Abstract

ABSTRAKPrinsip adanya peradilan TUN, untuk menempatkan kontrol yudisial dalam penyelenggaraan pemerintahan yang baik menjadi bias dalam sistem ketatanegaraan Indonesia. Bila suatu putusan PTUN tidak memiliki kekuatan eksekutorial, bagaimana mungkin hukum dan masyarakat dapat mengawasi jalannya pemerintah yang dilaksanakan oleh pejabat-pejabat TUN. Masalah ketidakpatuhan Badan atau Pejabat Tata Usaha Negara dalam melaksanakan putusan Pengadilan Tata Usaha Negara dikemukakan pula oleh Supandi dalam penelitian disertasinya, masih sering terjadi putusan Pengadilan Tata Usaha Negara yang tidak dilaksanakan/dipatuhi oleh Pejabat Tata Usaha Negara yang bersangkutan, sehingga dapat menimbulkan ketidakpastian hukum dalam pelaksanaan pemerintahan dan pembangunan. beberapa faktor yang menyebabkan lemahnya eksekusi putusan Pengadilan Tata Usaha Negara yang telah berkekuatan hukum tetap, yaitu: Pertama, ketiadaan aturan hukum yang memaksa bagi Pejabat TUN untuk melaksanakan putusan Pengadilan yang telah berkekuatan hukum tetap. Kedua, faktor amar putusan hakim yang tidak berani mencantumkan pembayaran uang paksa apabila pejabat TUN yang bersangkuan tidak melaksanakan putusan Pengadilan dikarenakan belum adanya peraturan pelaksana yang jelas, dan Ketiga, adalah faktor kepatuhan Pejabat TUN dalam menjalankan putusan Pengadilan yang telah berkekuatan hukum tetap. Kata Kunci : Keputusan Tata Usaha Negara, Pejabat Negara, Pemerintahan, administrasi, Peradilan Tata Usaha Negara ABSTRAKThe principle of a state administrative court, to place judicial control in good governance is biased in the Indonesian constitutional system. If a state administration court decision does not have an executive power, how can the law and the public be able to oversee the administration of the government carried out by state administration officials. The problem of non-compliance of the State Administration Agency or Official in implementing the decision of the State Administrative Court was also raised by Supandi in his dissertation research, there were still frequent decisions of the State Administrative Court that were not implemented / obeyed by the relevant State Administration Officer, so that it could lead to legal uncertainty in governance and development. Several factors cause the weak execution of the decisions of the State Administrative Court that have permanent legal force,namely: First, the absence of legal rules that force the State Administrative Officer to implement the court decisions that have permanent legal force. Second, the factor of the judge's decision that does not dare to include forced payment if the state administrative officer in question does not implement the Court's decision, and Third, is the compliance factor of the state administration official in carrying out the court's decision which has permanent legal force. Keywords : Decree of State Administration, State Officials, Government, Administration, State Administrative Court

