Abstract

Secara hakikat, demokrasi dapat dimaknai sebagai suatu sistem pemerintahan di mana keputusan politik dibuat oleh rakyat atau warga negara secara langsung atau melalui perwakilan yang mereka pilih dalam pemilihan umum. Pasal 1 ayat (2) UUD NRI Tahun 1945 menyatakan bahwa: kedaulatan berada di tangan rakyat dan dilaksanakan menurut Undang-Undang Dasar, berimplikasi penegasan kedaulatan rakyat. Serta Pasal 28E Ayat (3) UUD NRI 1945 memberikan hak konstitusional atas kebebasan berserikat, berkumpul, dan berpendapat, yang memperkuat pelaksanaan demokrasi Pancasila yang berlandaskan nilai Pancasila dan UUD 1945 sebagai wujud negara hukum demokratis. Pemilihan kepala daerah merupakan salah satu instrument utama dalam mewujudkan kedaulatan rakyat di tingkat lokal. Sejak tahun 2005 Indonesia menerapkan sistem pemilihan kepala daerah secara langsung oleh rakyat sebagai implementasi demokrasi langsung pasca-reformasi. Pada akhir tahun 2025 menguat wacana atas gagasan mengembalikan pilkada melalui DPRD dari semula yang ditetapkan melalui pemilihan umum. Berdasarkan latar belakang tersebut penulis hendak membahas terkait: Pemilihan kepala daerah melalui DPRD ditinjau dari prinsip-prinsip demokrasi di Indonesia, dan implikasi pemilihan kepala daerah melalui DPRD terhadap kualitas demokrasi dan legitimasi kepemimpinan daerah di Indonesia. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan, konseptual, dan historis untuk mengkaji dasar hukum, relevansi, serta implikasi sistem pemilihan kepala daerah oleh DPRD. Dalam kajian ditemukan bahwa prinsip demokrasi tidak semata-mata dimaknai sebagai partisipasi langsung rakyat dalam menentukan pemimpin daerah, melainkan juga dapat diwujudkan melalui mekanisme demokrasi perwakilan, di mana DPRD sebagai lembaga hasil pemilihan umum memiliki legitimasi untuk mewakili kehendak rakyat. Namun mekanisme pemilihan kepala daerah melalui DPRD memiliki tantangan serius terhadap pemenuhan prinsip kedaulatan rakyat, partisipasi politik, dan akuntabilitas.

Abstract

Penggunaan teknologi Artificial Intelligence/AI pada penyelenggaraan Pemilu 2024 menjadi salah satu isu hangat dalam kajian Hukum Pemilu. Peserta Pemilu banyak memanfaatkan teknologi AI demi meningkatkan elektabilitas. Namun terkadang, penggunaan AI disalahgunakan sehingga menimbulkan disinformasi. Di sisi lain, aturan penggunaan AI juga tidak jelas dalam Aturan pada Pemilu 2024. Artikel ini akan membahas urgensi pengaturan penggunaan AI untuk kampanye pada Pemilu dalam Undang-Undang Pemilu di Indonesia. Artikel ini merupakan penelitian hukum bertipe reform-oriented research yang merekomendasikan perubahan aturan kepemiluan. Pendekatan yang dipergunakan ialah pendekatan peraturan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa terdapat kekosongan hukum  terkait penggunaan AI pada penyelenggaraan pemilu berdasarkan Undang-Undang Nomor 7 Tahun 2017. KPU dan Bawaslu dihadapkan pada permasalahan kekosongan hukum dalam penanganan isu AI pada Pemilu 2024 sehingga tidak dapat melakukan tindakan atas penyalahgunaan AI. Oleh karena itu, artikel ini merekomendasikan kepada pembentuk undang-undang untuk membuat UU AI tersendiri di Indonesia dan UU Pemilu kedepan harus mengakomodir perkembangan teknologi, khususnya penggunaan AI. UU AI dan revisi UU Pemilu tersebut akan dapat menjadi acuan KPU dan Bawaslu dalam membuat aturan teknis penggunaan AI dalam Pemilu termasuk kode etik penggunaan AI dalam Pemilu.

