Abstract

Life insurance for Umrah and Hajj services protects pilgrims and their families financially in case of unforeseen events during Hajj. This insurance product can cover medical expenses, replacement costs of lost or damaged property, and monetary compensation in the event of death or permanent disability. By having life insurance for Umrah and Hajj, pilgrims can feel comfortable and concentrate on their pilgrimage without worrying about potential financial risks. As a risk transfer institution, insurance companies are always willing to bear all risks insured to them. However, the coverage is certainly based on the type of insurance company itself. The result of the study is PT. Asuransi Bringin Jiwa Sejahtera Jiwa organizes a Health Insurance Program for Hajj and Umrah participants by ensuring compliance with Article 80 of Law Number 8 of 2019 and Article 5 of Government Regulation Number 8 of 2022. The insurance covers life, accident, and health insurance for Hajj and Umrah pilgrims, as well as coordinating protection activities for Indonesian citizens abroad, PT. Asuransi Jiwa Bringin Jiwa Sejahtera can make claim payments and account deductions on behalf of PT. Life Insurance Brings a Prosperous Life if the documents are completed correctly. If the required documents are not submitted, PT. Asuransi Bringin Sejahtera Life may request the Head Office to forward the claim documents to the relevant Branch Office within 14 working days., Insurance Claim Barriers Customers are often delayed due to factors such as long filing times, incomplete requirements, premium payments, and insurance decision-making time. Insurers face obstacles such as slow resolution of problems and lengthy compensation processes, which can result in cancellation of coverage if the insurer already knows the real situation. The insurer must also address false or untrue statements or failure to disclose known information to the insured, as per Article 251 KUHD.

Abstract

ABSTRAKMinuman beralkohol mengandung kadar etanol atau etil alkohol yangberbeda untuk setiap jenisnya. Alkohol sering menjadi penyebab tindakan kriminal.Ada banyak kasus tertangkap karena kejahatan atau pelanggaran yang disebabkanoleh konsumsi, distribusi atau produksi alkohol. Akibat dari penggunaan danpenyalahgunaan tersebut, minuman alkohol dilarang dalam beberapa hal, baik darisegi norma agama, sosial, maupun hukum. Penelitian ini membahas tentangperedaran minuman beralkohol di Kabupaten Semarang, karena dengan beredarnyaminuman beralkohol tanpa SIUP, maka akan menimbulkan dampak negatif bagimasyarakat Kabupaten Semarang. Adapun permasahan dalam penelitian ini adalah:1) Penegakan hukum Peraturan Daerah Nomor 9 Tahun 2013 Tentang Pengawasandan Pengendalian Minuman Beralkohol yang dilakukan Satpol PP di KabupatenSemarang; dan 2) kendala dalam penegakan aturan Peraturan Daerah Nomor 9Tahun 2013 Tentang Pengawasan dan Pengendalian Minuman Beralkohol yangdilakukan Satpol PP di Kabupaten Semarang. Dalam penelitian ini menggunakanmetode penelitian hukum empiris, yakni pendekatan dilakukan penelitian lapangandengan melihat serta mengamati apa yang terjadi di lapangan, penerapan peraturanperaturan tersebut dalam praktiknya dalam masyarakat.

Abstract

ABSTRAKPemasangan reklame telah menimbulkan kontroversi, kegaduhan dan memicuproblem di Kota Semarang. Pelanggaran pemasangan reklame, dikhawatirkan menimpapengguna jalan dan dapat menggangu keselaran serta keseimbangan Kota Semarang.Penelitian ini bertujuan untuk mengatur penyelenggaraan reklame agar sesuai dengankeharmonisan, keselarasan, melindungi, serta menjamin kepentingan umum masyarakat.Penelitian ini menggunakan metode penelitian hukum empiris, yakni melalui hasillapangan yang diperoleh melalui data data yang dikumpulkaan saat wawancara danobservasi. Penelitian ini menggunakan pendekatan undang-undang. Berdasarkan hasilpenelitian dapat disimpulkan bahwa terdapat persoalan mengenai bagaimana penegakanhukum terhadap pelanggaran pemasangan reklame di Kota Semarang. Sebagian wilayah diKota Semarang pemasangan reklame belum optimal. Akibat hukum dari pelanggaranpemasangan reklame tersebut berupa sanksi denda dan pembongkaran. Selain itu,penegakan hukum mengalami hambatan berupa faktor internal yang berasal dari kurangnyakesadaran masyarakat, kurangya sarana dan informasi dan minimmnya koordinasi antarpenegak, adapula faktor eksternal yang menghambat berasal dari pemasangan reklameyang tidak berizin atau illegal.Kata Kunci : Penegakan Hukum, Pelanggaran, Reklame

