Abstract

Abstrak Penelitian ini bertujuan menganalisis konsep pengelolaan zakat dalam hukum Islam klasik, mengevaluasi model kontemporer, serta mengkaji isu-isu hukum dan solusi syariah dalam konteks dinamika sosial-ekonomi modern. Penelitian kualitatif ini menggunakan pendekatan multidisipliner dengan analisis teks fiqh klasik, fatwa kontemporer, studi kasus lembaga zakat global, dan data empiris terkini. Pendekatan maqasid al-shariah dan teori taysir (kemudahan) menjadi kerangka analisis utama. penelitian ini menemukan bahwa, prinsip keadilan distributif (QS. At-Taubah: 60) dan sistem Baitul Mal tetap relevan, tetapi memerlukan reinterpretasi untuk menjawab kompleksitas modern, seperti perluasan objek zakat (aset digital, saham) dan redefinisi asnaf (pengungsi, urban poor). Sinergi tridaya (negara, swasta, komunitas) terbukti optimal: negara sebagai regulator, lembaga swasta sebagai inovator, dan komunitas sebagai jaring pengaman berbasis lokal. Prinsip amanah (QS. An-Nisa: 58) menuntut sistem pengawasan hybrid (syariah-audit keuangan) dan sanksi progresif (pidana hingga restorative justice). Dengan demikian, zakat berpotensi menjadi instrumen transformatif pengentasan kemiskinan global jika dikelola dengan integritas syar’i, adaptasi teknologi, dan kolaborasi antarlembaga. Rekomendasi kebijakan mencakup harmonisasi regulasi internasional, sertifikasi amil berbasis kompetensi, dan pemberdayaan berbasis data. Kata Kunci: Zakat, Hukum Islam, Kontemporer.   Abstract This study aims to analyze the concept of zakat management in classical Islamic law, evaluate contemporary models, and examine legal issues and sharia solutions in the context of modern socio-economic dynamics. This qualitative study uses a multidisciplinary approach with analysis of classical fiqh texts, contemporary fatwas, case studies of global zakat institutions, and current empirical data. The maqasid al-shariah approach and the theory of taysir (ease) are the main analytical frameworks. This study found that the principle of distributive justice (QS. At-Taubah: 60) and the Baitul Mal system remain relevant, but require reinterpretation to address modern complexities, such as the expansion of zakat objects (digital assets, stocks) and the redefinition of asnaf (refugees, urban poor). The synergy of tridaya (state, private sector, community) has proven optimal: the state as a regulator, private institutions as innovators, and the community as a locally-based safety net. The principle of amanah (QS. An-Nisa: 58) demands a hybrid supervision system (sharia-financial audit) and progressive sanctions (criminal to restorative justice). Thus, zakat has the potential to become a transformative instrument for global poverty alleviation if managed with sharia integrity, technological adaptation, and inter-institutional collaboration. Policy recommendations include harmonization of international regulations, competency-based amil certification, and data-based empowerment. Keywords: Zakat, Islamic Law, Contemporary.

Abstract

Abstrak Pernikahan beda agama merupakan isu krusial dalam wacana hukum Islam kontemporer, khususnya ketika dihadapkan pada prinsip-prinsip maqāṣid al-syarī‘ah. Artikel ini mengkaji problematika nikah beda agama dengan menitikberatkan pada prinsip ḥifẓ al-dīn (perlindungan terhadap agama) sebagai fondasi normatif utama dalam hukum keluarga Islam. Dalam konteks Indonesia, realitas sosial yang plural dan kompleks semakin memunculkan ketegangan antara norma keagamaan dan kebebasan individu, terlebih pasca diterbitkannya Surat Edaran Mahkamah Agung (SEMA) No. 2 Tahun 2023 yang secara eksplisit menolak legalitas pernikahan lintas agama. Dengan pendekatan yuridis-normatif berbasis maqāṣid, kajian ini menemukan bahwa pernikahan beda agama tidak hanya berpotensi melemahkan prinsip ḥifẓ al-dīn, tetapi juga menimbulkan implikasi negatif terhadap keturunan (ḥifẓ al-nasl), akal (ḥifẓ al-‘aql), dan harta (ḥifẓ al-māl). Oleh karena itu, diperlukan pendekatan hukum yang tidak sekadar legalistik, tetapi juga integratif dan solutif dalam menjawab ketegangan antara norma syar‘i dan realitas hukum nasional. Kata kunci: Nikah beda agama, maqāṣid al-syarī‘ah, ḥifẓ al-dīn, hukum keluarga Islam, SEMA No. 2 Tahun 2023   Abstract Interfaith marriage is a crucial issue in contemporary Islamic legal discourse, especially when faced with the principles of maqāṣid al-syarī‘ah. This article examines the problematic of interfaith marriage by emphasizing the principle of ḥifẓ al-dīn (protection of religion) as the main normative foundation in Islamic family law. In the Indonesian context, plural and complex social realities increasingly give rise to tensions between religious norms and individual freedom, especially after the issuance of the Supreme Court Circular (SEMA) No. 2 of 2023 which explicitly rejects the legality of interfaith marriage. With a juridical-normative approach based on maqāṣid, this study found that interfaith marriage not only has the potential to weaken the principle of ḥifẓ al-dīn, but also has negative implications for descendants (ḥifẓ al-nasl), reason (ḥifẓ al-‘aql), and property (ḥifẓ al-māl). Therefore, a legal approach is needed that is not merely legalistic, but also integrative and solution-oriented in responding to the tension between sharia norms and national legal realities. Abstract

