Abstract

AbstrakPokok penelitian ini adalah peran penghulu dalam menentukan hak perwalian atas anak perempuan yang lahir akibat hamil di luar nikah. Pokok permasalahan terdiri dari dua sub masalah yaitu: Bagaimana pertimbangan penghulu KUA Kecamatan Ujunglue Kabupaten Bulukumba mementukan hak perwalian atas anak perempan yang di lahirkan akibat hamil di luar pernikahan. Bagaimana dasar hukum penghulu KUA Kacamatan Ujungloe Kabupaten Bulukumba dalam menentukan hak perwalian atas anak perempuan yang lahir akibat hamil di luar pernikahan. Adapun hasil penelitian ini menunjukkan peran penghulu dalam menentukan hak perwalian atas anak perempuan yang lahir akibat hamil di luar nikah: KUA kecamatan Ujungloe dalam menentukan hak perwalian atas anak perempuan yang lahir akibat diluar nikah mengikut pada KHI yakni membolehkan si ayah biologis menjadi wali nikah bagi si anak perempuan selama orang tua si anak (ayah biologis dengan ibu kandung si anak) terikat pada ikatan perkawinan. Dasar hukum yang dipakai oleh KUA UjungLoe UU No. 1 Thn 1974 yang searah dengan Kompilasi Hukum Islam, sebagai lembaga yang melaksanakan sebagian tugas Kementerian Agama Indonesia tentunya KUA Ujung Loe mengikitui ketentuan perundang-undangan yang berlaku, yang mengakui status anak yang hamil diluar nikah merupakan anak sah dari kedua orang tuangnya. Menyagerakan menikah merupakan jalan yang sangat dianjurkan dari menjauhkan dari perbuatan zina, bagi mereka yang sudah baligh dan memilki kesiapan. Kata Kunci: penghulu, anak di luar nikah, wali hakim.

Abstract

Human Rights Obligations remains a problem that is always interesting to talk about, especially in the perspective of Islamic criminal law. Human rights in Islamic criminal law become the main aspect because obligations must be fulfilled first before being able to claim the rights. If the obligation is fulfilled, then the rights of all human beings can also be fulfilled. The Islamic law has the concept that obligations are more or more priority than the rights, and this is very different from the national legal system and the Western legal system. The principle of fulfilling the obligation first than the prosecution of the rights is the nature of the law which encourages avoidance of someone committing acts that can harm others. In order to create order in life or create benefit in society, the Islamic criminal law regulates it with the concept of al-darūriyāt al-khamzah.

Abstract

Salah satu tujuan disyariatkan hukum Islam adalah untuk mewujudkan dan memelihara  agama, jiwa, akal, kehormatan dan keturunan serta harta. Sebaliknya segala tindakan yang bisa mengancam keselamatan salah satu dari lima tujuan pokok disyari’atkannya hukum tersebut dianggap sebagai perbuatan jahat yang dilarang. Oleh sebab itu kejahatan pembunuhan dan penganiayaan merupakan kejahatan yang diancam dengan hukuman kisas. Kisas ialah mengambil pembalasan yang sama. Kisas itu tidak dilakukan, bila yang membunuh mendapat pemaafan (pengampunan) dari ahli waris yang terbunuh, dan diganti dengan sanksi diyat (membayar ganti rugi) yang wajar.   Pembayaran diyat hendaknya dilakukan dengan baik, umpamanya dengan tidak mendesak yang membunuh, dan yang membunuh hendaklah membayarnya dengan baik pula, umpamanya tidak menangguh-nangguhkannya. Bila ahli waris si korban sesudah Tuhan menjelaskan hukum-hukum ini, membunuh yang bukan si pembunuh, atau membunuh si pembunuh setelah menerima diyat. Maka terhadapnya di dunia diambil kisas dan di akhirat dia mendapat siksa yang pedih. Jadi mengorbankan satu anggota tubuh untuk menyelamatkan jiwa adalah sesuatu yang tidak bertentangan dengan akal, dan juga berimplikasi pada penyelamatan harta masyarakat secara lebih luas. Tentu saja hukuman seperti itu hanya berlaku bagi negara-negara yang melaksanakan hukum Islam secara utuh, tetapi bagi bangsa Indonesia hukuman potong tangan masih menjadi persoalan bagi masyarakat kebanyakan.

