Abstract

 Notaris merupakan seorang pejabat umum yang berwenang untuk membuat suatu akta otentik. Dalam membuat suatu akta otentik, tentunya perlu dipahami mengenai syarat-syarat otentisitas serta penyebab kebatalan maupun pembatalan suatu akta Notaris. Selain itu dalam membuat suatu akta Notaris harus mengedepankan tindakan pencegahan agar tidak terjadi cacat yuridis suatu akta yang mengakibatkan hilangnya otentisitas maupun batalnya suatu akta tersebut. Dalam penelitian ini, penulis mencantumkan beberapa rumusan masalah yaitu apa saja karakteristik kebatalan dan pembatalan suatu Akta Notaris serta apakah ada dasar hukum istilah kebatalan dan pembatalan suatu Akta Notaris dalam Undang-Undang Jabatan Notaris. Penelitian ini termasuk dalam jenis penelitian normatif atau doktrinal yang mempunyai sifat preskriptif, menggunakan pendekatan undang-undang mempelajari bahan-bahan hukum primer dan sekunder. Adapun salah satu hasil penelitian adalah terdapat beberapa karakteristik kebatalan dan pembatalan akta Notaris yang memiliki implikasi hukum yaitu akta Notaris yang dapat dibatalkan, akta Notaris batal demi hukum, akta Notaris yang hanya memiliki kekuatan pembuktian sebagai akta dibawah tangan, akta Notaris yang dibatalkan oleh para pihak sendiri, atau akta Notaris batal berdasar asas praduga yang sah.Kata-Kunci: Akta Notaris, akta otentik, bahasa hukum,  Notary is a public official authorized to make an authentic deed. In making an authentic deed, it is necessary to understand the terms of authenticity and the causes of the nullification or cancellation of a Notary deed. In addition, in making a deed, a Notary must prioritize preventive measures so that there is no juridical defect of a deed which results in the loss of authenticity or the cancellation of the deed. In this study, the authors create several formulations of the problem, namely what are the characteristics of the nullification and cancellation of a Notary Deed and whether there is a legal basis for the term nullification and cancellation of a Notary Deed in the Undang-Undang Jabatan Notaris. This research method is normative or doctrinal research that has a prescriptive nature, using a law approach to study primary and secondary legal materials. One of the results of the research is that there are several characteristics of the nullification and cancellation of a Notary deed which has legal implications, namely a Notary deed that can be canceled, a Notary deed is null and void, a Notary deed which only has the power of proof as an underhand deed, a Notary deed which is canceled by the parties. itself, or the Notary deed is void based on the principle of a valid presumption.Keywords: Notary deed, authentic deed, legal language

Abstract

Labor Protection is the ideal and purpose of the existence of labor law to provide legal protection in the omnibus law (Job Creation Act), which accommodates the interests of workers but also accommodates the ease of doing business in micro and small firms in the form of wages as seen in Article 90 B. the existing problems regarding the legal ratio of labor law in Indonesia based on the Job Creation Act and what are the forms of legal protection for workers in micro and small businesses based on the legislation?, the purpose of this study is to find out and analyze the ratio of labor law legislation in Indonesia. Indonesia is based on the Job Creation Act to find and explore forms of legal protection for workers in micro and small businesses. At the same time, the benefits of this research are divided into two, namely, theoretically, to provide a legal ratio to the wages of micro-enterprise workers. And small, while in practice, it is to provide legal protection for workers in Micro and Small businesses. The employment agreement is also a form of agreement regulated in the Manpower Act and the Law on Job Creation as an alternative to protecting workers' rights with the principle of proportionality which aims to increase workers’ bargaining power.How to cite item: Pranowo, P., Tanudjaja, T., Octarina, N. Abstract

