Abstract

The main objectives of a person to invest are to become wealthier and to gain tranquility in his life. It becomes absurd when the right customers for indemnity (kafalah) towards customers who received a risk become unguaranteed. The customer is often difficult to understand the terms contained in the insurance policy that written in a very small font. The ambiguities of these terms become significant obstacles in the settlement of claims. Cases of claim are mostly the result of the customers difficulty in understanding these terms and the lack of a good explanation of the company concerning the content of the policy.DOI: 10.15408/aiq.v5i1.2114

Abstract

Free trade and foreign investment that characterize the 21st Century trade and business model do not benefit all parties, particularly Islamic countries. Only those who have well-established economic system and large capital gain the most benefit. This condition had occurred during the Ottoman Khalifah. Therefore, this article aims to prove that free trade and foreign investment during the Ottoman, in the form of capitulation, brought negative impact on the Ottoman’s economy and politics. Capitulation is an agreement between the Ottoman and Western European countries that regulated economic and legal sectors by giving privilege to the European countries to come and trade in the Ottoman. The Ottoman became a free market place that eliminated the Islamic economic system. The Ottoman saw the agreement as its Siyasah Syar’iyah Al-Maliyah to protect the political sovereignty when facing European countries. Once the agreement benefited the Ottoman, later it caused economic political problems. The domestic industries faced difficulty when competing with foreign trades. The Ottoman government did not have full authority over the law and justice of the Europeans in the Ottoman. The capitulation that was expected by the Ottoman to protect its economy and politics had put the country under the domination of Western Europe. What happened to the Ottoman is proof that the free market is only beneficial to developed countries with active industries. Therefore, this historical fact should be reference for Islamic countries in conducting their foreign economic system.

Abstract

Basically, a Muslim does not leave the Muslim community, but with the development of Islam many problems occur. The departure of the Prophet Yusuf from the Muslim community has been described in the Qur'an. He served various maturity processes under the guidance of Allah al-Mighty. The figure of the Prophet Yusuf has been depicted and immortalized as a shadow ruler who officially served as minister of finance, agriculture and head of the logistics affairs agency. The question arises whether a Muslim can become a non-Muslim leader who will later be neglected and will have a negative impact on the faith and syari'ah carried out by Muslim leaders who control non-Muslim governments. With literature study and content analysis approach, the writer describes the literature qualitatively about the status of Muslims who are in the midst of non-Muslims and vice versa, to dismiss the opinion of good kafirs who are more worthy of being leaders than evil and corrupt Muslims. A Muslim can become a leader in the midst of non-Muslims for the benefit and preaching of Islam as was done by the Prophet Yusuf A.S, who proved himself clean after leaving prison. The criteria for a leader in Islam are flexible enough that sometimes a Muslim who is not consistent with sharia rules can sometimes bring great benefits to Muslims. Not only that, many Muslim leaders who were very instrumental in protecting Muslims and spreading Islam in Russia such as Berke Khan have deployed infidel armies to protect Muslims from destruction.Pada dasarnya seorang muslim tidak meninggalkan komunitas muslimnya, akan tetapi seiring perkembangan islam banyak masalah yang muncul. Hengkangnya Nabi Yusuf dari komunitas Muslim telah dijelaskan dalam Alquran.  Dia menjalani berbagai proses pendewasaan di bawah bimbingan Allah swt. Sosok Nabi Yusuf telah digambarkan dan diabadikan sebagai penguasa bayangan yang resmi menjabat sebagai menteri keuangan, pertanian, dan kepala badan logistik.  Timbul pertanyaan apakah seorang Muslim bisa menjadi pemimpin non-Muslim yang nantinya akan terabaikan dan berdampak negatif pada keimanan dan syari'at yang diemban oleh tokoh Muslim yang menguasai pemerintahan non-Muslim.  Dengan pendekatan studi pustaka dan analisis isi, penulis mendeskripsikan literatur secara kualitatif tentang status umat Islam yang berada di tengah-tengah non-Muslim dan sebaliknya, untuk menepis pendapat seorang kafir yang baik lebih layak menjadi pemimpin daripada seorang Muslim yang jahat dan korup.  Seorang Muslim bisa menjadi pemimpin di tengah-tengah non-Muslim untuk kemaslahatan dan dakwah Islam seperti yang dilakukan oleh Nabi Yusuf A.S yang membuktikan dirinya bersih setelah keluar dari penjara. Kriteria seorang pemimpin dalam Islam cukup fleksibel sehingga terkadang seorang Muslim yang tidak konsisten dengan aturan syariah dapat membawa manfaat yang besar bagi umat Islam. Tidak hanya itu, banyak pemimpin Muslim yang sangat berjasa dalam melindungi umat Islam dan menyebarkan Islam di Rusia seperti Berke Khan yang telah mengerahkan pasukan kafir untuk melindungi umat Islam dari kehancuran.

