Abstract

This study examines the Indonesian government's legal responsibilities in protecting citizens' personal data, focusing on constitutional, administrative, and criminal aspects. Using normative legal research methods, the analysis incorporates provisions from the 1945 Constitution, the Personal Data Protection Law (UU PDP), and related regulations to evaluate the state's obligations in preventing and addressing data breaches. The findings reveal that personal data protection is a constitutional right under Article 28G(1) of the 1945 Constitution, reinforced by the UU PDP. As data controllers, government institutions bear layered responsibilities including preventive measures, administrative compliance, victim compensation, and constitutional accountability. However, criminal liability only applies to individual officials rather than government institutions as legal entities. Despite existing safeguards, regulatory gaps remain particularly concerning administrative sanctions, compensation mechanisms, and the establishment of an independent oversight body as mandated by the UU PDP. To strengthen data protection, this study recommends: (1) refining implementing regulations; (2) enhancing oversight mechanisms; (3) improving government officials' capacity; (4) increasing public awareness; and (5) fostering international cooperation to address cross-border data violations. These measures are crucial for ensuring effective personal data protection and safeguarding citizens' constitutional rights in the digital age.

Abstract

Violations of the Regency/Municipal Minimum Wage (UMK) in Indonesia not only undermine workers’ fundamental rights but also expose structural deficiencies in the enforcement of labor criminal law. Previous studies have predominantly framed minimum wage violations as individual misconduct, thereby neglecting the systemic and collective dimensions of corporate decision-making. This article addresses that gap by critically examining the application of participation doctrines under Articles 55 and 56 of the Indonesian Penal Code (KUHP) and their relevance for attributing liability to actors across organizational hierarchies. Employing a normative juridical method with statutory and conceptual approaches, this study integrates doctrinal analysis, judicial interpretation, and comparative insights from global practices on corporate and collective criminal liability. The findings reveal that wage violations often result from deliberate policies formulated at managerial or corporate levels, thus requiring recognition of functional perpetration and structural participation. Furthermore, this article argues that the doctrine of abuse of circumstances (misbruik van omstandigheden) should be considered to exempt coerced or vulnerable actors from liability, thereby preventing the criminalization of structural victims. By advancing a critical interpretation of participation in labor-related crimes, this study contributes both to the theoretical development of collective liability in Indonesian criminal law and to practical reform strategies that strengthen the protection of workers’ constitutional rights.

Abstract

Penelitian ini untuk menganalisa sejauh mana batasan yang dimiliki notaris pada khususnya berkaitan dengan promosi diri yang berakibat pada rusaknya martabat dari profesi notaris. Metoda yang digunakan berupa metode normatif dengan kajian berfokus kepada peraturan dan jurnal ilmiah. Hasil dari tulisan ini adalah media sosial dapat dikatakan mengedukasi publik apabila bersifat informatif. Namun, akan menjadi pelanggaran kode etik ketika ada klaim berlebihan atas jasa yang ditawarkan serta melakukan perbandingan dengan sesama notaris lain. Sedangkan, jika konten yang ditawarkan menawarkan tarif maka termasuk dalam kategori pelanggaran. Pada akhir tulisan, penulis merekomendasikan perlunya pedoman khusus dan detail dari pihak terkait agar notaris dapat beradaptasi dengan baik di era digital tanpa ada pelanggaran integrasi profesi.

Abstract

This study explores the urgency and legal framework of Emergency Interim Relief (EIR) in Indonesian arbitration law, emphasizing its role in safeguarding parties’ rights and ensuring legal certainty in urgent disputes. EIR, as a temporary measure issued before a full arbitral tribunal is constituted, is crucial for preventing irreparable harm such as asset dissipation or evidence destruction. Although Law No. 30 of 1999 grants tribunals the authority to issue interim measures, its lack of explicit enforcement mechanisms historically limited their effectiveness. The issuance of Supreme Court Regulation No. 3 of 2023 (PERMA 3/2023) marks a significant development by providing procedural clarity, mandating court registration of interim orders, and introducing fixed timelines for enforcement, including for foreign awards. These reforms align Indonesian arbitration practice more closely with international standards and enhance its attractiveness as a dispute resolution hub. However, limitations remain, notably the narrow scope of PERMA 3/2023, which primarily addresses security seizures, and uncertainties regarding the enforceability of emergency awards under institutional rules such as the 2025 BANI Rules.

Abstract

In a marriage, the aim is to create a happy household, a family filled with peace, love and affection. Marriage causes the mixing of husband and wife's assets or joint assets, unless they make a Marriage Agreement which regulates the separation of assets. A marriage agreement does not only discuss matters of property but also all matters related to the obligations of husband and wife. Prior to the Constitutional Court Decision No. 69/PUU-XIII/2015, marriage agreements could only be made before the marriage occurred. And after the issuance of Constitutional Court Decision No. 69/PUU-XIII/2015, agreements can be made after marriage. The purpose of the marriage agreement is to provide preventive and repressive legal protection, in addition to preventing problems arising in the household such as fighting over property, domestic violence, negligence of rights and obligations between husband and wife. This is a form of protecting women's rights in marriage.

