Abstract

The study concerning political law of Sidawangi society towards customary right over “Oro-Oro” land is commonly triggered by the presence of the arbitrary village officers. Historically, “Oro-Oro” land is characterised as a communal land, but its management is initiated exclusively through an agreement and doubtful rights. The legal law concerning customary right over “Oro-Oro” land is truly expected by Sidawangi society. The action of arbitrary village officers is deemed to be one of crucial factors to realise their expectation.Furthermore, the rumour of switching “Oro-Oro” land into plantation land by the corporation also toughens the strong desire of Sidawangi society to realize their expectation. The present study aims to investigate the significance of legal law and the warranty of customary rights both in the 1945 Constitution, agrarian law and international conventions. This study is conducted through an interview to Sidawangi society and literature studies regarding customary right over “Oro-Oro” land as expected by Sidawangi society. Customary right over “Oro-Oro” land, initiated by Sidawangi Society in Sumber Sub-District, originally refers to a communal area which has been exclusively possessed. In other words, this type of land is not privately preserved. The people in Sidawangi society are only allowed to maintain and gather the result. The arbitrary of village officers seize trees in “Oro-Oro” land without any kinds of certain customary right. The phenomenon in Lampung has provided insight regarding the conflict occurs when the people expect is not fulfilled. The residents inevitably expect the existence of political law in society towards customary land. The legal protection towards customary right over “Oro-Oro” land is essentially guaranteed by 1945 constitution, Basic Agrarian Law Constitution, and international convention of indigenous community.

Abstract

The state of Pancasila law is a tool for people who have the power to regulate human relations in society and regulate the symptoms of power in society. As a country with the largest Muslim population in the world, Indonesia does not make Islam its legal basis. The Islamic Nomocracy and its values are embedded in the state of Pancasila law, as well as manifestation of democracy itself. Through these hyphoteses, the writer tries to find a common flateform between Pancasila and the Islamic Nomocracy in the formation of Indonesian democracy. This classic problem requires special attention, because the debate always triggers reactions and actions. Islam as a religion with complex system of living is believed to be a powerful mechanism in dealing with various life problems encountered. The Shari’ah consists of a combination of pre-Islamic customs and habits with principles and laws originated from the Qur’an and authentic prophetic tradition. Islamic scholars try to form Islamic teachings as ethical and national policies. Even so, the principle of the Pancasila state was accepted as final, at least there were Islamic nomocracy values embedded in the Pancasila while at the same time they contributed to build Indonesia’s democracy as a modern country. The theological values in the Pancasila and islamic nomocracy should not be a mere formal rule, but should address the substance of democracy in Indonesia. The rule of law must be supported by a democratic system because there is a clear correlation between the rule of law which relies on the constitution, and the sovereignty of the people which is carried out through a democratic system. In a democratic system, people’s participation is the essence of this system. However, democracy without legal regulation will lose form and direction, while law without democracy will lose meaning.

