Abstract

Perubahan UUD NRI Tahun 1945 masih jauh dari proses demokrasi deliberatif. Padahal sejatinya keterlibatan rakyat merupakan sesuatu hal yang mutlak, agar perubahan tidak sarat akan kepentingan politik saja, tetapi seharusnya mengedepankan kepentingan rakyat sebagai wujud dari kedaulatan rakyat. Perubahan UUD NRI Tahun 1945 belum menerapkan prinsip demokrasi deliberatif karena cenderung lebih banyak mengandung politisasi MPR dan bersifat elitis daripada keterlibatan rakyat. Demokrasi deliberatif yang digagas merupakan solusi alternatif dan bermanfaat bagi negara-negara demokrasi, masih dapat menjadi pilihan terbaik bagi Indonesia. Minimnya peran MPR memberikan ruang publikkepada rakyat dalam amendemen, mengharuskan MPR memperkokoh sistem ketatanegaraan Indonesia guna melibatkan rakyat melalui pemberdayaan dan penguatan kewenangan DPD dalam proses amendemen. Praktiknya dapat menerapkan sistem e-debelibarative democracy, tentunya proses ini mesti memiliki dasar hukum yang kuat dan tertuang dalam konstitusi serta beradaptasi terhadap perkembangan digitalisasi

Abstract

Kepercayaan terhadap lembaga perwakilan, baik di tingkat pusat maupun di tingkat daerah selalu dalam posisi yang rendah. Kepercayaan rendah tersebut disebabkan banyaknya peraturan perundang-undangan yang tidak mendapat validitas dari masyarakat. Berdasarkan perspektif teori, validitas suatu peraturan perundang-undangan bisa didapatkan melalui partisipasi publik. Maka dari itu, pembentukan peraturan perundang-undangan harus dilakukan melalui partisipasi yang bermakna dalam rangka menjaga perwujudan demokrasi dan hak asasi manusia masyarakat. Berdasarkan hal tersebut, tim kami menginisiasikan program pengabdian kepada masyarakat yang memiliki dua tujuan, pertama yakni memberikan pemahaman kepada anggota dewan dan masyarakat mengenai pentingnya partisipasi yang bermakna dalam pembentukan regulasi. Maka dari itu, metode yang digunakan dalam pengabdian masyarakat ini adalah metode focus group discussion dengan melibatkan anggota Dewan Perwakilan Rakyat Daerah Provinsi Jawa Barat, buruh di Kota Bandung, dan Badan Eksekutif Mahasiswa di Universitas Padjadjaran. Alasan pemilihan buruh dan mahasiswa untuk mewakili unsur masyarakat sebab buruh merupakan kelompok masyarakat yang rentan secara ekonomi dan menjadi pihak terdampak langsung dari Rancangan Peraturan Daerah yang saat ini sedang disusun, yakni Raperda Jaminan Sosial Ketenagakerjaan. Sedangkan alasan pemilihan mahasiswa sebab dalam praktiknya mahasiswa seringkali memiliki aspirasi dalam jalannya pemerintahan. Hasil dari program pengabdian ini yakni terwujudnya forum yang dapat memfasilitasi buruh dan mahasiswa untuk menyampaikan aspirasi dalam pembentukan peraturan daerah, meskipun demikian program ini belum bisa memastikan apakah aspirasi tersebut dipertimbangkan dan diberikan penjelasan mengenai diterima ataukah tidaknya, namun kami berhadap ada kesadaran dan pemahaman yang muncul dari sosialisasi yang kami lakukan mengenai pentingnya partisipasi yang bermakna dalam pembentukan peraturan perundang-undangan.

Abstract

The problem that arises because the regions do not have absolute independence to take care of their own household affairs can be one of the factors that hinder Indonesia from becoming a welfare state through the progress of the regions. The problem of the essence of regional autonomy at the level of implementation of its system in the frame of the Unitary State of the Republic of Indonesia is still not in accordance with the nature of broad, real, and responsible regional autonomy so that this will also hinder the achievement of the greatest happines of the greatest number for as in the theory of utilitarianism in achieving the goal of the state to become a welfare state ). The research method used is normative juridical by taking a historical approach and legislation. The results showed that the urgency of implementing broad, real, and responsible regional autonomy is needed in the regional government system in order to meet regional needs with the essence of autonomy possessed in order to realize the greatest happiness of the regional community.

Abstract

This article explores the deterioration of democracy in Indonesia attributed to the lack of effective opposition within its presidential multiparty system. The dominance of fat coalitions in the legislature has undermined the checks and balances function of the House of Representatives (DPR), reducing it to a body that merely approves government proposals including problematic legislation and controversial public programs without meaningful scrutiny. The lack of institutional support and incentives for opposition parties has contributed to this dysfunction, as coalition participation offers access to public office, funding, and legal protection, while opposition yields none. In response, this article proposes the institutionalization of the Rights of the Opposition,  which includes: the right to hold leadership positions in DPR organizational bodies; special rights in the legislative process such as the right to delay the deliberation of constitutionally significant or publicly controversial bills; the right to initiate and lead oversight mechanisms; influence budget deliberations; and participate in the appointment of public officials. It also outlines the need for specific incentives such as protocol privileges, financial resources for policy research, and eligibility for state honours. Framed within the concept of constitutional repair, the article identifies key pathways for reform based on four interrelated aspects: specificity, feasibility, temporality, and priority. These reforms aim to strengthen the DPR’s capacity for oversight and restore its role as a democratic counterbalance to executive power.

Abstract

Government policy reflects the extent to which Indonesian citizenship law accommodates the issue of Foreign Terrorist Fighter (FTF)s, as well as future projections of what can be done against FTF based on related laws and regulations, especially those related to citizenship laws. The method used in this study is normative juridical, with data collection through literature study. The results showed that the citizenship status of Foreign Terrorist Fighters from Indonesia based on a human rights perspective, the state can only revoke a person's citizenship based on a court decision. A person's citizenship status is a fundamental right, and a precious right, therefore, the rights of every citizen must be recognized, respected, protected, facilitated, and fulfilled by the state. In solving the problem of citizenship status of former FTF from Indonesia, it is necessary to improve performance and cooperation in the deradicalization process by all elements of the Government and Law Enforcement Officers commanded by the National Counterterrorism Agency and the development of sterile area infrastructure with a high security system to carry out the deradicalization process while carrying out the FTF citizenship status determination trial process.
