Abstract

One of the goals of the state as mandated by the 1945 Constitution of the Republic of Indonesia is to improve the welfare of the people. Based on Article 74 Paragraph (1) of Law Number 40 of 2007, it is affirmed that companies that carry out their business activities in the field of natural resources and / or fields related to natural resources must carry out social and environmental responsibilities. How is the implementation of the corporate social and environmental responsibilities based on Law Number 40 of 2007 to improve the welfare of the community of Rumbai Pesisir Subdistrict of Pekanbaru City? The research method used in this research is socio-legal research. The results of this research that the corporate social and environmental responsibility programs on the community economy that have been carried out by PT Chevron Pacific Indonesia are called Local Business Development. The corporate social and environmental responsibility program for the community economy that has been carried out by PT Asia Forestama Raya, namely the creation of traditional markets managed by the community. The conclusion is that the government and the community can utilize the corporate social and environmental responsibility programs as an alternative source of business capital to improve the economy and welfare of the people in the Rumbai Pesisir Subdistrict of Pekanbaru City.

Abstract

This community service activity aims to provide legal education to employees of PT Sucofindo Pekanbaru Branch regarding the Omnibus Law of the Job Creation Act. The method of implementation used in this community service activity is to use the lecture method as well as dialogue and discussion. This community service activity was carried out on Wednesday, December 30, 2020 at 13.00 WIB until it was finished at the Ayam Remuk Pak Tisto Restaurant, which is located at Yos Sudarso Street, Rumbai Pesisir District, Pekanbaru City. This community service activity was attended by 17 (seventeen) workers of PT Sucofindo Pekanbaru Branch. The conclusion is that this community service activity has been successful. From the questionnaires given before the activity started, only 43.5% of participants were able to answer correctly. Meanwhile, after the activity was completed, 84.7% of participants managed to answer correctly.

Abstract

One of the goals of the establishment of Indonesia as a country is to improve the welfare of the people. The Covid-19 pandemic that has hit Indonesia since March 2020 has greatly affected the condition of the national economy, including in Pekanbaru City. The method used in this research is sociological law research. The strategy that can be applied by MSME actors in Pekanbaru City to survive during the Covid-19 pandemic is to make creative innovations that do not violate government policies. Law Number 20 of 2008 concerning Micro, Small and Medium Enterprises stipulates that the government is obliged to empower MSMEs in order to maintain national economic stability. Law Number 20 of 2008 concerning Micro, Small and Medium Enterprises stipulates that the forms of empowering MSMEs that must be carried out by the government include funding assistance, improving facilities and infrastructure, information on business opportunities, partnership programs, facilitating business licensing, providing business opportunities, conducting trade promotion activities, as well as institutional support.Keywords: MSMEs, Empowerment, Covid-19 Pandemic

Abstract

Islamic banks are banks that carry outtheir business activities based ons hari a principles. At thet ime of theeconomic crisis in 1998, many conventional banks had collaps edwhile Islamic banks were not affected. After thecrisis, Islamic banking experienced significant developments in Indonesia. What is the strategy in the management of Islamic banks in Indonesia basedon Law Number 21 of 2008? The methodused in this study isnormative legal researc husing the statutory approach. The results of this study explain that from 2008 to 2018 there were no Islamic banks that experienced legal problems, while conventional banks existed, namely Century Bank and IFI Bank. Based on Article 34 of Act Number 21 of 2008 it is affirmed that Islamic banks mustimplement good governance that coverstheprinciples of transparency, accountability, accountability, professionalism and fairness in carrying out their business activities. So, thestrategy in managing Islamic banks in Indonesia applies the principles of good corporate governance.

Abstract

This research aims to explain the direction of policy regarding supervision of Islamic banking in the banking system in Indonesia. The method used in this research is normative legal research using the statutory approach. The results of this research explain that the policy regarding supervision of Islamic banking in the national banking system in Indonesia is headed toward an independent direction. In Law Number 7 of 1992 and Law Number 10 of 1998, it is stated that supervision of Islamic banking is done by Bank Indonesia as the central bank. Based on Law Number 21 of 2008, supervision of Islamic banking is strengthened by not only being supervised by Bank Indonesia, but also by the National Sharia Council of the Majelis Ulama Indonesia by placing Sharia Supervisory Councils in each Islamic bank. After the ratification of Law Number 21 of 2011, supervision of Islamic banking moved from Bank Indonesia to an independent institution called the Financial Services Authority.

