Abstract

Judicial review might be submitted by the parties as a form of objection to the judge's decision which has permanent legal force. In practice, it is possible for an object of dispute to be filed in two chambers of courts that cause two sentences with permanent legal force contradict each other as in between case Number 162 PK/TUN/2015 and 1053/PDT/2019. The two cases decide which party has the right to manage a mining business permit area, but when the two decisions are about to be executed, the two Mining Business Permit Areas between PT Pasir Prima Coal Indonesia (PT PPCI) and PT Mandiri Sejahtera Energindo Indonesia (PT MSEI) will still overlap. This paper uses a normative empirical research method with a judicial case study approach, which its normative research based on the provisions of the applicable laws and regulations is carried out in parallel by dissecting several related court decisions. The legal materials used in this study are in the form of books containing the opinions of legal practitioners and academics, legislations, and of course the court's decisions. In their considerations, the Panel of Judges in the general court room focuses on seeking material truth, and the Panel of Judges in the state administrative court looks at the administrative process in the issuance of a state administrative decision. The Chief Justice of the Supreme Court through his letter explained that the case could go through a second review where the composition of the panel of judges consisted of the chairman of the Supreme Court, the Supreme Court justices from civil chamber, and the Supreme Court justices from the state administrative law chamber, as stated in the Supreme Court Circular Number 5 of 2014 and Circular Letter of the Supreme Court Number 4 of 2016.

Abstract

Human rights are essential things to uphold because their existence guarantees the equality of all humanity. In Indonesia, the issue of human rights is still often a problem, and one source of the problem is the imbalance between human rights and unbalanced with human rights obligation. This research was conducted with a systematic literature review approach to propose a human rights law paradigm based on human rights obligations. From the perspective of legal analysis, the nature of this research is categorized into prescriptive research. The materials in this study were sourced from laws, books, and scientific articles from national and international journals that deal with the concept of human rights and human rights law. The results of this study indicate that the enforcement of human rights must look at fulfilling human rights obligations because, in general, a person can claim rights if they have met the requirements. By basing their rights on obligations, human rights law will improve. This article is expected to be able to be one of the references in the application of human rights law in Indonesia to build justice between human rights and obligations.

Abstract

Testing public officials decision in Indonesia, which has been the authority of the State Administrative Court (PTUN) should be done through a constitutional complaint mechanism, written under the authority of the Constitutional Court of the Republic of Indonesia (MKRI). This is due to all public officials have the potential to perform acts that violate or harm the constitutional rights of citizens as guaranteed in the 1945 Constitution (UUD 1945). This additional authority to examine and decide cases of constitutional complaints should be possible in the framework of carrying out the functions of the Constitutional Court as the guardian of the constitution as implemented in countries that apply the principle of constitutional supremacy, one of which is as applied in the Constitutional Court of The South Korea. Even though South Korea has an administrative court which also has the authority to examine the decision of public officials, South Korea still open space for its citizens to file constitutional complaint in Constitutional Court of South Korea when there is a public official decision that harm and violating the constitutional rights of the citizens that have been guaranteed in constitution. Thus, when all legal remedy for violations of constitutional rights as a result of the issuance of public official decision has been exhausted, but violations still occur, then this constitutional complaint mechanism into the need to provides maximum protection and respect the constitutional rights of citizens. Therefore, the additional authority to examine and decide constitutional complaint can not be separated from the authority of the Constitutional Court.

Abstract

The Indonesian State Administrative Court has applied the oplossing theory, where claims related to disputes over the procurement of government goods or services are considered to be merged in the civil realm so that they are assumed to be not authorized to handle the dispute. This research is normative juridical research by comparing the practice of handling cases of government procurement of goods and services in the Indonesian State Administrative Court, the Constitutional Court, and the French Administrative Court. Research shows that there are inconsistencies in the Indonesian state administrative court regarding the interpretation of the oplossing theory after the enactment of Law Number 30 of 2014 concerning Government Administration, while in France, the plaintiff can file a lawsuit in the form of annulment of administrative decisions related to the procurement of government goods and services or a compensation claim. The implication of eliminating the oplossing theory is that a third party can file a claim for compensation against a dispute over the procurement of government goods and services in the state administrative court in accordance with the Constitutional Court Decision Number 22/PUU-XVI/2018 regarding the grace period for filing a lawsuit by a third party.

