Abstract

Perkawinan merupakan suatu hal yang penting dalam kehidupan manusia, dari perkawinan tersebut seseorang akan dapat memperoleh keseimbangan baik secara biologis, psikologis, maupun sosial. Menurut Undang-Undang Nomor 1 Tahun 1974, yang dimaksud dengan ikatan jasmani dan rohani antara seorang pria dan seorang wanita sebagai suami istri untuk membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Lahirnya Undang-Undang Nomor 16 Tahun 2019 tentang perubahan atas Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan yang mengatur bahwa usia perkawinan bagi laki-laki dan perempuan adalah 19 tahun tentunya akan menambah jumlah permohonan dispensasi perkawinan di bawah umur di Pengadilan Agama. . Tulisan ini dibuat dalam bentuk tulisan yuridis empiris (hukum sebagai realitas sosial, budaya, atau das sein). Dari hasil penelitian penulis, faktor pendorong untuk mengajukan dispensasi nikah antara lain pertama, faktor ekonomi, kedua, faktor pendidikan orang tua, ketiga, hubungan biologis, dan keempat, kehamilan di luar nikah. Pengadilan Agama Klas IB Tanjung Pati telah mengimplementasikan Undang-Undang Nomor 16 Tahun 2019. Berlakunya undang-undang tersebut ibarat pisau bermata dua, di satu sisi undang-undang menginginkan pendidikan yang layak bagi anak, dan di sisi lain menyangkut kebutuhan komunitas.

Abstract

In essence, social media gave birth to new concerns, including the emergence of the development of the spread of pornography with pornographic sites in sharing various types of site views which are very tempting and have a major influence on the nation's morals and personality which will have a negative impact on Indonesia so that it threatens life and social order. Indonesian society. The development of pornography in society has also resulted in an increase in immoral acts. Related to the Internet and communication tools, of course very closely related to Cybercrime (Crime in cyberspace). According to the Organization of European Community Development (OECD) Cybercrime is all forms of illegal access to a data transmission. That is, all types of illegal activity in a computer system is a crime. In this thesis entitled "Criminological Analysis of the Spread of LGBT Pornographic Content in Cyberspace (Study of Court Decisions Number: 343/Pid.Sus/2020/PN.Pbr)".)" discusses the problem, namely: What are the factors that cause the spread of LGBT pornographic content in cyberspace and what is the modus operandi of perpetrators in spreading LGBT pornographic content in cyberspace. The method used to answer the problems mentioned above. In terms of the type of data studied, this study uses two types of research, namely normative juridical research that is analytically descriptive by reviewing court decisions and analyzing them. The results of the research namely; the factors that led to the spread of LGBT pornographic content in cyberspace were technological sophistication, sexual needs, lack of attention in the field of religion, and weak attention from the government. The perpetrator's modus operandi in spreading LGBT pornographic content is none other than because the perpetrator wants to vent his sexual desires and inform social media that he is gay.

Abstract

Indonesia is a country that has ethnic and cultural diversity, this becomes an advantage as well as a weakness if the government is not able to develop rules and policies that represent the needs of its citizens.This can be seen in the system of inheritance distribution in Indonesia which adheres to three systems of inheritance law, namely Customary Inheritance Law, Islamic Inheritance Law and Indonesian Civil Inheritance Law. The legal system of heirs is influenced by the kinship system owned by a region. Indonesia knows 3 (three) kinship systems, namely matrilineal, patrilineal and parental kinship systems. The matrilineal kinship system sees the maternal lineage, the patrilineal kinship system sees the paternal lineage, and the parental kinship system sees the maternal and maternal lineage. The Minangkabau are a growing tribe in West Sumatra Province, where the people adopt a matrilineal kinship system, a kinship system and the Inheritance is inherited according to the lineage of the Mother. This means that boys and girls and their families, including racism mother, who inherited the property. Basic on decision No 292 / K / Ag / 2019 that the origin of the land on the decision proved to be the executor of Appeal, but still devolved court Religion. This is contrary to the West Sumatra Regional Regulation No. 16 of 2008 Article 12 paragraph 2 on Ulayat Land and its Use, if the peace decision is not accepted by the disputing party as referred to in paragraph 1 then the disputing parties may take the matter to the District Court. It is clear that the regulation states that the Religious Court does not have the authority to examine and adjudicate matters a quo. Inheritance of High Estate in Minangkabau is only regulated in the provisions of customary law which sometimes when there is a dispute over the division of heirs of High Estate, often overrides the provisions of customary law in resolving disputes so that in its application some rules even make the essentials of High Estate reduced or even lost.

