Abstract

Drug abuse among adolescents poses a serious threat to individual well-being and family stability. Within the Islamic framework, parents play a central role as moral and spiritual guides in protecting their children from harmful behaviors. This study explores the role of Islamic parenting in preventing adolescent drug abuse through the lens of da'wah psychology. This research employed a qualitative method using a literature review approach. Relevant scholarly works on Islamic parenting, da'wah psychology, and drug prevention strategies were analyzed. Descriptive analysis was conducted to examine the interconnections between Islamic values, parenting practices, and adolescent behavior. Findings indicate that Islamic parenting, when grounded in religious teachings and moral development, serves as an effective preventive mechanism against drug abuse. The integration of da'wah psychology enhances parents' ability to communicate religious and ethical messages persuasively, fosters stronger emotional bonds, and supports the creation of a psychologically healthy home environment. Key elements such as early inculcation of Islamic values, wise supervision, positive role modeling, and active parental involvement in children’s lives contribute significantly to deterring adolescents from drug-related behavior. The study concludes that Islamic parenting, supported by principles of da'wah psychology, provides a holistic framework for drug abuse prevention. Strengthening parental awareness and engagement within this framework can help nurture a resilient, morally grounded younger generation.

Abstract

This research aims to analyze the law of Ijarah Muntahiyah Bit Tamlik (IMBT) in the perspective of Islamic law and positive law in Indonesia, as well as examine the suitability and synergy between the two. IMBT is a complex form of Islamic financing contract because it combines two different contracts, namely rent (ijarah) and transfer of ownership (grant or sale). This research uses a normative juridical method with a comparative approach and critical analysis, namely comparing the legal basis of IMBT in muamalah fiqh and legislative regulations in Indonesia, including the Compilation of Sharia Economic Law, Banking Law, Bank Indonesia Regulations, and Civil Code. Data collection techniques are carried out through library research by examining primary and secondary sources. The results of the study show that Islamic law allows IMBT contracts to be safe if the lease contract and the promise of ownership are separated and not made in one binding contract. Transfer of ownership can only be done after the lease period ends, and the contract structure must be in accordance with the principles of justice, clarity, and free from elements of usury and gharar. In positive law in Indonesia, IMBT is also legally recognized, although it has not been regulated in a special law. However, its existence has been legitimized through the DSN-MUI fatwa, the Compilation of Sharia Economic Law (KHES), the Sharia Banking Law, and Bank Indonesia Regulations. There is substantial synergy between the principles of fiqh muamalah and positive law in Indonesia, although there is still a need to strengthen regulations and epistemological reconstruction so that IMBT can be carried out more comprehensively, legally according to sharia, and strong in national law in modern economic practices.

Abstract

This study aims to analyze the legality of YouTuber income from an Islamic economic perspective, especially in relation to the content produced and advertisements displayed through the Google AdSense program. The main focus of this study is to review the halal or haram status of YouTuber income based on sharia principles, as well as to understand the form of contract that underlies the cooperation between YouTubers and advertising providers. This study uses a library research method by reviewing Islamic literature, fatwas of the Indonesian Ulema Council, books, scientific journals, and other relevant documents related to muamalah law and digital media. The results of the study show that the profession of YouTuber is permissible in Islam as long as the uploaded content does not violate sharia. The permissibility of income from AdSense depends heavily on two things: content and type of advertisement. If both are in accordance with Islamic values, then the income is halal and even obligatory to be zakat if it meets the nisab and haul. From the perspective of the contract, the collaboration between YouTubers and Google AdSense can be categorized as syirkah abdan and ju'alah, which is valid as long as it meets the requirements such as clarity of the agreement, the consent of both parties, and is free from elements of usury, gharar, and maysir. The MUI fatwa emphasizes that transactions through social media must reflect faith, piety, and noble morals, and avoid all forms of content or activities that damage sharia values. Therefore, Muslim YouTubers have a sharia responsibility to maintain the integrity of content and digital ethics in all their activities. Keywords: Legality, YouTuber Income, Islamic Law