Abstract

Pejabat tata usaha negara memiiki kewajiban utntuk melakukan eksekusi putusan Peradilan Tata Usaha Negara (PTUN) yang sudah berkekekuatan hukum tetap, salah satunya putusan PTUN mengenai sengketa proses pemilu. Namun, fakta yang terjadi dilapangan putusan PTUN tidak selalu dapat dieksekusi dengan baik walaupun sudah terdapat mekanisme upaya paksa eksekusi dan sanksi jika tidak melakukannya. Berbagai faktor dapat mengambat eksekusi putusan PTUN, salah satunya diakibatkan putusan itu sendiri yang tidak dapat diekskusi karena bersinggungan dengan putusan lembaga peradilan lainnya. Kondisi ini membuat ketidakpastian hukum, baik bagi pejabat tata usaha yang wajib melakukan eksekusi serta bagi penggugat yang memiliki hak untuk dipenuhi dengan dieksekusinya putusan PTUN. Pada studi kasus Putusan  Nomor 242/G/SPPU/2018/PTUN.JKT, Komisi Pemilihan Umum (KPU) selaku pejabat tata usaha terkait tidak dapat melaksanakan putusan PTUN tersebut demi mematuhi Putusan MK yang secara final dan sejajar dengan undang-undang telah memberikan landasan hukum bagi KPU dalam melakukan tindakan penyelenggaraan pemilu untuk menetapkan daftar calon tetap anggota DPD 2019. Metode pendekatan masalah yang digunakan dalam metode penelitian ini adalah penelitian hukum normatif yang berbasis pada studi kepustakaan, dengan analisa berbagai sumber dan bahan hukum terkait eksekusi putusan peradilan tata usaha negara. State administrative officials have obligation to carry out the execution of State Administrative Court (PTUN) decision that already have permanent legal force, one of which is the PTUN decision regarding the election process dispute. However, in facts, the PTUN decision is not always executed properly even though there is already a mechanism to forced execution and sanctions whether not doing so. Various factors can hamper the execution of PTUN decision, one of which as result of the decision itself cannot be executed since it collides with the decisions of other judicial institutions. This condition creates legal uncertainty, both for administrative officials who are obliged to carry out executions and for plaintiffs who have the right to be fulfilled by the execution of the PTUN decision. In the case study of Decision Number 242 / G / SPPU / 2018 / PTUN.JKT, the General Election Commission (KPU) as the related administrative officer could not carry out the PTUN decision in order to comply with the Constitutional Court Decision which is final and parallel to the law that has provided reasons law for the KPU in carrying out election administration actions to determine the final list of candidates for DPD members 2019. The problem approach method used in this research method is normative legal research based on literature study, with analysis of various sources and legal materials related to the execution of state administrative judicial decisions.

Abstract

Abstrak Direksi Badan Usaha Milik Negara (BUMN) berdasarkan pengaturan Pasal 87 Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Negara dengan memperhatikan konstruksi Undang-Undang lain terkait seperti Undang-Undang Nomor 28 Tahun 1999 tentang Penyelenggara Negara yang Bersih dan Bebas dari Korupsi, Kolusi dan Nepotisme dan Undang-Undang No. 5 Tahun 1986 tentang Peradilan Tata Usaha Negara, memiliki kedudukan sebagai Pejabat Pemerintahan dengan berbagai konsekuensi turunan selayaknya jabatan pemerintahan lain yang harus patuh pada berbagai ketentuan yang lebih kaku. Sementara dalam ketentuan Pasal 91 UU BUMN, Direksi BUMN dituntut memiliki kemandirian dalam menjalankan tugasnya dan lebih otonom dalam melakukan pengelolaan BUMN yang dituntut fleksibel sesuai dengan ciri badan hukum privat. Melalui penelitian yuridis normatif bertipologi evaluatif dan metode analisis kualitatif, penelitian ini membahas bagaimana konsepsi hukum yang seharusnya atas status kedudukan Direksi Badan Usaha Milik Negara. Studi ini menemukan bahwa konstruksi pengaturan status hukum Direksi BUMN menempatkan Direksi BUMN pada dua posisi sekaligus antara statusnya sebagai Penyelenggara Negara disisi lain sebagi Pimpinan dari Badan Hukum Privat. Meskipun sebagai badan hukum privat, status sebagai penyelenggara negara tidak dapat dilepaskan mengingat kedudukan BUMN merupakan kepanjangan tangan pemerintah dalam pelaksanaan tugas pelayanan umum selain permodalannya yang sebagian/keseluruhannya berasal dari negara. Kata Kunci: Status Hukum, Direksi BUMN, Penyelenggara Negara

