Abstract

Artikel ini bertujuan untuk merekonstruksi syarat-syarat pemanfaatan pulau-pulau kecil di Indonesia dari investasi asing akibat liberalisme dan kapitalisme. Pasca terbitnya Peraturan Pemerintah Pengganti Undang-Undang No. 2 Tahun 2022 Tentang Cipta Kerja, investor asing sangat terbuka dan leluasa untuk memanfaatkan pulau-pulau kecil dengan melakukan privatisasi sumber daya alam di wilayah pulau-pulau kecil Indonesia. Situasi ini terjadi karena Perppu Cipta Kerja melonggarkan syarat-syarat kepada investor asing dengan menghilangkan pertimbangan sosial dan ekologis sehingga melanggar hak asasi manusia. Untuk menganalisis masalah tersebut, artikel ini menggunakan penelitian hukum normatif yang dianalisis melalui pendekatan perundang-undangan dan konsep. Konstitusi menjamin hak-hak warga negara dalam memanfaatkan sumber daya alam tanpa diskriminasi dan melindungi hak asasi manusia. Dengan demikian, negara wajib memberikan persyaratan yang sesuai dengan konstitusi dan HAM bagi investor asing diantaranya dengan melibatkan masyarakat lokal, mempertimbangkan aspek ekologi, sosial, ekonomi, dan melakukan alih teknologi. Oleh karena itu, konsep pemanfaatan pulau-pulau kecil dalam Perppu Cipta Kerja perlu diubah dan memasukkan prinsip-prinsip HAM berdasarkan konstitusi Republik Indonesia.

Abstract

Abstract:A political party is an entry point to affirm the Democratical State. In order to realize the function, political party needs operational fund so that the state-issued Government Regulation Number 1 of 2018 concerning Financial Aid to Political Party which raised financial assistance to political party from 108 rupiahs per valid vote to 1,000 rupiahs per valid vote. However, it became polemic because of increasing political party aid fund without supervision of the management and reporting of aid fund. As a result of the absence of supervision, there is corruption in political party because the supervision of management, reporting of political party fund and sanction have not been done optimally so that political party is not able to accommodate and realize the principles of Good and Clean Governance as mentioned in Law Number 2 Year 2011 concerning Political Party. The purpose of this research is to answer the polemic of increasing political party budget related to the system of monitoring political party fund comprehensively. The method used is juridical-normative with legislation and conceptual approach.Keywords: Political Party, Fund System, DemocracyAbstrak:Partai politik merupakan entry point dalam menegaskan kehidupan Negara Demokrasi. Dalam rangka mewujudkan fungsi tersebut partai politik membutuhkan dana operasional sehingga negara mengeluarkan Peraturan Pemerintah Nomor 1 Tahun 2018 tentang Bantuan Keuangan Kepada Partai Politik yang menaikan bantuan dana partai politik dari Rp.108 per suara sah menjadi Rp.1000 per suara sah. Namun menjadi polemik adalah kenaikan jumlah dana bantuan partai politik tersebut tanpa diimbangi dengan pengawasan terhadap pengelolaan dan pelaporan dana tersebut. Akibat tidak adanya pengawasan tersebut rawan terjadinya praktik korupsi dalam partai politik karena selama ini pengawasan pengelolaan, pelaporan dana partai politik dan sanksi belum dilakukan secara maksimal sehingga belum mengakomodir dan mewujudkan prinsip-prinsip Good and Clean Governance sebagaimana yang diatur dalam Undang-Undang Nomor 2 Tahun 2011 tentang Partai Politik. Tujuan penelitian ini dimaksudkan untuk menjawab polemik kenaikan anggaran partai politik secara komprehensif terkait sistem pengawasan dana partai politik. Metode penelitian adalah yuridis-normatif dengan pendekatan perundang-undangan (statute approach) dan konseptual (conceptual approach). Kata Kunci: Dana Partai Politik, Demokrasi, dan Good Clean GovernanceАннотация :Политические партии являются отправной точкой в утверждении жизни демократического государства. Чтобы реализовать эту функцию, политическим партиям нужен оперативный фонд. В связи с этим, государство издало Постановление правительства № 1 от 2018 года о финансовой помощи политическим партиям по увеличению фонда политических партий со 108 рупий до 1000 рупий за один действительный голос. Однако, проблемой стало то, что увеличение количества финансовой помощи политическим партиям не было сбалансировано с наблюдением за управлением и отчётностью этих фондов. В результате отсутствия такого наблюдения имеются тенденции к коррупционной деятельности в политических партиях, потому что всё это время наблюдение за управлением, отчётность о фондах политических партий и санкции осуществляются неоптимально. Все вышеперечисленные причины ещё не соответствуют и не реализуют принципы честного и надлежащего управления (Good and Clean Governance), урегулированные в Законе № 2 от 2011 года о Политических партиях. Целью данного исследования является решение вопроса увеличения бюджета политических партий в полном объёме, который связан с системами наблюдения за фондами политических партий. Abstract

