Abstract

This service activity is intended to provide guidance to the elderly, which has not been done by many educational, social and community institutions. The coaching activities are focused on religious guidance for the elderly. Given that at his age, of course, the need for religious spirituality is a necessity. This service activity was carried out at the Muslim Kaffah elderly cottage in Malang city. These activities include pre-activities, during activities (coaching and socialization, and post-activities in the form of evaluation. The topic raised in the coaching activity was about ikhlas. There are several tips to be able to maintain sincerity, namely (1) Praying to always be sincere in worship, (2) In doing good deeds, seeing people who are better, (3) Feeling afraid that his practice is not accepted by Allah, (4) Not easily influenced by human speech, (5) Believing that no one has power over heaven and hell, (6) Eighth: Always remembering to be alone in the grave. These activities are very beneficial for the elderly, so there needs to be cooperation with the government to develop these activities.

Abstract

The growth of Islam as a minority group in South Korea necessitates various efforts to ensure that the Muslim community is accepted as part of the broader societal framework. The recent indications of Islamophobia in Korea further emphasize the need to shape a positive image of Islam within Korean society. Fear and expressions of hatred towards Islam and Muslims can emerge as a result of misunderstanding, stereotypes, or misinformation. This article proposes the application of representative Islamic principles to foster positive relationships with the surrounding community. These principles include the principles of peace, multiculturalism, and the concept of rahmatan lil alamin (universal mercy). The implementation of these principles can serve as a foundation for Muslims to be accepted and coexist harmoniously with other groups. This is expected to provide a deeper understanding of the values of Islam as a conceptual framework for promoting harmony in a society characterized by cultural and religious diversity. Pertumbuhan Islam sebagai kelompok minoritas di Korea Selatan menuntut perlunya berbagai upaya agar umat Islam diterima sebagai bagian dari kerangka sosial yang lebih luas. Adanya indikasi Islamopobia di Korea belakangan ini semakin menegaskan perlunya membentuk citra positif tentang Islam dalam masyarakat Korea. Ketakutan dan ekspresi kebencian terhadap Islam dan umat Muslim, dapat muncul sebagai hasil dari ketidakpahaman, stereotip, atau informasi yang salah. Artikel ini mengusulkan penerapan prinsip-prinsip Islam yang representatif untuk membentuk hubungan positif dengan masyarakat sekitar. Prinsip-prinsip ini mencakup prinsip perdamaian, multikulturalisme, dan konsep rahmatan lil alamin (rahmat universal). Implementasi prinsip-prinsip ini dapat menjadi dasar bagi umat Islam untuk diterima dan hidup berdampingan secara harmonis dengan kelompok lain. Hal ini diharapkan dapat memberikan pemahaman yang lebih mendalam tentang nilai-nilai Islam sebagai kerangka konseptual dalam mempromosikan harmoni dalam masyarakat yang ditandai oleh keberagaman budaya dan agama.

Abstract

In higher education context, Islamic Religious Education is one of the subjects that aim to develop student's characte. However, in reality there are many problems such as learning that focus only on the cognitive aspect. In addition, the implementation of the course is impressed only as a complement. Based on these problems, it is necessary to innovate in Islamic religious learning so that can contribute in character building of students. This study aims to find an alternative solution of character building of students through integration of science logic in Islamic religious learning. This research belongs to library research with descriptive-qualitative approach. Data collection techniques use documentation. For analysis using document analysis with content analysis techniques. The results showed that the process of integration of science logic in Islamic religous learning can be realized on the paradigm, approach, strategy, methods,materials, and evaluation of learning. while the implications can be seen from the steps of learning and the characters that are formed on the students themselves.

Abstract

This qualitative study is a concrete effort to reduce sexual violence in public universities based on digital literacy with a campaign pattern. Based on cases that continue to increase every year, this study targets students at Brawijaya University and Malang State University who are positioned as the main data. This data is tracked using survey and documentation techniques which are then processed systematically with secondary data in the form of related articles and books. In general, the study focuses on the issue of how the design of gender jurisprudence can be conveyed effectively to students. The results of this study are a special campaign account on Instagram social media called @gendercampaign. This account produces sexual violence prevention content based on gender jurisprudence. An important strategy in this campaign is the maximum use of algorithms, design creativity, content design and Instagram features.

Abstract

The Bajo community, as a traditional maritime group, has long practiced marine environmental conservation, such as avoiding marine pollution and protecting endangered species. However, these conservation efforts are often perceived as lacking a firm legal foundation within both formal legal systems and Islamic law, making local wisdom-based conservation initiatives susceptible to neglect by both the government and the broader society. This study aims to analyze the marine environmental conservation practices of the Bajo community from the perspectives of Islamic environmental jurisprudence and the concept of green constitutionalism. The study conducted a qualitative approach. Data were collected through interviews and Focus Group Discussions (FGDs) with Bajo community members, religious leaders, and relevant stakeholders. The findings reveal that the unwritten customary regulations of the Bajo community emphasize the sanctity of the sea and promote a subject-to-subject relationship between humans and nature. The conservation practices of the Bajo community align with the principles of Islamic environmental law (fiqh al-bi’ah), particularly the principle of prioritizing environmental sustainability for the welfare of humanity. Furthermore, the study finds that Bajo conservation traditions have adopted the principles of green constitutionalism enshrined in Article 28 H of the 1945 Constitution of Indonesia, which ensures the right to a healthy and sustainable environment.

