Abstract

The sex industry in Indonesia is a phenomenon that has existed since the colonial era and has continued to develop both openly and covertly. The absence of explicit legal regulations on prostitution in Indonesia, combined with advancements in digital technology, has created new challenges in enforcing consistent regulations and has led to increased sexual exploitation, particularly of children. This study aims to explore the ambiguous regulations surrounding the commercial sex industry, focusing on voluntary sex work and sexual exploitation within the context of Indonesian law. This study employs a normative juridical research method, analyzing existing legal norms, including the Indonesian Penal Code, the Electronic Information and Transactions Law, and regional regulations governing prostitution. The findings indicate that Indonesia’s criminal policy targeting buyers of sexual services has not been entirely effective in reducing demand, as clients tend to shift to more discreet digital platforms. While this policy was expected to disrupt the industry, it has instead fostered the emergence of a black market that is more difficult to monitor, thereby increasing the risks of exploitation. Therefore, a more comprehensive policy approach is needed—one that not only focuses on criminalization but also ensures the protection of sex workers’ rights.

Abstract

In facing the challenges of globalization, organizations are not only required to achieve financial benefits, but also to ensure sustainability in social and environmental aspects. This study explores the role of transformational leadership in building a sustainable organization, with a case study at PT Pos Indonesia (Persero). Through a qualitative approach, this study analyzes the impact of transformational leadership on innovation, employee engagement, and organizational culture that supports sustainability. The results of the study indicate that transformational leadership contributes significantly to creating a clear long-term vision, encouraging employee empowerment, and building a positive organizational culture. The main factors that influence the effectiveness of this leadership include effective communication, empathy, employee empowerment, appreciation for contributions, and delivery of a clear vision. These findings provide insights for organizational leaders in developing responsive and adaptive leadership strategies to future business challenges

Abstract

This study aimed to evaluate the effectiveness of the SEHATI (Free and Fast Halal Certification for Micro and Small Businesses) service innovation in improving the efficiency of the halal certification process in Indonesia. The main issue raised is the low efficiency of time, cost, and access to halal certification services, especially for Micro and Small Businesses (UMK). By using a mixed method approach and convergent parallel design, quantitative data was collected through a survey of 71 UMK actors, while qualitative data was obtained through interviews with BPJPH, LPH, and PPH assistants. The results of the analysis showed that time efficiency, cost efficiency, process accessibility, and flexibility do not have a significant effect on service satisfaction. At the same time, qualitative findings reveal various obstacles such as limited digital literacy, hidden costs, and inefficiencies in the field verification process. Although SEHATI has brought about change through digitalization and self-declaration, its implementation has not been fully effective. SEHATI is a strategic innovation with the potential to improve the efficiency of halal certification, yet its implementation still requires improvements in the aspects of assistance, system simplicity, and digital infrastructure so that its benefits are felt evenly and sustainably by MSME actors.

Abstract

Kegiatan pengabdian masyarakat ini bertujuan untuk meningkatkan pemahaman masyarakat Kabupaten Bandung Barat tentang manfaat koperasi berbasis syariah dalam mendukung perekonomian umat. Melalui metode penyuluhan, tim pengabdi memberikan edukasi tentang prinsip-prinsip syariah yang mendasari operasional koperasi, seperti keadilan, transparansi, dan bagi hasil (profit-sharing). Peserta yang terdiri dari pelaku UMKM, ibu rumah tangga, dan pemuda antusias mengikuti sesi pemaparan materi serta diskusi interaktif. Hasil evaluasi menunjukkan peningkatan signifikan dalam pemahaman peserta tentang manfaat koperasi syariah, seperti akses pembiayaan halal, pengelolaan keuangan yang transparan, dan pemberdayaan ekonomi berbasis komunitas. Kegiatan ini diharapkan dapat mendorong partisipasi aktif masyarakat dalam membangun koperasi syariah sebagai solusi ekonomi berkelanjutan. Dukungan dari pemerintah daerah dan stakeholder terkait juga diperlukan untuk memastikan keberlanjutan program ini.

Abstract

Kegiatan Pengabdian Kepada Masyarakat (PKM) ini bertujuan memberdayakan narapidana perempuan di Lapas Perempuan Kerobokan melalui penyuluhan motivasi dan pelatihan kewirausahaan. Metode yang digunakan adalah pendekatan edukatif dan partisipatif, mencakup ceramah, diskusi, simulasi, serta coaching personal. Kegiatan ini berhasil meningkatkan motivasi, kepercayaan diri, dan pengetahuan kewirausahaan bagi 30 warga binaan perempuan. Evaluasi menunjukkan peningkatan signifikan pada pemahaman dan kesiapan mental peserta untuk menghadapi kehidupan pasca-lapas. Program ini membuktikan bahwa intervensi yang menggabungkan aspek psikologis dan keterampilan praktis dapat menjadi model rehabilitasi sosial yang efektif, memanusiakan, dan memberdayakan. Kegiatan ini juga menjadi contoh kolaborasi multipihak antara akademisi, lembaga pemasyarakatan, dan komunitas dalam menciptakan sistem pembinaan yang lebih holistik dan transformatif.