Abstract

Abstract In Indonesia before the arrival of Europeans, kingdoms such as majapahit and Mataram were familiar with land and indirect taxes on merchandise. Royal officials of tax collectors are not paid by the kingdom, so often they excessive taxes. Individual tribute or group of people given to the king or ruler as a form of respect and submission to the rule of the king or ruler of an Indonesian territory is a form of tax in the era of kingdoms in Indonesia grow. The tribute is in the form of crops and trade in trade goods. In return, the people receive security services and order security. In the kingdom of Mataram kings have carried out a self-sufficient and autonomous life. The surrender is greater to the economic interests of the region or kingdom, to finance the administration of the local government, and to finance the land and the power of the kingdom. Keywords: Taxes, Powers, Income, Autonomy. Abstrak Di Indonesia sebelum kedatangan bangsa Eropa, kerajaan seperti majapahit dan Mataram sudah mengenal bentuk pajak tanah dan pajak tidak langsung terhadap barang dagangan. Pejabat kerajaan pemungut pajak tidak digaji oleh kerajaan, maka sering kali mereka menerapkan pajak secara berlebihan. Upeti perorangan ataupun kelompok orang diberikan kepada raja atau penguasa sebagai bentuk penghormatan dan tunduk patuh pada kekuasaan raja atau penguasa suatu wilayah Indonesia merupakan bentuk pajak pada zaman kerajaan-kerajaan di Indonesia tumbuh. Upeti tersebut berupa hasil bumi dan pemajakan barang perdagangan. Sebagai imbalannya maka rakyat mendapat pelayanan keamanan dan jaminan ketertiban. Di kerajaan Mataram raja-raja sudah melaksanakan hidup swasembada dan otonom. Penyerahan tersebut lebih besar pada kepentingan ekonomi daerah atau kerajaan, membiayai penyelenggaraan pemerintahan setempat, dan membiayai pertanahan dan kekuatan kerajaan. Kata Kunci: Pajak, Kekuasaan, Pendapatan, Otonomi

Abstract

The article aims to examine the impact of Covid-19 on the community's economy and village development. The village always gets help, leads to circumstances or gives birth to the village losing its identity. The loss of the village's identity is proven by the existence of whatever is required by the government in its transmission, it must get rewards in the form of material. The basic problem is how to fulfill the economy as a basic human need in order to carry out activities in the world in order to fulfill welfare, safety. The relationship between village democracy with the direction of the economy and village development which is an inseparable unit. Democracy influences the handling of Covid-19, is a real test of the results of village democracy in realizing the economy and development. The research is intended to understand the impact of outbreaks on the village economy, rural development that is sweeping the world. The views of the village community have experienced a crisis of confidence, due to the role played by the central and regional governments that do not pay attention to the village as an independent government losing its identity. For the sake of the realization of a village democracy in the field of economy and development, ideally building the character of a society free from dependency. Keywords: Covid-19, Economy, Development, and Democracy. AbstrakArtikel bertujuan mengkaji dampak Covid-19 terhadap perekonomian masyarakat dan pembangunan desa. Desa selalu mendapatkan bantuan, mengarah pada keadaan atau melahirkan desa kehilangan identitasnya. Hilangnya identitas desa terbukti dengan adanya apapun yang diharuskan oleh pemerintah dalam penularannya, harus mendapatkan imbalan berupa materi. Persoalan mendasar bagaimana pemenuhan perekonomian sebagai kebutuhan dasar manusia dalam rangka menjalankan aktivitas di dunia guna memenuhi kesejahteraan, keselamatan. Hubungan antara demokrasi desa dengan arah perekonomian dan pembangunan desa yang merupakan satu kesatuan yang tidak dapat dipisahkan. Demokrasi mempengaruhi penanggulangan Covid-19, merupakan ujian nyata hasil demokrasi desa dalam mewujudkan perekonomian dan pembangunan. Penelitian dimaksudkan untuk memahami dampak wabah terhadap perekonomian desa, pembangunan desa yang sedang melanda dunia. Pandangan masyarakar desa  telah mengalami krisis kepercayaan, akibat peran yang dimainkan pemerintah pusat dan daerah yang kurang memperhatikan desa sebagai pemerintahan mandiri kehilangan identitasnya. Demi terwujudnya suatu demokrasi desa di bidang perekonomian dan pembangunan, idealnya membangun karakter masyarakat yang bebas dari ketergantungan. Kata Kunci: Covid-19, Perekonomian, Pembangunan, dan Demokrasi.

