Abstract

ABSRACT Training of Constructing Scientific Report on Social Major (Law) has done on SMA Negeri 3 Denpasar, by the Guiding Team of the Lecturers of Law Faculty of Udayana University through a practice of constructing a report in a class through a workshop. Aproximately, 40% are for meanwhile, 60% are by practice of composing and providing some reference which is related to the constructing of a social-scientific report, and there all are done well so far. This fact was indicated by the responds which were given by the students of SMA Negeri 3 Denpasar, especially for those who join the KIR group.This activity has been done once a week.

Abstract

Bali Provincial Regulation No. 8 of 2020 concerning Bali Province Industrial Development Plan Year 2020-2040 was created to balance the structure and fundamentals of the Balinese economy which includes three pillars, namely tourism, agriculture, and industry. Besides, it also reflects an effort to reduce the dependence of the Balinese economy on tourism. This article assesses the process of the creation of Bali Provincial Regulation No.8 of 2020 concerning Bali Province Industrial Development Plan Year 2020-2040 and its content, mainly regarding the position of the small and medium tourism industry. It also offers a lens on the future legal framework of the tourism industry in Bali. It is a normative legal study that uses the statute, conceptual, and analytical approaches. This article argues that the future legal framework of the tourism industry should deal with, at least, the following five issues: mass tourism; degradation of nature and environmental quality; meeting the perception and expectation of travelers; the quality of tourism services; and protection to the tourists as a costumer.

Abstract

The establishment of Government Administration Law brings significant change to the competence of the previously restricted Administrative Court to become expanded. This study aims to find the philosophical considerations from the extension of Administrative Decision meaning on Government Administration Law, to classify the legal implication arising from the regulation of the expansion of administrative decision meaning towards dispute submission process in Administrative Court and to formulate ideal attitude of the State Administrative Judge in resolving State Administrative Disputes. This is a combination of normative and empirical legal research. The study indicated that the legislator main consideration in regulating the expansion of administrative decision meaning on Government Administration Law is to expand the absolute competence of Indonesian Administrative Court which previously felt very narrow. The implication arises after new regulation consists of: the expansion of Administrative Court adjudicate authority for factual actions, subject expansion that have the authority to issue Administrative Decision, the expansion of the Administrative Court adjudicate authority over Administrative Decision which has a legal consequences although still need the approval from above instance, the regulation that Administrative Decision can be sued through the Administrative Court of any potential loss that may arise by the issuance of its Administrative Decision and the expansion towards the parties who have a chance to field a State Administrative accusation. The ideal attitude of State Administrative Judge is the judge should remain based on the strong theoretical concepts of the law so can create understanding and attitude in handling a case in Indonesian Administrative Court.

Abstract

There are three major components within the space management that is reciprocally-related, they are: planning, utilizing, and space-controlling. Within the space management that takes place in the local sector, the aspect of planning belongs to the authority of the provincial government to uphold, meanwhile, the aspect of utilizing and space controlling are to be endorsed by the city or regency governing and administration. In the Province of Bali, the planning of space management has been arranged based upon the Local Regulation of Bali Province No 16 Year 2009. Within this regulation, there has been an overlapping conception regarding the enactment of the region of the holy places with the region of tourism. Among ten (1O) regions of holy places that have been stated by this regulation, there has been only one region of holy place that suits and consistent based upon its utility, which is being utilized as the region of holy place. On the other hand, the other nine (9) remaining region of holy places status have a/so been enacted as the region of tourism.

Abstract

ABSTRAK Penilitian ini bertujuan untuk memberikan informasi mengenai bagaimana bentuk perlindungan hukum mengenai kelestarian Cagar Budaya di Indonesia serta Bagaimana peran pemerintah daerah dalam menjaga kelestarian cagar budaya didaerahnya masing-masing. Pada penelitian jurnal ini menggunakan penelitian hukum normatif dengan pendekatan peraturan perundang-undangan serta berbagai literature yang memiliki relevansi terkait dengan pokok bahasan. Hasil dari penelitian ini menunjukkan bahwa yaitu pertama, perlindungan hukum oleh pemerintah terkait perlindungan hukum situs cagar budaya ataupun benda cagar budaya terdapat dalam ketentuan Pasal 95 ayat (1) UU No 11 Tahun 2010 yang dimana pemerintah pusat maupun daerah memiliki kewajiban untuk melaksanakan pelestarian cagar budaya. Kedua, peran pemerintah daerah terhadap perlindungan situs warisan cagar budaya dalam melestarikan cagar budaya terdapat ketidakjelasan mengenai kewenangan antara pemerintah pusat maupun pemerintah daerah, serta instasi terkait, mengakibatkan adanya saling lempar tangung jawab antar instansi yang ada. Sehingga dengan permasalahan ini terdapat kekaburan norma ataupun ketidakpastian hukum terkait perlindungan hukum oleh pemerintah daerah terhadap situs warisan cagar budaya. . Kata Kunci: Peran Pemerintah, Perlindungan , Cagar Budaya ABSTRACT The purpose of this research is provide information about legal protection of ancient cultural heritage preseverance in Indonesia. In addition, examining the role of regional government towards cultural heritage on their respective region with the current regulations. The research method used on this research is normative legal research methods through the approach of applicable laws and regulations related to the topic. The results of this study indicates: first , the protection of cultural heritage or cultural heritage objects is contained in the provisions of Article 95 section (1) of act No. 11 of 2010 which states that the central and regional governments have protection to carry out cultural preservation. Seccond, the role of local governments in the protection of cultural heritage sites in cultural heritage there is unclear authority and accountability between central government as well as regional government is not explicitly regulated, in which this situation leads to responsibility shifting between existing institutions. Coordination and cooperation between government and related institution in carrying out their affairs in preserving national cultural heritage become necessary urgency supported with clear and firm regulations. Abstract