Abstract

ABSTRAKSatu di antara permasalahan ketatanegaraan yang perlu dikaji secara akademis untuk mendapatkan jawaban akademis adalah permasalahan pengisian jabatan Presiden dan Wakil Presiden di Indonesia. Secara teoritis, pengisian jabatan dapat ditafsirkan dalam2 (dua) perspektif. Pertama dalam artian sempit pengisian jabatan hanya dipahami sebagai suatu proses pengisian jabatan apabilaterjadi kekosongan jabatan Presiden dan Wakil Presiden saja. Kedua, dalam artian luas pengisian jabatan dapat dipahami sebagai suatuproses atau mekanisme yang di dalamnya memuat ketentuan tentang syarat calon, mekanisme pengisian jabatan, masa jabatandan dalam hal terjadi kekosongan jabatan. Penelitian ini mengkaji pengisian jabatan Presiden dan Wakil Presiden di Indonesia dalamartian luas khususnya berkenaan dengan kekosongan jabatanPresiden dan Wakil Presiden. Di Indonesia pengaturan tentang pengisian jabatan Presiden dan Wakil Presiden ini tercantum dalamKetentuan Pasal 6, 6A, 7, dan Pasal 8 Undang-Undang Dasar Tahun1945 serta Undang-Undang RI No. 42 Tahun 2008 tentang Pemilihan Umum Presiden dan Wakil Presiden Republik Indonesia kemudian diganti dan dikompilasikan dalam Undang-Undang No 7Tahun 2017 tentang Pemilihan Umum. Penelitian ini diklasifikasikan sebagai penelitian dengan tipe decriptive explanatory, yakni denganmengumpulkan dan menyimpulkan informasi tentang permasalahan yang diteliti. Sementara studi explanatory digunakan untuk menjelaskan dan menghitung informasi deskriptif. Pendekatan dalam penelitian ini adalah kualitatif. Selain itu untuk memperdalam analisis metode comparative analysis digunakan untuk mendapatkan fokus studi yang khusus dalam masyarakat yang berbeda. Kata kunci : Presiden dan Wakil Presiden, Pengisian jabatan, kekosongan jabatan ABSTRACTOne of the problems in the state administration that needs to be studied academically to get an academic answer is the problem of filling the positions of President and Vice President in Indonesia. Theoretically, filling a position can be interpreted in2 (two) perspectives. First, in the narrow sense of filling a position, it is only understood as a process of filling a position ifthere are vacancies in the positions of President and Vice President only. Second, in the broad sense of filling the position can be understood as athe process or mechanism in which it contains provisions on the requirements of the candidate, the mechanism for filling the position, term of officeand in the event of a vacancy. This study examines filling the positions of President and Vice President in Indonesiabroad terms especially with regard to vacancy positionsPresident and vice president. In Indonesia, arrangements for filling the positions of President and Vice President are listed inProvisions of Articles 6, 6A, 7 and Article 8 of the Basic Law of the Year1945 and RI Law No. 42 of 2008 concerning the Election of the President and Vice President of the Republic of Indonesia was later replaced and compiled in Law No. 72017 concerning General Elections. This research was classified as a descriptive explanatory type of research, namely withcollect and conclude information about the problem under study. While explanatory studies are used to explain and calculate descriptive information. The approach in this research is qualitative. Abstract

ABSTRAKEra baru telah dimulai dalam Pemilihan Umum dan Pilkada Serentak, karena undang-undang memerintahkan kepada seluruh bangsa Indonesia, untuk menyelenggarakannya. Dalam praktik, terdapat tantangan dalam tindak pidana Pilkada. Faktor perundang-undangan yang kontradiktif antara UU Pemilihan (Les Specialist) dengan aturan limitasi waktu dan KUHP (Lex Generalis) yang dibatasi KUHAP, serta faktor kualitas manusia yang menjalankan hukum, jauh dari kualitas ideal. Kondisi demikian mengakibatkan Sistem Peradilan Pidana Pilkada gagal menjalankan fungsinya, tidak dapat dilakukan melalui penal-code, namun keadilan dan kepastian hukum terwujud melalui sarana non-penal. Menyikapi kondisi demikian, mesti dilakukan pembenahan, dengan peningkatan kualitas keilmuan penyelenggara Pilkada dan pendekatan integral antara sarana penal dan non penal sejalan dengan perkembangan stelsel pidana hukum administrasi.Kata kunci: Pemilihan Serentak, Kode Penal, Non PenalABSTRACTA new era has begun in the General Election and Simultaneous Local Election, because the law ordered all Indonesian people to hold it. In practice, there are challenges in criminal acts in the elections. Contradictory legislative factors between the Election Law (Les Specialist) with the time limitation rules and the Criminal Code (Lex Generalis) which are limited by the Criminal Procedure Code, as well as the human quality factors that run the law, are far from ideal quality. Such conditions result in the Pilkada Criminal Justice System failing to carry out its functions, it cannot be done through a penal code, but justice and legal certainty are realized through non-penal means. Responding to these conditions, improvements must be made, by improving the quality of the knowledge of the election organizers and an integrated approach between the means of punishment and non-punishment in line with the development of administrative criminal law systems.Keywords: Simultaneous Election, Penal Code, Non Penal