Abstract

The State of the Republic of Indonesia is a legal state (rechstaat) where the principle of state law is to ensure the certainty, order and protection of the law aimed at obtaining the truth and not being a state based on power (machtstaat) or where power is subject to law. The development of the law in the life of the society requires legal certainty on the legal relationship of individuals and subjects of law. Law is one of the means that everybody needs to fill their lives, especially in the economic system that enters the era of globalization. The need is manifested in the form of clear legal products and has legal certainty and strict law enforcement action of law enforcement officials. The public's need for legal products as a written evidence tool in a courtesy proof resulted in every public lawsuit involving the parties to be included in a letter of law. If a particular article is made so as to be a means of proof, then the letter or article is called the act is a special writing made to be written evidence. The act as a written evidence tool in certain cases is a powerful evidence tool for parties bound thereto. It is clear that the authentic deed in society is a widespread public need in civil law as regulated by the KUHPerdata, especially on the need for written proof.

Abstract

Tanah dan bangunan adalah benda tidak bergerak (benda tetap) sehingga proses jual belinya berbeda dengan jual beli benda bergerak seperti kendaraan, televisi, dan lain-lain. Secara hukum, jual beli benda bergerak terjadi secara tunai dan seketika, yaitu selesai ketika pembeli membayar harganya dan penjual menyerahkan barangnya. Hal tersebut berbeda dengan jual beli tanah dan bangunan yang memerlukan akta otentik. Penelitian ini mengkaji tindakan hukum masyarakat awam yang menjadi polemik terkait jual beli tanah secara di bawah tangan. Penulis melakukan penelitian hukum normatif (normative law research) menggunakan studi kasus normatif berupa produk perilaku hukum. Teknik analisis yang digunakan adalah inventarisasi hukum positif, asas-asas dan doktrin hukum, penemuan hukum dalam perkara in concreto, sistematik hukum, taraf sinkronisasi, perbandingan hukum dan sejarah hukum. Kajian ini menyimpulkan bahwa praktik jual beli tanah secara di bawah tangan adalah sah dan mengikat secara hukum serta pembeli juga dapat untuk memproses peralihan hak/balik nama Sertifikat Hak Milik (SHM) dari penjual kepada pembeli.

Abstract

ABSTRAK Kegelapan bagi bangsa Eropa merupkan pertumbuhan peradan Madinah. Cita Piagam Madinah telah memberikan insfirasi sekaligus pembelajaran terbaik dalam pembangunan daerah. Madinah merupakan kota Propinsi sebagaimana di Indonesia tentang pemerintahan daerah. Otonomi pada dasarnya mempunyai wilayah, kewenangan mengurus urusan pemerintahan, dan kepentingan masyarakat setempat menurut prakarsa sendiri berdasarkan aspirasi masyarakat. Kabupaten/kota sebagai bentuk otonomi memiliki desentralisasi secara kewilayahan. Belum ada tulisan yang mengkontruksikan piagam madinah dengan pemilihan kepala daerah di Indonesia. Menggunakan metode deskripsi menggambarkan keadaan cita piagam Madinah ke dalam bentuk pencapaian otonomi madani. Nilai-nilai baik dari sistem Madinah harus senatiasa menjadi pertibangan baik calon gubernur maupun bupati/walikota. Kepala Daerah dalam melaksanakan tugas pokoknya, pada akhirnya akan cenderung menitik beratkan pertanggungjawabnya kepada Presiden sebagai ekspresi kedudukannya sebagai wakil pemerintah pusat di daerah untuk gubernur hal ini sangat sejalan dengan nilai Cita Madinah. Bupati/Walikota memiliki hak otonomi Madani atau sebagai pondasi utama dalam otonomi daerah. Maka jaman kegelapan Eropa dan kemajuan peradaban Madinah setidaknya menjadi bahan pertibangan baik bagi yang tertarik mencalonkan diri ataupun terpilih menjadi kepala daerah.Kata Kunci: Piagam Madinah, daerah, otonomi, Madani. ABSTRAK The darkness of Europe is merely the growth of the Medina model. The ideals of Medina Charter have provided the best inspiration and learning in regional development. Medina is a provincial city as in Indonesia about local government. Autonomy basically has the territory, the authority to take care of government affairs, and the interests of local people according to their own initiative based on the aspirations of the people. Districts / municipalities as a form of autonomy have regional decentralization. There is no writing that contradicts the medina charter with the election of regional heads in Indonesia. Using the description method describes the state of the Medina charter in the form of the attainment of civil autonomy. The good values of the Medina system must always be the consideration of both the governor and the regent / mayor candidates. Head of Region in carrying out its main duty, in the end will tend to emphasize its responsibility to the President as the expression of his position as representative of central government in the region for the governor this is very much in line with the value of Ideals Medina. The regent/mayor has the right of Civil autonomy or as the main foundation in regional autonomy. So the era of European darkness and the progress of Medina civilization at least be a matter of good for those interested in being nominated or elected head of the region. Abstract