ABSTRAK Jurnal ini memiliki tujuan untuk mengetahui pengaturan zonasi kawasan rawan bencana yang diatur dalam Perda RTRW Kabupaten Jembrana dan memberikan rekomendasi pentingnya pengaturan mitigasi bencana likuifaksi dalam Perda RTRW Kabupaten Jembrana. Metode yuridis normatif sebagai dasar metode penelitian dalam jurnal yang dikombinasikan dengan analisis peraturan perundang-undangan untuk menganalisis permasalahan hukum dalam topik bahasan. Hasil dari penelitian ini menemukan bahwa dalam Perda RTRW Kabupaten Jembrana telah mengatur zonasi kawasan rawan bencana dari beberapa jenis potensi bencana yang ada. Namun terdapat salah satu jenis potensi bencana yang belum mendapat pengaturan mitigasi dalam Perda RTRW Kabupaten Jembrana, yaitu bencana likuifaksi yang potensi terjadinya bencana ini di beberapa wilayah Kabupaten Jembrana termasuk dalam kategori risiko sedang hingga risiko tinggi. Sehingga perlu untuk menambahkan pengaturan mitigasi bencana likuifaksi dalam porses revisi Perda RTRW Kabupaten Jembrana yang terbaru. Kata Kunci: Mitigasi, Bencana Likuifaksi, Tata Ruang ABSTRACT The writing in this journal is motivated by the problem of liquefaction disaster mitigation regulation that have not been regulated in the Jembrana Regency Spatial Planning Regulation. This journal aims to find out the zoning regulation for disaster-prone areas as regulated in the Jembrana Regency Spatial Planning Regulation and provide recommendations for liquefaction disaster mitigation regulation in the Jembrana Regency Spatial Planning Regulations. The Normative Juridical Method as the basis for research methods in journals is combined with the analysis of legislation to analyze legal issues in the topic of discussion. The results is found that the Jembrana Regency Spatial Planning Regulation has regulated the zoning of disaster-prone areas from several types of potential disasters. However, there is one type of potential disaster that has not received mitigation regulation in the Jembrana Regency Spatial Planning, and that is namely the liquefaction disaster where the potential for this disaster in several areas of Jembrana Regency is included in the moderate to highrisk category. Because of that, it is necessary to add a liquefaction disaster mitigation regulation in the revision process of the latest Jembrana Regency Spatial Planning Regulation Key Words: Mitigation, Liquefaction Disaster, Spatial Planning

Abstract

ABSTRAK Penulis meneliti hal ini bertujuan untuk memahami kaitan antara pendirian perusahaan holding dan penguasaan pasar atau yang biasa disebut dengan Trust dalam Undang – Undang Nomor 5 Tahun 1999 Tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat. Adapun jurnal ini mengambil studi kasus pembentukan PT GoTo Gojek-Tokopedia sebagai penggabungan lini usaha dari Gojek dan Tokopedia dengan membentuk suatu perusahaan induk. Studi ini diadakan dengan melakukan pendekatan studi literatur dengan metode normatif dengan membandingkan undang – undang dengan berita. Studi ini menunjukkan hasil bahwasannya GoTo sebagai Holding Company yang dibentuk oleh Gojek dan Tokopedia tidak memenuhi unsur – unsur trust sebagaimana yang dikira. Dalam aspek bisnis, pembentukan holding sangat diperlukan untuk membuat kebertahanan di tengah gempuran pesaing dan menaikkan valuasi dari entitas usaha. Kata Kunci: Holding, Trust, Bisnis, Gojek, Tokopedia ABSTRACT The writer carries out the research to explore the correlation between the establishment of holdings and market control that commonly referred to Trust in Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. This journal takes a case study of the formation of PT. GoTo Gojek-Tokopedia as the merging of the business lines from Gojek and Tokopedia by forming a holding company. This research uses the literature study approach and the normative method by comparing the law with the news. The results of this study show that GoTo as a holding company formed by Gojek and Tokopedia did not fulffil the elements of trust as expected. In the business aspect, the formation of a holding is very necessary to survive in the middle of the competitor tactics in addition to increasing the valuation of business entities. Abstract