Abstract

This paper aimed to reveal the government administration system's distinction in finance and justice that existed in the Umayyad. The Umayyad had the right side in improving government administration, finance, economy, and justice. To what extent was the reform and distinction of government administration, finance, and judiciary pursued by the Umayyad that led to society's benefit besides the atrocities he had ever made? The researchers conducted a library study with a descriptive analysis approach, collected sources, verified, and interpreted the policies and updates made by the Umayyad. The study showed the Umayyad had made distinctions and reforms that brought about a lot of benefits. Although they seemed the duplication of Persian and Roman governments, financial administration policies still referred to Islamic rules and were not influenced by Rome and Persia. The most significant reform was establishing the Mazalim Court separated from the ordinary judiciary. The perpetrators of this crime were not ordinary people but state officials handled directly by the caliph and judges who could act reasonably and act decisively. A vast area of neat administration supported the economic activity, and along with Islamic law, the Umayyad did not exercise a monopoly. However, this government lasted shortly for 90 years (661-750 AD) because of the power succession policy, the ruler's lifestyle, fanaticism, and political opponents' attack.

Abstract

Writing this article aims to explain the development of Islamic da'wah in the Maldives Islands, which is unique and rarely found in other Muslim regions. So far, the Maldives is only known as a tourist spot. It is rarely known that all of the Maldives adhere to Islam. The British have also ruled the Maldives for 78 years, influencing the Maldives to some extent. What is the form of da'wah carried out by Abu al-Barakat, whose origins are still debated by historians? But what is clear is that he had a significant influence on the spread of Islam in the Maldives Islands, which is corroborated by classical sources such as the text attributed to Ibn Battuta and several contemporary books. We conducted a literature study on this paper, with a historical approach, by collecting data, verifying and analyzing the data thoroughly, and rewriting the results of the analysis inductively in a qualitative descriptive form. Islam spread in the Maldives peacefully without violence and continues to survive from Christian missionaries and Shiite sects who come to spread their views. Scholars say about the fiqh theory that faith in conscience will not be changed by the sins and heresies it commits.

Abstract

Islam is a moderate religion that is very close to the dignity of women which is very different from the two religions of its predecessors. In both religions women are considered as a burden in life and very detrimental, women's rights are morally and materially ignored. Like ownership of property, the right to issue testimony, identity is assigned to the husband not to his father. Even as far back as 1956 and perhaps up to now in France and Germany full of women's freedom must obtain the husband's permission to conduct transactions, such as buying and selling, grants from his own property. With library studies and comparative approaches and qualitative methods the author reveals whether Jews and Christians have similarities in their treatment of women in theory and is there a difference between the two religions? Do Islam, Judaism and Christianity in theory give equal treatment to women? Let a Muslim know that there is a gap between the teachings of Islam and the behavior of some Muslims today that are no longer in accordance with Islamic norms. Such behavior does not originate from Islam as a moderate religion.Keywords: Islamic Moderation, In Gender, Comparison, Judaism and Christian.