Penelitian ini membahas pelaksanaan mediasi secara elektronik di Pengadilan Agama Makassar dalam perspektif hukum Islam berdasarkan PERMA No. 3 Tahun 2022. Studi ini menggunakan pendekatan yuridis dan teologis normatif (syar’i), dengan menggunakan metode pengumpulan datanya yaitu observasi, wawancara, dan dokumentasi. Hasil penelitian ini menjelaskan bahwa efektivitas penerapan PERMA No. 3 Tahun 2022 tentang mediasi secara elektronik di Pengadilan Agama Kelas 1 A Makassar sudah cukup efektif karena dilihat dari segi waktu, biaya, tempat dan jarak, hanya saja untuk efektif dalam hal penyelesaian perkara, tentu berbeda dengan mediasi secara langsung, karena kalau mediasi secara langsung mediator dapat melihat psikologi emosional. Mediasi secara elektronik ini merupakan salah satu bentuk upaya memelihara jiwa (hifz al-nafs), karena diterbitkannya Perma Nomor 3 Tahun 2022 tentang Mediasi di Pengadilan Secara Elektronik, adalah untuk mengantisipasi kondisi pandemi Covid-19 yang saat itu belum pulih secara total. Sehingga mediasi secara elektronik menjadi pilihan yang terbaik untuk menghindari segala kemungkinan hal-hal yang tidak diinginkan.

Abstract

Penelitian ini menganalisisis Permasalahan Kekerasan seksual terhadap anak yang terus meningkat setiap tahunnya di Indonesia. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum terhadap anak korban kekerasan seksual berdasarkan perspektif Undang-Undang Perlindungan Anak dan Kompilasi Hukum Islam serta mengkaji penerapan perlindungan hukum dalam Putusan Nomor 1128 PID.SUS Tahun 2023 Pengadilan Negeri Makassar. Jenis Penelitian ini tergolong kualitatif dengan menggunakan pendekatan penelitian normatif-empiris yang melibatkan studi pustaka dan analisis putusan pengadilan. Data dikumpulkan melalui observasi, wawancara mendalam dan dokumentasi. Lalu, teknik pengolahan dan analisisi data dilakukan melalui tiga tahapan yaitu: reduksi data, penyajian data  dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa perlindungan hukum bagi anak korban kekerasan seksual telah diatur dalam berbagai regulasi, seperti Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak, serta hukum Islam yang menekankan pentingnya hukuman tegas terhadap pelaku kekerasan seksual.  Kompilasi Hukum Islam (KHI) tidak secara eksplisit mengatur kekerasan seksual sebagai pasal tersendiri seperti dalam peraturan pidana atau Undang-Undang Perlindungan Anak. Namun, Kompilasi Hukum Islam (KHI) tetap dapat dikaji secara normatif dari segi prinsip perlindungan terhadap anak, seperti yang tersirat dalam ketentuan tentang hak dan kewajiban orang tua terhadap anak, serta nilai-nilai keadilan dalam keluarga Islam.

Abstract

This research aims to find out the reality of elderly worship at the Gau Mabaji Gowa Elderly Center and to find out the implementation of the rules of jurisprudence for elderly worship at the Gowa Gau Mabaji Elderly Center. This type of research is field research. This research is a form of social research that uses a qualitative descriptive format. The type of approach used is a Normative Theological approach which is based on sharia elements from the Al-Qur'an and Hadith to be used as a reference related to the problem being studied. The results of this research show that 1) There are 22 elderly people at the Gau Mabaji Gowa Elderly Center and only 6 elderly people are still carrying out worship. 2) There are 3 elderly people who have applied the jurisprudence of elderly worship when performing prayers, in the form of which they pray while sitting on a chair because they are no longer able to stand for long, 3 people also apply the jurisprudence of elderly worship when purifying themselves, in the form of tayammum when they feel very cold and worried that if forced it would make them sick. The implication of this research is that it is hoped that the Government and Society will pay more attention to the needs of the elderly, not only for their clothing, food and shelter, but also for the worship needs of the elderly which are no less important. Providing an understanding of the jurisprudence of elderly worship for the elderly so that they can still carry out their worship optimally in limited circumstances.

