Penelitian ini bertujuan untuk mengetahui kedudukan krayawan yang di PHK secara lisan dan apa landasan hukum dari pemutusan hubungan kerja secara lisan serta untuk mengetahui kekuatan hukum dari pemutusan hubungan kerja secara lisan dalam tinjauan undang undang ketenagakerjaan.Hasil penelitian menunjukan bahwa pemutusan hubungan kerja secara lisan dinilai menyalahi aturan hukum dikarenakan, Undang-Undang 13 Tahun 2003 tentang Ketenagakerjaan mengatur tata cara pemutusan hubungan kerja yang terbagi atas tiga cara yakni pemutusan hubungan kerja yang dilakukan oleh buruh, pengusaha maupun dengan putusan pengadilan, ketiga cara tersebut tidak memperbolehkan adanya pemutusan hubungan kerja secara lisan, hal ini membuat pemutusan hubungan kerja secara lisan batal demi hukum.

AbstractThe use of Indirect Evidence in Business Competition Law, especially in handling cases becomes a problem in its own right for the judiciary, both for the KPPU institution, as well as the District Court and the Supreme Court as the highest institution in the judiciary, because there are pros and there are also contra to the use of Indirect evidence. This study uses a normative legal research method using the law approach and case approach. The legislative approach refers to Law Number 5 of 1999 and its implementing regulations, namely the Regulation of the Business Competition Supervisory Commission Number 4 of 2010 concerning Cartels, while for the case approach based on the Decisions of the Business Competition Supervisory Commission, District Courts and Supreme Court with the aim of exploring and understand the meaning of different truths in cases that have been decided by the Supreme Court against the Decision of the Business Competition Supervisory Commission which has permanent legal force. The results of this study reveal that the power of proof using Indirect Evidence still reaps the pros and cons, where in the use of Indirect Evidence in each case the strength of the evidence is different.Keywords:Indirect evidence, Cartel, KPPU, Supreme Court

Permasalahan utama dalam skripsi ini adanya putusan yang bervariatif terkait pemenuhan hak tenaga kerja yang diputus pailit, yang menyebabkan ketidak pastian hukum mengenai prosedur dan pemenuhan hak – hak normatif dalam pemenuhan hak pekerja pada perusahaan yang diputus pailit. Seperti salah satu kasus PT. Starlight Prime Thermoplast, yang dalam putusan tingkat pertama majelis hakim mengabulkan pembayaran hak pekerja. Tapi, pada tingkat kasasi, majelis hakim membatalkan putusan tingkat pertama, dikarenakan Pengadilan Hubungan Industrial tidak berwenang memeriksa dan mengadili terhadap pihak yang telah dinyatakan pailit. Pada kasus lain yaitu pada kasus PT. Henrison Iriana, pada putusan kasasi PT. Henrison Iriana, majelis hakim mengabulkan untuk tim kurator membayar uang pesangon, uang penghargaan masa kerja serta uang penggantian hak kepada penggugat yang merupakan salah satu pekerja perusahaan tersebut.Metode penelitian ini menggunakan pendekatan yuridis yang mengacu pada kasus putusan di Pengadilan Hubungan Industrial No. 13/Pdt.Sus-PHI/2018/PN.Yyk dan putusan No. 970 K/Pdt. Sus-PHI/2018.Kesimpulan dari penelitian ini yaitu, tuntutan hak pekerja pada perusahaan yang telah dipailitkan adalah dengan cara didaftarkan dan dicocokkan kepada kurator. Dengan adanya aturan yang tidak komprehensif dan kurang sinergis antara Undang - Undang Ketenagakerjaan dan Undang - Undang Kepailitan, menyebabkan adanya ketidakpastian hukum dalam proses pemenuhan hak – hak pekerja.

AbstractIn the overcredit agreement under the hand on the vehicle, the car caused a loss both from the leasing party and the parties who took the action. In fact, the leasing financing agreement prohibits the action stated in the clause.This study examines the legality of overcredit within the scope of Civil Law in Indonesia. Then the researcher explained the right stages in overcrediting car vehicles officially according to the SOP (Standard Operating Procedure) on leasing PT. Toyota Astra Financial. In addition, the research study examined the legal consequences of overcrediting under the hands of car vehicles in a philosophical, juridical, and sociological perspective.The results of the study show that due to the law of overcrediting under the hands of car vehicles in terms of philosophical contradiction with the Contracted Justice Theory proposed by John Rawls. The act of overcrediting under the juridical aspect can also have a negative impact by paying compensation to the leasing party in accordance with the Civil Code Article 1243, Article 1266, and Article 1267 due to default (broken promise). Then, overcredit under the hand can also end in court as in the case of Decision Number 10 / Pdt.G / 2017 / PN.Rkb.Keywords: Due to Law, Under Hands, Overcredit, Leasing Agreement