This paper aims to determine to what extent Garuda totem is faced with covid-19 totem in the constitution of Indonesia. It begins with the pandemic hit a worldwide including Indonesia, all countries are busily making effective policies. Reviewing the existing policies, the president and the regional heads have an extraordinary role. A well-saying that the king can do no wrong while carrying out his policies. Many issues concerning the existence of Garuda totem are currently being in the spot light. Thus, this study focuses on the discussion upon the struggle of Garuda totem over the new totem that has changed the policy arrangement in Indonesia. A normative legal research method sets as a basis for conducting an analysis. The struggle made the existence of Garuda totem hits a polemic in the indonesian constitution. This so-called totem does not just apply on religious values. The state even has its respective totem as a form of sacredness for its people. The research result on the consenquences of Garuda totem, holding the shield of Pancasila and setting its feet on Indonesia’s diversity, are indicating an inseparable bondage for the king of the country and the king of the region during 2019-nCoV which befell the worldwide, particularly Indonesia. In addition, the national emblem, Garuda Pancasila, is not just an ordinary image. It has a meaning that is coming from Indonesian cultures. It has a sacred value (holy) that must be protected and maintained its dignity by everyone who claims to be the citizens of Indonesia. This is to signify an ethic of showing the love for the country. Lastly, in order to avoid the threats to Garuda totem, the state is required to be more careful in making policiesTujuan dari penulisan ini yaitu untuk mengetahui sejauh mana totem Garuda dihadapkan pada totem Covid-19 dalam ketatanegaraan Indonesia. Berawal dari adanya pandemik yang melanda dunia termasuk Indonesia, semua negara disibukan untuk segera mengambil kebijakan-kebijakan yang efektif. Melihat kebijakan-kebijakan yang ada menempatkan Presiden dan Kepala Daerah memiliki peran yang sangat luar biasa dan dapat dikatakan sebagai the king can not do wrong dalam menjalankan kebijakannya. Permasalahan-Permasalahan yang berkenaan dengan keberadaan totem Garuda saat sekarang banyak disoroti, fokus pembahasan mencoba mengkaji pergumulan totem garuda atas totem baru yang merubah tatanan kebijakan di Indonesia. Metode penelitian hukum yang bersifat normatif sebagai pijakan dalam melakukan analisis. Adanya pergumulan atau pertarungan yang menjadikan keberadaan totem Garuda mengalami polemik dalam ketatanegaraan Indonesia. Apa yang dinamakan sebagai totem sendiri rupanya bukan hanya berlaku pada nilai-nilai keagamaan saja, bahkan sekelas negara memiliki totem masing-masing sebagai bentuk kesakralan bagi masyarakatnya. Hasil penelitian Konsekuensi totem Garuda yang memegang perisai Pancasila dan menapakan kakinya pada kebhinekaan Indonesia, sebagai bentuk ikatan yang tidak terpisahkan bagi raja negara maupun raja daerah pada saat adanya 2019-nCoV yang menimpa dunia dan Indonesia khususnya. Labang Negara yaitu Garuda Pancasila bukan hanya sebuah gambar yang biasa saja, mempunyai makna yang lahir dari budaya-budaya Indonesia, memiliki nilai sakralitas (suci) yang wajib di lindungi yang harus dipertahankan martabatnya oleh setiap orang yang mengaku sebagai warga Indonesia untuk menandakan sebuah etika yang menunjukan rasa kecintaan terhadap tanah air. Abstract