Abstract

Waqf is known as an asset of the people that can be utilized at all times. However, the productive management and development of waqf assets for social welfare has yet to be realized optimally. The enactment of Law No. 41 of 2004 concerning waqf has become a momentum to realize waqf productively. The waqf foundation Ar-Risalah and Persyarikatan Muhammadiyah which acts as nazhir waqf has the duty and responsibility to manage and develop waqf assets from wakif to productive ones. The research method used in this study uses empirical juridical research method. Based on research that productive waqf management implemented by the Ar-Risalah waqf foundation is by empowering plantations such as oil palm, banana and coconut plantations as well as renting shops, mini markets and renting waqf houses. Whereas the management of productive waqf by the Muhamadiyah Association is in the form of increasing the value of waqf assets by utilizing the functions of buildings such as the Muhammadiyah Taqwa Mosque and Muhamadiyah Dakwah Building which stand on waqf land to be developed into rental shops as a place to sell and use excess land to gain profits from renting parking spaces. The efforts of the Ar-Risalah Wakaf Foundation in developing waqf assets to become productive waqf for social welfare by managing waqf assets to be used as a source of income, one of which is by investing in the development of waqf land. Meanwhile, the efforts of Persyarikatan Muhamadiyah to form a cash waqf body as a form of management and development in a productive direction. The form of increasing social welfare carried out by nazhir waqf is by carrying out social empowerment, such as providing a place of business to be used as a place to open a business by the local community.

Abstract

A mixed marriage will bring legal consequences to the parties who do it, namely related to property in the marriage. The joint assets formed during the marriage are not only located in the territory of Indonesia, but also located abroad (Singapore). This study examines the position of joint assets in mixed marriages located outside the territory of Indonesia who filed for divorce and property claims in the District Court. The purpose of this article, which is based on the results of this research, aims to determine legal certainty regarding the status of joint property in mixed marriages located abroad (Singapore) based on Decision No. 552 / Pdt.G/2013/PN.Dps) by Judge. The research method used in this study is a normative legal research method with a source of law, namely statutory regulations. The research method used is a normative juridical approach. Research specifications use analytical descriptive and data sources use secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. Materials from the results of this study indicate that joint assets located abroad (Singapore) are subject to the Indonesian Judge's decision. In the eligibility conditions in the Strata Title rules that apply in Singapore, the holder of a Permanent Resident permit has the right to transfer or sell property located in that country.

Abstract

This study aims to analyze the settlement of divorce disputes in religious courts after the implementation of the Circular Letter of the Supreme Court of the Republic of Indonesia Number 1 of 2022 concerning the Implementation of the Formulation of the Results of the Plenary Meeting of the Supreme Court Chamber in 2022 as Guidelines for the Implementation of Tasks for the Courts dated December 15, 2022. The method used for this research is a normative legal research method that refers to literature research and laws, then data collection and analysis are carried out after which conclusions are drawn using the deductive method of thought. The results showed that, the issuance of the Formulation of the Religious Chamber number 1 letter b point 2) Circular Letter Number 1 of 2022 which stipulates that in an effort to maintain a marriage and fulfill the principle of making divorce difficult, divorce cases on the grounds of continuous disputes and quarrels can be granted if it is proven that the husband / wife is in continuous dispute and quarrel, or has separated the place of residence for at least 6 (six) months does not just appear but goes through a long process. The Supreme Court through the formulation of the Religious Chamber Meeting in Supreme Court Circular Letter 4 of 2014 also provides a number of indicators as a clue to the condition of a broken marriage. This is then refined in Supreme Court Circular Letter 3 of 2018 which provides instructions to judges to consider sufficiently and thoroughly in adjudicating divorce cases. The formulation of the Religious Chamber Meeting in Supreme Court Circular Letter 1 of 2022 emphasizes the provisions of Article 39 paragraph (2) of Law Number 1 of 1974 concerning Marriage which makes it easier for judges to explore the root causes of divorce filed by husband or wife to minimize the reasons for divorce of continuous disputes and quarrels.

Abstract

Society and banks are two components that need each other. Banks run businesses to make a profit. Like conventional banks which earn profits through interest on loans from debtors. Banks provide loans, but must also guarantee the repayment of the capital lent to debtors by binding the loan with mortgage rights. When the debtor is unable to pay the debt and is declared in default, the bank as the winner of the mortgage right has the right to sell the collateral with the mortgage right, submitting an auction request to the KPKNL. The auction winner is the bidder with the highest price. Auction winners often have difficulty controlling the auction object, because the debtor does not accept the auction results and makes various efforts to maintain the collateral, one of which is by filing an unlawful act lawsuit with the district court. The problem in this thesis is: What is the legal certainty of the transfer of ownership of mortgage objects through auction? What is the legal protection for the winner of the auction for the execution of mortgage rights filed as a party in a lawsuit against the law in terms of the Consumer Protection Law? What are the efforts of the auction winner in dealing with the plaintiff as debtor? The method used in this research is Sociological Juridical, the type of data collected is secondary and primary data, the data collection method is interviews and the nature of the research is descriptive. The research results obtained. 1) The transfer of rights through an auction occurs when the auction minutes are published which function as the basis for rights, but the transfer of rights only occurs on paper, because the auction winner cannot control the object. 2) The Consumer Protection Law guarantees that consumers get their rights, but what happens is that business actors often transfer or even eliminate responsibilities by having standard agreements which are actually prohibited by law. 3) The winner of the auction as a consumer, in facing the debtor's demands, tries to defend his rights, the losses arising from the demands from the debtor are the burden of the consumer himself, the business actor, in this case the bank, is not responsible for the losses suffered by the consumer, under the pretext of the object of the auction what has been purchased by the consumer, namely the auction winner, is at a low price, so that the loss becomes the burden of the auction winner.