Abstract

AbstrakPandemi Covid-19 telah melanda lebih dari 200 negara sehingga mengancam perekonomian global dan nasional tak terkecuali Indonesia. Sebagai negara hukum formil (rechtstaat), Indonesia memerlukan peraturan perundang-undangan sebagai dasar bertindak untuk mengatasinya. Pada bulan Maret 2020, presiden mengeluarkan Perppu No. 1 Tahun 2020 tentang Kebijakan Keuangan Negara dan Stabilitas Sistem Keuangan Untuk Penanganan Pandemi COVID-19 yang kemudian disahkan oleh DPR menjadi undang-undang, banyak pihak mengkritik Perppu tersebut karena dianggap memberikan absolutisme penguasa, namun sesungguhnya Perppu tersebut memberikan kepastian hukum guna mencapai tujuan dan kemanfaatan yang lebih luas yakni pemulihan dari krisis ekonomi akibat Covid-19. Permasalahan yang dibahas dalam tulisan ini adalah, bagaimana penggunaan serta pengawasan diskresi yang dikeluarkan untuk penanganan pandemi Covid-19 dan bagaimana perlindungan terhadap diskresi yang dilaksanakan Pemerintah berdasarkan Perppu No. 1 Tahun 2020 dalam rangka penanganan Covid-19. Metode pendekatan yang digunakan dalam tulisan ini adalah pendekatan konseptual, berdasarkan pada asas kepastian dan kemanfaatan hukum, serta menjelaskan penggunaan diskresi berdasarkan Undang-Undang No. 30 Tahun 2014.Kata Kunci: Peraturan Perundang-undangan, Kepastian Hukum, Covid-19AbstractCovid-19 pandemic has affect more than 200 countries so that it is threatening global and national economic, including Indonesia. As a formal legal state (rechtstaat), Indonesia need laws and regulation as a basis for handle it. In March 2020, the president issued Perppu No. 1 of 2020 concerning State Financial Policy and Financial System Stability for Handling the COVID-19 Pandemic which was then passed by the House of Representative into law, many parties criticized the Law providing leadership absolutism, but in fact this Law provides legal certainty to recovery from the economic crisis caused by Covid-19. The problem discussed in this paper is about how to protect the implementation of the release of discretion issued for handling the Covid-19 pandemic and protection against discretion by the Government based on Perppu No. 1 of 2020 in the context of handling Covid-19 and. The method used in this paper is about conceptual, based on the legal certainty and utilities, and explains the use of discretion based on Law No. 30 of 2014 concerning Government Administration.Keywords: Laws and Regulations, Legal Certainty, COVID-19

Abstract

AbstrakSalah satu poros kekuasaan dalam konsep trias politica adalah kekuasaan eksekutif yang pada dasarnya merupakan cabang kekuasaan yang memegang kewenangan administrasi pemerintahan negara tertinggi. Salah satu kewenangan Presiden dalam menjalankan kekuasaan eksekutif adalah pemberian atau penolakan grasi yang diartikulasikan dalam bentuk Keputusan Presiden. Tulisan ini bertujuan untuk mendiskursuskan Keputusan Presiden tentang pemberian grasi dalam sistem pemerintahan presidensiil di Indonesia dalam kaitannya dengan kedudukan Presiden sebagai Kepala Negara dan Kepala Pemerintahan serta kemungkinan Keputusan Presiden a quo dijadikan Objek Sengketa Tata Usaha Negara. Hasil dari diskursus tulisan ini memperlihatkan bahwa dalam sistem pemerintahan presidensiil seperti yang dianut oleh Negara Republik Indonesia dimana tidak terdapat perbedaan atau dikotomi antara kedudukan Presiden sebagai Kepala Negara dan Kepala Pemerintahan, maka tidak dimungkinkan pula adanya pembedaan jenis Keputusan Presiden selaku Kepala Negara dan Keputusan Presiden selaku Kepala Pemerintahan, yang ada hanyalah Keputusan Presiden saja. Selain itu, mengingat semua unsur-unsur Keputusan Tata Usaha Negara dalam Pasal 1 Angka 3 Undang-Undang tentang Peradilan Tata Usaha Negara telah terpenuhi, serta tidak terdapatnya pengecualian terhadap Keputusan Presiden tentang pemberian atau penolakan grasi dalam Pasal 2 Undang-Undang a quo, maka sejatinya Keputusan Presiden tentang pemberian atau penolakan grasi dalam sistem pemerintahan presidensiil di Indonesia merupakan Keputusan Tata Usaha Negara sehingga seharusnya dapat menjadi Objek Sengketa Tata Usaha Negara, mengingat mekanisme pengujian suatu Keputusan Tata Usaha Negara adalah melalui Pengadilan Tata Usaha Negara.Kata Kunci: Grasi, Keputusan Presiden, Kepala Negara, Kepala Pemerintahan, Sistem Pemerintahan Presidensiil, Keputusan Tata Usaha Negara. AbstractOne of power in the concept of trias politica is executive power which is basically a branch of power that holds the highest administrative authority of the country. One of the President's authorities in exercising executive power is the granting or rejection of clemency articulated in the form of a Presidential Decree. This writing aims to examine the Presidential Decree regarding granting clemency in a presidential governmental system in Indonesia in relation to the position of the President as Head of State and Head of Government and the possibility of the Presidential Decree being the object of State Administrative Dispute. The results of this writing show that in a presidential governmental system as adopted by the State of the Republic of Indonesia where there is no difference or dichotomy between the position of the President as the Head of State and the Head of Government, it is also not possible to distinguish the types of Presidential Decrees as Head of State and Presidential Decrees as Head of Government, there is only a Presidential Decree. In addition, considering that all elements of the State Administrative Decree in Article 1 Number 3 of the Law on State Administrative Courts have been fulfilled, and there are no exceptions to the Presidential Decree on granting or rejecting clemency in Article 2 of the Act a quo, then the Presidential Decree on granting or rejecting clemency in the presidential governmental system in Indonesia is a State Administrative Decree so that it should be the object of State Administrative Dispute considering the mechanism of examining a State Administrative Decree is through the State Administrative Courts.Keywords:   Clemency, Presidential Decree, Head of State, Head of Government, Presidential Governmental System, State Administrative Decree.