Abstract

Meningkatnya angka cerai gugat yang diajukan perempuan di Indonesia menunjukkan adanya dinamika sosial sekaligus problem perlindungan hukum dalam praktik peradilan agama. Meskipun berbagai regulasi telah mengatur hak-hak perempuan pasca perceraian, implementasinya di lapangan masih sering mengalami kendala. Penelitian ini bertujuan untuk menganalisis implementasi perlindungan hukum terhadap hak-hak perempuan dalam perkara cerai gugat di Pengadilan Agama Makassar Kelas 1A. Penelitian ini menggunakan pendekatan kualitatif dengan metode yuridis normatif dan yuridis empiris. Data diperoleh melalui studi dokumen, wawancara mendalam, dan observasi lapangan, serta dianalisis menggunakan model interaktif Miles & Huberman. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap hak-hak perempuan pasca perceraian telah diatur dalam berbagai peraturan, antara lain Undang-Undang Nomor 1 Tahun 1974, Kompilasi Hukum Islam (KHI), Surat Edaran Mahkamah Agung (SEMA) Nomor 3 Tahun 2018, dan Peraturan Mahkamah Agung (PERMA) Nomor 3 Tahun 2017. Pengadilan Agama Makassar Kelas 1A menerapkan strategi perlindungan melalui mekanisme penahanan akta cerai dan pemberian hak-hak seperti nafkah iddah, mut’ah, nafkah madliyah, mahar, dan hadanah. Putusan-putusan pengadilan, seperti perkara Nomor 1655/Pdt.G/2024/PA.Mks dan 760/Pdt.G/2023/PA.Mks, mencerminkan komitmen yudisial dalam menjamin pemenuhan hak-hak perempuan. Namun demikian, implementasi perlindungan hukum dihadapkan pada berbagai kendala struktural dan kultural, seperti rendahnya pemahaman hukum, minimnya penggunaan mekanisme eksekusi, serta keterbatasan akses terhadap bantuan hukum. Hal ini menunjukkan bahwa perlindungan hukum belum sepenuhnya efektif dalam menjamin keadilan substantif bagi perempuan pasca perceraian. Oleh karena itu, diperlukan upaya penguatan literasi hukum, sosialisasi regulasi, dan pemberdayaan perempuan melalui sinergi antara lembaga peradilan, akademisi, dan masyarakat sipil.

Abstract

The purpose of this research is to find out the view of Islamic law on the use of the veil in the contemporary era. This type of research is qualitative research in the form of literature (library research) with the approach used, namely the normative theological approach. The research data is obtained from various sources, such as the Qur'an, hadith, fiqh books and scientific journals. The research results of the discussion of the veil in the contemporary era, namely Islamic law guarantees individual rights to embrace and practice religious teachings, including wearing the veil for Muslim women without discrimination. The veil is a symbol of obedience and Muslim identity. However, it is often associated with discrimination and negative stigma. Veiled women must obey religious rules, maintain good manners, ethics in dressing according to sharia, and respect norms and culture, thus creating relevance between the wisdom and identity of Muslim women in the modern era. This research provides a new contribution in understanding the relevance of the veil in the contemporary era through the lens of Islamic law and its implications for women's rights and obligations. This research is expected to provide a more comprehensive and tolerant understanding of the veil issue for academics, legal practitioners, religious leaders, and society as a whole.

Abstract

Syekh Yusuf al-Makassari, also known as Syekh Yusuf Abu MahasinHadiyatullah Ta al-Khalawati al-Makassari or simply Tuanta Salamaka ri Gowa (meaning "Our Great Teacher from Gowa"), was a prominent Islamic scholar,Sufi, and national hero of Indonesia. His tomb, located in Gowa, South Sulawesi,attracts people from both within and outside the region, who visit for variouspurposes, including fulfilling vows, making offerings, or simply praying for blessings and safety in this world and the hereafter. This research is an empirical legal study with a descriptive qualitative method. The research uses theological and anthropological approaches. The research findings show that, from the perspective of Islamic law, visiting graves is allowed as long as it meets the conditions and requirements according to the teachings of the Prophet Muhammad and does not deviate from these teachings. However, in the view of scholars, the tradition of visiting the Tomb of Syekh Yusuf, which is frequently practiced by the community, such as making vows, holding ceremonies, and asking for blessings, has varying opinions among scholars. Some permit it, while others prohibit it. It is advisable that when making a vow or asking for something, the community should fulfill it by holding a thanksgiving event or fasting as a form of gratitude to Allah SWT for the fulfillment of their vow.

Abstract

This study presents three research questions: First, what is the concept of proof of land ownership rights from the perspective of Islamic law? Second, what is the process of issuing land certificates as proof of land ownership rights according to Islamic law ? Third, what is the legal force of land certificates as proof of land ownership rights according to Islamic law? The type of research used is library research with a normative theological (sharia) approach. The data sources used are data obtained indirectly (secondary data), including primary sources such as the Qur'an, Hadith, and legislation; secondary sources like literature and scientific journals; and tertiary sources such as magazines, dictionaries, and Google. The results of this study show that: First, the concept of proof of land ownership in Islamic law aims to provide legal certainty regarding land ownership rights. Proof of land ownership can be in the form of written documents (kitabah), testimony (syahadah), and continuous physical control (qabdh wa istighlal). Second, applying Islamic legal principles such as justice (al-'adalah), benefit (al-maslahah), transparency (al-ṣidq), and public announcement (I'lan) in land certificates ensures that the land registration process is conducted fairly, accurately, and openly. Third, land certificates serve as a perfect means of proof in the legal system, providing legal protection for landowners and preventing ownership disputes.
