Abstract

Penemuan Vaksin COVID-19 tidak terlepas dari keuntungan (benefits), baik berupa hak ekonomi maupun hak moral yang diperoleh inventor atau penemunya, dan itu berkaitan dengan permohonan atau pendaftaran paten. Artikel ini membahas mengenai konsekuensi paten beserta hak eksklusifnya yang dianggap sebagai hambatan dalam memenuhi kebutuhan Vaksin COVID-19 bagi semua orang. Penelitian ini menggunakan tipe penelitian yuridis-normatif, yang mencoba memecahkan permasalahan dengan menggunakan berbagai instrumen hukum melalui pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukkan pentingnya dilakukan analisis mengenai adanya perbenturan antara kepentingan individu dan kepentingan publik dalam usaha penemuan Vaksin COVID-19. Pada akhirnya, penemuan Vaksin COVID-19 memang seyogyanya menjadi hak milik publik demi kepentingan kesehatan masyarakat global, maka pemerintah ataupun negara-negara dunia diharapkan menentukan apa dan bagaimana kebijakan yang sebaiknya dilakukan untuk mempercepat akses Vaksin COVID-19 secara adil dan merata, namun tetap mengakui keberadaan hak paten di dalamnya.The discovery of the COVID-19 Vaccine cannot be separated from the benefits, both in the form of economic rights and moral rights obtained by the inventor, and that related to patent application or registration. This article discusses the consequences of the patents and their exclusive rights which are considered obstacles in fulfilling the need for a COVID-19 Vaccine for everyone. The study uses juridical-normative research, which tries to solve problems using various legal instruments through a statute approach and conceptual approach. The result shows the importance of conducting an analysis of the conflict of interest between individual (private) interests and public interests in the discovery of the COVID-19 Vaccine should indeed belong to the public. In the last, the discovery of the COVID-19 Vaccine should indeed become public domain in the interests of global public health, so the government or world countries are expected to determine what and how policies should be implemented to accelerate access to the COVID-19 Vaccine fairly and equitably, but still recognize the patent rights in it.

Abstract

The background of this research is the agreement giving birth to an engagement or legal relationship that gives rise to rights and obligations for each party. Thus an agreement in the form of an agreement is essentially binding, even in accordance with Article 1338 paragraph 1 of the Civil Code, this agreement has binding power as a law for the parties who make it. The purpose of this study is to find out the terms of the agreement that resulted in default and settlement efforts between PT. PLN with residents of Prasung Tani Rw 01 RT 01 Sidoarjo Regency. This research method uses empirical juridical with a descriptive qualitative approach. The findings of this study indicate that in the agreement between PT PLN and PT Saba Prima with residents of the village of Prasung Tani RT 01 RW 01 Sidoarjo Regency there was a default that occurred. In the case of default that occurred in the Agreement between PT PLNand PTSaba Prima with residents of Prasung Tani village RT01 RW01 Sidoarjo Regency, there were several default settlements, namely the first party chose to go through the Non-Litigation route, namely through consensus deliberation with the villagers of Prasung Tani RT 01 RW 01 Regency Sidoarjo

Abstract

The advancement of information technology and cultural changes in information sharing have had a significant impact on how personal data is managed and accessed. The aim of this research is to determine legal protection for neighborhood administration association in the implementation of personal data collection duties. The method used by the researcher is a qualitative method with normative judicial analysis using several research questions formulated by the researcher. The Neighborhood Association (RT) requires sufficient knowledge to carry out its duties as a personal data processor as stated in the Personal Data Protection (PDP) Law. In carrying out their duties as processors, Neighborhood Association (RT) administrators must pay attention to the obligations contained in the law. However, considering the amount of data that is still being leaked, as a personal data processor, they cannot solve all the problems alone and bear the consequences as stated in the Personal Data Protection (PDP) Law. There needs to be legal certainty that also helps carry out Neighborhood Association (RT) duties as a personal data processor. Referring to countries in the world, Indonesia is lagging behind in the struggle to ensure that personal data protection laws are implemented from the private to the government level, including Neighborhood Association (RT)

Abstract

The current circulation of processed products from home industries makes product standardization certification important as an effort to protect the public. This study aims to explain the legal certainty of P-IRT and post market BPOM as an effort to protect consumers. The method used in this research is the normative juridical method which is carried out with a statutory approach and with an analytical approach. The specification used is conceptual descriptive. The data that will be used is secondary data including legislation and literature relevant to P-IRT and Post Market BPOM. From the research conducted, the results showed that the implementation of P-IRT based on BPOM Regulation Number 22 of 2018 can be a protection for the public from harmful products. As a responsibility for the supervision of products that have given P-IRT certificates, the implementation of post market supervision by BPOM on the basis of implementation of BPOM Regulation Number 9 of 2020 as a form of protecting consumer rights as stipulated in Law Number 8 of 1999 concerning Consumer Protection. In their application, both show clear legal certainty for consumers.

