Abstract

The OJK supervision system for Sharia banking can be implemented in three ways, namely providing permits, integrating all provisions, and integrating one-stop licensing. In the context of Islamic law, the OJK supervision system in Sharia banking consists of two aspects, namely providing rules and regulations related to banking management and licensing through OJK regulations, as well as direct and indirect supervision in collaboration between the OJK and the National Sharia Council (DSN) to form a Board. Sharia Supervisor (DPS) who will supervise banking compliance with the Sharia principles used.In supervising Sharia banking, OJK acts as the Al-Hisbah Institution, which is a supervisory institution that oversees market operations. The DPS formed by OJK and DSN acts as Muhtasib, which is assigned to carry out direct supervision of each Sharia bank. However, OJK only gives authority to DPS to control and assess the implementation of Sharia concepts in the Sharia banking sector and does not have the authority to provide provisions, policies, or penalties in supervising the implementation of activities in Sharia banks.To support the development of the Sharia economy in Indonesia, DPS, which acts as Muhtasib in supervising Sharia banking, needs to be given special authority apart from controlling and assessing, namely also providing policies and provisions related to licensing before and during activities in the sharia banking sector.Keywords: Sharia Economic Law, OJK, DPS, and Sharia Banking

Abstract

Abstract: Riba and Gharar: a Review of Law and Ethics of Modern Business Transactions. Numerous interpretations of riba and interest in modern financial institution vary based on who interpreted them. The fuqaha (fiqh experts) and Moslem economists have different opinion in that the ‘illat of riba said by the fuqaha is considered not accurate based on the development of Islamic law. Gharar, translated as speculation, is equal with gambling because there is uncertainty for both buyer and seller. Such practices are commonly done by modern society like transactions in agricultural crops that are still in the field by using wholeseller system. From Islamic ethics of transactions, riba, interest and gharar are not in accordance with the transaction ethics. Such practises are banned because they are unnatural, exploitative and non productive for economic activity. Abstrak: Riba dan Gharar: Suatu Tinjauan Hukum dan Etika dalam Transaksi Bisnis Modern. Berbagai macam interpretasi tentang riba dan juga bunga pada lembaga keuangan modern (bank), baik itu dari fukaha maupun ekonom Muslim, nampaknya terjadi karena ‘illat riba yang dikemukakan para fukaha dipandang tidak akurat dalam perkembangan pemikiran hukum Islam. Gharar yang diterjemahkan sebagai spekulasi disamakan dengan judi karena ketidakpastian kedua belah pihak (penjual dan pembeli). Praktik semacam ini banyak dilakukan oleh masyarakat modern, seperti jual beli hasil pertanian yang masih di lahan dengan sistem borongan. Bila dilihat dari sisi etika transaksi Islam, baik riba, bunga dan gharar menyalahi keetisan dalam transaksi. Pertimbangan etik larangan riba, bunga dan gharar, dikarenakan adanya ketidakwajaran, eksploitasi dan tidak produktif. Sementara sistem etik ekonomi menekankan produk, kewajaran dan kejujuran di dalam perdagangan, serta kompetisi yang adil.

Abstract

Abstract: Dynamic Development of Family Law in Muslim Countries. This article examines the dynamics of the development/renewal of Islamic family law in Muslim countries. The aim is to obtain a concrete picture of the development, from its original form, i.e conventional fiqh, to become positive law and apply it in Muslim countries. This research is classified as library research using a combination of historical and socio-anthropological approaches. Data were obtained from several secondary sources in the form of laws and regulations, books, articles, and many other documents related to the topic under study. The results of this study indicate that the role of the state in enforcing a legal system is absolute, in the sense that a law can be applied when it has been legislated as positive law. Apart from that, this study also found the fact that three models are applied in the development of family law in Muslim countries, namely; First, the state still applies the conventional legal system (fiqh). Second, the state carries out legal reforms within the school of thought. Third, the state makes its family law that is separate from religious norms to keep up with changes and developments in society.

Abstract

Lampung's indigenous peoples have a tribal culture divided into two large customary groups, namely the Saibatin and Pepadun indigenous peoples, and the majority of community members embrace Islam in terms of marital affairs, which will be passed down through the family. Indigenous peoples, in general, continue to follow the procedures outlined in their customary law. The purpose of this study is to examine the position of women in inheritance distribution in Lampung customary law in the districts of Way Kanan and Pesisir Barat through the lens of Islamic Family Law in Indonesia. This research is a field study that describes and describes the situation and phenomena that occurred in greater detail. This study investigated the role of women in inheritance distribution in depth. A qualitative descriptive research method is one in which only situations and events are described. This study does not seek or explain relationships, nor does it test hypotheses or make predictions; instead, it simply describes variables one by one. A purposive sample was used in this study. The following people participated in this study as informants: Key informants included four traditional leaders, four women who were heirs, and four indigenous people. Data was gathered through interviews, observations, and documentation, as well as primary and secondary sources. Data collection activities are carried out after the research has been completed or compiled. Data collection is one of the processes in research that can aid in the resolution of the problems being studied; thus, the data collected must be adequate. Data analysis begins with data collection and ends with data reduction, data presentation, and conclusions.

