Abstract

Polygamy is a form of plural marriage that generates complex psychological dynamics for all individuals involved. This practice is not only associated with legal and religious dimensions, but also engages deeper psychological aspects, including personal motivations, emotional adaptation processes, gender-based power relations, and intrapersonal as well as interpersonal conflicts within family life. This article aims to analyze the psychological aspects of polygamy by focusing on three main dimensions: (1) individuals’ psychological motivations for engaging in or accepting polygamous marriage, (2) patterns of psychological adaptation that develop within polygamous families, and (3) forms of psychological conflict and their implications for mental health. This study employs a qualitative method through a library research approach and a descriptive-analytical analysis of literature in psychology, family sociology, and gender studies. The findings indicate that polygamy is often associated with high levels of emotional tension, particularly among women and children, and tends to encourage coping mechanisms that are not always adaptive in the long term. This article emphasizes that a psychological perspective is a crucial element in understanding, evaluating, and formulating social and policy responses to polygamous practices in a more comprehensive manner.

Abstract

Terbitnya Surat Edaran Mahkamah Agung (SEMA) Nomor 2 Tahun 2023 menandai pergeseran paradigma hukum keluarga di Indonesia, dari praktik judicial activism yang membuka celah perkawinan beda agama, menuju restriksi administratif yang menutup total praktik tersebut. Penelitian ini bertujuan untuk menganalisis implikasi yuridis SEMA tersebut dengan membenturkan dua perspektif diametral: doktrin perlindungan agama (Hifz al-Din) dan hak konstitusional warga negara. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Temuan penelitian menunjukkan bahwa: (1) SEMA No. 2 Tahun 2023 merupakan manifestasi Sadd al-Dzarai (tindakan preventif) negara untuk menjaga kemurnian akidah dan mencegah kerancuan status nasab anak (Hifz an-Nasl); (2) Dalam tata hukum Indonesia, hak membentuk keluarga (Pasal 28B UUD 1945) dikategorikan sebagai derogable rights yang pelaksanaannya dibatasi oleh nilai-nilai agama sebagaimana diatur dalam Pasal 28J ayat (2) UUD 1945; (3) Meskipun menciptakan kepastian hukum dan unifikasi tafsir hakim, SEMA ini berpotensi memicu resistensi hukum berupa penyelundupan hukum (smuggling of law) melalui perkawinan di luar negeri atau perpindahan agama semu. Penelitian ini menyimpulkan bahwa SEMA No. 2 Tahun 2023 meneguhkan posisi Indonesia sebagai negara hukum berketuhanan yang menempatkan validitas teologis sebagai prasyarat mutlak validitas administratif perkawinan.

Abstract

Mediation is a form of Alternative Dispute Resolution that aims to achieve amicable settlements between disputing parties. In the context of family disputes in Indonesia, mediation plays a strategic role in preventing divorce and maintaining family unity and harmony. However, the effectiveness of mediation is influenced not only by legal and procedural factors but also by the psychological conditions and dynamics of the parties involved. This study examines the role of psychological aspects in determining the success of family dispute mediation in the Religious Courts of Indonesia. Using an empirical legal research design with a qualitative sociological approach, primary data were collected through in-depth interviews with judges, mediators, and disputing parties at the Religious Court of Purwakarta, supported by direct observation of mediation sessions. The findings reveal that mediators who understand the psychological dynamics of the parties are more capable of creating a conducive mediation environment, managing emotions effectively, and facilitating constructive communication. Psychological aspects significantly contribute to the achievement of amicable agreements and to the sustainability of post-mediation relationships. Accordingly, the integration of psychological approaches into the training and practice of family mediation in the Religious Courts should be strengthened to enhance the effectiveness of family dispute resolution in a peaceful, humane, and just manner. This study aligns with the principles of Islamic law, particularly the concepts of islah (reconciliation) and shulh (amicable settlement), as well as the objectives of maqāṣid al-sharīʿah, especially hifz al-nasl (the protection of progeny and family integrity).

Abstract

The phenomenon of childfree or the conscious decision not to have children is becoming an increasingly prominent social issue in modern society, including in Indonesia. This decision gave rise to normative, moral, and psychological debates in society based on religious values. This study aims to analyze the phenomenon of childfree from the perspective of Islamic law and psychology, in order to understand how this life choice can be accepted or rejected within the framework of religious values and individual psychological well-being. The research uses a qualitative approach with the library research method through descriptive analysis of Islamic legal literature, maqāṣid al-syarī'ah theory, and studies of modern psychology and Islamic psychology. The results of the study show that in Islamic law, childfree can be categorized as a decision that is mubah as long as it is based on considerations of benefits such as health, emotional stability, or economic factors, and does not contradict the principles of maqāṣid al-syarī'ah. From a psychological perspective, these decisions are closely related to the factors of mental readiness, social pressure, and the need for self-actualization that reflect the process of finding a balance in life and personal happiness. Meanwhile, from the socio-religious side, this phenomenon still causes stigma because it is considered deviant from cultural norms and religious values that place children as a symbol of family success. Thus, the phenomenon of childfree requires a holistic and moderate approach in order to understand the proportionate relationship between individual freedom, social welfare, and Islamic spiritual values.

Abstract

Islamic philanthropy through zakat management plays a crucial role in achieving social welfare. This study aims to explore the transformation of zakat management strategies in the Zakat Collection Unit (UPZ) of Pacet Sub-district, Cianjur, and analyze its impact on the local community. Using a descriptive qualitative approach, the study gathered data through in-depth interviews, field observations, and documentation involving UPZ administrators, zakat recipients (mustahik), and other stakeholders. The findings reveal that the UPZ of Pacet Sub-district has implemented various innovations, including the digitalization of zakat collection and distribution systems, as well as enhanced transparency in reporting. These strategies have successfully increased public trust and participation in Islamic philanthropy. The impacts include improved access to education and healthcare services, economic empowerment of zakat recipients, and reduced poverty rates in the area. This study confirms that the transformation of zakat management in the UPZ of Pacet Sub-district significantly contributes to social development. The recommendations proposed include strengthening the capacity of administrators, developing sustainable empowerment programs, and enhancing inter-agency synergy to maximize the benefits of zakat in creating inclusive social welfare.