Abstract

The proposal to pardon corruption offenders within a restorative justice framework, as articulated by President Prabowo Subianto, has sparked diverse responses. However, the President later clarified that his statement was not an endorsement of pardoning corrupt individuals but rather an emphasis on the importance of asset recovery in combating corruption. Given that imprisonment has proven ineffective as a deterrent and insufficient in addressing state losses, asset recovery presents a viable legal strategy in corruption law enforcement. This research examines two key issues: the extent to which asset recovery serves as a deterrent in criminal law and its impact on the fulfillment of human rights. Employing a normative juridical approach through statutory and conceptual analysis, the findings suggest that asset recovery not only deters corruption and restores state finances but also advances justice and human rights. Accordingly, this research recommends that the Indonesian House of Representatives and the government expedite the enactment of the Asset Forfeiture Bill (RUU) to strengthen asset recovery mechanisms in corruption cases.

Abstract

Indonesia is struggling with too many overlapping laws which is reflected in the number of judicial review cases the Constitutional and Supreme Court received. There is a need to develop a more systematic way to analyze legal reasoning. This study suggests a tech-driven framework for digital laws, which could help with national legal reforms in line with SDG 16. This study compares Tesseract OCR, PyMuPDF and  the Gemini API to extract text from PDFs. Gemini API accuracy tops other methods, thus it is used for the rest of study. Then the text is cleaned and turned into structured JSON which gets plugged into ChromaDB for analyzing semantic similarities and ArangoDB for mapping out legal relationships. The result is a machine-readable version of Indonesian laws. The whole approach shows a scalable method for taking complex legal documents and turning them into a structured knowledge base. The experimental results demonstrate that the Gemini API significantly outperforms conventional methods, achieving 97% text accuracy, 95% structural accuracy, and only 3% Word Error Rate, compared to 78% and 90% for Tesseract and PyMuPDF, respectively.

Abstract

Abstract: Islam is the most followed religion in Indonesia, making Indonesia contains the largest Muslim population of all countries in the world. However, Indonesia is not a religion state. This has become an issue in several Muslim groups in Indonesia, whether it is permissible to have a state under the Republic of Indonesia based on their beliefs. Purpose: This paper will explain the relationship between Islam and The State of Indonesia and the study of Islamic government law related to the Indonesian government. Design/Methodology/Approach: This research is qualitative. The approach used is statute, conceptual, and hermeneutics, while the assessment method used is comparative. Findings: The system of government of Indonesia has a close relationship to the principles and substance of Islamic law. Although the State of Indonesia is not an Islamic state, Indonesia is also not a secular state, which separates religion and state. From the Islamic government law’s perspective, it’s called tamyiz or proportional. Indonesia takes Islam in the principles of state proportionally. Therefore, The State of Indonesia is not contrary to the principles of Islam. Originality/value: Numerous studies have been undertaken to examine the correlation between religion and the government in Indonesia.   This article builds upon the earlier research conducted by other scholars.   This article affirms that the Indonesian State is not in conflict with Islam.

Abstract

A promissory note constitutes an unconditional written promise by the issuer (maker) to pay a specified sum to the holder (payee) at an agreed time. Although its use in Indonesian corporate financing and cross-border transactions has grown, its legal standing in default (wanprestasi) disputes remains governed by overlapping and partly untested provisions of the Commercial Code (KUHD) and Civil Code (KUH Perdata). This study employs normative legal research using statutory, conceptual, case-based, and comparative approaches, examining eight Supreme Court and first-instance decisions issued between 2001 and 2022 and comparing them against Article 3 of the United States Uniform Commercial Code, the United Kingdom's Bills of Exchange Act 1882, and the Geneva Convention 1930. The analysis shows that a promissory note occupies a dual legal position as a negotiable instrument under KUHD Articles 174–177 and as a contractual instrument under the KUH Perdata and identifies three recurring jurisprudential inconsistencies: inconsistent application of the abstraction principle, variable tolerance for formal defects, and unsettled criteria for what constitutes sufficient notice of default. These findings indicate that judicial guidance, rather than case-by-case adjudication alone, is needed to stabilize this area of commercial law. The study recommends that the Supreme Court issue a circular letter (SEMA) or regulation (PERMA) through its Civil Chamber plenary meeting to unify these standards, alongside legislative reform of the KUHD's negotiable-instrument provisions.