Abstract

This study compares legal maxims or legal principles in common law and Islamic law, focusing on the similarities and differences in applying these rules in dispute resolution. The legal maxim in these two legal systems is a fundamental principle that guides judges and legal practitioners in interpreting legal rules and deciding cases. In common law, legal maxims develop through precedent and jurisprudence. In contrast, in Islamic law, this rule comes from religious texts such as the Qur'an and Hadith, as well as the development of law by scholars. The normative-comparative approach method is used to analyze the similarities and differences of the maxim legal in both legal systems. This method helps identify important points of similarity and differences and reveals ways in which the two legal systems can complement each other. This comparative study concludes that Common Law and Islamic Law originate from different foundations, secular precedent versus divine revelation; they share a fundamental commitment to justice, embodied in maxims like "no punishment without law." Their paths diverge in methodology: Common Law prioritizes legal certainty through precedent, while Islamic Law seeks balance through moral objectives (maqasid-al-shari'ah). Significantly, in pluralistic systems like Indonesia, these traditions converge pragmatically. Courts creatively blend principles, merging pacta sunt servanda with al-`ādatu muhakkamatun to deliver legally sound and contextually just rulings. This demonstrates that the future of effective dispute resolution lies not in choosing between systems, but in their thoughtful integration to achieve substantive justice.

Abstract

This study examines the role of international cooperation in anti-terrorism law enforcement in response to the complexity of terrorism threats that are transnational and transnationally organized. Using normative research methods that focus on the analysis of laws and regulations and international legal instruments, this study examines the effectiveness of cooperation mechanisms between countries in strengthening law enforcement and preventing acts of terrorism. The findings of the study show that international cooperation, through intelligence exchange, legal harmonization, extradition, and technical capacity building of law enforcement officials, makes a significant contribution to strengthening the effectiveness of anti-terrorism law enforcement. However, challenges in the form of differences in political interests, domestic legal constraints, and state sovereignty issues are still the main obstacles. This study recommends strengthening inclusive cooperation mechanisms based on respect for international norms as a strategic step to deal with the dynamics of terrorism threats globally. Thus, international cooperation is not only a tool of law enforcement but also a key element in terrorism prevention strategies.

Abstract

This article examines the implementation of the principle of non-refoulement in Indonesia’s policy on foreign refugees from both international and national legal perspectives. As a non-signatory to the 1951 Refugee Convention and its 1967 Protocol, Indonesia is not bound by their formal obligations; however, the principle of non-refoulement remains relevant as part of customary international law. The study employs a normative legal research method, analyzing primary and secondary legal sources, including international instruments, national regulations, and policy practices. Findings indicate that while Indonesia has taken initial steps through Presidential Regulation No. 125 of 2016, the absence of a dedicated refugee law, inconsistent inter-agency coordination, limited administrative capacity, and negative public perceptions hinder effective implementation of non-refoulement. Furthermore, refugee detention conditions and ad hoc decision-making often fail to meet international human rights standards. The article concludes that harmonizing international norms with domestic law is essential for a more structured and humane refugee protection framework. Recommendations include enacting specific legislation on refugees, enhancing institutional coordination, improving detention facilities, and increasing public awareness. With stronger political will and commitment to humanitarian values, Indonesia can strengthen its role as a responsible transit country and contribute meaningfully to global refugee protection efforts.

Abstract

Pandemi covid 19 mempunyai dampak yang sangat besar terhadap sektor perekonomian, tidak terkecuali bidang usaha koperasi. Menghadapi hal tersebut koperasi berusaha bertahan dengan berbagai cara, salah satunya melakukan perubahan struktur koperasi. Tujuan pengabdian kepada masyarakat ini untuk menambah wawasan pengetahuan bagi anggota koperasi. Metode yang digunakan dalam kegiatan ini melalui sosialisasi penyuluhan hukum. Hasil yang diperoleh dalam kegiatan ini terlihat dalam simulasi rapat anggota tahunan koperasi dengan bahasan pokok perubahan struktur pengurus koperasi. Pengurus koperasi bertugas untuk mengelola kegiatan dan bidang usaha dengan tujuan untuk kesejahteraan anggota. Perubahan pengurus dilakukan melalui rapat anggota koperasi yang dilakukan secara tatap muka atau secara daring. Keputusan dari rapat anggota tahunan tersebut dilaporkan kepada pemerintah atau pemerintah daerah berdasarkan wilayah keanggotaan koperasi. Pengawasan kegiatan koperasi dilakukan oleh pemerintah sebagai bentuk perlindungan hukum terhadap anggota koperasi yang terdaftar, jika dalam pengawasan ditemukan pelanggaran maka pemerintah berwenang unutk memberikan sanksi administratif. Kegiatan pengabdian kepada masyarakat ini mempunyai dampak yang cukup signifikan dengan indikator pemahaman ketentuan peraturan perundang-undangan yang berlaku bagi anggota dan pengurus koperasi hikmah berkah silaturahim.

Abstract

This study discusses women's right to abortion without the husband's consent from the perspective of Islamic family law. The main focus of this study is to explore how Islam views women's reproductive rights in the context of abortion decision-making, especially when the decision is made without involving the husband. This study uses a normative approach by referring to primary sources such as the Qur'an, Hadith, and jurisprudence books, as well as secondary sources in the form of scholars' fatwas and contemporary literature. The analysis results indicate that Islam allows women to make decisions regarding their health, including abortion in cases of medical emergencies or pregnancy due to rape. However, the principle of joint responsibility in marriage also requires the involvement of the husband in such decision-making. Conflicts between women's reproductive rights and the rights of husbands often arise due to differences in views on the priorities of justice and maslahah (well-being). Abortion without the husband's consent can have a negative impact on household harmony, such as communication breakdowns, distrust, and moral conflicts. Therefore, the proposed solution is the application of the principle of consultation (musyawarah) as an effort to reach a fair and beneficial agreement for all parties.