Abstract

Dalam hal ketenagakerjaan, pemerintah sangat memperhatikan perlindungan tenaga kerja dan keselamatan kerja. Tentu saja, tujuan pemerintah dalam hal ini adalah untuk melindungi dan memperhatikan keselamatan kerja dari pekerja secara umum. Dalam Pasal 27 ayat (2) Undang-Undang Dasar Negara Tahun 1945 menyatakan bahwa setiap warga negara berhak atas pekerjaan dan kehidupan yang layak. Sesuai dengan keadaan dan kemampuan keuangan negara Indonesia, dan seperti negara-negara berkembang lainnya, Indonesia juga memiliki program jaminan sosial. Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial dan dijelaskan pada Pasal 13 ayat (1) bahwa pemberi kerja secara bertahap wajib mendaftarkan dirinya dan pekerjanya sebagai peserta kepada Badan Penyelenggara Jaminan Sosial, sesuai dengan program jaminan sosial yang diikuti. Dalam hal ini sistem jaminan sosial ini diimplementasikan oleh pemerintah melalui BPJS yang diatur dalam UU BPJS, maka dari itu seharusnya PNS dalam hal ini tunduk dengan UU BPJS, namun pada faktanya PNS masih menggunakan TASPEN.In terms of employment, the government is very concerned about labor protection and work safety. Of course, the government’s aim in this regard is to protect and pay attention to the safety of work and vulnerable workers in general. Article 27 Paragraph (2) of the 1945 Constitution of the Republic of Indonesia states that every citizen has the right to work and a decent life. In accordance with the state and financial capabilities of the Indonesian state, and like other developing countries, Indonesia also develops a social security program. Law 40 of 2004 concerning the Social Security System and it is explained in article 13 paragraph (1) that employers must gradually register themselves and their workers as participants with the Social Security Administering Agency, in accordance with the social security program being followed. In this case the social security system is implemented by the government through BPJS which is regulated in the BPJS Law, therefore civil servants in this case should comply with the BPJS Law, but in fact civil servants still use TASPEN.

Abstract

Transfer of rights to land is the transfer of rights to land plots from one party to another in the process of buying and selling a land object. In its implementation, strong evidence is needed in the transfer of land rights so that there is no dispute in the future that harms one of the parties in the sale and purchase of land objects. In its implementation, there are often problems related to the transfer of rights to land that has not been certified. Government Regulation Number 24 of 1997 concerning Land Registration states that for the purposes of transferring rights to the Land Office, the sale and purchase of land rights must be proven by a PPAT deed. Proof of PPAT deeds is important in the transfer of land rights to strong evidence and is recognized by the state as an official authorized to make deeds in accordance with interests. The deed made by PPAT is a requirement to register the land in order to get a certificate on the land.

The necessity of obtaining proper music licenses is well-understood, but the complexities and costs involved often lead to gaps in compliance. Local regulations, including zoning laws, noise ordinances, and alcohol licensing, further complicate the legal landscape for karaoke operators. Non-compliance with these laws can result in severe penalties, including fines, legal disputes, and potential business closures. Social media has emerged as an essential tool for marketing and customer engagement in the karaoke industry. Platforms like Facebook, Instagram, and TikTok enable businesses to reach a broader audience and create interactive experiences that enhance customer loyalty. However, the use of copyrighted music in social media posts poses significant legal risks. While social media offers opportunities for growth, businesses must navigate these platforms carefully to avoid copyright infringement and other legal challenges. Managing online reputations is critical in the age of social media, where negative reviews or viral posts can significantly impact a business's image. Proactive strategies for handling customer feedback and maintaining a positive online presence are essential for mitigating reputational risks. The regulatory environment for karaoke businesses is evolving, with stricter enforcement of copyright laws and changing social media policies. Businesses must stay informed and adapt to these changes to ensure continued compliance and operational success. Karaoke businesses should prioritize legal education and seek expert guidance to navigate the complexities of copyright law and other regulatory requirements effectively. Abstract

Globalization and economic liberalization have increased foreign investment in Indonesia, including through the establishment of Foreign Investment Limited Liability Companies (PT PMA). PT PMA often establishes other business entities, such as Limited Partnership (CV), to maximize its business. This phenomenon raises legal questions regarding the legitimacy, regulations, and implications of establishing a business entity by PT PMA. This research aims to find the legal ratio of foreign investment legal entities in the form of limited liability companies and to analyze the status of limited partnerships established by limited liability companies that have the status of foreign capital limited liability companies. The type of research used in this research is normative legal research. The problem approaches used in compiling this research are the conceptual approach, the statutory approach, and the comparative approach. The results of the research found that Limited Liability Companies can establish limited partnerships, by becoming passive partners, and Limited Liability Companies with foreign capital can establish limited partnerships, this is because there is no prohibition.