Kemajemukan bangsa Indonesia sebagai satu kesatuan yang tidak terpisahkan. Kemajemukan merupakan hasil catatan sejarah negara hukum Indonesia. Negara hukum Indonesia yang bertumpu pada Pancasila sebagai falsafah negara bangsa merupakan visi negara. Teori negara hukum Arsitoteles walaupun sederhana, sampai perkembangan konsepsi negara hukum Pancasila merupakan sarana yang dapat digunakan untuk menjawab permasalahan negara hukum dalam hukum negara itu sendiri. Hasilnya negara hukum dapat dikatakan sebagai visi negara Indonesia sedangkan hukum negara dapat dikatakan sebagai misi yang digunakan untuk mencapai visi negara hukum Pancasila. Visi negara hukum mesti diurai dengan hukum negara harus melibatkan nilai-nilai Pancasila dalam menggapai negara hukum Pancasila.

Abstract

Justice as an ideal and legal objective can be realized through law. Hans Kelsen said, justice is the legality that the benchmark lies in its validity according to positive law. This study aims to describe the concept of fairness according to Hans Kelsen's philosophy and relevance to the concept of al-Adl al-Qur; an. This study is a literature review, with a philosophical approach - Usul Fiqh. The results of the study show that the concept of al-'Adlu in the Qur'an has a wider scope from a human perspective. Al-'Adl has the substance of absolute justice only possessed by the Divine, revealed to the Prophet Muhammad, the Prophet's behavior is justice (prophetic philosophy). Subjective justice, which is essentially an attempt to fulfill positive legal certainty as a benchmark, is completely untenable. Because, justice is not limited to validity according to positive law but justice must pay attention to the meaning of lafadz al-'Adl is a transcendental basis that is absolute for human benefit. The concept of "al-'Adl" offers three levels of benchmarks of justice, namely dharurîyat, hajîyat and tahsinîyat as the spirit of the Qur'an that links morality and belief.Keywords: absolute, al-‘adl, justice, legal satisfation ABSTRAKKeadilan sebagai cita-cita dan tujuan hukum bisa diwujudkan melalui hukum. Hans Kelsen menyebutkan, keadilan adalah legalitas bahwa tolak ukurnya terletak pada keabsahannya menurut hukum positif. Penelitian ini bertujuan mendeskripsikan konsep adil menurut filsafat Hans Kelsen dan relevansi dengan konsep al-Adl al-Qur;an. Metodologi kajian ini merupakan kajian pustaka, dengan pendekatan filosofis-Ushul Fiqih. Hasil kajian bahwa konsep al-‘Adlu dalam al-Qur’an memiliki ruang lingkup lebih luas dari perspektif manusia. Al- ‘Adl memiliki substansi keadilan mutlak hanya dimiliki oleh Ilahi, diwahyukan kepada Nabi Muhammad, maka perilaku Nabi adalah keadilan (filsafat profetik). Keadilan subjektif yang pada esensinya sebagai upaya pemenuhan kepastian hukum positif sebagai tolak ukur, sepenuhnya tidak dapat dipertahankan. Sebab, keadilan tidak terbatas pada keabsahan menurut hukum positif tetapi keadilan harus memperhatikan makna lafadz al-‘Adl basis transendental yang bersifat absolut bagi kemaslahatan manusia. Konsep “al-‘Adl” menawarkan tiga tingkatan tolak ukur keadilan, yakni dharurîyat, hajîyat  dan tahsinîyat sebagai ruh dari al-Qur’an yang mengaitkan antara moral dan kepercayaan.Keyword: absolut, al-‘adl, keadilan kepastian hukum