Abstract

Human life is inherently paired. So that humans get married. Marriage is a legal and regular offspring connector so as to avoid mixing offspring or bloodline. inbreeding is clearly prohibited in the Marriage Law. The Compilation of Islamic Law also regulates the prohibition of marriage. Then there is a cancellation of marriage from inbreeding. As a result of the cancellation of marriage, the position of children from the cancellation of marriage arises. In terms of the Marriage Law related to the consequences of marriage cancellation in Article 28, the cancellation of marriage begins after a decision from the Court that has permanent legal force and is valid from the time of the marriage. The decision regarding the cancellation of marriage states that it does not apply retroactively to children born from the marriage. This creates uncertainty regarding the position of children from the cancellation of marriage for inbreeding. A marriage is declared invalid according to law and religion if it violates the provisions regarding the conditions or prohibitions in marriage. So can these provisions also apply to the cancellation of marriage for inbreeding. As well as legal protection for the fulfilment of children's rights due to marriage cancellation of inbreeding.

Abstract

This study explores the understanding of halal products among Indonesian Muslim migrant workers (IMMW) in South Korea. Previous studies indicate that knowledge of halal and haram influences consumption behaviour. South Korea, a growing hub for IMMW and the halal industry, offers a unique socio-cultural context. Using a socio-legal approach, this research investigates how cultural and social factors affect IMMW’s understanding and choices regarding halal consumption. Data were gathered through interviews and questionnaires with 104 respondents and analysed descriptively. Findings reveal that IMMW in South Korea has a strong awareness of halal standards, with 100% of respondents prioritising halal status before consumption. However, access to accurate halal information remains limited, indicating a gap in the dissemination of information and legal support. The study recommends collaboration between the Indonesian and South Korean governments to enhance legal protection and improve access to halal education and resources for IMMW. By addressing these issues, both countries can better support the religious and consumer rights of Muslim migrant workers. This article offers insights into the intersection of socio-cultural factors and legal awareness in a minority-Muslim setting and provides policy suggestions to promote fair and inclusive access to halal products.Penelitian ini mengkaji pemahaman tentang produk halal di kalangan pekerja migran Muslim Indonesia (PMI) di Korea Selatan. Studi sebelumnya menunjukkan bahwa pengetahuan tentang halal dan haram memengaruhi perilaku konsumsi. Korea Selatan, yang menjadi pusat berkembang bagi PMI dan industri halal, menawarkan konteks sosio-budaya yang unik. Dengan pendekatan sosio-hukum, penelitian ini menyelidiki bagaimana faktor budaya dan sosial memengaruhi pemahaman dan pilihan PMI terkait konsumsi halal. Data dikumpulkan melalui wawancara dan kuesioner dengan 104 responden dan dianalisis secara deskriptif. Temuan menunjukkan bahwa PMI di Korea Selatan memiliki kesadaran yang kuat tentang standar halal, dengan 100% responden memprioritaskan status halal sebelum konsumsi. Namun, akses terhadap informasi halal yang akurat masih terbatas. Hal ini menunjukkan adanya kesenjangan dalam penyebaran informasi dan dukungan hukum. Studi ini merekomendasikan kolaborasi antara pemerintah Indonesia dan Korea Selatan untuk meningkatkan perlindungan hukum dan memperbaiki akses terhadap pendidikan dan sumber daya halal bagi PMI. Dengan mengatasi isu-isu ini, kedua negara dapat lebih baik mendukung hak-hak agama dan konsumen pekerja migran Muslim. Artikel ini memberikan wawasan tentang perpotongan antara faktor-faktor sosiokultural dan kesadaran hukum dalam konteks minoritas Muslim, serta memberikan saran kebijakan untuk mempromosikan akses yang adil dan inklusif terhadap produk halal.

Abstract

This study aims to analyze the formulation of legal regulation for the criminalization of LGBT sexual behaviour in Indonesia through the perspectives of Maqashid Syari'ah and Utilitarianism. In a country with a Muslim-majority population, the LGBT phenomenon frequently raises a conflict between human rights protection and religious values. Using a normative juridical approach, this study examines legislation, legal theories, and relevant secondary data. Findings indicate that there is no explicit national regulation criminalizing LGBT behaviour. The Maqashid Syari'ah perspective emphasizes the protection of five fundamental principles: religion, life, intellect, lineage, and property. Meanwhile, Jeremy Bentham's Utilitarianism asserts that legal policy should maximize societal benefit. The study concludes that integrating these two approaches provides a balanced foundation for criminal policy formulation that upholds moral values and public interest without compromising justice and human rights.

Abstract

The dynamics of the application of Article 97 of the Compilation of Islamic Law in the distribution of joint property after divorce shows the phenomenon of contra legem carried out by judges to achieve substantive justice. This study analyzes the philosophical construction of Article 97 of the Compilation of Islamic Law and the judge's decision that deviates from the provisions of the 50:50 division through the perspective of Maqasid Shariah. The research method uses normative juridical with a qualitative approach, analyzing the Supreme Court Decision Number 266K/AG/2010 and the Decision of the Jakarta High Court of Religion Number 126/Pdt.G/2013/PTA. JK as primary data. The results showed that judges applied distributive justice by taking into account the factual contributions of each party, resulting in a proportional division of 75:25 and 67:33 that deviated from the normative provisions. The findings reveal that the approach of Maqasid Syariah through the principles of hifdz al-mal and hifdz al-nafs provides theological legitimacy for deviations for the sake of substantive justice. The research concludes the need for a reformulation of Article 97 of the KHI by integrating the principle of proportionality of contribution to create a legal framework that is more adaptive to contemporary social realities without sacrificing legal certainty.
