Abstract

Perkembangan hukum pidana di Indonesia mengalami transformasi dengan pengakuan korporasi sebagai subjek hukum pidana. Paradigma baru diperlukan karena tindak pidana korporasi tidak selalu bersifat personal melainkan hasil kebijakan atau praktik sistemik. Konsep vicarious liability menjadi fondasi, meski masih banyak perdebatan konseptual dan praktis. Penelitian ini menggunakan pendekatan yuridis normatif, menggunakan bahan hukum primer dan sekunder, dengan analisis kualitatif deskriptif dan interpretatif, serta validasi melalui studi kasus putusan pengadilan terkait sanksi pidana korporasi kasus suap. Analisis menunjukkan pentingnya harmonisasi prinsip vicarious liability dengan asas geen straf zonder schuld dan pengakuan kesalahan kolektif. Model compliance defense menjadi instrumen penting untuk menunjukkan itikad baik korporasi dalam pencegahan tindak pidana, mendukung pemisahan tanggung jawab antara korporasi dan individu. Standardisasi pembuktian dibutuhkan untuk menjamin keadilan dan transparansi proses hukum. Peran Mahkamah Agung krusial dalam menyusun pedoman teknis pembuktian compliance dan hubungan kausal, guna menciptakan kepastian hukum dan efektivitas penegakan. Pengembangan sanksi restoratif dan compliance model dapat mendorong reformasi tata kelola dan pencegahan korupsi. Diperlukan harmonisasi prinsip, diferensiasi pengaturan untuk korporasi dan UMKM, serta penguatan budaya antikorupsi melalui compliance program. Integrasi sanksi restoratif dan model compliance diharapkan meningkatkan efektivitas penegakan hukum sekaligus menjunjung keadilan substantif, dengan dukungan regulasi dan pedoman implementasi yang jelas dari Mahkamah Agung.

Abstract

Kesadaran hukum masyarakat desa dapat dibina melalui pelatihan paralegal yang melibatkan warga desa dan aparat pemerintah desa sebagai pesertanya. Kesadaran hukum merupakan unsur yang penting dalam proses penegakan hukum. Artikel ini memaparkan mengenai kegiatan pengabdian kepada masyarakat dalam bentuk pelatihan paralegal yang diselenggarakan oleh Fakultas Hukum Universitas Pancasila bekerja sama dengan beberapa lembaga negara serta pemerintah, dan juga lembaga swadaya masyarakat. Para peserta pelatihan paralegal ini ialah warga masyarakat dan perangkat pemerintah Desa Karang Suraga dan Desa Bulakan, Provinsi Banten. Simpulan yang dapat diambil ialah bahwa pelatihan paralegal merupakan program yang penting bagi upaya menumbuhkembangkan pemahaman, kesadaran serta keterampilan masyarakat di bidang hukum. Melalui pelatihan paralegal, masyarakat dan aparat desa dibekali pemahaman mengenai hukum yang kelak dapat mereka manfaatkan untuk merespons dan menyelesaikan problem hukum yang mereka hadapi sehari-hari.

Abstract

Problem sampah masih tetap menjadi permasalahan serius bagi masyarakat. Walaupun secara hukum pengaturan mengenai lingkungan yang bersih dan sehat telah ada, namun dalam praktiknya kondisi lingkungan tetap rawan mengalami pencemaran, termasuk karena keberadaan sampah. Masyarakat Desa Umbul Tanjung juga menghadapi problem sampah, yang jika tidak tertangani dengan baik, maka berpotensi pula menimbulkan dampak negatif, baik terhadap kesehatan masyarakat bahkan terhadap hasil tangkapan ikan para nelayan di Desa Umbul Tanjung. Kajian ini akan membahas mengenai kegiatan pengabdian kepada masyarakat yang dilakukan oleh tim Fakultas Hukum Universitas Pancasila yang ditujukan untuk mengatasi persoalan sampah. Kegiatan tersebut lantas menawarkan beberapa alternatif solusi untuk mengatasi problem sampah di Desa Umbul Tanjung yang mengedepankan sinergi antara aspek sosial, hukum, dan teknologi ramah lingkungan.