Abstract

This study aims to analyze the relationship model of married couples in Tabligh Jama'ah in Bandar Lampung City and Metro City. And to explore the actualization of the rights and obligations of married couples in maintaining family harmony in the tabligh congregation of Bandar Lampung City and Metro City. This field research intensively examines how the husband and wife relationship model in the family of tabligh congregation in Bandar Lampung City and Metro City. Data were collected using observation, interview, and documentation methods. The research informants consisted of six families. The data analysis technique used in this research is qualitative data analysis. Based on the results of the study, it was found that the husband and wife relationship model in tabligh congregation in Bandar Lampung City and Metro City is that the husband in the tabligh congregation family is absolutely the leader of the household, and this is also by Marriage Law No.1 of 1974 article 31 and Compilation of Islamic Law article 79. And the actualization of the rights and obligations of married couples in maintaining the household. The actualization of the rights and obligations of spouses in preserving family harmony in tabligh congregation Bandar Lampung City and Metro City includes 3 things, namely the fulfillment of alimony which is the right of the wife, decision making which is the right of both worshipers, as well as maintenance and protection.

Abstract

Tradisi Shotel adalah tradisi yang melarang menikahi wanita yang salah satu orang tuanya sudah meninggal dunia. Tradisi ini telah menempatkan perempuan sebagai pihak yang mengalami kerugian. Padahal ketentua hukum Islam dan hukum positif tidak ada larangan pernikahan antara laki-laki dengan perempuan yang salah satu orang tuanya sudah meninggal dunia. Penelitian ini fokus pada isu tentang kontroversi tradisi shotel yang dilihat dalam perspektif hukum Islam dan hukum positif. Penelitian ini merupakan penelitian lapangan dengan sumber data utama yaitu data primer. Data primer diperoleh melalui wawancara dengan analisa dengen mengunakan deskriptif analitik. Tradisi shotel, dari segi hukum Islam dipandang sebagai urf fasid dan tidak bertentangan dengan ketentuan hukum positif. Masyarakat sebaiknya meninggal tradisi, selain karena bertentangan dengan hukum Islam dan hukum positif juga merugikan pihak perempuan

Abstract

The Integrated Law Enforcement Center (Sentra Gakkumdu) plays a vital role in ensuring the integrity of General and Regional Elections. However, its effectiveness has always been debated. Data from Lampung Province show an extremely low prosecution rate, indicating entrenched issues in its structure, legal framework, and institutional culture. This study aims to analyze the central causes of Gakkumdu’s ineffectiveness in Lampung and to formulate a concrete, integrated institutional-strengthening model from the perspective of Fiqh Siyasah Dusturiyah. This research employs an integrated socio-legal approach, combining normative legal analysis of legislation with qualitative empirical methods and in-depth interviews conducted through purposive sampling. To maintain methodological consistency, the empirical findings were critically analyzed using Lawrence Friedman’s Legal System Theory (Structure, Substance, Culture). The findings reveal that Gakkumdu’s ineffectiveness stems primarily from: 1) conflicting SOPs regarding evidentiary standards (legal substance); 2) inter-agency ego (legal culture); and 3) the ad hoc status of its personnel (legal structure). Consequently, the proposed strengthening model emphasizes harmonizing technical operational regulations, cultivating a collaborative culture, and evaluating performance based on quantitative metrics to boost the case completion rate. From the perspective of Fiqh Siyasah Dusturiyah, this reinforcement aligns with the core principles of al-mashlahah al-‘ammah (public good) and ‘adl (justice) as the philosophical foundation for political legitimacy. This study concludes that an integrated Gakkumdu strengthening model, informed by FSD, is essential to ensure a transparent electoral process and bolster public trust. It offers a conceptual contribution by bridging empirical legal analysis (Friedman) with Islamic ethical jurisprudence (FSD) in the context of Indonesian election law enforcement.

