Abstract

Hukum dan ekonomi merupakan dua ilmu yang berbeda, namun mempunyai korelasi yang erat sehingga melahirkan suatu kajian baru yaitu hukum ekonomi. Kajian ini kemudian dikaitkan dengan konsep syariah, dan melahirkan studi hukum ekonomi syariah. Tujuan penelitian ini adalah mengetahui relasi hukum dan ekonomi dalam membentuk suatu kajian baru dan peranannya dalam pengembangan studi hukum ekonomi syariah di Indonesia. Metode penelitian dalam artikel ini adalah jenis peneltian kualitatif yang bersifat deskriptif analitis dan tergolong library research, dimana data diperoleh dari bahan pustaka berupa buku, artikel jurnal, dan bahan pustaka lannya, analisis data dilakukan dengan model analisis deskripsi dan analisis isi. Hasil penelitian menunjukkan bahwa antara ekonomi dan hukum mempunyai kaitan yang sangat erat dan saling mempengaruhi, dimana suatu perkembangan ekonomi akan mempengaruhi peta hukum. Begitu juga sebaliknya, perubahan hukum juga akan memberikan dampak yang luas terhadap ekonomi. Relasi hukum dan ekonomi dalam konteks Islam membentuk studi hukum ekonomi syariah. Studi ini merupakan gabungan dari kajian fiqh muamalah dan ekonomi syariah. Relasi kajian hukum dan ekonomi dalam konteks Islam berpengaruh pada perkembangan ekonomi syariah dan hukum ekonomi syariah di Indonesia, meliputi pembentukan lembaga fatwa ekonomi syariah (DSN MUI), lembaga keuangan syariah, peraturan perundang-undangan tentang ekonomi syariah, pendidikan ekonomi syariah dan hukum ekonomi syariah. (Law and economics are two different sciences, but have a close correlation so as to give birth to a new study, namely economic law. This study is then associated with the concept of sharia, and gave birth to the study of sharia economic law. The purpose of this research is to find out the relationship between law and economics in forming a new study and its role in the development of sharia economic law studies in Indonesia. The research method in this article is a type of descriptive analytical qualitative research and is classified as library research, where data is obtained from library materials in the form of books, journal articles, and other library materials, data analysis is carried out with a description analysis model and content analysis. The results showed that between the economy and law have a very close relationship and influence each other, where an economic development will affect the legal map. Vice versa, changes in the law will also have a broad impact on the economy. The relationship between law and economy in the Islamic context forms the study of sharia economic law. This study is a combination of the study of fiqh muamalah and Islamic economics. The relationship between legal and economic studies in the Islamic context affects the development of Islamic economics and Islamic economic law in Indonesia, including the formation of Islamic economic fatwa institutions (DSN MUI), Islamic financial institutions, legislation on Islamic economics, Islamic economic education and Islamic economic law.)

Abstract

This study aims to determine the strategy for accelerating halal certification for Micro, Small, and Medium Enterprises (MSMEs) in Bangkalan Regency using the Analytical Hierarchy Process (AHP) method, as well as to examine the strategy from the perspective of maslahah mursalah in order to provide maximum benefits for MSME actors and the wider community. This type of research is qualitative using the AHP (Analytical Hierarchy Process) approach with the research subjects of the Ministry of Religion, MUI, Halal Center UTM, Cooperative Office. The data used are primary data and secondary data with data collection techniques using interviews and questionnaires. Based on AHP analysis, the criteria that are very influential in the process of accelerating halal certification strategies in Bangkalan are the role of halal certification bodies, which obtained the highest weight of 0.514, compared to market demand with a weight of 0.280, awareness of business actors with a weight of 0.138, and the role of government with a weight of 0.068. From the perspective of maslahah mursalah, these strategies not only aim to fulfill the immediate needs of MSMEs and consumers for halal assurance but also serve the broader public interest by promoting social welfare, economic justice, and community trust. By prioritizing the role of halal certification bodies and enhancing awareness through socialization programs, the approach ensures that the certification process is efficient, transparent, and inclusive. This aligns with the principle of maslahah mursalah, which advocates for solutions that bring maximum benefit and prevent harm to society.