Abstract

To enhance economic growth in Indonesia, active community participation through the establishment of companies is crucial. Various types of companies, both non-legal entities and legal entities, exist to meet business needs, including Micro, Small, and Medium Enterprises (MSMEs). With the introduction of the Individual Company concept in Law No. 11 of 2020 on Job Creation, significant changes have emerged in the structure and decision-making mechanisms. The Individual Company allows individuals to establish a business with just one shareholder, eliminating the minimum capital requirement and the need for multiple founders. This shift impacts the democratic principles of decision-making, where strategic decisions are entirely in the hands of one individual, potentially reducing accountability and transparency. This research employs a normative research method. The findings indicate that the Job Creation Law introduces individual companies in Indonesia, allowing individuals to establish companies without partners and removing the minimum capital requirement. This supports Micro and Small Enterprises (MSEs) and emphasizes legal equality in shareholder decisions, despite implementation challenges related to the role of the General Meeting of Shareholders (GMS). The elimination of the GMS and Board of Commissioners in Individual Companies grants absolute power to the single shareholder, increasing the risk of abuse of power. While decision-making becomes more efficient, the lack of control may lead to legal issues and ineffective governance.

Abstract

Sales and Purchase Agreements (Perjanjian Pengikatan Jual Beli—PPJBs) frequently give rise to disputes when legal defects arise in the transfer of land rights, particularly where such defects prejudice buyers acting in good faith. The tension between legal certainty of land ownership and the protection of good-faith parties remains a legal problem that has yet to be fully resolved in judicial practice. This study examines the application of the doctrine of unlawful acts in PPJBs and evaluates the form and effectiveness of legal protection afforded to landowners and good-faith buyers. Employing a normative legal research method, the study adopts statutory, conceptual, and case-based approaches, with particular attention to judicial decisions concerning PPJB disputes. The findings demonstrate that unlawful acts in PPJBs predominantly originate from the bad faith of one of the contracting parties or third parties. At the same time, courts tend to provide proportional protection to good-faith buyers without disregarding the rights of the lawful owner. The study concludes that effective legal protection in PPJB disputes can only be achieved through a balanced application of the principles of good faith and legal certainty within the agrarian law framework.

Abstract

This study aims to describe the complete systematic land registration program, including its legal basis, procedures, and obstacles and solutions in its implementation. This study used an empirical legal study method that refers to secondary and primary data. The results of the study indicate that the complete systematic land registration program is based on Law Number 5 of 1960 concerning Basic Agrarian Principles and Regulation of the Minister of Agrarian Affairs and Spatial Planning or the Head of the National Land Agency Number 6 of 2018. The implementation of the complete systematic land registration program includes location and budget preparation, collection of physical and legal data, bookkeeping and certificate issuance, and certificate delivery. Obstacles in the implementation of complete systematic land registration in Cibinong District include a lack of public understanding, differences in land area, limited land history data, and the existence of absentee land. Solutions to overcome obstacles in the implementation of complete systematic land registration include strengthening governance through outreach and cross-agency coordination, structuring transparent financing mechanisms, and updating land data through re-measurement and integration of digital land plot maps.

Abstract

The prohibition of deputy ministers holding multiple positions has become a polemic within the government structure due to the absence of explicit legal norms regulating such restrictions. This issue later developed following a Constitutional Court ruling stating that the prohibition on ministers holding multiple positions also applies to deputy ministers. This study aims to examine the legal position of deputy ministers in the Indonesian government system and the legal implications arising from the prohibition on holding concurrent positions. The research employs a normative legal method using statutory and conceptual approaches. Secondary data, consisting of primary, secondary, and tertiary legal materials, are analyzed descriptively and analytically. The study concludes that deputy ministers are state administrators appointed by the President to assist ministers in carrying out their duties and functions. Accordingly, the principles of state administration are inherent in the office of the deputy minister. The prohibition of dual positions has legal implications for interpretation, limits presidential prerogatives, and requires the application of sanctions.
