Abstract

The provision of a Business Identification Number (NIB) is an important thing for business actors. One of the benefits of the issuance of NIB for business actors is that the government can provide assistance by means of technical guidance, consultation, and training to increase knowledge of the application of Indonesian national standards and halal product guarantee certification, and so on. However, today, there are still many business actors who do not know how the benefits of NIB for business actors, especially the role of NIB in protecting business actors. This article aims to find out how the role of the Business Identification Number in protecting business actors in Indonesia. This study uses normative juridical research method. The results showed that there are several roles of the Business Identification Number in protecting business actors. Business actors get legal protection in carrying out business operations. In addition, NIB also functions as a legal identity for business actors, which allows them to obtain valid business licenses, commercial licenses, and operations. In addition, NIB makes it easier for businesses to apply for business licenses and fulfill legality requirements. NIB can also increase the competitiveness of business actors by fulfilling the requirements to obtain certification. The issuance of NIB for business actors can be a form of contribution to the development of a better business ecosystem.

Abstract

This paper explores the role of universities in advancing Pancasila as a guiding ideology through community engagement in Kenteng Village. As Indonesia faces challenges in maintaining national identity and unity, the significance of Pancasila— the nation’s foundational philosophical framework—cannot be overstated. The study examines a collaborative program initiated by a local university aimed at fostering ideological understanding and enhancing national awareness among villagers. Through workshops, seminars, and hands-on activities, university students and faculty worked closely with the Kenteng community to facilitate discussions on Pancasila values, encouraging active participation in civic life. The program also aimed to empower villagers by equipping them with skills and knowledge to promote social cohesion and resilience. The findings indicate that the initiative not only deepened the community's appreciation for Pancasila but also strengthened ties between the university and the village. Participants reported increased awareness of national issues and a stronger commitment to local governance and community development. This case study demonstrates that effective community engagement by universities can serve as a model for similar initiatives across Indonesia, reinforcing the importance of Pancasila in contemporary society. Ultimately, the paper advocates for a more structured approach to university-community partnerships, highlighting their potential to cultivate a deeper understanding of national identity and values among future generations.

Abstract

One of the efforts to realize preventive efforts to prevent all risks of personal data protection is to establish basic precaution logging as a personal data protection strategy that will serve as a guide for parties involved in personal data protection efforts. Indonesia, which has not formulated such a strategy, can make the provisions in France as a reference. The urgency of this research is that there is a mandate in Article 59 letter a of the Personal Data Protection Law in Indonesia for the Institution to formulate and determine policies and strategies for Personal Data Protection as a guide. This research employs the Library Research method, also known as Legal Research, which focuses on analyzing primary and secondary legal materials based on literature. The results show that France already has an institution called CNIL which formulates basic precautions in logging operations to guide personal data protection strategies. As a result, there are 8 basic precautions in logging operations, which are to provide a logging system that can implement and learn by Indonesia, that are: keep these logs for a rolling period of between six months and one year; perform, for application logs, a record of the creation, consultation, sharing, modification, and deletion; inform users; protect the logging equipment and the logged information; ensure the proper functioning of the logging system; ensure that processors are contractually obliged; and actively analyze, in real time or in the short term.

Abstract

This comparative analysis delves into the intricate landscape of cross-border trade disputes, focusing on Indonesia and Australia. As two significant players in the global trade arena, understanding their dispute resolution mechanisms is crucial for fostering bilateral and multilateral trade relationships. The study examines the legal frameworks, institutional mechanisms, and cultural factors influencing trade dispute resolution in both countries. Indonesia's approach may reflect its unique socio-political context, while Australia's system could showcase its commitment to transparency and adherence to international trade norms. Key aspects explored include the role of governmental bodies, such as trade ministries and dispute settlement panels, as well as the utilization of alternative dispute resolution methods like arbitration and mediation. Moreover, the analysis delves into the effectiveness and efficiency of these mechanisms in resolving disputes promptly while maintaining fairness and equity for all parties involved. Comparisons are drawn between Indonesia and Australia in terms of legal precedents, enforcement mechanisms, and the level of stakeholder engagement in the dispute resolution process. Additionally, cultural nuances and historical contexts are considered to understand how these factors shape the negotiation and resolution of trade conflicts. By synthesizing these insights, the study aims to provide policymakers, trade practitioners, and academics with a comprehensive understanding of the strengths and weaknesses of each country's approach to cross-border trade dispute resolution. Ultimately, it seeks to contribute to the development of best practices and strategies for enhancing trade relations and promoting economic cooperation between Indonesia and Australia, as well as other nations globally.