This article proposes the idea of accommodating the concept of personal data protection in zakat management law in Indonesia. It is because the Zakat Management Organization and online platforms that facilitate zakat payments online still need legal certainty regarding collecting, using, and reporting personal data about zakat payers (muzakki). There needs to be more clarity on the types of muzakki's personal data that can be collected and reported by Zakat Management Organization and online platforms to the government, which creates the potential for a muzakki's personal data breach. This article uses normative legal research methods with statutory and conceptual approaches. In conclusion, a mutually agreed-upon personal data protection agreement is required between Zakat Management Organization, the online platform, and muzakki. Therefore, it is necessary to reform the zakat management law to be adaptive to personal data protection by amending Law Number 23 of 2011 concerning the Management of Zakat.

Abstract

The presence of digital technology brings significant changes in many aspects of human life, including the economy and financial services. The rapid development of financial technology (fintech) is being responded quickly by many countries including Indonesia and Malaysia. Not only conventional fintech, but Sharia fintech is also developing significantly in both countries. This phenomenon is caused by the efficiency and ease of fintech. However, fintech in Indonesia is not followed by a comprehensive protection of personal data. The absence of special regulation on the protection of personal data in Indonesia causes the data often be misused by certain parties such as being stolen, sold, transferred and eliminated irresponsibly causing harm to fintech users. Meanwhile, Malaysia has built a legal system of personal data protection since 2010 and becomes the first country in the ASEAN region to have a comprehensive personal data protection law system. Therefore, the article aims to overview and compare the personal data protection law in Malaysia especially in fintech. To answer the problem, this study uses a normative-empirical method with a comparative law approach. The result of this article shows that Indonesia should learn from Malaysia by doing benchmarking as an effort to establish a comprehensive regulation for protecting personal data. A comprehensive regulation and law enforcement on the protection of personal data are urgently needed in Indonesia to protect the rights of fintech users.

Abstract

This study aims to examine the application of indirect evidence in handling cartel practices in the cooking oil industry, focusing on a case study of Decision No. 24/KPPU-I/2009 Jo. No.03/KPPU/2010/PN.JKT.PST Jo. Number 582K/PDT.SUS/2011. The research method used is the juridical-normative approach, which relies on legal sources such as laws and regulations, legal principles, norms, principles, and expert opinions to analyze the issues studied. In the KPPU decision No. 24/KPPU-I/2009, the Business Competition Supervisory Commission (KPPU) stated that 21 cooking oil producers were proven to have practiced cartels. However, business actors applied with the Central Jakarta District Court, which then overturned the decision through Decision No. 03/KPPU/2010/PN.JKT.PST. The cancellation was based on the consideration that KPPU only relied on analysis, theories, and definitions considered speculative and not supported by substantial evidence. KPPU then filed an appeal to the Supreme Court, but the Supreme Court rejected the appeal and upheld the settlement of the first-level court through Decision No. 582K/PDT.SUS/2011. This study also highlights that challenges in indirect evidence can be overcome by implementing a leniency program, as has been implemented in various countries. This program incentivizes parties involved in the cartel to disclose information to the competition authority.

