Abstract

Studi ini bertujuan untuk mengetahui bagaimana peradilan Agama Islam di Iran. Jenis penelitian dalam penulisan ini yang penulis lakukan adalah menggunakan penelitian kualitatif yaitu melakukan metode kepustakaan (library research) dari info yang berasal dari berita, jurnal- jurnal dan buku-buku yang berkaitan dengan tema penelitian. Revolusi Iran tahun 1979 telah mampu merubah wajah Iran yang moderat dan sekuler menjadi sebuah negara yang Islamis. Iran, sebelum revolusi 1979 merupakan negara moderat dan sekuler. Namun demikian, kedekatan masyarakat dengan para ulamanya yang memiliki image yang baik serta rentang sejarah yang cukup lama, sehingga hal ini memudahkan terjadinya transformasi “kesadaran dalam beragama”. Iran mengadopsi sistem hukum yang dipengaruhi oleh hukum Islam (Syariah) dan hukum sipil. Undang-undang dasar negara ini memberikan kekuasaan pada hukum Syariah dalam banyak aspek kehidupan dan terdapat beberapa jenis pengadilan di Iran: Pengadilan Umum, Pengadilan Khusus, Pengadilan Administratif. Abstract

Malaysia is a Muslim-majority country, but it does not apply Islamic law as a whole or use the khilafah al-Islamiyah legal system. The country's legal system is under the control of the federal government, which has ultimate authority in determining the direction and policy of national law. However, jurisdiction over sharia law remains with the sharia judiciary. In the federalism system applied, each region has its own policy in managing its sharia court.This research was conducted using the library research method with a qualitative approach. The data sources used include books, journals, and articles in Indonesian and English. The collected data were analyzed through content analysis method. The results showed that the difference in the authority of the Syariah Court in Malaysia is reflected in the variety of enakmen references used by each state. This is because, in a federal system, state governments have broader authority to manage and regulate legal affairs in their respective regions.

Abstract

This research aims to understand the existence of customary systems in responding to marital disputes that occur in society. In the Minangkabau community, customs are inseparable from daily life. One such place is Jorong Sungai Sanda, where the presence of customs is still very strong. In Sorong Sungai Sanda, the term  mamak limo  is known, which refers to the head of customs. Whenever issues arise in the community, they report them to the  mamak  as the elder in society. This research is a field study. Data was obtained through interviews with relevant parties such as the mamak, the community, and other related parties.The conclusion of this research is that the role of  mamak  in the Jorong Sungai Sanda community is still very strong. In resolving marital disputes, the  mamak  plays an active role; when conflicts arise, it is the  mamak  who mediates to find a solution. The advantage of resolving disputes through this system is that it allows for quick resolution and avoids the emergence of new problems. However, in this dispute resolution, the  mamak  does not instruct their nephews to handle their divorces in court, which may lead to new issues in the future.

Abstract

Penyuluh Agama Islam (PAI) at the Kantor Urusan Agama (KUA) in Padang Pariaman Regency play a crucial role as the frontline in advocating for couples and resolving community conflicts. However, PAI has not yet functioned optimally, as reflected by the high divorce rate in this region, ranking second after Padang City in West Sumatra. Conflicting couples also tend to overlook the role of PAI and KUA as third parties that could help mediate their issues. To address this, the community service team sought to enhance PAI’s performance through ToT (Training of Trainers) mediator training, aimed at strengthening marital literacy and preserving marriages in the region. The approach used was group counseling with the Community-Based Rehabilitation (CBR) method. Data analysis applied Miles and Huberman’s techniques, including data reduction, data display, and conclusion drawing, alongside the Logical Framework Approach (LFA) for a more structured analysis. This training is beneficial in preparing PAI to become professional mediators, skilled in resolving household conflicts and reducing the tendency of couples to pursue litigation through the Pengadilan Agama (Religious Court).

Abstract

The bilateral inheritance system ensures equal rights for men and women while reflecting social justice values rooted in local traditions. However, its practice often sparks debates regarding its alignment with Islamic law. This study aims to analyze the practice of bilateral inheritance in the Dusun VII Sei. Cabang Kiri community, Langkat Regency, through the lens of maqashid syariah, focusing on equity and public benefit. Employing a semi-ethnographic design with a qualitative approach, the research involved structured interviews and thematic data analysis to understand inheritance patterns and their underlying values. The findings reveal that the bilateral inheritance system in this community aligns with the principles of maqashid syariah through family deliberation (musyawarah), fostering justice, equality, and social harmony. Such a system not only exemplifies the integration of local customary values and maqashid syariah but also serves as a relevant model for achieving justice, equality, and social harmony within Indonesia’s pluralistic legal framework. Future research is recommended to adopt comparative or interdisciplinary approaches to further explore similar practices in other indigenous communities across Indonesia.