Abstract

AbstractTrade secret is information that is not known to the public in the field of technology and / or business, has economic value because it is useful in business activities, and is kept confidential by the owner of a trade secret. The problem is how is the legal protection of regional food products in the Pekanbaru City based on Law Number 30 of 2000 about Trade Secrets? What are the obstacles in legal protection for regional food products in Pekanbaru City? The method used in this research is socio-legal research. The results of this research indicate that the typical regional food products and their variations in Pekanbaru City are protected as a trade secret based on Law Number 30 of 2000 about Trade Secrets because they are confidential, have economic value, and are kept confidential. If there is a violation of the trade secret, then there are strict criminal sanctions in Law Number 30 of 2000 about Trade Secrets. Constraints in legal protection against trade secrets in the Pekanbaru City, namely there are no regional regulations specifically made to regulate and protect regional specialties, businesses do not know and understand the law regarding trade secrets, and regional specialties are the cultural heritage of the people taught hereditary and inherited from generation to generation without registered rights. Keywords: Typical Foods, Trade Secrets, Legal Protection AbstrakRahasia dagang adalah informasi yang tidak diketahui oleh umum di bidang teknologi dan/atau bisnis, mempunyai nilai ekonomi karena berguna dalam kegiatan usaha, dan dijaga kerahasiaannya oleh pemilik rahasia dagang. Permasalahannya yaitu bagaimana perlindungan hukum terhadap produk makanan khas daerah di Kota Pekanbaru berdasarkan Undang-Undang Nomor 30 Tahun 2000 tentang Rahasia Dagang? Bagaimana hambatan-hambatan dalam perlindungan hukum terhadap produk makanan khas daerah di Kota Pekanbaru? Metode yang digunakan dalam penelitian ini adalah penelitian hukum sosiologis. Hasil dari penelitian ini menunjukkan bahwa produk-produk makanan khas daerah maupun variasinya yang ada di Kota Pekanbaru dilindungi sebagai sebuah rahasia dagang berdasarkan Undang-Undang Nomor 30 Tahun 2000 tentang Rahasia Dagang karena bersifat rahasia, mempunyai nilai ekonomi, dan dijaga kerahasiaannya. Apabila terjadi pelanggaran terhadap rahasia dagang tersebut, maka ada sanksi pidana yang tegas dalam Undang-Undang Nomor 30 Tahun 2000 tentang Rahasia Dagang. Hambatan-hambatan dalam perlindungan hukum terhadap rahasia dagang di Kota Pekanbaru yaitu tidak ada peraturan daerah yang dibuat secara khusus untuk mengatur dan melindungi makanan khas daerah, pelaku usaha tidak mengetahui dan memahami hukum mengenai rahasia dagang, serta makanan khas daerah merupakan warisan kebudayaan masyarakat yang diajarkan secara turun-temurun dan diwariskan dari generasi ke generasi tanpa didaftarkan haknya. Kata Kunci: Makanan Khas Daerah, Rahasia Dagang, Perlindungan Hukum

Abstract

Regulation of the Minister of Education, Culture, Research, and Technology Number 30 of 2021 concerning the Prevention and Handling of Sexual Violence in Higher Education Environments raises pros and cons. The method used in this research is normative legal research. The forms of sexual violence that have become controversial in society are showing the genitals on purpose without the victim's consent; taking, recording, and/or distributing photos and/or audio and/or visual recordings of victims with sexual nuances without the victim's consent; upload a photo of the victim's body and/or personal information that is sexually nuanced without the victim's consent; disseminating information related to the victim's body and/or personal sexual nature without the victim's consent; touching, rubbing, touching, holding, hugging, kissing, and/or rubbing body parts on the victim's body without the victim's consent; and undressing the victim without the victim's consent. If there is an agreement or it is carried out on a consensual basis, then sexual acts within the university environment do not violate the Regulation of the Minister of Education, Culture, Research, and Technology Number 30 of 2021 concerning the Prevention and Handling of Sexual Violence in Higher Education. Prevention and handling of sexual violence in universities should be carried out with the principles of best interest for victims, justice and gender equality, equality of rights and accessibility for persons with disabilities, accountability, independence, prudence, consistency, and guarantee of non-repetition.Keywords: College, Sexual Violence, Regulation AbstrakPeraturan Menteri Pendidikan, Kebudayaan, Riset, dan Teknologi Nomor 30 Tahun 2021 tentang Pencegahan dan Penanganan Kekerasan Seksual di Lingkungan Perguruan Tinggi menimbulkan pro dan kontra. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Bentuk-bentuk kekerasan seksual yang menjadi kontroversi di masyarakat yaitu memperlihatkan alat kelamin dengan sengaja tanpa persetujuan korban; mengambil, merekam, dan/atau mengedarkan foto dan/atau rekaman audio dan/atau visual korban yang bernuansa seksual tanpa persetujuan korban; mengunggah foto tubuh dan/atau informasi pribadi korban yang bernuansa seksual tanpa persetujuan korban; menyebarkan informasi terkait tubuh dan/atau pribadi korban yang bernuansa seksual tanpa persetujuan korban; menyentuh, mengusap, meraba, memegang, memeluk, mencium, dan/atau menggosokkan bagian tubuh pada tubuh korban tanpa persetujuan korban; serta membuka pakaian korban tanpa persetujuan korban. Apabila ada persetujuan atau dilakukan atas dasar suka sama suka, maka perbuatan seksual di lingkungan perguruan tinggi tidak melanggar Peraturan Menteri Pendidikan, Kebudayaan, Riset, dan Teknologi Nomor 30 Tahun 2021 tentang Pencegahan dan Penanganan Kekerasan Seksual di Lingkungan Perguruan Tinggi. Pencegahan dan penanganan kekerasan seksual di lingkungan perguruan tinggi seharusnya dilaksanakan dengan prinsip kepentingan terbaik bagi korban, keadilan dan kesetaraan gender, kesetaraan hak dan aksesibilitas bagi penyandang disabilitas, akuntabilitas, independen, kehati-hatian, konsisten, serta jaminan ketidakberulangan.Kata kunci: Perguruan Tinggi, Kekerasan Seksual, Peraturan