Abstract

Pelayanan publik merupakan kebutuhan masyarakat yang harus dipenuhi oleh pemerintah dalam suatu negara. Pedoman umum yang digunakan dalam memberikan pelayanan publik kepada masyarakat adalah Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik di Kantor Sistem Administrasi Manunggal Satu Atap (SAMSAT). Adapun permasalahan dalam penelitian ini adalah: 1) implementasi Undang-undang Nomor 25 Tahun 2009 Tentang Pelayanan Publik di Kantor Sistem Administrasi Manunggal Satu Atap (SAMSAT) Kabupaten Rembang; 2) hambatan yang dihadapi petugas Kantor Sistem Administrasi Manunggal Satu Atap (SAMSAT) Kabupaten Rembang dalam pelaksanaan pelayanan publik pada perpanjangan Surat Tanda Nomor Kendaraan (STNK). Metode penelitian yang digunakan adalah metode penelitian empiris, penelitian hukum empiris berorientasi pada data primer (hasil penelitian dilapangan). Hasil penelitian menunjukkan bahwa pelayanan publik yang baik telah terlaksana sesuai dengan Undang-undang Nomor 25 Tahun 2009 Tentang Pelayanan Publik, karena telah meliputi indikator pelayanan publik yang baik sesuai dengan ketentuan standar pelayanan publik di Kantor Sistem Administrasi Manunggal Satu Atap (SAMSAT). Hambatan yang dihadapi terkait kendala ketika melakukan pajak lima tahunan biasanya SATLANTAS mengeluarkan surat tersebut terlalu lama dan masyarakat mengeluhkan hal tersebut. Untuk kendala sarana dan prasarana adalah kurangnya sarana dan prasarana di kantor SAMSAT yang membuat masyarakat kurang nyaman dengan suhu ruangan. Kendala pada aplikasi New Sakpole masih belum Efektif dan masih banyak masyarakat yang masih mengeluh terhadap alur prosedurnya.

Abstract

Workers with Disabilities, especially those working in private companies, have rights and obligations to obtain welfare. Private companies have an obligation to employ persons with disabilities as much as 1% (one percent) of the total number of employees working in the company. As explained in Article 53 paragraph (2) of Law Number 8 of 2016 concerning Persons with Disabilities which contains "Private companies are required to employ at least 1% (one percent) of Persons with Disabilities from the total number of employees or workers". Workers with disabilities also have other rights such as obtaining employment opportunities in private companies, obtaining positions according to the type and degree of disability, obtaining health, social and other benefits, and the company is obliged to provide adequate accommodation for workers with disabilities as a form of accessibility, in accordance with what is regulated in the legislation. The research method that was carried out by the researchers used normative juridical research methods and the data used primary and secondary data. The data collection technique used in this research is the interview method for employees with disabilities and HRD PT. Apparel One Indonesia 1 has complied with statutory regulations, such as providing opportunities to work. This company has also provided health insurance, social insurance, work accidents, and others. However, accommodation and accessibility within this company are not adequate, and this company has not fulfilled the quota of workers with disabilities of 1% of the total number of employees.  for workers with disabilities without discrimination and has placed positions that are in accordance with the type and degree of disability.