Abstract

ABSTRAKDiskualifikasi calon kepala daerah terjadi pada pilkada serentak 2018 yaitu di Gorontalo, dimana Mahkamah Agung memerintahkan untuk mendiskualifikasi pasangan calon kepala daerah petahana Rum Pagau-Lahmuddin Hambali sebagai calon Bupati Boalemo Gorontalo karena memecat direksi rumah sakit dalam waktu 6 bulan sebelum pilkada serentak sehingga melanggar Pasal 71 ayat (2) UU Nomor 10 Tahun 2016 dan beberapa daerah juga terjadi diskualifikasi calon dengan pelanggaran yang sama yang dilakukan oleh calon kepala daerah petahana beberapa diantarana Pilkada Bupati Jayapura, Pilwakot Makassar, Pare-Pare dan Sinjai. Simpang siur dalam upaya hukum yang dilakukan calon mengakibatkan kesempatan untuk melakukan pembelaan diri terhadap pelanggaran yang dilakukan menjadi hilang antara lain melakukan upaya hukum kepada Pengadilan Tata Usaha Negara, yang seharusnya terdapat upaya administrasi terlebih dahulu di Bawaslu sehingga berlanjut ke Pengadilan Tinggi Tata Usaha Negara sebelum dilakukan upaya hukum terakhir di Mahkamah Agung.Kata kunci: pelanggaran, diskualifikasi, upaya hukum. ABSTRACTDisqualification of regional head candidates occurs in 2018 simultaneous local elections in Gorontalo, where the Supreme Court ordered the disqualification of incumbent regional head candidates Rum Pagau-Lahmuddin Hambali as Gorontalo Boalemo Regent candidate for firing hospital directors within 6 months prior to simultaneous local elections which violated Article 71 Paragraph (2) of Law Number 10 Year 2016 and several regions also occur disqualification of candidates with the same violations committed by incumbent regional head candidates in the regions of the Jayapura Regent Election, Pilwakot Makassar, Pare-Pare and Sinjai. The confusion in the legal efforts of the candidates resulted in the opportunity to defend themselves against the violations committed being lost, among others, conducting legal remedies to the State Administrative Court, which should have an administrative effort first in the Election Supervisory Body so that it continues to the State Administrative High Court before being carried out final legal remedy in the Supreme Court.Keywords: violation, disqualification, legal remedies.

