Abstract

Abstract: This study aims to find out how the legal arrangements for the implementation of Corporate Social Responsibility (CSR) in mining activities and to find out how the analysis of CSR Application Analysis to Communities Around Mining. The research method used is normative juridical with a qualitative approach that is used in the hope that the desired data can be obtained by the author of a clear and complete picture. The results of this study indicate that regulations related to CSR have been regulated in several legal regulations. In government regulation number 47 of 2012 concerning social and environmental responsibility of limited liability companies, it has been explained in article 4 paragraph that says that social and environmental responsibility is carried out by the board of directors based on the company's annual work idea after obtaining an agreement from the board of commissioners or the GMS in accordance with the company's basic budget, unless stipulated otherwise in the statutory provisions«. Law No. 22 of 2001 concerning Oil and Gas. If you look at Law number 22 of 2001 regarding oil and gas, it is not explained in writing that regulates the legal rules related to CSR. However, if you read carefully, there is one provision that alludes to the rule of law. Law Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining. Scholarship assistance, buses and several other programs are one of several CSR programs that have been implemented by PT Gorontalo Minerals. Judging from the CSR assistance provided to the community, it has been shown that PT Gorontalo Minerals implements CSR programs in accordance with applicable legal provisions, although only a few CSR programs have been provided by PT Gorontalo Minerals to the community.

Abstract

This study aims to determinea form of tackling the crime of cockfighting gambling.The method used in this research is empirical or sociological research methodology. This study uses a qualitative approach and sampling using purposive sampling and using descriptive analysis techniques. The results of this study indicate thata form of countermeasure carried out to tackle the crime of cockfighting gambling by means of preventive and repressive measures. In the preventive action stage, basically, stakeholders try to take precautions before the crime occurs. However, the most important role in preventing the occurrence of a crime is the supervision of the local community who then cooperates with law enforcement so that the crime of cockfighting gambling is easily detected.The countermeasures carried out by the authorities should be carried out with good coordination and cooperation, so as to make countermeasures that are right on target.

Abstract

Penyandang disabilitas merupakan bagian integral dari masyarakat dan berhak mendapatkan perlindungan hukum serta diakui keberadaannya. Meski demikian, realitas menunjukkan masih banyak penyandang disabilitas yang mendapatkan diskriminasi dan tidak mendapatkan haknya secara penuh. Kabupaten Boalemo, seperti daerah lain di Indonesia, memiliki jumlah penyandang disabilitas yang signifikan. Namun, perlindungan hukum dan pemenuhan hak-hak mereka masih menjadi isu yang perlu mendapatkan perhatian lebih. Diskriminasi, akses yang terbatas terhadap pendidikan, pekerjaan, dan fasilitas publik, serta kurangnya pemahaman masyarakat terhadap hak dan kebutuhan penyandang disabilitas menjadi tantangan utama. Penelitian ini bertujuan untuk memahami pengaruh budaya dan nilai-nilai masyarakat di Kabupaten Boalemo terhadap pandangan dan perlakuan terhadap penyandang disabilitas serta merumuskan rekomendasi tentang bagaimana perlindungan hukum bagi penyandang disabilitas dapat ditingkatkan dengan memperhatikan budaya dan nilai-nilai lokal. Pendekatan cultural studies menjadi landasan dalam mengungkap dinamika dan interaksi antara budaya, hukum, dan hak-hak penyandang disabilitas.

Abstract

Indonesia and Singapore were the founding members of an economic and geopolitical organization of countries in the Southeast Asian region called the Association of Southeast Asian Nations (ASEAN). ASEAN mandates each member country to create regulations and policies related to e-commerce transactions through the 1999 ASEAN Summit. This paper is a normative study and aims to analyse the development of e-commerce regulations in Indonesia and Singapore by utilizing comparative and statute approaches. The result of the study finds out that Singapore has designed its e-commerce master plan since 1998, meanwhile, Indonesia started to develop the master plan related to e-commerce a decade late than Singapore through the Acceleration and Expansion of Indonesian Economic Development program (MP3EI), which launched in 2011. Indonesia has regulated a few components related to e-commerce, but some are still partial and spread in a few regulations. This paper recommends governments unify all e-commerce components regulations into one act that can cover legal protection and become the basis of procedure regulation related to e-commerce in Indonesia. The usage of the Trustmark stamp and online registration procedure for the e-commerce activities required by Singapore can be enforced in Indonesia as a solution to problems that occur in e-commerce activity in Indonesia.

Abstract

This research is to find out the GEC's steps in responding to Election Supervisory Body (ESB) recommendations of the Gorontalo Regency in the 2020 Pilkada. The method used in this research is a normative research type that uses a statutory and case study approach. The results of this study indicate that in responding to the Gorontalo ESB recommendation letter, the Regency GEC Gorontalo held a plenary meeting with the ability to conduct consultations with the Gorontalo Provincial GEC, then the Gorontalo Regency GEC asked for information from the election candidate as the reported party, then the GEC asked for information as well as consulted with experts including legal lecturers and also related officials who ultimately poured out the results of the study by making the Gorontalo Regency GEC decision Number: 658/KPU-Kab/X/2020 concerning Follow-Up of the Recommendations of the Gorontalo Regency Election Supervisory Body (ESB) Against Alleged Election Administration Violations, dated 17 October 2020 in Fo Form PATL-2 based on the provisions of Law Number 1 of 2015 and GEC Regulation Number 13 of 2014.

