Abstract

The purpose of this paper explains the increase in honorary or contract personnel to support the performance of civil servants, especially in the context of public services in local governments. Public services are closely related to the community, and contract labor plays an important role in realizing maximum service. The focus of this research is on the implementation of employment contracts and legal protection for health workers at the Palembang City Health Office. This research uses normative research methods with a focus on regulations and written legal materials. Data collection techniques are carried out through documentation, involving data collection through documents related to research problems. The document includes primary, secondary, and tertiary legal materials. Data analysis is carried out in depth and comprehensively with an analytical descriptive approach to answer problems in research. The analysis is carried out by considering the variation of data and the basic nature of the data that is not easily quantified, as well as thorough and holistic. The results showed that the work implementation agreement at the Padang Tuesday Health Center was a form of a certain time work agreement, with valid regulations and conditions based on Article 1320 of the Civil Code. However, the laws and regulations on which the legal basis for the appointment of contract workers do not specifically address the legal rights and protections for contract workers, indicating that there are loopholes that must be addressed.

Abstract

The purpose of this article is to understand and analyze the legal liability of PT. Pos Indonesia (Persero) Sirah Pulau Padang District and Kayuagung City regarding loss of goods of service users. normative legal research, which focuses on the analysis of applicable legal theories and regulations. The research method used is empirical juridical with primary and secondary data sources. The research results showed that there were several cases of lost goods at PT. Pos Indonesia area. PT. Pos Indonesia, based on its internal regulations and policies, has an obligation to provide compensation to service users in the event of loss of goods. However, the compensation claim process often experiences obstacles and often causes customer dissatisfaction. The recommendation from this research is the need to improve the compensation claim mechanism and increase the quality of service so that public trust in PT. Pos Indonesia can be maintained.

Abstract

Berkembangnya pengaturan merger di Indonesia tidak dapat terlepas dari terjadinya krisis keuangan pada tahun 1997 di Indonesia. Banyak perusahaan mengalami kesulitan likuiditas dan finansial yang luar biasa yang menyebabkan kinerja usahanya belum stabil, sehingga perlu dilakukan efisiensi. Salah satu upaya yang dilakukan banyak perseroan terbatas untuk tujuan bisnisnya adalah merger. Berdasarkan telaah yuridis dapat disimpulkan bahwa PPh atas merger dapat dokonstruksikan berdasarkan dilakukan tidaknya revaluasi aktiva tetap dan penghitungan dengan mempergunakan harga pasar atau nilai buku.

Abstract

Lawsuits of Bankruptcy and Postponement of Debt Payment Obligations (Penundaan Kewajiban Pembayaran Utang or PKPU) are still easy weapons for financial institutions against debtors who are in arrears in paying their debts. In fact, a settlement can be made that should not impose further losses on the debtor, who has to sign a contract that benefits the creditor. Based on normative juridical studies, two conclusions are produced. First, the Bankruptcy and PKPU Law, Consumer Protection Law, Otoritas Jasa Keuangan (OJK) Law, P2SK Law, and POJK-7/POJK.05/2022 have not been able to protect debtors in the financing sector in the event of a bankruptcy and PKPU lawsuit. Second, ideally, consumer protection in the event of bankruptcy and PKPU in the financing sector in Indonesia is carried out by making regulations that enable consumers to report injustices they receive to independent consumer protection institutions and commercial courts and dispute resolution institutions between consumers as debtors and creditors. It must implement electronic options to provide certainty of justice and public benefits to the parties, especially consumers. It is recommended that in the future, there be recommendations from independent consumer protection institutions regarding standard contracts for financial institutions as well as commercial courts and online dispute resolution institutions.

Abstract

Bank’s as commercial service providers aim, among others, to generate profits. In terms of providing their services they make agreements with consumers. Therefore the basis of the bank's legal responsibility with customers is contractual responsibility and the legal basis for the customer's lawsuit against the bank is a violation of the agreement or default. A detailed distinction of responsibility is not found in the Consumer Protection Law, as is known from the relatively large number of decisions of the Consumer Dispute Settlement Body throughout Indonesia that were canceled by the Supreme Court for various reasons. In that regard, one of the reasons is that the Consumer Protection Law does not regulate the legal basis for lawsuits other than tort. This research uses a normative method that refers to Law Number 8 Year 1999 on Consumer Protection and principles as the basis for enforcing the law. The conceptual method is used by connecting and interpreting legal principles concerning consumer protection against unlawful acts on the principle of bank responsibility. The results of this research indicate that there is a need for a legal conception of the development of risk-based bank responsibility principles for losses due to standard agreements in opening banking accounts as a form of consumer protection. It is also an embodiment of the Consumer Protection Law which aims to create a balance of protection of consumer interests and business actors as an effort to create a healthy economy.

