered (siri) marriage couples can now record their marriage in the Family Card. This article aims to analyze the policy of issuing Family Cards for unregistered marriage couples using the Islamic jurisprudence (ushul fiqh) approach. This article is a literature study, with data sourced from the Minister of Home Affairs regulations and various related literatures. The obtained data is then analyzed using a normative-philosophical approach, specifically ushul fiqh theories such as the concepts of public interest (maslahah) and preventing harm (adz-dzari’ah). The article argues that in every policy, there will be potential benefits (maslahah) and harms (mudharat). In the policy of recording unregistered marriages, the government needs to close the means that cause harm (saddu al-dhariah) to ensure this policy is not interpreted as a form of legalizing unregistered marriages. The government also needs to open the means that lead to benefits (fathu al-dhariah) so that the goal of fulfilling children's civil rights with the basis of having a birth certificate, and the purpose of the Marriage Law, namely the validity of marriage, can be achieved through the use of unregistered marriage data for expediting the marriage legalization process (itsbat nikah) in Religious Courts. The conclusion of this article is that to achieve the ideal policy objectives, aspects of benefits and harms need to be considered. This article contributes to understanding state policies from the perspective of ushul fiqh and indicates that it remains a relevant approach.

Abstract

Studies on the rights of persons with disabilities in the private sphere need attention. This is because several regulations legitimize discrimination against persons with disabilities. In a divorce, for example, a normal couple can divorce their partner on the grounds of disability, which they fear will interfere with their rights and obligations in the household. This article examines the law on divorcing couples who become disabled holistically, from laws, regulations, and fiqh. This article is normative research by examining laws from the perspective of norms. This article is literature research by examining sources from the available texts. This article uses an ushul fiqh approach that emphasizes the reinterpretation of story verses as a basis for ijtihad. This article finds that divorce should not be based solely on the cause of the spouse is disabled. This means that divorce must be based on a more substantive element: a broken marriage. Broken marriages are not always born from the cause of a partner who becomes disabled. Many cases show that even though the couple is still normal, they are ignorant of their obligations in the household. Kajian mengenai hak-hak difabel dalam ranah privat perlu mendapat perhatian lebih. Pasalnya, beberapa peraturan justru melegitimasi diskriminasi atas difabel. Dalam perceraian misalnya, pasangan yang normal dapat menceraikan pasangannya dengan alasan difabel yang dikhawatirkan akan mengganggu hak dan kewajibannya dalam rumah tangga. Artikel ini mengkaji hukum menceraikan pasangan yang menjadi difabel secara holistik, baik dari peraturan perundang-undangan dan fikih. Artikel ini merupakan penelitian normatif dengan mengkaji hukum-hukum dari perspektif norma. Artikel ini merupakan penelitian pustaka dengan mengkaji sumber-sumber literatur yang berasal dari teks-teks yang tersedia. Artikel ini menggunakan pendekatan ushul fikih yang menekankan pada reinterpretasi ayat-ayat kisah sebagai landasan ijtihad. Artikel ini menemukan bahwa perceraian tidak boleh dilandaskan pada sebab pasangan menjadi difabel semata. Artinya, perceraian harus didasarkan pada unsur yang lebih substantif, yaitu broken marriage. Perkawinan yang rusak tidak selalu lahir dari sebab pasangan yang menjadi difabel. Banyak kasus menunjukkan bahwa meskipun pasangan masih normal, mereka abai terhadap kewajibannya dalam rumah tangga.

Abstract

The relationship between government authority and civil society groups (philanthropic institutions) is often dynamic and tends to be imbalanced when one side becomes dominant. Mosque-based BMTs in Solok City show an interesting relationship pattern with the government, particularly before and after the Solok City government received an award. This article examines the pattern of relations between the two using Gretchen Helmke and Steven Levitsky's typology of relations. This field study's data is sourced from interviews with several Solok City officials involved in managing MB-BMT. Data was collected through observation, interviews, and documentation, followed by qualitative analysis. Gretchen Helmke and Steven Levitsky's theory on the typology of relations between the private sector and the state is used to analyze these relations. The results of this study strengthen existing theory, as evidenced by the success of MB-BMT in Solok City, where the relationship between MB-BMT and the Solok City Government is a complementary substitution. The MB-BMT institution aims to strengthen the objectives set by the Solok City Government to protect the community from the clutches of loan sharks by channeling philanthropic funds exclusively through the qardh agreement. Meanwhile, the Solok City Government adopts a passive stance, meaning it grants full autonomy to the mosque institution to manage its operations, resulting in the Solok City Government being ineffective and its role being replaced by the MB-BMT institution. From a management perspective, the MB-BMT in Solok City only performs the functions of a Mal institutional body and does not carry out the tasks of a Tamwil institution. Research shows that when the government is fully involved in the capital and management of MB-BMT institutions, these institutions become inactive and ultimately cease to function.