Abstract

This study aims to evaluate the effectiveness of existing law enforcement related to environmental pollution in the Taluduyunu River. The method used in the study is normative and then analyzed in a descriptive qualitative. The results showed that the basis of law enforcement evaluation of the Taluduyunu River due to pollution of mining waste (Case Study Buntulia District, Pohuwato Regency). The results of this study revealed that law enforcement against river pollution due to mining waste is still not effective. Despite clear regulations regarding waste disposal, many mining companies have not fully complied with these regulations. Increased coordination between government agencies, the application of more stringent sanctions, as well as environmental awareness on the part of the industry are needed to thoroughly address this issue. To improve the effectiveness of law enforcement, there is a need for stricter policy reforms, increased capacity of law enforcement institutions, and closer collaboration between government, industry, and civil society in an effort to maintain environmental sustainability and public health affected by mining waste pollution.

Abstract

Black stone mining is one of the trades carried out in several areas of Gorontalo which have mineral mining potential. Unfortunately, in some areas, mining is often carried out without permits, even though there is good mining potential in that location. To collect and describe information directly, this research uses the right approach. This method involves gathering important information through interviews, studies, and participatory perceptions at exploration locations. Next, the data obtained is examined using measurable techniques to differentiate examples and identify relationships between mining activities and the impacts they have on the environment and society. The police have planned a “Central Conversation” (FGD). The aim of the FGD is to find appropriate and feasible arrangements to resolve this issue collectively.

Abstract

The Constitutional Court's presence yields positive impacts on constitutional law, yet isn't devoid of controversies, including Judge misconduct, transgression of 'nemo judex idoneus in propria causa' principle, and potential super body transformation. This paper aims to comprehend and analyze constitutional interpretation dominance in assessing laws against the 1945 Constitution through a constitutional dialogue approach. This normative writing employs legal, historical, and conceptual methods. Findings underscore: 1) Demonstrating respect for state institutions, notably the People's Consultative Assembly of Indonesia. 2) Establishing a more democratic system to test the 1945 Constitution's compatibility in the Constitutional Court. 3) Breaking the monopoly of Constitutional Court-centric constitutional interpretation. 4) Reviving 'nemo judex idoneus in propria causa' principle is pivotal due to extensive testing of Constitutional Court Law, addressing concerns about verdict impartiality.

Abstract

Tujuan penulisan ini adalah untuk mengetahui pentingnya perlindungan hak asasi manusia dalam pelaksanaan upaya paksa eksekusi putusan Peradilan Tata Usaha Negara (PTUN) dan Kendala Pelaksanaan Eksekusi Paksa Putusan PTUN dalam mewujudkan Perlindungan Hak Asasi Manusia. Sebagaimana diketahui, Penguatan eksekusi putusan pengadilan tata terus diperkuat melalui perubahan Undang-Undang tentang PTUN tahun 2005 dan terakhir 2009 melalui Upaya paksa serta pengenaan sanksi administratif terhadap tergugat yang dalam hal ini adalah pejabat pemerintahan yang tidak melaksanakan putusan pengadilan yang telah memperoleh kekuatan hukum tetap. Tulisan ini menggunakan metode Normatif dengan pendekatan perundang-undangan dan pendekatan konseptual dan dianalisis menggunakan Teknik deskriptif analitis. Hasil penelitian menunjukan Perlindungan hak asasi manusia merupakan hal yang penting dalam menyelesaikan pelaksanaan eksekusi paksa putusan PTUN agar eksekusi dapat memastikan keadilan bagi semua pihak yang terlibat sesuai dengan prinsip negara hukum yang berkeadilan dalam Undang-Undang Dasar 1945. Selain itu, Kendala Pelaksanaan Eksekusi Paksa Putusan PTUN dalam mewujudkan Perlindungan Hak Asasi Manusia yaitu Kurangnya kerjasama atau permohonan upaya paksa dari pihak penggugat ke PTUN, kurangnya Kesadaran Pejabat, dan kurangnya aturan pelaksana. Pada akhirnya, penulisan ini menawarkan solusi perlunya payung hukum yang lengkap dan tidak bertentangan satu sama lainnya untuk pelaksanaan eksekusi, pelaksanaan penegakan hukum yang konsisten dan tegas, dan peningkatan efisiensi sistem birokrasi dan kapabilitas aparatur pemerintah. Implementasi dari solusi-solusi ini diharapkan dapat memperbaiki proses eksekusi putusan PTUN, menjadikannya lebih berkeadilan, serta berkontribusi positif pada penegakan hukum dan penghormatan terhadap hak asasi manusia di Indonesia.

Abstract

Applying restorative justice in Indonesia is beset by obstacles like a lack of knowledge, inadequate infrastructure, and opposition from law enforcement, especially when human rights considerations are incorporated into the process. For this reason, the relationship between these two elements is worth examining. This paper explores and analyses the integration or synthesis of restorative justice with human rights in Indonesia. This paper employs a normative approach with prescriptive analysis based on studies of legislation and cases that integrate the principles of restorative justice with human rights. The findings indicate that collocation helps understand how grammatical structures can reflect and influence the interpretation of restorative justice in human rights, particularly in legal texts and policy reports. In Indonesia, restorative justice can be used in conjunction with the enforcement of human rights laws, particularly when addressing grave human rights breaches, since it emphasizes balanced reconciliation, recovery, and reintegration between offenders, victims, and society. In conclusion, although it has several implementation and legal issues, restorative justice can be an alternate strategy for resolving grave human rights breaches. The recommendations are for a stronger and more comprehensive legal framework to support the implementation of restorative justice in Indonesia's human rights context.