Abstract

This paper explores the role of legal strategies and advocacy in shaping higher education institutions into world-class research and education hubs, with a comparative focus on Universitas Negeri Semarang (UNNES) in Indonesia, Dhofar University in Oman, and the University of Sharjah in the United Arab Emirates. Central to this analysis is the development of Centers of Excellence (CoEs) as catalysts for academic innovation, international collaboration, and institutional prestige. The study investigates how legal frameworks—ranging from national laws to internal university policies—facilitate or hinder the strategic growth of CoEs in each context. It highlights how legal advocacy can drive policy reform, secure essential resources, safeguard intellectual property, and promote academic freedom and international accreditation. By examining case studies from the three institutions, the paper underscores the importance of legal professionals not only as compliance officers but as key actors in institutional transformation. Ultimately, the research demonstrates that a robust, forward-thinking legal strategy is essential to advancing the global aspirations of universities in emerging knowledge economies.

Abstract

Perlindungan Konsumen bertujuan melindungi hak-hak konsumen. Di Kabupaten Jepara, konsumen handphone tidak mendapatkan hak-haknya karena pelaku usaha tidak memberikan informasi garansi yang benar dan jelas, dengan beberapa unit handphone dijual seolah masih bergaransi padahal masa garansinya sudah habis sehingga perlu mengkaji perlindungan hukum yang diberikan serta pengawasan. Tujuan penelitian ini yaitu (1) Mengetahui dan menganalisis perlindungan konsumen terhadap garansi produk handphone. (2) Mengetahui dan menganalisis pengawasan DISPERINDAG dalam Informasi menyesatkan garansi produk handphone di Kabupaten Jepara. Penelitian ini menggunakan pendekatan kualitatif yang didasarkan pada jenis penelitian hukum yuridis empiris. Teknik pengumpulan data yang digunakan meliputi wawancara, observasi, dokumentasi, dan studi pustaka. Adapun data sekunder menggunakan bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Validitas data menggunakan teknik triangulasi, sedangkan analisis data melalui pengumpulan data, reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa masih banyaknya konsumen yang tidak memahami ha-hak terkait konsumen. Selain itu, pelaku usaha tidak memberikan informasi yang jelas dan benar terhadap konsumen terkait informasi garansi. Pelaku usaha kurang memahami tanggung jawa pelaku usaha dan lebih mementingkan keuntungan tanpa mempertimbangkan hak-hak konsumen. Pengawasan yang dilakukan masih kurang efektif karena berbagai macam kendala. Beberapa kendala antara lain pengawasan terkait perdagangan handphone dengan informasi menyesatkan terkait garansi produk sebanyak satu kali dalam bebarapa tahun terakhir. Selain itu belum adanya Peraturan Daerah yang mengatur tentang Pengawasan produk dan/atau jasa di daerah Jawa Tengah dan minimnya SDM serta anggaran. Simpulan dari penelitian ini adalah (1) Perlindungan hukum bagi konsumen atas informasi menyesatkan garansi produk handphone di Kabupaten Jepara berjalan belum maksimal, dimana masih terdapat perdagangan handphone dengan menggunakan informasi menyesatkan terkait garansi karena minimnya pengawasan yang dilakukan. (2) Minimnya anggaran untuk pengawasan dan pembinaan, serta reorganisasi yang mengintegrasikan BPSK ke dalam Dinas Perindustrian dan Perdagangan, serta luasnya wilayah yang harus dipantau, menyebabkan dinas terkait belum dapat melakukan pengawasan optimal terhadap perdagangan dengan informasi menyesatkan mengenai garansi produk handphone.