Abstract

Sengketa Informasi Publik merupakan sengketa yang terjadi antara Badan Publik dan Pengguna Informasi Publik berkaitan dengan hak memperoleh dan menggunakan informasi menurut ketentuan yang diatur dalam Undang-Undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik, para pihak yang tidak puas terhadap Putusan Komisi Informasi dapat melakukan gugatan kepada Pengadilan Tata Usaha Negara (PTUN). Artikel ini membahas dua permasalahan utama, pertama bagaimanakah penyelesaian sengketa informasi publik di PTUN Indonesia dengan studi kasus Putusan PTUN Jakarta Nomor 3/G/KI/2016/TUN, Kedua, bagaimana model penyelesaian sengketa informasi publik di PTUN Korea Selatan? Metode penelitian yang digunakan adalah penelitian hukum nomatif dengan pendekatan undang-undang dan pendekatan komparasi. Hasil penelitian menunjukkan PTUN Indonesia mempunyai kewenangan absolut dalam penyelesaian sengketa informasi publik apabila telah terlebih dahulu diputus melalui ajudikasi non litigasi oleh Komisi Informasi dan proses penyelesaian sengketa informasi publik di PTUN merupakan penyelesaian sederhana karena pemeriksaan hanya dilakukan terhadap Putusan Komisi Informasi Pusat, berkas perkara serta permohonan keberatan dan jawaban atau keberatan tertulis dari para pihak tanpa mediasi. Sedangkan di PTUN Korea Selatan pemohon infomasi dapat langsung mengajukan keberatan terhadap badan publik yang memutuskan untuk menolak menyampaikan informasi melalui banding administratif atau litigasi administratif.

Abstract

The Desa Law gave rise to a discussion about the legitimacy of Desa Adat in Indonesia. Along with the main objective of the Desa Law to empower villages, some regions thought the normalization of Article 5 of the Desa Law would go hand in hand with the strengthening of the Desa Adat. The Siak Regency Government issued the Siak Regency Regulation No. 2 of 2018 concerning the Establishment of Desa Adat in Siak Regency, to compel the villages in their area to meet the criteria as Indigenous Villages as mandated by the Desa Law. The Regional Regulation of the Province of West Sumatra Number 7 of 2018 concerning Nagari shows political debate to fulfill the mandate of the Village Law, which is criticized as large among the minimal nuances of custom and culture. Bali, which has been living in a circle of the existence of Desa Adat and Desa Dinas, has also examined the responses to the existence of the Desa Law drawn from discussions and discourses on village integration and/or village elections. In the midst of this process, the Provincial Law of Bali Province No. 4 of 2019 was published in the Adat Law (Perda Desa Adat). This paper will show that the Desa Adat Law, which is rich in nuances of customs and culture, was not published to fulfill the mandate of the Desa Law, but instead strengthened the existence of Desa Adat in Bali. This Perda has revised traditional and official relations in Bali by giving more space to the Customary Villages to work together with the Dinas Desa in synergy to empower the community within the philosophical framework of the Balinese people. The effectiveness of this regional regulation needs to be tested to prove the authority of the Desa Adat and Desa Dinas in Bali.

Abstract

The promulgation of Article 27 paragraph (3) of Law Number 2 of 2020 adds to the precarious atmosphere of the pandemic that has occurred since 2020. The law that was present with the aim of providing procedures for implementing government actions in dealing with this pandemic turned out to have brought many questions from the general public regarding the interests of the general public. The political party that accompanies the promulgation of the law is because it is considered to provide immunity to state administrative officials against policies that will be issued as an effort to handle the COVID-19 pandemic because it is not an object of state administration. This research comes with several fundamental questions such as why the law legitimizes the existence of state administrative decisions that cannot be the object of a lawsuit at the state administrative court and how the general principles of good governance can be guaranteed to be implemented if the transformation of state administrative policies into the object of the state administrative dispute is removed. Abstract

The determination of the elected Regent and Deputy Regent by the General Election Commission (KPU) of Sabu Raijua Regency was formed without paying attention to the provisions of the Legislation and General Principles of Good Governance. The reason is that Orient Riwu Kore was only known to have dual citizenship after issuing the KPU Decree. The Constitutional Court later annulled the KPU decree. In contrast, Article 24C of the Constitution mandates that the MK's authority decide disputes regarding the general election results. On the other hand, the KPU stipulation decree is related to the general election process, not a dispute over the vote results. The dispute resolution process should be done through administrative efforts to the BAWASLU and the PTUN. Therefore, it becomes a question regarding the basis of the authority and reasons for the Constitutional Court to resolve disputes over the general election process. This research is in the form of normative juridical. The approach used in this research is the statutory approach and the case approach. This research is categorized in a prescriptive research typology. The data that has been collected will be analyzed qualitatively, and the results of this study are categorized in the form of prescriptive-analytical research. The result of this research show if the dispute of the KPU decree should be solved by administrative efforts in the form of adjudication to Bawaslu. Only then can the PTUN lawsuit be filed. However, suppose the dispute resolution process is carried out through the Administrative Court, it will take a long time. So that it can be understood that the acceptance of the applicant's application by the Constitutional Court is due to the absence of a more effective mechanism that can be carried out for the determination of the KPU decree other than through the Constitutional Court.