Rights of building use are land rights where the land is not owned by itself but still has the right to construct and own buildings in accordance with the provisions of Article 35 paragraph (1) of the UUPA. Building use rights are used if land is purchased in lots and the contractor who sells the land provides the land in the form of a building use rights status certificate. Many people do not realize that the term of the right to build has expired. In fact, if you want to change the status of the right to build to a property right, you can do this at the time of purchasing the land. However, the community is still indifferent to this matter, and begins to prioritize the transfer of usufructuary rights to become property rights when there is a transaction on the land, for example at the time of land sale. The problem that will be studied in this paper is about how the existence and legal certainty in guaranteeing land with the status of usufructuary rights that have expired and the obstacles in the process of changing land from usufructuary rights to land ownership rights. Normative legal research is the method with a statutory approach. The status of Building Use Rights that are still valid or those that have expired are regulated in PP Number 18 of 2021. As well as obstacles that occur in the process of changing rights from HGB to property rights such as timeframe and costs, citizen need to be aware for the legal of building use rights. Indonesian citizens need to pay more attention to the land rights they own, so that later mistakes will not occur, especially in the administration related to land rights.

Abstract

This study aims to analyse the ability of I Gusti Ngurah Rai Airport to deal with catastrophic impacts brought by both earthquakes and tsunamis. It bases its analysis on twelve (12) indicators of earthquake and tsunami preparedness. It intends to develop strategies for dealing with these disasters to reduce the number of casualties. A questionnaire as its research instrument aided its data collection. The survey was carried out between a period of November – December 2022. The research is designed to combine qualitative and quantitative methods through a qualitative descriptive analysis approach, Likert analysis, SWOT and QSPM. The results show that I Gusti Ngurah Rai Airport Disaster Management Strategies for earthquakes and tsunamis fall in an outstanding category. Furthermore, it is emphasised that as a priority, a strategy that needs to be implemented by I Gusti Ngurah Rai Airport for earthquake and tsunami disaster mitigation is to strengthen disaster mitigation capabilities through twelve (12) earthquake and tsunami alert indicators by utilising advances in information technology. For future studies, it is hoped that new methods in disaster mitigation will be further explored.Keywords: airport; mitigation; earthquake; tsunami; victim AbstrakPenelitian ini bertujuan menganalisis kemampuan Bandara I Gusti Ngurah Rai dalam menghadapi bencana gempa bumi dan tsunami berdasarkan 12 indikator siaga gempa dan tsunami serta menyusun strategi penanggulangan bencana tersebut agar tidak ada korban jiwa. Pengumpulan data menggunakan kuesioner sebagai instrumen penelitian dengan periode penelitian November – Desember 2022. Rancangan penelitian menggunakan kombinasi metode kualitatif dan kuantitatif, melalui pendekatan analisis deskriptif kualitatif, analisis Likert, SWOT dan QSPM. Hasil penelitian menunjukkan kemampuan Bandara I Gusti Ngurah Rai dalam mitigasi bencana gempa bumi dan tsunami berada pada kategori sangat baik berdasarkan 12 indikator gempa bumi dan tsunami. Strategi prioritas yang dapat diimplementasikan Bandara I Gusti Ngurah Rai untuk mitigasi bencana gempa bumi dan tsunami adalah penguatan kemampuan mitigasi bencana gempa bumi dan tsunami melalui 12 indikator siaga gempa bumi dan tsunami dengan memanfaatkan kemajuan teknologi informasi. Untuk penelitian ke depan, diharapkan metode-metode baru akan dieksplorasi lebih lanjut.Kata kunci: bandara; mitigasi; gempa bumi; tsunami; korban

Abstract

Feed is one of the most determining factors in cultivation activities, with good and correct feed making techniques it is expected to create fish feed with a formulation that is in accordance with the growth of catfish. The purpose of this community service is to improve the knowledge, attitudes and skills of fish farmers. The method of implementing the activity is through practice, discussion and question and answer. The results of the community service activities went well and correctly, participants were able to understand the material presented by the resource person including feed formulation, material selection and fish feed printing. The tools and materials used in this activity are feed printing machines (vertical and extruder) and scales. While the materials used are 25% fish meal, 22% soybean meal, 40% bran, 10% tapioca, 2% vitamins, 1% minerals