Abstract

ABSTRACT The development of Global Positioning System (GPS) and voice recorder technology in rental car vehicles offers real benefits in improving fleet security, tracking in the event of loss, and monitoring renter behavior. However, the installation of these devices without explicit notification and consent has the potential to violate the right to privacy—a human right protected by Article 12 of the Universal Declaration of Human Rights (UDHR), Article 28G paragraph (1) of the 1945 Constitution, and clarified in Law Number 27 of 2022 concerning Personal Data Protection. This study uses a juridical-normative method with a statutory regulatory approach and the concept of the right to privacy to analyze the legality of installing GPS and voice recorders in rental cars. The results of the study indicate that (1) GPS installation is permissible as long as it is accompanied by transparency, written consent, and data access is limited to vehicle security purposes only; (2) voice recorders have the potential to violate criminal provisions on wiretapping because they record private conversations without permission; and (3) national regulations do not yet provide detailed technical guidelines regarding the consent mechanism, storage time limits, and audits of data use. This study recommends updating rental agreement clauses, implementing the principle of privacy by design in devices, and strengthening state oversight to ensure the protection of renters' privacy rights as well as legal certainty for car rental businesses. Abstract

The increasing development of technology and information provides a number of benefits and negative impacts. The spread of fake news (hoaxes) is one of the cases that often occurs in Indonesia. Perpetrators of spreading fake news use social media as a platform for spreading fake news. Regarding the spread of fake news, it is regulated in Law Number 1946, the Criminal Code, and the ITE Law of 2016. The urgency in several of these policies includes law enforcement factors, the benefits of law for society, as community control, and not giving rise to multiple interpretations and realizing justice. This research uses a type of normative juridical research. The data collection technique used is library research. The analysis used is a normative analysis method. This research shows the urgency of several policies that regulate the spread of fake news in Indonesia.

Abstract

The criminal act of gambling in Indonesia is regulated in the Criminal Code (KUHP) Article 303 and the Information and Electronic Transactions Law (UU ITE) Article 27 paragraph (2) which can generally be applied to online gambling players even if the person concerned does not gambling as a livelihood, but in practice law enforcement is more targeted at online gambling organizers and is not yet optimal for ensnaring online gambling players at the individual level so that weak law enforcement against online gambling players has the potential to give rise to legal uncertainty, so this research is a type of normative legal research or literature research that carried out by examining theories, concepts, legal principles and statutory regulations related to the urgency of criminal regulation of online gambling players in fulfilling the principle of legal certainty through a statutory approach and a conceptual approach with primary legal material sources, the Criminal Code and the Law. ITE as well as secondary legal materials in the form of books, scientific journals, articles, literature related to this topic which are collected through literature studies and analyzed deductively so that they can provide prescriptions for criminal regulations for online gambling players who must guarantee the law. certainty in order to protect the public from the increasing dangers of widespread online gambling.

Abstract

ABSTRAK Dalam ranah hukum perdata, peran notaris dan Pejabat Pembuat Akta Tanah (PPAT) memiliki dampak signifikan dalam pembuatan dokumen hukum yang sah. Fokus abstrak ini adalah pada kewajiban bagi notaris yang juga merangkap jabatan sebagai PPAT, keabsahan akta notaris dan PPAT yang wilayah kerjanya berbeda, serta akibat hukum terhadap notaris yang membuat akta di luar wilayah jabatannya. Undang-Undang Jabatan Notaris (UUJN) memberikan ketentuan yang tegas terkait dengan larangan merangkap jabatan di luar wilayah jabatan, dengan sanksi administratif dan perdata bagi pelanggar. Keabsahan akta notaris dan PPAT tergantung pada aspek formal dan materiil, serta kepatuhan terhadap ketentuan hukum yang berlaku. Pembatalan akta notaris dapat terjadi jika terjadi pelanggaran hukum atau kekeliruan dalam pembuatannya. Dalam menjalankan tugas, notaris dan PPAT perlu menjaga integritas, meningkatkan pengetahuan, dan memastikan kepatuhan terhadap peraturan yang berlaku. Kolaborasi dengan otoritas terkait juga penting untuk memperoleh bimbingan dan dukungan yang diperlukan. Dengan demikian, pemahaman yang baik tentang kewajiban, keabsahan, dan akibat hukum dalam praktik notaris dan PPAT menjadi kunci dalam menjalankan tugas mereka secara efektif dan profesional.Kata Kunci: Notaris, Pejabat Pembuat Akta Tanah (PPAT), Undang-Undang Jabatan Notaris (UUJN).

Abstract

Undang-Undang Nomor 14 Tahun 2005 tentang Guru dan Dosen yang mengatur hak serta tanggung jawab pendidik, termasuk jaminan keamanan saat menjalankan tugas. Peraturan Menteri Pendidikan dan Kebudayaan Nomor 10 Tahun 2017 juga menunjukkan komitmen pemerintah dalam melindungi guru. Penelitian ini berfokus pada kasus dugaan penganiayaan oleh Supriyani, seorang guru honorer di Konawe Selatan, yang dituduh menganiaya seorang murid. Kasus ini memicu perhatian nasional dan internasional meskipun bukti yang ada tidak mencukupi. Tujuan penelitian adalah untuk menilai rasio decidendi putusan terhadap Supriyani serta kesesuaian putusan nomor 104/Pid.Sus/2024/P.N. Andoolo dengan prinsip keadilan. Metode yang digunakan melibatkan analisis bukti dan kesaksian dalam persidangan. Hasil penelitian menunjukkan bahwa saksi yang memberatkan, yaitu anak di bawah umur dan orang tua, tidak dapat diandalkan karena keterbatasan informasi yang mereka miliki. Keterangan anak di bawah umur tidak dapat dijadikan alat bukti karena tidak disumpah, dan orang tua hanya mendengar cerita. Oleh karena itu, kesimpulan penelitian menunjukkan bahwa kasus ini seharusnya tidak dilanjutkan ke persidangan, mengingat ketidakcukupan bukti yang ada. Penelitian ini menyoroti pentingnya perlindungan hukum bagi pendidik dalam menjalankan tugas mereka.