Abstract

Penelitian ini bertujuan untuk mengkaji keabsahan penggunaan bank konvensional dalam penyaluran dana beasiswa dari perspektif fiqh muamalah. Masalah utama yang diangkat adalah potensi keterlibatan unsur riba dalam proses distribusi dana beasiswa melalui sistem perbankan konvensional, yang secara prinsip bertentangan dengan syariat Islam. Dengan menggunakan metode studi pustaka (library research), data diperoleh dari literatur klasik seperti Al-Mughni karya Ibnu Qudamah dan Al-Majmu’ karya An-Nawawi, serta literatur kontemporer seperti Fatawa al-Mu‘ashirah karya Yusuf al-Qaradawi dan fatwa-fatwa Dewan Syariah Nasional MUI. Analisis dilakukan dengan pendekatan analisis isi dan triangulasi sumber melalui perbandingan pandangan ulama lintas mazhab dan pendekatan maqashid al-shariah.Hasil penelitian menunjukkan bahwa penggunaan bank konvensional dapat ditoleransi dalam kondisi darurat dengan syarat ketat, seperti tidak adanya unsur riba dan penggunaan akad wakalah yang sah secara syariah. Namun, solusi ini bersifat temporer dan bukan ideal dalam jangka panjang. Oleh karena itu, diperlukan strategi transisi menuju sistem penyaluran beasiswa berbasis keuangan syariah, baik melalui kemitraan dengan bank syariah maupun pemanfaatan teknologi keuangan digital syariah (sharia fintech). Literasi fiqh muamalah, tata kelola dana yang amanah, serta penguatan regulasi syariah menjadi kunci dalam mewujudkan sistem penyaluran beasiswa yang tidak hanya efisien, tetapi juga sesuai dengan prinsip-prinsip Islam

Abstract

The development of technology continues and develops in accordance with the times. The use of technology is also carried out to the context of daily life so that life becomes more practical. Then, this context is also very close to the use of technology in the judicial process through the e-court system. This is what makes Constitutional Court Decision Number 46/PUU-VIII/2010 concerning the Examination of Article 43 paragraph (1) of Law Number 1 Year 1974 concerning Marriage appear and change the paradigm of proof from the determination of children outside marriage can be done by using technology in the form of DNA tests. In this case, electronic evidence or digital evidence can be strong evidence to recognize the father's nasab position over the child. The research method used in this research is Normative Juridical with a statutory approach and a case approach. The results and discussion of this study found that it turns out that the application of digital evidence can realize children's rights when looking at several existing decisions. Of the 10 (ten) decisions and/or court decisions that have been reviewed, all of them use digitized evidence and make the judge's view more objective, resulting in a decision that recognizes the father's lineage to the child. The context of this recognition is the essence that the concept of child recognition makes his rights fulfilled and the father cannot deny that the child is his own child. In addition, DNA evidence, CCTV and photos and videos exist to strengthen the position of the father's lineage to a child whose father previously did not recognize his own child. Regulatory reconstruction in the application of digital evidence to realize children's rights is carried out by changing the provisions of the Religious Courts Law and the Marriage Law in terms of strengthening the position of children's rights.

Abstract

this article aims to compare the legal standing of unregistered marriages children from different legal system, Islamic marriage law and residency law in Indonesia. Due the Act no. 1 /1974 and Islamic Law Compilation no. 1/1991 every unregistered marriages children can obtain legal status by pursuing a marriage decree (isbat nikah) or through the jurisprudence of a Constitutional Court Decision otherwise he does not have legal protection by the state because his parents’ marriage is not recognized and he cannot obtain birth certificates for children and other civil relations. On the contrary according to Regulation Of The Minister Of Internal Affairs Of The Republic Of Indonesia Number 9 Of 2016 About Accelerate Increasing Coverage Of Birth Certificate Ownership he can acquire the birth certificate by the letter of absolute liability (SPTJM)provided by the parents. From the maqashid sharia perspective this contradiction impact the legal standig of unregistered marriage children. This research is literary research with a comparative study with qualitative approach. In accordance with maqashid sharia every child must equal legal standing as resident without any discriminatory position since it is included in the area of basic necessity (mashlahat dharuriyat) as the origin of all rights relating to legal subjects
