Abstract

This research aims is to describe the problem of legal protection for children, both from a criminal and civil perspective. By identifying differences and weaknesses in existing protection systems, this research seeks to provide an in-depth look at the steps that need to be taken to improve the situation. The research method used in this research is judicial normative with primary sources from journals regarding child protection as well as positive legal products on legal protection for children, especially children in conflict with the law. Legal ideology regarding children in Indonesia still shows differences in approach at various levels and legal domains. The implementation of the law to children and the role of parents as guardians and protectors of children do not yet have sufficient clarity. This condition places children in a very vulnerable position, where protection of their rights and welfare is often not optimal. The role of parents in protecting children is still limited, and the state has not standardized their role or provided adequate space to help children face legal problems.

Abstract

Criminal liability is grounded in the principle of geen straf zonder schuld, which requires the presence of both actus reus and mens rea to establish guilt. However, in the enforcement of corruption law in Indonesia, evidentiary practices tend to prioritize state financial losses and abuse of authority, often sidelining the assessment of the perpetrator’s mental element. This reveals a critical gap between doctrinal principles and judicial practice, particularly in cases involving public policy decisions. This study aims to examine the position of mens rea in the evidentiary framework of corruption crimes and to analyze the criminal liability of public officials in the absence of proven intent, as reflected in the sugar import policy case. Using normative legal research with statutory, conceptual, and case approaches, this study analyzes Decision of the Central Jakarta District Court Number 34/Pid.Sus-TPK/2025/PN Jkt.Pst. The findings indicate that although mens rea in Indonesian criminal law is doctrinally reflected through intent and negligence, judicial reasoning in corruption cases tends to adopt a formalistic approach by emphasizing procedural violations and state losses. This study argues that such an approach leads to the criminalization of public policy in the absence of proven culpability. The novelty of this research lies in its critique of the shift from a culpability-based system toward a loss-based liability model in corruption cases. It concludes that state losses arising from policy decisions without intent to unlawfully benefit should be understood as occupational risks rather than grounds for criminal punishment, thereby reaffirming the centrality of mens rea in criminal liability.

Abstract

This study discusses the application of cyber notary in sharia economic transactions in Indonesia, focusing on the challenges and potentials related to legal certainty. The main problems faced are how to maintain the validity of electronic contracts in accordance with the principles of sharia law, as well as challenges such as data protection, privacy, and digital infrastructure gaps. This research uses normative legal methods with legislative and conceptual approaches, as well as utilizing primary data sources from related regulations and secondary legal materials from academic literature. The results of the study show that cyber notary has great potential to increase efficiency and reduce costs in Islamic economic transactions. However, significant challenges related to electronic document verification and data security remain major obstacles. This research recommends the need for clearer harmonization of laws and regulations, improvement of digital infrastructure, and strengthening of the data security system. With these steps, cyber notary can be an effective instrument in supporting the development of sharia economic transactions, while still ensuring compliance with sharia principles such as honesty, fairness, and clarity. Thus, the implementation of cyber notary has the potential to bring positive changes in the Islamic economic legal system in Indonesia, provided that these challenges can be overcome effectively.