Dalam pelaksanaannya, reforma agraria didukung oleh dua kegiatan besar, yaitu reformasi aset dan reformasi akses. Reformasi aset diwujudkan melalui kegiatan legalisasi aset. Hasil utama dari kegiatan ini adalah sertifikat tanah. Sedangkan reformasi akses adalah menciptakan akses perbankan bagi masyarakat melalui kegiatan PTSL. Orang yang memegang sertifikat tanah dapat meminjam untuk mendapatkan modal dari bank untuk memulai bisnis. Jenis penelitian yang digunakan adalah yuridis normatif. Teknik pengumpulan bahan hukum dilakukan melalui penelitian kepustakaan dan analisis bahan pustaka, serta penelitian pencarian bahan di internet termasuk artikel dan jurnal ilmiah yang berkaitan dengan penulisan ini. Kemudian dianalisis dengan teknik deskriptif analitis dan kritis. Hasil penelitian menunjukkan bahwa, wilayah Kabupaten Malang sebagai wilayah yang terletak di dataran tinggi tentu memiliki potensi sumber daya alam yang dapat dikelola agar menciptakan manfaat serta kesejahteraan, dan tentunya dapat dijadikan sebagai pendapatan daerah. Penetapan subjek reforma agraria sejalan bersamaan dengan penetapan objek reforma agraria. Proses penetapan persyaratan subjek penerima reforma agraria dilakukan oleh Bupati melalui Sidang PPL yang disidangkan berdasarkan Draft Sidang PPL yang disusun oleh Kantor ATR/BPN Kabupaten Malang. Draft Sidang PPL tersebut memuat inventarisasi & identifikasi objek dan subjek, pengukuran dan pemetaan yang dijadikan acuan untuk menetapkan syarat-syarat subjek penerima reforma agraria. Legalisasi aset dapat dilaksanakan berdasarkan SK Redistribusi yang diterbitkan oleh Kantor ATR/BPN Kabupaten Malang, dari SK Redistribusi tentu berdasarkan subjek dan objek reforma agraria yang telah memenuhi persyaratan. Setelah SK Redistribusi diterbitkan, menjadi dasar/legalitas untuk dilakukannya Pembukuan Hak dan Penerbitan Sertipikat. Setelah itu, subjek penerima TORA berhak mendapatkan sertipikat tanah dari pelaksanaan redistribusi tanah.

Abstract

Indonesia is a constitutional state which was contain in Article 1 paragraph (3) of the 1945 Constitution of the Republic of Indonesia and based on the prevailing laws and regulations. The current laws and regulations are considered to have a lot of influence on legal positivism teachings, the law is considered rigid and causes the number of regulations that Indonesia has. The number of regulations is considered quite a cause for concern, and can lead to a decline in the quality of regulations in Indonesia. So, the Government tries a new method, namely the omnibus law method in simplifying regulations in Indonesia. The government's efforts to reduce regulatory obesity through the omnibus law method are considered formal flaws because they are not in accordance with the rules for the formation of laws and regulations stipulated in Law no. 12 of 2011. The progressive legal view of the omnibus law is necessary then to see the real and living substantial aspects of society and the consideration of social perspectives needs to be adjusted and the Government needs to continue to explore the real aspects in society.

Abstract

This study aims to find alternative solutions to peer-to-peer lending problems. This study uses a normative juridical approach. The data collection technique used is documentation technique (scientific journal articles related to peer-to-peer lending). The data analysis technique used is analytical descriptive analysis regarding default settlement options in peer-to-peer lending. The results of this study indicate that alternative solutions for solving peer-to-peer lending problems are based on  Article 21 POJK No. 77/POJK.01/2016 the parties are required to mitigate risks through litigation channels, namely by going to court on the basis of default (Article 1243 Civil Code) made by the recipient of the loan; and the non-litigation route, namely through mediation because mediation efforts are included in the substance of the law (Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution).

Abstract

This study aims to find out the legal provisions related to the determination of the notary's honorarium which has been regulated by law, the social responsibility of the notary in helping to make deeds for people who can't afford it, and the legal sanctions for a notary who refuses to provide services to people who can't afford it. This research is normative juridical research with a literature review approach to legislation which is analyzed qualitatively. The results of this study indicate that a notary is a state official who is authorized to provide notary services to the public in general so that he is not paid by the state, but he can collect honorarium from his client in the amount as stipulated by UUJN and also based on an agreement between the notary and his client; the notary is also obliged to provide free services to people who cannot afford to pay the honorarium because this is their obligation as stipulated in Article 37 UUJN; and a notary who refuses to provide free services to people who can't afford it, he will be subject to sanctions in the form of a written warning, temporary dismissal, honorable discharge, or dishonorable discharge.