Abstract

AbstrakPembiayaan (leasing) adalah penyedia uang atau tagihan yang dipersamakan dengan demikian, berdasarkan kesepakatan atau persetujuan kedua belah pihak lain, mewajibkan pihak yang di biayai (konsumen/nasabah) untuk mengembalikan uang (tagihan) tersebut setelah jangka waktu yang telah di tentukan atau tertentu dengan imbalan bayar jasa atau sistem bagi hasil. Pembayaran dapat dilakukan secara berkala disertai dengan hak pilih bagi perusahaan tersebut. Tujuan penelitian ini adalah (1) Mengetahui perbedaan sistem bunga dalam pembiayaan konvensional dan margin dalam pembiayaan syariah, (2) Mengetahui tinjauan hukum islam tehadap terhadap bunga dalam pembiayaan konvensional dan margin dalam pembiayaan syariah, (3) Mengetahui margin lebih rendah daripada bunga dalam pembiayaan. Jenis penelitian yang digunakan adalah field research dengan tekhnik data secara kualitatif. Penelitian dekskriktif adalah suatu bentuk penelitian yang di tujukan untuk mendeskriktifkan atau menggambarkan fenomena-fenomena yang terjadi baik fenomena alamiah maupun rekayasa, sedangkan penelitian kualitatif ialah metode penelitian yang menghasilkan data dari metode dekskriktif baik berupa kata-kata tertulis maupun secara lisan dari orang-orang yang bersangkutan. Hasil penelitian menunjukkan bahwa dalam pembiayaan konvensioanal adalah pendapatan kotor atas pinjaman atau balas jasa yang diberikan oleh nasabah ke perusahaan, bunga biasanya terjadi dalam transaksi pinjaman kredit dan penghimpunan dana, besar kecilnya bunga tergantung pada jumlah uang yang dipinjam dan lamanya pemakaian uang. Di sisi lain margin dalam pembiayaan yang berbasis syariah adalah keuntungan secara bersih yang hanya didapatkan dari akad jual beli, keuntungan margin merupakan bagian dari harga yang disepakati antara penjual dan pembeli, dan apabila penjual dan pembeli telah sepakat maka besarnya laba tidak akan berubah.Kata Kunci : Bunga Pembiayaan, Pembiayaan Konvensional, Pembiayaan Syariah. AbstractFinancing (leasing) is a provider of money or equalized bills thus, based on the agreement or agreement of the two other parties, obliging the financed party (consumer / customer) to return the money (bill) after a predetermined or certain period of time with payment for services or a profit sharing system. Payments can be made periodically along with the right to vote for the company. The objectives of this study are (1) Knowing the differences in interest systems in conventional financing and margins in Islamic financing, (2) Knowing the Islamic law review of interest in conventional financing and margins in Islamic financing, (3) Knowing that the margin is lower than interest in financing. . This type of research is field research with qualitative data techniques. Descriptive research is a form of research aimed at describing or describing the phenomena that occur both natural and engineering phenomena, while qualitative research is a research method that produces data from the descriptive method in the form of written or oral words from people who concerned. The results show that conventional financing is gross income on loans or remuneration provided by customers to companies, interest usually occurs in credit loan transactions and fundraising, the size of the interest depends on the amount of money borrowed and the length of time it is used. On the other hand, the margin in sharia-based financing is the net profit that is only obtained from the sale and purchase agreement, the profit margin is part of the price agreed upon between the seller and the buyer, and if the seller and buyer have agreed, the amount of profit will not change.Keywords: Conventional Financing, Interest Financing, Sharia Financing.