Abstract

AbstrakHukum Acara Peradilan Administrasi (murni), sehingga suatu gugatan tidak menghalangi dilaksanakannya KTUN yang digugat tesebut. Namun undang-undang memberikan peluang kepada penggugat untuk mengajukan permohonan kepada hakim, agar selama proses pemeriksaan berlangsung dapat dilakukan penundaan terhadap KTUN yang disengketakan. Penundaan tersebut merupakan kompensasi dalam beracara di Pengadilan Tata Usaha Negara. Jadi apabila ketentuan tersebut dilaksanakan maka, jelas bahwa gugatan Penggugat (misalnya terhadap surat perintah bongkar rumah) tetap dilaksanakan maka untuk menggugat tidaklah ada artinya lagi sebab rumahnya telah dibongkar, sebelum gugatan diproses dan diputus, berdasarkan pada ketentuan Pasal 67 ayat (2) UU No. 5 Th. 1986, Penggugat dapat mengajukan permohonan agar pelaksanaan Keputusan Tata Usaha Negara ditunda selama pemeriksaan sengketa Tata Usaha Negara sedang berjalan, sampai ada putusan Pengadilan yang memperoleh kekuatan hukum tetap. Tuntutan ganti rugi atau tuntutan tambahan (accessoir) setelah dikabulkannya tuntutan pokok yang diajukan oleh penggugat pada peradilan administrasi, ganti rugi adalah pembayaran sejumlah uang kepada orang atau badan hukum perdata atas beban badan administrasi negara berdasarkan putusan pengadilan administrasi karena adanya kerugian material yang diderita penggugat berdasarkan Peraturan Pemerintah No. 43 Tahun 1991.KATA KUNCI : PENUNDAAN, GANTI RUGI,PERADILAN ADMINISTRASIAbstractAdministrative Judicial Procedures (pure), so that a lawsuit does not preclude the implementation of the State Administrative Decree sued. However, the law provides an opportunity for the plaintiff to submit a request to the judge, so that during the examination process can take place a delay on the disputed KTUN. The postponement is compensation in court proceedings at the State Administrative Court. So if the provisions are implemented then, it is clear that the Plaintiff's claim (for example against a house demolition order) continues to be carried out so to sue has no meaning anymore because the house has been demolished, before the lawsuit is processed and decided, based on the provisions of Article 67 paragraph (2) of Law Number 5 of 1986, the Plaintiff may submit a request that the implementation of the State Administration Decree be postponed during the examination of the State Administration dispute in progress, until there is a court decision that obtains permanent legal force. Compensation claim or additional claim (accessoir) after the principal claim filed by the plaintiff in administrative court, compensation is the payment of a sum of money to a person or a legal entity for the burden of the state administrative body based on the administrative court's decision due to a material loss suffered by the plaintiff based on Government Regulation No. 43 of 1991. KEY WORD : DELAY, INDEMNITY, ADMINISTRATIVE JUSTICE

Abstract

Efforts to encourage the implementation of proper governments are continually done in each country, including one of them in the Republic of Indonesia. A decent government can be realized if it is followed by government decisions that are responsive to the needs and interests of the community. The decision of the state administration officials in the effort to realize a proper government must be based on the general principles of good governance, especially those that have been mentioned in Act. No. 30 of 2014 concerning Government Administration. In term of realizing a proper government, it not only becomes the duty of the state administration officials through the decisions formed, but also the involvement of the community as the plaintiff for any government decision that feels disadvantaged and the state administrative court as an institution that examines and decides disputes between the community and the government by continuing to refer the laws and general principles of a good government is part of realizing a good governance.

Abstract

Human rights are essential things to uphold because their existence guarantees the equality of all humanity. In Indonesia, the issue of human rights is still often a problem, and one source of the problem is the imbalance between human rights and unbalanced with human rights obligation. This research was conducted with a systematic literature review approach to propose a human rights law paradigm based on human rights obligations. From the perspective of legal analysis, the nature of this research is categorized into prescriptive research. The materials in this study were sourced from laws, books, and scientific articles from national and international journals that deal with the concept of human rights and human rights law. The results of this study indicate that the enforcement of human rights must look at fulfilling human rights obligations because, in general, a person can claim rights if they have met the requirements. By basing their rights on obligations, human rights law will improve. This article is expected to be able to be one of the references in the application of human rights law in Indonesia to build justice between human rights and obligations.

Abstract

The Indonesian State Administrative Court has applied the oplossing theory, where claims related to disputes over the procurement of government goods or services are considered to be merged in the civil realm so that they are assumed to be not authorized to handle the dispute. This research is normative juridical research by comparing the practice of handling cases of government procurement of goods and services in the Indonesian State Administrative Court, the Constitutional Court, and the French Administrative Court. Research shows that there are inconsistencies in the Indonesian state administrative court regarding the interpretation of the oplossing theory after the enactment of Law Number 30 of 2014 concerning Government Administration, while in France, the plaintiff can file a lawsuit in the form of annulment of administrative decisions related to the procurement of government goods and services or a compensation claim. The implication of eliminating the oplossing theory is that a third party can file a claim for compensation against a dispute over the procurement of government goods and services in the state administrative court in accordance with the Constitutional Court Decision Number 22/PUU-XVI/2018 regarding the grace period for filing a lawsuit by a third party.