Abstract

ABSTRACTTransportation has now become a basic human need in fulfilling its mobility. The government is trying to make this happen by building mass public transportation such as bus rapid transit or BRT, city transportation and online-based transportation. However, it seems that it is still unable to meet the needs of various communities so that illegal public transportation or dark travel with private vehicles with black plates does not meet the requirements for public transportation, so that if an accident occurs it will be weak in the field of legal regulations as stipulated in Law Number 22 of 2009 concerning Traffic and road transport. The author conducted research using normative juridical methods guided by applicable laws and regulations, as well as using analytical descriptive methods to find out and understand the object of study. Illegal public transportation or dark travel operates without a permit to transport passengers without life insurance protection and does not pay mandatory fees as stipulated in Law Number 33 of 1964 concerning Passenger Accident Compulsory Insurance Funds, so that if an accident occurs the legal consequences are weak because they will not receive compensation. loss, if the passenger dies or suffers permanent disability. The government is responsible for organizing public transportation in an effort to meet the need for safe, secure, comfortable and affordable transportation. So public transportation must be in the form of a company that is licensed, legal entity and is required to pay mandatory contributions for life insurance for passengers, if an accident occurs they will receive compensation. Public transportation is illegal if in the event of an accident it will not get compensation due to death and permanent disability, because it does not pay mandatory coverage. As a result, passengers only receive compensation from the vehicle owner.

Abstract

The most fundamental thing about the modus operandi of violations in the implementation of Agrarian Law is the error in understanding, recognizing and applying the conversion of land rights from before and after the enactment of UUPA No. 5 of 1960. Apart from that, the worst thing is that there have been actions, among others, legalizing the mutation of documents with legal defects, the wrong application of the relevant law, changing the measuring papers to pictures of the situation and the mistakes of law enforcers and law enforcement. The results of this study indicate that the Basic Agrarian Law has never regulated that since the enactment of the Law, lands owned by citizens and foreigners have become land controlled by the State. Conversely, when the law is enacted, the old land rights must first apply the conversion provisions that are relevant to the position of the case, in this case are Article 1 paragraph (3), (4), (5) Provisions Conversion of UUPA and Article 12. These regulations are actually looser for foreign citizens who are being burdened with former rightsground lease. This concession and protection are explicitly or implicitly stated in these regulations, namely when there are obstacles for foreign nationals to obtain land conversion e.I dobecome property rights based on Article 1 paragraph (1) of the UUPA Conversion Provisions No. 5 of 1960, then article 1 paragraph (3) protects foreign ownership through conversion to building use rights referred to in article 35 paragraph (1) UUPA No. 5 of 1960. Abstract

The presence of online transportation is considered to really help the community in the process of mobilizing goods or people. Online transportation is currently very popular among the public, because online transportation is considered cheap and practical. Transportation is a system consisting of facilities and infrastructure, supported by management and human resources which form a service network that functions as a driver, driver and supporter of development. Protection by providing compensation for losses is an important basic basis in insurance, requiring the company to have a legitimate financial interest in the object or event being insured. In the context of online transportation, it is important for companies like Gojek to apply this principle in passenger accident life insurance. This research is a legal research using a normative juridical approach. The specifications of this research are analytical descriptive, because this research can provide a comprehensive, systematic picture and analysis of the realities in the field, especially regarding liability and insurance protection contained in legislation. Data collection is carried out by making observations and using applicable legislation. In carrying out transportation activities other than carrying out passenger trips, the transportation service provider is obliged to insure its liability, meaning that the public transportation company is obliged to compensate for losses suffered by passengers or goods senders due to negligence in carrying out transportation services. Based on article 237 paragraph (1) of the Road Traffic and Transportation Law, it is stated that public transportation companies are obliged to participate in an accident insurance program as a manifestation of their responsibility for insurance coverage for victims and public transportation companies are obliged to insure people employed as vehicle crew. The form of insurance protection provided by Gojek to passengers who use its services is the application of Article 302 of the Criminal Code. The online transportation service provider company Gojek provides insurance to passengers to ensure that travel is protected because passenger safety is Gojek's priority. The form of insurance protection for passengers in Gojek online transportation is stated in the GoRide Pasangger Insurance provisions.