Abstract

This study aims to decide on the Impact Testing of Corporate Social Responsibility on the Execution of Monetary Organization Recorded in Exchange Effect Indonesia. Studies use quantitative spellbinding methodology, hoping to break the relationship between at least two factors. The number of residents in this study is organizations listed on the Indonesia Stock Exchange year 2018-22020, that is as much 30 organizations. For Example study, this is 30 organizations multiplied for 3 years with the aim of the sample in this study being 90 information. Procedure The investigation used is an examination of the recurrence of information boards. Reasonability test with use test t factual directed on a number of matter for test influence Among Variable Dependent and dependent variable with the assumption that different factors are seen as fixed. Judging from the consequences of the t-test presented in table 4.9 above, Corporate Social Responsibility (X) has a t count of 2.566144 with an importance level of 0.0120. This shows that t count is more prominent than t table (2.56144 > 1.662) with an importance value (0.0120 <0.05). So it can be concluded that Corporate Social Responsibility (X) has a significant effect on the Execution of Monetary (Y). Viewed from consequence testing coefficient certainty, is known that the change in R2 factor free in review is 0.559048 or 55.9%. This implies that 55.9% of Execution Monetary (Y) influenced and could understand by Variable dependent in this review, specifically Corporate Social Responsibility (X). While another 44.1% made sense by various factors in outside regression models.

Abstract

AbstrakPenelitian ini bertujuan untuk menjelaskan pengaturan dan pemanfaatan Corporate Social Responsibility terhadap pembangunan perekonomian desa di Provinsi Riau, serta sanksi hukumnya, menurut Peraturan Daerah Provinsi Riau Nomor 6 Tahun 2012. Penelitian ini bersifat deskriptif dengan jenis yuridis normatif melalui pendekatan perundang-undangan dengan metode analisis kualitatif. Perusahaan-perusahaan besar yang beroperasi di Provinsi Riau wajib melaksanakan program Corporate Social Responsibility untuk membangun desa. Terhadap perusahaan yang tidak melaksanakan Corporate Social Responsibility di Provinsi Riau, maka perusahaan tersebut dapat dikenakan sanksi berupa peringatan tertulis, pembatasan kegiatan usaha perusahaan, pembekuan izin usaha perusahaan, dan pencabutan izin usaha perusahaan.Kata Kunci: Corporate Social Responsibility; Pembangunan Desa; Sanksi Hukum.AbstractThis research aims to explain the arrangement and use of Corporate Social Responsibility for rural economic development in Riau Province, as well as legal sanctions according to Riau Province Regional Regulation No. 6 of 2012. This research is descriptive in nature with normative juridical type through the legislation approach with qualitative analysis methods. Large companies operating in Riau Province are required to implement a Corporate Social Responsibility program to develop villages. For companies that do not carry out Corporate Social Responsibility in Riau Province, these companies may be subject to sanctions in the form of written warnings, restrictions on company business activities, suspension of company business licenses, and revocation of company business licenses.Keywords: Corporate Social Responsibility; Legal Sanctions; Village Development.

Abstract

Islamic bank is a bank that runs its business activities based on sharia principles. At the time of the economic crisis of 1998, many conventional banks collapse while Islamic banks are not affected. After the crisis, Islamic banking experienced significant growth in Indonesia. The problem discussed in this research is how is the history and development of regulation on Islamic banking in national legal system in Indonesia? The method used in this research is normative legal research by using approach of legislation. Sources of data used in this research are secondary data, namely data obtained from legislation, scientific journals, and legal literature. Data collection techniques used in this research is literature study. Data analysis technique used in this research is qualitative analysis. The result of this research is that the initiative on establishment of Islamic bank in Indonesia was started since 1990 by the Indonesian Council of Ulama, which was realized with the establishment of Bank Muamalat Indonesia on November 1, 1991. The early development of Islamic banking in the national banking system was responded quickly by the government with the enactment of Act Number 7 of 1992 about Banking, which was later amended by Law Number 10 of 1998. In addition to being a devastation to the national banking system, the economic crisis that occurred in 1998 also became the starting point for the development of Islamic banking in Indonesia. Some conventional banks began to expand their business by establishing Islamic banks. Responding to the development of significant Islamic banking in the national banking system, on July 16, 2008 was enacted Law Number 21 of 2008 about Islamic Banking as the legal basis for Islamic banks in Indonesia.