Abstract

This article aims to explain the importance of the steps that Islamic banks must take to stay away from usury to increase Muslim confidence in Islamic banking, which has been stretched all this time to revive the Muslim economy. Riba can cause prolonged inflation and even make the country's economy collapse slowly. However, there are still many usury practices carried out by Islamic banks due to several factors, such as central bank regulations and managers who do not yet understand the rules of Islamic law. This discussion is carried out through a literature study and a descriptive analysis approach through documents and journals that discuss Islamic banking. We interpret the results obtained: Islamic banking is still involved in Mu'amalah Riba, which is more than an extension of conventional banks that sell their products. However, there is still an event to get away from usury by implementing the rules of Islamic Shari'ah thoroughly by developing the proper investment methods. Islamic banks may perform Mudharabah (profit sharing), Musyarakah, Murabahah, Ijarah, and Muzara'ah by paying attention to the distribution of profits and losses by Islamic law. Let these trading and investment instruments be carried out in real terms with full responsibility.

Abstract

Research aims: Risk management in financial institutions struggles with setting suitable capital charges for operational losses, resulting in large, disproportionate reserves that impact profits. This study, therefore, aims to develop a tailored operational risk measurement model for general takaful companies, addressing this challenge and optimizing capital allocation.Design/Methodology/Approach: This study employed a hybrid approach, merging the loss distribution approach (LDA) with historical data and scenario analysis for insurance company loss events. Compiling data into distributions, it utilized Monte Carlo simulations to determine value at risk (VaR). The resulting VaR guided the calculation of operational risk capital charges for future periods.Research findings: Measurement using the hybrid method could produce more adequate operational risk capital charges. These results confirm the acceptability of the VaR calculation and have been validated by the Kupic test.Theoretical contribution/Originality: This research offers a more comprehensive alternative method of measuring operational risk by combining historical company data with expert opinions, making it more likely to be practiced in the industry.Practitioner/Policy implication: The results of this study put forward an alternative, more suitable model for industry and regulators to measure operational risk management in general takaful companies.

Abstract

The Indonesian Islamic capital market has experienced significant growth over the past decade, both in terms of the number of Islamic stocks, market capitalisation, and increased investor participation. However, its contribution to the total national capital market remains limited. This study aims to comprehensively examine the dynamics of the development of Indonesia's Islamic capital market from 2014 to 2024 through a SWOT analysis approach and the principles of Islamic maqāṣid. The methodology used is a descriptive-qualitative approach based on literature review and secondary data analysis from the OJK, IDX, and relevant empirical sources. The findings indicate that the Islamic capital market has strengths in terms of ethical values and Islamic compliance, but faces structural challenges such as low literacy and liquidity. Strategic opportunities arise from the integration of Islamic fintech, the development of ESG products, and synergy with the national halal economy. This study contributes to the development of maqāṣid-based policies that not only pursue profitability but also ensure sustainability and socio-economic justice.

Abstract

This article explored the integration of Islamic economics into the economic life of the Minangkabau people, examined through historical and contemporary perspectives. Using a qualitative approach based on literature study and in-depth interviews, the research investigated how Islamic principles—such as justice, distributive equity, and sharia-compliant resource management—are embedded within Minangkabau socio-economic traditions. Historically, since the era of the Minangkabau Sultanate, Islamic values were institutionalized through customary systems and cooperation mechanisms that regulated economic relations and social solidarity. In the modern context, the dynamics of globalization have introduced Islamic financial institutions, sharia-based enterprises, and structured zakat and waqf management, which coexist with enduring indigenous practices. The findings indicated that despite challenges from conventional economic systems, the synergy between Islamic values and local traditions continues to support community empowerment, inclusive finance, and cultural resilience. This study contributed to Islamic institutional economics and indigenous economic thought by identifying three dimensions of integration: normative, institutional, and practical. These dimensions produce a hybrid model that is adaptive, resilient, and sustainable. Beyond its local relevance, the Minangkabau experience offers insights for Muslim societies worldwide, demonstrating how cultural authenticity and Islamic ethics can be harmonized with modern development to address global economic challenges.