Abstract

Tingginya kebutuhan investasi untuk penyediaan infrastruktur pembuatan instalasi gas medik, memberikan pilihan kepada RS. Panti Wilasa Dr.Cipto untuk mengadakan Kerja Sama Operasi (KSO) dengan PT. Surya Medika Mulia Sari. KSO merupakan suatu perjanjian baru, yang lahir dalam dunia bisnis sesuai kebutuhan masyarakat, walaupun Perjanjian KSO tidak diatur dalam KUH Perdata, namun ketentuan materiil dari Perjanjian KSO tetap mengikuti ketentuan dalam KUH Perdata. Penelitian ini mengkaji: a) analisis yuridis; b) karakteristik perjanjian; c) dan bentuk penyelesaian apabila terjadi sengketa dalam Perjanjian KSO No.059/RSPWDC/PKS.03/VII/2020 tentang pengadaan dan pemasangan sentral dan instalasi gas medis antara RS.Panti Wilasa Dr.Cipto dengan PT. Surya Medika Mulia Sari. Metode penelitian yang digunakan adalah yuridis normatif sehingga data yang dibutuhkan adalah data sekunder. Analisis dalam penelitian ini menggunakan teori dan asas hukum yang berkaitan dengan penelitian. Dari analisa yang dilakukan, Perjanjian KSO telah memenuhi baik syarat subyektif maupun obyektif perjanjian. Karakteristik Perjanjian KSO antara RS.Panti Wilasa Dr.Cipto dan PT. Surya Medika Mulia Sari terdiri atas 2 perjanjian, yaitu KSO dan perjanjian jual beli. Bentuk KSO yang disepakati oleh kedua pihak adalah KSO non administratif dengan skema Bangun Guna Serah, oleh karena KSO ini tidak membentuk badan usaha baru maka tanggung jawab berada pada tiap anggotanya yang ada dalam Perjanjian KSO. Adanya perjanjian antara pihak yang membuat perjanjian menimbulkan konsekuensi hukum, oleh karena itu penelitian ini juga dilakukan untuk mengetahui cara menyelesaikan perselihan yang dipilih oleh para pihak dalam Perjanjian KSO.

Abstract

Secara umum, balapan liar merujuk pada kegiatan memacu kendaraan bermotor, terutama kendaraan roda dua, di jalan raya tanpa dilengkapi perlengkapan keselamatan. Praktik ini dapat membahayakan pengemudi dan orang lain di sekitarnya. Indonesia telah melarang balapan liar melalui Pasal 115 huruf b Undang-undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan. Pasal tersebut menyatakan, "Pengemudi kendaraan bermotor di jalan dilarang berbalapan dengan kendaraan lain," sedangkan Pasal 297 menjatuhkan sanksi pidana bagi pelanggar, dengan ancaman pidana kurungan maksimal satu tahun atau denda hingga Rp.3.000.000,00. Kepolisian memainkan peran penting dalam menegakkan hukum dan ketertiban. Penelitian ini dilakukan di wilayah hukum Polres Kudus dengan menggunakan metode yuridis sosiologis dan teknik pengumpulan data melalui wawancara dengan narasumber dari satlantas Polres Kudus serta studi dokumen. Skripsi ini bertujuan untuk mengevaluasi penegakan hukum terkait balapan liar, sanksi yang diterapkan terhadap remaja pelaku balap liar, dan kendala yang dihadapi petugas kepolisian. Hasil penelitian menunjukkan bahwa upaya kepolisian sangat penting dalam menanggulangi balapan liar di Kudus, mengingat tingginya insiden balapan liar yang dapat membahayakan pengguna jalan dan masyarakat sekitar. Upaya kepolisian harus didukung oleh partisipasi masyarakat guna menjamin keamanan dan ketaatan terhadap aturan Undang-Undang lalu lintas jalan raya. Dengan demikian, kolaborasi antara kepolisian dan masyarakat diharapkan dapat menciptakan kehidupan yang tentram, nyaman, dan tertib sesuai dengan ketentuan perundang-undangan.