Abstract

AbstrakPokok masalah dalam penelitian ini mengkaji tentang tinjauan hukum islam terhadap penerapan akad wadiah pada produk tabungan Bank Syariah Mandiri ( Bank Syariah Mandiri Cabang Maros ), Penulis mengambil jenis penelitian adalah penelitian lapangan (field research) menggunakan metode kualitatif dengan  Pendekatan Empiris sejauh mana implementasi hukum yang di jalankan dengan sumber data diperoleh dari data primer yaitu data langsung dari para pihak dalam Bank Syariah Mandiri Cabang Maros sedangkan data sekunder diambil berupa arsip, jurnal, buku dan referensi lainnya yang berkaitan dengan penelitian, Pada Bank Syariah Mandiri cabang Maros dalam penerapan akadwadiah pada produk tabungan sudah sesuai dengan Fatwa DSN MUI 2/DSN-MUI/IV/2000 tentang tabungan. Akad wadiah yang diterapkan Bank Syariah Mandiri cabang Maros mengunakan akad wadiah yad dhamanah di mana pihak nasabah dan pihak bank berakad ketika nasabah menggunakan wadiah yad dhamanah maka uang yang ditititpkan akan di kelola pihak Bank Syariah Mandiri Cabang Maros dengan perjanjian nasabah akan diberikan berupa pemberian insentif (bonus) yang tidak diperjanjikan di awal akad yang hanya diketahui oleh pihak bank serta diberikan pelayanan terbaik kepada nasabah.Kata Kunci: Akad Wadiah, Bank Syariah Mandiri, Produk Tabungan. AbstractThe main problem in this study examines the review of Islamic law on the application of wadiah contracts on savings products at Bank Syariah Mandiri (Bank Syariah Mandiri Maros Branch). run with data sources obtained from primary data, namely direct data from parties in Bank Syariah Mandiri Maros Branch while secondary data is taken in the form of archives, journals, books and other references related to research, at Bank Syariah Mandiri Maros branch in the application of akadwadiah on products savings are in accordance with the Fatwa of DSN MUI 2/DSN-MUI/IV/2000 concerning savings. The wadiah contract implemented by Bank Syariah Mandiri Maros branch uses a wadiah yad dhamanah contract where the customer and the bank make an agreement when the customer uses the wadiah yad dhamanah, the money deposited will be managed by the Bank Syariah Mandiri Maros Branch with the customer agreement being given in the form of incentives (benefit) which was not agreed at the beginning of the contract which is only known by the bank and provided the best service to the customer.Keywords: Decision, Marrige Ratification, The Cild Marrige.

Abstract

The aimed of this research are 1) To know the practice in implementation and the meaning of Peta Kapanca's tradition In Wedding In Simpasai Village Lambu Subdistrict Bima Regency. 2) To know the view of Imam Syafi'i to the implementation of Peta Kapanca's tradition in Wedding In Simpasai Village Lambu Subdistrict Bima Regency. The Kings of this research is qualitative descriptive research by using Teologi Normatif (Syar'i) approachment and fenomenology. The sources of  this research data are the  figure of religion, the figure of society, the future of  custom and Zikir Kapanca's Team. The method of data collect are Observation, Interview and documentation. The technique of data processing are data reduction, data presentation and conclusion. The results of this research are the implementation of Zikir and Peta Kapanca in Simpasai Village Lambu Subdistrict Bima Regency beginning with greetings, istighfar, syahadat, shalawat and read  another ayat of holy Quran. Inai's leaf patch. The bridge sit on the place with the hands positions are straight. Banana's leaf and the bridge's foot straight. The bridge patch Inai's leaf until seven times. Yellow rice sow patch on the bridge by read shalawat of prophet Mohammad. The view of Imam Syafi'i to this tradition is not contadiction with Him caused this tradition accomodations the syariah and the values of Islam as His fiqih that meaning : custom can be consideration of law. Therefore, Zikip Peta Kapanca's Tradition of Simpasai Village can be eternal based on Imam Syafi'i's Perspective  in consider of Islam Law. The implication of this research are 1. Hopefully to all the society of Bima Regency and especially for Simpasai Village for maintain this culture that develop in our society Especially Zikir peta Kapanca. 2 Zikir peta Kapanca's culture is legacy of our Grandmother in Kingdom time, throughout needed the caring of our  government, the figure of religion, the figure of custom, the figure of society, Young generation, and also the researcher.Keywords : Wedding, Kapanca Map, Imam Syafi’i