Abstract

The study determines whether Islamic bank management understands hybrid contracts in the DSN-MUI funding fatwa and its influence on developing funding products in Islamic banks. The type of research used is normative juridical to examine the application of Islamic legal rules both at the methodological level (uṣul fiqh) and fiqh rules and at the product level (fiqh). The primary data of this study comes from the DSN-MUI fatwa and interviews to explore the understanding of Islamic bank management towards hybrid contracts in the DSN-MUI funding fatwa. This study indicates that from eight fatwas on DSN- MUI funding products, only fatwa No. 86 and 87 containing hybrid contracts. There are several theoretical frameworks, standards, and limitations (ḍawābiṭ) that the DSN-MUI has determined. The study also shows that the management of Islamic banks, generally, has understood the theoretical framework, standards and limitations of hybrid contracts on Islamic bank funding products only in textual concept. The textual understanding can increase the portfolio of funding products. This can be evidenced by the increasing portfolio of muḍārabah savings and income smoothing programs at Islamic banks.  Abstrak Penelitian ini mengkaji apakah manajemen bank syariah memahami kontrak hybrid dalam fatwa pendanaan DSN-MUI dan pengaruhnya terhadap pengembangan produk pendanaan di bank syariah. Metode yuridis normatif digunakan untuk mengkaji penerapan kaidah hukum Islam baik pada tataran metodologis (ushul fiqh) dan kaidah fikih maupun tataran produk (fikih). Data utama penelitian ini bersumber dari fatwa DSN-MUI dan wawancara untuk menggali pemahaman manajemen bank syariah terhadap multi akad pada fatwa pendanaan DSN-MUI. Penelitian ini menunjukan bahwa dari 8 fatwa produk pendanaan DSN-MUI hanya fatwa No. 86 dan 87 yang terdapat multi akad dengan beberapa kerangka teori, standar, dan batasan-batasan (ḍawābiṭ) yang telah ditentukan oleh DSN-MUI agar tidak terjeurumus pada multi akad yang dilarang. Penelitian ini juga menunjukan bahwa manajemen bank Syariah secara umum sudah memahami kerangka teori, standar dan batasan-batasan multi akad pada produk pendanaan bank Syariah pada konsep tekstual di mana dapat mempengaruhi peningkatan portofolio produk penadanaan. Hal ini dapat dibuktikan dengan meningkatnya portofolio tabungan mudharabah dan program income smoothing di bank Syariah.

Abstract

On the 26th of September 2023, the 7th President of Indonesia, Joko Widodo, officially inaugurated the launch of the first carbon credit trading platform of Indonesia, IDXCarbon. The launch of this carbon credit trading has marked another stepping stone of Indonesia to its commitment to combating climate change and further strengthening its position in the global environmental conservation arena. The aim of this article is to critically evaluate the potential opportunities and benefits of the carbon trading scheme in Indonesia through the lens of Environmental Economics theory, while also assessing the potential challenges through the scope of Political Ecology theory . This article employs Environmental Economics theory in analyzing how the establishment of a carbon trading market presents potential benefits in addressing greenhouse gas emissions by implementing economic value in carbon reductions. The carbon trading adoption in the environmental policy framework in Indonesia aims to encourage low-carbon economic practices and innovations across various sectors. On the contrary, this article will also provide a critical examination towards the adoption of carbon trading in Indonesia through the lens of Political Ecology theory. Political Ecology theory will highlight the underlying power relations across state, private actors, local communities, and international stakeholders that raise skepticism regarding the credibility, governance, and the actual environmental impact of the carbon trading scheme in Indonesia. Furthermore, Political Ecology theory focuses on the potential challenges, such as fair implementation and preventing the marginalization of vulnerable communities involved in carbon trading practices. Overall, the establishment of a carbon trading market in Indonesia through IDXCarbon marked a revolutionary step in Indonesia’s commitment to combat climate change. Through the comparative analysis of the potential opportunities and challenges in regards to the adaptation of carbon trading in Indonesia, this article argue that the adaptation of carbon trading in Indonesia requires a robust regulatory and environmental ethical framework in order to balance the potential benefits presented by the framework while mitigating the potential challenges that can further hinder the overall benefits of carbon trading.