Abstract

Restorative justice offers an alternative framework for addressing the needs of both victims and offenders in Indonesia. While it presents a more hopeful solution compared to traditional punitive measures, concerns about fairness remain. Specifically, victims may feel that the response to the offense does not match the seriousness of the crime, leading to a sense of being undercompensated. This article explores how restorative justice is integrated into Indonesia’s criminal justice system through both normative and empirical legal research. Bandar Lampung serves as the primary focus of this study due to its establishment of a Restorative Justice House and its reputation as a leading practitioners of restorative justice in the country. The research involved observing practices at the District Prosecutor’s Office in Bandar Lampung, allowing for an empirical understanding of how legal regulations are enacted in practice. Additionally, the study reviews the normative aspects of the law related to restorative justice, particularly focusing on the Attorney General’s Regulation No. 15 of 2020 and its Circular No. 1 of 2021 concerning the termination of prosecution based on restorative justice. The findings indicate that restorative justice is primarily applied to lesser criminal cases that fit specific criteria. These cases often involve first-time offenders, crimes that carry potential sentences of at most five years, and financial damages up to Rp 2,500,000. Of the 13 cases examined, 10 were effectively resolved using restorative justice methods. This highlights the potential of restorative justice on repairing harm, addressing victims’ needs, ensuring that offenders take responsibility, and fostering social cohesion. What sets this study apart is its combination of doctrinal legal analysis and fieldwork, enabling a comprehensive evaluation of how restorative justice norms are operationalized within prosecutorial practices in Indonesia.

Abstract

Sektor pertanian merupakan penopang utama perekonomian masyarakat Desa Hurun, Kecamatan Teluk Pandan, Kabupaten Pesawaran. Namun, berbagai program perlindungan dan pemberdayaan petani sebagaimana diamanatkan Pasal 13 Undang-Undang Nomor 19 Tahun 2013 belum terlaksana secara optimal. Dalam konteks Siyasah Tanfidziyyah, pemerintah desa berkewajiban menegakkan prinsip keadilan dan kemaslahatan melalui pelaksanaan kebijakan eksekutif yang berpihak pada petani. Berangkat dari kondisi tersebut, penelitian ini bertujuan menganalisis implementasi kewenangan Kepala Desa dalam memberikan perlindungan kepada petani serta mengkaji kesesuaiannya dengan perspektif Siyasah Tanfidziyyah. Penelitian ini menggunakan metode kualitatif deskriptif dengan pendekatan field research. Data primer diperoleh melalui wawancara mendalam dengan Kepala Desa dan petani, serta observasi lapangan terkait praktik pertanian dan program desa. Data sekunder dikumpulkan melalui peraturan perundang-undangan, literatur fiqh siyasah, dan penelitian terdahulu. Analisis data dilakukan melalui proses reduksi, kategorisasi tematik, dan interpretasi berbasis teori Siyasah Tanfidziyyah. Hasil penelitian menunjukkan bahwa pelaksanaan perlindungan petani di Desa Hurun masih jauh dari optimal. Penyediaan sarana produksi seperti pupuk dan bibit tidak merata, pelatihan pertanian belum berjalan efektif, dan pendampingan kelembagaan petani sangat terbatas. Koordinasi antara pemerintah desa, pemerintah daerah, dan lembaga pertanian juga masih lemah. Dari perspektif Siyasah Tanfidziyyah, kondisi ini mencerminkan belum terpenuhinya prinsip kemaslahatan, keadilan, dan tanggung jawab eksekutif yang seharusnya menjadi landasan kepemimpinan desa. Kesimpulan penelitian menegaskan bahwa Kepala Desa belum melaksanakan kewenangan perlindungan petani secara maksimal sesuai amanat UU 19/2013 maupun nilai-nilai Siyasah Tanfidziyyah.

Abstract

This study examines the legal status of children resulting from an annulled marriage from the perspective of human rights and child protection. This study aims to analyze the legal status of children resulting from an annulled marriage from the perspective of human rights and child protection. In judicial practice, annulment decisions often omit the status of children born from the marriage. Judges generally focus solely on the validity of the marriage, rather than on fulfilling the rights of children born from the relationship. This situation creates a legal gap because, even though the child is not at fault for the annulment of their parents' marriage, their legal status is often unclear, impacting the protection of their rights. The purpose of this study is to examine the extent to which human rights and child protection principles are integrated into judges' legal considerations when deciding annulment cases. This research uses a normative legal method with a statutory approach and case studies of several relevant court decisions. The research results show that the omission of the child's status in the verdict has the potential to conflict with the principles of non-discrimination and the best interests of the child as stipulated in the Convention on the Rights of the Child (CRC), which Indonesia has ratified through Presidential Decree No. 36 of 1990, and Law No. 35 of 2014 concerning Child Protection. From a human rights perspective, children born from an annulled marriage still have a civil relationship with their mother and their mother's family as stipulated in Article 43 paragraph (1) of the Marriage Law and the Constitutional Court Decision, No. 46/PUU-VII/2010.