The problem that will be examined in this research with the object of the ruling is variatively related to the fulfillment of labor rights in the LAYOFFS thus causing the uncertainty of law on the procedure and fulfillment of rights-normative rights in fulfilling the rights of the diPHK workers. Like one case PT. Hollit International, which in the first-level decision of the Tribunal judges rejected the suit of all rights of workers, but at the rate of appeal, the Tribunal cancelled the court of first degree, as the Industrial Relations Tribunal at the Central Jakarta District Court had misapplied the law. This research uses a qualitative research type that is the type of data and the analysis used is narrative, in the form of statements that use reasoning. Using a normative juridical approach, referring to the application of the law contained in a verdict and the law conceptualized as the norm or the rules applicable in society. The results show the demands of the rights of workers in LAYOFFS by the company, with the ruling that is not comprehensive and less synchronous between the manpower law and the ruling in the Industrial relations Court at the Central Jakarta District Court, causing uncertainties in the process of fulfilling the rights of workers. AbstractThis research was conducted because of the varied object of the decision related to the fulfillment of the rights of workers who were dismissed from work, causing legal uncertainty regarding procedures and fulfillment of workers' normative rights. Like one of the cases of PT. Hollit International, who in the first instance verdict of the panel of judges rejected the claim of all workers' rights, but at the cassation level, the panel of judges overturned the first instance because the Industrial Relations Court at the Central Jakarta District Court had incorrectly applied the law. This research uses qualitative research that is the type of data and analysis that is used is narrative, in the form of statements that use reasoning. By using a normative juridical approach, referring to the application of the law contained in a decision and the law which is conceptualized as a norm or norm that applies in society. The results of the research show that the court's decision on the claim of workers 'rights which is dismissed by the company is not comprehensive and is not synchronous between the Labor Law and the Decision in the Industrial Relations Court, causing legal uncertainty in the process of fulfilling workers' rights.Keywords: Rights, Labor, Mutation, Termination of Employment

Abstract:This study aims to explain the Law Enforcement of Supervision of Foreign Workers by the Tangerang Regional Supervision Agency 2 Based on Law No. 13 of 2003 concerning Labor in the City of South Tangerang. This study uses qualitative research using an empirical normative research approach. This study conducted a review of the laws and regulations, books, and journals (library research) that are directly related to this research. The researcher also conducts direct field research by observing and interviewing relevant parties, namely the Tangerang Regional Supervision Region 2. The results of the study indicate that there are still foreign workers who violate the applicable provisions stipulated in Article 42 to Article 49 concerning the Use of Foreign Workers Act Number 13 of 2003 concerning Manpower and the insufficient number of supervisors of the Tangerang 2 Regional Supervision Agency to supervise companies in the City of South Tangerang to carry out supervision in accordance with Law Number 13 of 2003 concerning Manpower.Keywords: Law Enforcement, Supervision, Foreign Workers

Abstract:A draft law must be able to answer and solve the main problem of the society so that with the existence of the law the community gets legal protection from the state. However, the draft of Cipta Kerja Law makes an endless controversy. In fact, the draft was allegedly containing some problems since its appearance. Therefore, academic research (Assesment Report) is needed so that the rules in the draft have basic scientific arguments that can be justified. Unfortunately, the draft does not conduct an assesment report to know whether the society need the law and urgent.Keywords: Legal Protection, Controversy and Assesment Report Abstrak:Sebuah rancangan undang-undang harus dapat menjawab dan menyentuh pokok permasalahan masyarakat sehingga dengan adanya undang-undang tersebut masyarakat mendapatkan sebuah perlindungan hukum dari negara. Namun, dalam RUU Cipta Kerja ini justru berakibat pada kontroversi yang tiada hentinya. Bahkan, disinyalir RUU ini mengandung kecacatan sejak awal pembentukannya. Oleh karena itu, dibutuhkan penelitian akademis sehingga aturan-aturan yang ada dalam RUU ini mempunyai basis argumentasi ilmiah yang dapat dipertanggungjawabkan yang salah satunya adalah dengan membuat Laporan Kelayakan. Sayangnya RUU ini belum melakukan laporan kelayakan apakah RUU ini dibutuhkan dan penting di masyarakat.Katakunci: Perlindungan Hukum, Kontroversi dan Laporan Kelayakan

Critical Legal Studies (CLS) merupakan salah satu alternatif pemikiran dalam filsafat hukum yang dapat memberikan pandangan berbeda terhadap hukum. Ciri khas dari pemikiran ini adalah tidak menjadikan hukum yang dibuat oleh negara diterima taken for granted begitu saja sebelum adanya proses perjuangan nalar kritis terhadap subtansi hukumnya. Ada situasi ketidakpercayaan dan kekhawatiran bahwa hukum yang dibuat negara tidak bisa mendatangkan keadilan karena prosesnya yang melalui pergulatan tarik menarik kepentingan politik kekuasaan dan ekonomi sehingga menyebabkan produk hukumnya rentan akan tabir ketidaksempurnaan. Netralitas, dan imparsialitas merupakan katakunci yang menjadi indikator untuk mempurifikasi hukum tersebut. Oleh karena itu, CLS berupaya untuk selalu membuka selubung relasi kekuasaan dan relasi ekonomi yang selalu mengintervensi hukum dengan perjuangan dan logikanya sendiri.

Abstract: Society has own legal system, namely customary law which can be a source of national law. It exists and has been legitimized in the Indonesian constitution. With the recognition of customary law, law enforcers and lawmakers must consider it. Customary law is not made by the State, but exists, and develops with the development of society. In certain areas, the application of customary law or compliance with customary law is more binding than state law. The basic concept of customary law is from the thought of Friedrick Karl von Savigny through his various works, thus making him the philosopher who built the foundation for the School of Legal History.