Abstract

This study aims to determine the urgency of PKWT for employees at a notary's office in terms of Indonesian labor law. This study uses a normative juridical legal approach. Data collection techniques in this study used documentation techniques in the form of scientific journal articles related to PKWT for employees at the notary's office in terms of Indonesian labor law. The data analysis technique used in this study is an analytical descriptive data analysis technique for PKWT juridical studies applied in a notary's office based on Indonesian labor law. The results of this study indicate that the urgency of PKWT for employees at a notary's office in terms of labor law in Indonesia is based on Law Number 11 of 2020 concerning Job Creation and Government Regulation Number 35 of 2021; PKWT must be made in writing (Article 57 paragraph (1) of Law No. Job Creation Law), PKWT drawn up in writing by a notary and its employees must be registered with the Manpower Office in the area where the notary's office is located (Article 14 paragraph (1) and (2) PP No. 35 of 2021).

Abstract

The initial wealth of foundation establishment as outlined in thedeed made by a notary must be written in the form of money accompanied by a statement of separation of assets of the founder and the preparation of the statement of separation of assets is the founder's obligation so that the founder has a commitment not to interfere in the assets of the foundation, but this becomes a dilemma when the founder does not have enough money to be deposited into the Foundation's treasury as the initial wealth, especially for operations, purchase of inventory and renovation of buildings. The initial wealth of the establishment by using a statement letter of separation of personal assets of the founder of the foundation by valuing the asset with money and the fastest solution is to get ad funds. is in debt to a bank with land and buildings as collateral that is tied to a Mortgage guarantee institution, asset ownership that has not been renamed to the name of the foundation, it’s a problems if the founder does’nt have good intentions to pay off the debt to the bank or hand over the assets. after it is paid off to the Foundation, therefore the Foundation should immediately ask a notary to not only make a deed of establishment of the Foundation but also make a deed of agreement on the transfer of rights either as a grant or waqf along with a deed of power to reverse the name on behalf of the foundation.

Abstract

Building Use Rights (BUR) according to Law Number 5 of 1960 Article 35 paragraph 1 concerning Basic Agrarian Regulations is the right to construct and own buildings on land that is not one's own, with a maximum period of 30 years. With the time period determined, the right holder is required to extend the specified period before the validity period ends. In extending the BUR, it is necessary to pay attention to the Regional Spatial Plan that has been determined by the Regional Government where the BUR are located. It will be a separate problem if the Spatial and Regional Planning in the area changes in line with the policies that have been set by the Regional Government, so that the term of the BUR cannot be extended or the period of time can be extended on condition that the holder of the BUR adjusts the building object. by following the Spatial and Regional Layouts that have been determined by the Regional Government. The purpose of this paper is to describe the status and administrative actions of the local government on the BUR which cannot be extended due to changes in the Spatial and Regional Planning. The method used in this research is juridical-empirical law research. Data sources consist of primary and secondary legal materials. The conclusion in this study aims to answer the problems that arise, namely the status and administrative actions of local governments on BUR which cannot be extended due to changes in Spatial and Regional Plans.

Abstract

The research was conducted aiming to find out how the process of settlement of land sale and purchase disputes was carried out. The research was conducted with reference to the applicable laws and regulations. Data analysis using data equations that have been obtained at the time of the study finally obtained the following research results: (1) Based on the decision of the case Number: 62/Pdt.G/2013/PN. Tk is a problem in the implementation of the sale and purchase of joint assets carried out without the consent of one of the parties. The decision of the panel of judges in Decision Number : 62/Pdt.G/2013/PN.Tk which rejected the plaintiff's claim was correct. This is because the disputed land is not a joint property (gono gini) of the Plaintiff and Defendant II. Defendant II did not act for himself but only served as a "proxy". The position of Defendant II who only acts as the "power" to sell the disputed land is reasonable because as has been considered above.