Abstract

Tulisan ini membahas (a) Pertimbangan hakim pada kasus perjanjian kredit dibawah tangan yang dilakukan pengambilalihan kredit pemilikan rumah, yaitu penjualan rumah KPR di bawah tangan oleh debitur yang belum melunasi hutangnya, merupakan suatu perbuatan melawan hukum karena rumah KPR itu merupakan benda jaminan hutang debitur kepada Bank; (b) Keabsahan jual beli yang bertujuan mengambil alih kredit pemilikan rumah secara di bawah tangan, yaitu adanya kesepakatan yang mengikat antara penjual dan pembeli; dan (c) Akibat hukum bagi pembeli terhadap pengambil alihan kredit pemilikan rumah yang dilakukan secara di bawah tangan dan upaya hukum yang ditempuh untuk mengatasinya, yaitu memiliki perlindungan hukum yang sangat lemah karena jual beli dibawah tangan tidak mengakibatkan terjadi peralihan hak atas tanah. Penelitian ini merekomendasikan: (a) Masyarakat yang ingin melakukan alih debitur atas KPR BTN dapat melakukannya setelah mendapatkan persetujuan dari pihak bank selaku kreditur; (b) Pihak Bank diharapkan memberikan informasi dengan jelasnya mengenai hak dan kewajiban para pihak, baik debitur dan kreditur benar-benar mengetahui di mana posisinya berada dan tidak mengabaikan kewajiban masing-masing; (c) Paralegal sebaiknya lebih diperhatikan lagi perlindungan hukum bagi pihak kreditur (bank dan bagi pihak ketiga dalam masalah oper kredit, hal ini untuk memberikan kepastian hukum pada pihak ketiga yang beritikad baik dalam meneruskan pembayaran kredit dari pihak pertama sampai lunas.

Abstract

The four fundamental patterns of knowledge, consisting of objectivist-idealist jurisprudence, objectivist-realist jurisprudence, subjectivist-realist jurisprudence, and subjectivist-idealist jurisprudence, are formed within the meta-paradigmatic framework proposed by Herman J. Pietersen, are still based on certain Western philosophical ideas. However, the essence of this framework is to answer the fundamental question of "how shall we live," and its meta-paradigmatic analysis is not only based on certain Western philosophies. It is concluded that the development of the various branches of law today does not only adopt these four basic patterns, as they apply very well only to legal branches such as legal naturalism and doctrinal law, legal positivism, legal expressivism, pragmatic legal realism, and CLSM. However, some legal streams related to certain philosophical and paradigmatic streams still need to be characterized by their basic knowledge patterns. Some of these legal streams include legal feminism, which is closely related to feminist philosophy, legal hermeneutics, which is closely related to hermeneutic philosophy, legal post-positivism, which is closely related to post-positivism paradigm, legal constructivism, which is closely related to constructivism paradigm, and the idea of progressive law. It is expected that in the future, there will be in-depth research on both Eastern and Western philosophical streams, which are essentially firmly related to meta-jurisprudence.

Abstract

Sharia economy is a subsystem of the national economic system. As an economic system with distinctive Sharia principles, which is an integral part of the national economic system, it should have regulations that can provide appropriate legal certainty for the community. However, this study highlights several weaknesses related to the regulations governing the resolution of Sharia economic procedural law, including the limitations of Supreme Court Regulation (Perma) Number 14 of 2016 concerning Procedures for the Settlement of Sharia Economic Cases and the pluralistic nature of Sharia economic procedural law sources. The aim of this research is to analyze the weaknesses in the resolution of Sharia economic procedural law, leading to disparities in the pursuit of justice by individuals in Religious Courts. This normative problem demands a reconstruction of Sharia economic procedural law to align it with Sharia principles and the values embodied in Pancasila. Furthermore, this study will compare the Sharia economic procedural law in Malaysia, which adheres to the principle of persons professing the religion of Islam, in the resolution of Sharia economic cases. The legal research method used is normative juridical, thus this research analyzes based on three aspects: philosophical, juridical, and sociological, to identify the urgency of legal reform of Perma Number 14 of 2016 concerning Procedures for the Settlement of Sharia Economic Cases. The findings of this research recommend a judicial review of Perma Number 14 of 2016 to build a Sharia economic procedural law derived from Islamic law and capable of providing legal certainty in all aspects of Sharia economic cases.

Abstract

International e-commerce has created challenges in terms of tax liability, referred to the study by Google-Temasek-Bain revealed that the combination of e-commerce had reached USD40 billion. Based on normative juridical method using new institutionalism theory, two conclusions are generated. First, the prevailing laws in Indonesia do not yet have a lex specialist that regulates tax liability regarding international e-commerce transactions. Second, it is important and urgent to reformulate secondary liability in tax laws that must cover the elements, exclusions, and standards. Reformulation of tax secondary liability of international e-commerce should be extended to overseas and domestic marketplaces, and social media, including general provisions and procedures, billing, mechanisms for warning and terminating access and normalization, as well as tax sanctions (administrative and criminal).

Abstract

Work agreements in a company must comply with company regulations but company regulations come into effect after being ratified by the Minister of Manpower or an appointed official. The formulation of the problem in this study is 1) What are the legal consequences for parties bound in a work agreement that are not in accordance with Company Regulations at PT Banyuasin Nusantara Sejahtera?; and 2) What is the legal settlement if a dispute arises due to a work agreement that is not in accordance with Company Regulations at PT Banyuasin Nusantara Sejahtera? The research method used is normative juridical research method. The data used in this research is secondary data. Based on the results of the study, it shows that 1) The legal consequences for parties bound by a work agreement that are not in accordance with Company Regulations at PT Banyuasin Nusantara Sejahtera are null and void by law and apply according to the provisions stipulated by. Legislation because the contents of the work agreement must not conflict with applicable company regulations and if there are conflicting provisions; and 2) Legal settlement if a dispute occurs due to a work agreement that is not in accordance with Company Regulations at PT Banyuasin Nusantara Sejahtera, namely Mediation, Conciliation and Arbitration