Abstract

Indonesian Modern Retail Business is a business activity selling various goods or services for direct or indirect consumption. Retail business in Indonesia can generally be classified into two, namely modern retail and traditional retail. Modern retail is actually a development of traditional retail which in practice applies modern concepts using technology and accommodates lifestyle developments in society (consumers). Modern shopping centers currently operating in West Sumatra include Plaza Andalas, Basko Grand Mall, Rocky Plaza, Transmart and SPR Plaza. To protect micro, small and medium enterprises (MSMEs), the West Sumatra Government also does not give permits to franchise retail networks in the form of minimarkets such as Indomaret and Alfamart which have mushroomed in various cities in Indonesia. Instead, the Minang Mart minimarket network was formed by the Regional Owned Enterprise (BUMD) PT Graphics Jaya West Sumatra in collaboration with PT Sentra Distribution Nusantara.

Abstract

This research to identify the root causes of people's reluctance to accept the government's declaration to certify land throughout Indonesia. The community's preconception has resulted in many uncertified waqf lands. According to data obtained from the head of the Padang Pariaman Regency's National Land Agency (BPN), only 6% of waqf lands in V Koto Timur, Padang Pariaman Regency, have been certified. Data collected between 2015 and 2020 showed there are approximately 156 prayer rooms (musalla) and 24 mosques that have not been certified. Furthermore, waqf land disputes are common in the region, including the withdrawal of waqf land by heirs and the creation of agricultural land on waqf lands whose management is neglected. Religious factors influence the reluctance to certify waqf land, particularly among the people of Padang Pariaman who still follow the Syattariyah order and have strong faith in the Nagari leaders, particularly the penghulu, who find it difficult to accept their waqf land for certification. The community stereotype holds that waqf lands can be taken over by the government if they are certified. Other factors contributing to the ignorance include the fact that the person who made the waqf or his heir no longer resides in the area

Abstract

The Islamic judicial system in Egypt has historically served as a central institution for the administration of justice based on Islamic law, particularly in matters of family law, inheritance, and civil dispute resolution. Over time, this system has undergone significant transformation influenced by political change, colonial intervention, and legal modernization, which reshaped its institutional structure, authority, and relationship with the modern state. Despite extensive scholarship on Islamic law and legal reform in Egypt, studies that systematically examine the historical development and institutional transformation of Islamic justice within the contemporary national legal framework remain limited. This study aims to analyze the evolution of the Islamic judicial system in Egypt by exploring its historical foundations, institutional changes, and integration into the modern state legal system. Employing a qualitative approach with historical-analytical methods, this research examines classical Islamic legal texts, Egyptian legislation, and relevant scholarly literature. The findings indicate that Islamic justice in Egypt has experienced substantial transformation through legal codification and the establishment of national courts, while maintaining the substantive role of Sharia principles, particularly in personal status law. This study highlights the ongoing negotiation between Islamic legal tradition and modern legal governance in contemporary Egypt.

Abstract

Abstract: Marital disputes are a common phenomenon in society and can be caused by various factors, such as cultural differences, economic issues, infidelity, and communication breakdowns. This study aims to analyze the main causes of marital disputes and explore the family law perspective in their resolution. The research method used is normative juridical research with a conceptual and statutory approach. The data in this study were obtained from primary, secondary, and tertiary legal materials through a literature review. The results show that in Indonesian family law, there are two main avenues for resolving marital disputes: litigation through the courts and non-litigation methods such as mediation and counseling. Although legislation has regulated the dispute resolution mechanisms, implementation in practice still faces challenges, such as low public legal awareness and limited access to mediation institutions. Therefore, efforts are needed to enhance public understanding of marital law and to strengthen the role of mediation and counseling institutions in resolving domestic disputes.Keywords: marital disputes, family law, dispute resolution.Abstrak: Sengketa dalam perkawinan merupakan fenomena yang sering terjadi di masyarakat dan dapat disebabkan oleh berbagai faktor, seperti perbedaan budaya, faktor ekonomi, perselingkuhan, hingga ketidakharmonisan dalam komunikasi. Penelitian ini bertujuan untuk menganalisis penyebab utama terjadinya sengketa dalam perkawinan serta mengeksplorasi perspektif hukum keluarga dalam penyelesaiannya. Metode penelitian yang digunakan adalah penelitian hukum yuridis normatif dengan pendekatan konseptual dan perundang-undangan. Data yang digunakan dalam penelitian ini bersumber dari bahan hukum primer, sekunder, dan tersier yang diperoleh melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa dalam hukum keluarga di Indonesia, terdapat dua jalur utama dalam penyelesaian sengketa perkawinan, yaitu jalur litigasi melalui pengadilan dan jalur nonlitigasi seperti mediasi dan konseling. Meskipun peraturan perundang-undangan telah mengatur mekanisme penyelesaian sengketa, implementasi di lapangan masih menghadapi kendala, seperti rendahnya kesadaran hukum masyarakat dan kurangnya akses terhadap lembaga mediasi. Oleh karena itu, diperlukan upaya untuk meningkatkan pemahaman masyarakat terhadap hukum perkawinan serta penguatan peran lembaga mediasi dan konseling dalam penyelesaian sengketa rumah tangga.Kata kunci: sengketa perkawinan, hukum keluarga, penyelesaian sengketa.
