Abstract

This paper aims to describe Takhrij as a medium for understanding the general rules established by imams that are built on the fiqh fiqh by induction and analyzing specific problems (furu 'fiqhiyah), this is what the takhrij ushul means for furu'.Takhrij also means to resolve differences furu 'fiqhiyah with the ushuliyah rules originating from the imams. It is expected to find a law that does not have the proposition shara 'by returning it to the rules and ushul. With a literature study and comparative approach to descriptive analysis, it is found that fiqh takhrij is also used to recognize the law that comes from a priest in a problem that has no text. Its can be made by comparing it with the same furu 'problem with the texts (qiyas), or comparing it with the understanding of Imam's texts or its generality. This is the furu takrij 'on furu'. Takhrij fiqh can be applied to contemporary problems such as loading and unloading insurance, inflation, copyright, furu 'and Syariah laws' in contemporary matters. The development of takhrij fiqh is dependent on the interaction of theory and practice in the existing field to produce solutions to contemporary problems.

Abstract

This study aims to find out about the implementation of the aqiqah in the Maulid Nabi in Nagari Padang Laweh in terms of tradition. Aqiqah is an expression of gratitude for the birth of a child, which is basically the seventh or fourteenth day of birth or the twenty-first day. However, this did not happen to the Nagari Padang Laweh, the implementation of the aqiqah was held to coincide with the celebration of the Prophet's Birthday in the month Rabiul Awwal determined by custom. This ritual has been carried out from generation to generation and is still ongoing today. The implementation of the aqiqah will be reviewed from the ‘urf prevailing in the Islamic tradition. The research method used is qualitative with a case study approach. The primary data of this study were obtained through interviews with thirteen informants. After the data is collected, it is classified based on existing themes, then coded and analyzed with valid theory, and ‘urf so that conclusions can be drawn. The case study in this research relates to the implementation of the aqiqah along with the celebration of the Bulan Maulid. The results of the study show that the implementation of the aqiqah which coincides with the Bulan Maulid will provide relief to parents who participate in giving away their children. This is in line with Islamic law, and has proven to contain a lot problem. The conclusion from this research is that the implementation of the aqiqah includes urf shahih and local wisdom that needs to be preserved.

Abstract

This research was motivated by the large number of reports from tourists regarding the rampant acts of extortion and disrespectful attitudes carried out by local residents who work as parking attendants, traders, and so on. This became increasingly serious when this discomfort surfaced on social media and went viral, resulting in tourists thinking twice about visiting Carocok Beach in Pesisir Selatan Regency, West Sumatra Province. If this is not addressed seriously, the impact will be felt by the regional government, local communities and traders, of course. However, efforts have been made to create comfort for tourists visiting Carokok Beach. This research uses qualitative methods accompanied by direct observations and interviews with parties who are considered capable of answering the problems in this paper. The results of this research show that: first, local people always try to be friendly towards tourists who visit Carocok Pesisir Selatan Beach, second, local people and local youth organizations investigate parties who commit extortion against tourists, third, local people maintain cleanliness tourist environment, fourth, do not increase car and motorbike parking fees arbitrarily, fifth, urge traders to be polite to tourists who shop, sixth, do not increase merchandise prices beyond the limit, seventh, ensure security for tourists by preparing security forces both from the Government and from the local community.