Abstract

The main problem in this research is about legal considerations in making decisions against members of the military who carry out criminal acts and how Islamic law regulates the sanctions or laws that will be given by narcotics abusers even though at the time of the Prophet there was no such case. The type of research used is qualitative research or methods (field acceptance), namely research that provides a qualitative picture where it is focused on field research methods and their relationship with contemporary Islamic law. This research is sourced from secondary data and primary data with primary primary data sourced from interviews of judges at Military Court III-16 Makassar. From the research conducted, the results show that: (1) In enforcing the criminal law against military personnel who commit narcotics crime, it is still regulated in the law. No. 35 of 2009 concerning Narcotics, in accordance with the case number 064-K / PM.II-09 / AU / III / 2017 by being subjected to the main law and an additional sentence of 1 year and dismissed from military service. (2) factors that cause the organization of the perpetrators of a crime, namely internal and external factors such as family, psychological and personal factors. In a personal factor, the syringe happens only part of the way. (3) law enforcement according to the imam of the mazhab against narcotics crime found in this case which occurred based on these findings was based on this. At the time of the Prophet there was no such thing as drugs so that it was confirmed to be khamar. Sanctions given are in the form of hada and ta'zir penalties in accordance with the criminal act committed.Keywords: Judges' Decisions ; Military ; Narcotics Criminal

Abstract

The main discussion of this research is to provide an analysis of the comparative political fiqh between Nahdlatul Ulama and Muhammadiyah in the Maqasyid Sharia View. The discussion of Islamic political fiqh in Maqasyid Syariah, it turns out that in Islam there are three political concepts, namely formalistic, substantive and secularistic. Likewise with Nahdltul Ulama and Muhammadiyah, although there are often differences of opinion in politics, both of them have agreed that in politics it must be based on the amar maruf nahi munkar movement or as a da'wah movement. As the largest religious organization in Indonesia that has a social base on the grassroots, then NU and Muhammadiyah are given the right to be at the forefront in providing political education and also realizing substantial democracy in this country. Apart from the political ideals of the two Islamic organizations, we should also continue to integrate them with the true ideals of Islam, coupled with the political climate in Indonesia which often applies religion as a political trade, making us to continue to be careful in deciding the steps we take. will be traversed by Muslims in Indonesia

Abstract

The point of this research is to find out how Abortion for Rape Victims Perspective of Positive Law and Islamic Law. The results of this study indicate that in Islamic law abortion is basically not allowed, because it kills the fetus which is considered sacred as a creation of Allah swt. According to positive law in Indonesia abortion is prohibited in the Criminal Code without any tolerance. KUHP as a general crime (Lex Generale), abortion is also regulated in Law no. 36 of 2009 concerning Health, articles 71-75 contain several indications that it is permissible to have an abortion. So PP No. 61 of 2014 concerning abortion due to rape as a more detailed elaboration of Law no. 36 of 2009. The view of Islamic law on Law no. 36 of 2009 and also PP No. 61 of 2014 does not violate religious rules and norms. The similarity of reasons is allowed because it is feared for the safety of the mother. In this PP, the safety of the mother is also prioritized, because if an abortion is not carried out, the mother's psyche will be disturbed. However, if she is not disturbed psychologically and accepts her pregnancy, then she cannot abort the pregnancy. If he does, he will be punished according to the rules. Abstract

The problem of handling marriage during the COVID-19 pandemic became a consideration for the Office of Religious Affairs (KUA) of Turatea District, Jeneponto Regency, in providing services. This research examines the problems of KUA in handling marriage during a pandemic from the perspective of Islamic law. This research is field research that describes the results of the discussion using descriptive qualitative methods, empirical juridical approaches, and normative theology. The results showed that the KUA of Turatea District had problems that were evident from the habits of the community, such as the lack of understanding of the community regarding COVID-19; the community did not report marriages; getting married at a marriage hall received a negative response; and the community was present on their initiative. Marriages carried out during a pandemic are legal according to Islamic law but still comply with health protocols so that harm is avoided as per the sadd al-dzariah rule.
