Abstract

The public's understanding of Islamic inheritance law is still low and often causes conflicts in the distribution of inheritance. To overcome these problems, the socialization of the mechanism for determining heirs in Islam is carried out which aims to increase public knowledge and awareness of the importance of implementing sharia inheritance law. This activity was carried out by a service team from the Indonesian Computer University involving one resource person from the Law Study Program. The implementation method includes lectures, group discussions, case studies, and evaluation using pre-test and post-test questionnaires. The results of the evaluation showed an increase in participants' understanding, with an average pre-test score of 4.5 to 8.3 in the post-test. The enthusiasm of the participants was very high and many expected regular follow-up programs. This activity has a positive impact in helping the community understand the mechanism for determining heirs and resolve disputes peacefully in accordance with sharia.

Abstract

This study aimed to evaluate the effectiveness of the SEHATI (Free and Fast Halal Certification for Micro and Small Businesses) service innovation in improving the efficiency of the halal certification process in Indonesia. The main issue raised is the low efficiency of time, cost, and access to halal certification services, especially for Micro and Small Businesses (UMK). By using a mixed method approach and convergent parallel design, quantitative data was collected through a survey of 71 UMK actors, while qualitative data was obtained through interviews with BPJPH, LPH, and PPH assistants. The results of the analysis showed that time efficiency, cost efficiency, process accessibility, and flexibility do not have a significant effect on service satisfaction. At the same time, qualitative findings reveal various obstacles such as limited digital literacy, hidden costs, and inefficiencies in the field verification process. Although SEHATI has brought about change through digitalization and self-declaration, its implementation has not been fully effective. SEHATI is a strategic innovation with the potential to improve the efficiency of halal certification, yet its implementation still requires improvements in the aspects of assistance, system simplicity, and digital infrastructure so that its benefits are felt evenly and sustainably by MSME actors.

Abstract

Introduction: The issue of abortion without spousal consent remains a contentious topic in Islamic jurisprudence, reflecting broader debates on women's autonomy and reproductive rights within marriage. Islamic family law traditionally emphasizes mutual agreement between spouses in major decisions, including those related to pregnancy. However, the question of whether a woman can independently decide to terminate a pregnancy without her husband’s approval remains subject to differing interpretations among scholars and legal schools. Purposes of the Research: This study aims to investigate the legality and ethical implications of unilateral abortion by women under Islamic jurisprudence, focusing particularly on the role and requirement of spousal consent. Methods of the Research: The research adopts a normative legal methodology, conducting a textual and thematic analysis of primary Islamic legal sources, including the Qur’an, prophetic traditions (Hadith), and the classical juristic rulings (fiqh), alongside contemporary scholarly opinions and legal frameworks in Muslim-majority countries. Results Main Findings of the Research: The findings reveal that while most Islamic legal traditions require spousal consultation or consent, certain conditions such as threats to the mother’s life or health may justify a woman's independent decision to abort. The study underscores a spectrum of legal opinions, from those mandating strict spousal consent to those permitting unilateral decisions based on the principle of avoiding harm (darar), and suggests that a balance can be achieved through a maqasid al-shari'ah (objectives of Islamic law) approach that prioritizes the well-being of the mother while respecting the marital partnership.

Abstract

This study compares legal maxims or legal principles in common law and Islamic law, focusing on the similarities and differences in applying these rules in dispute resolution. The legal maxim in these two legal systems is a fundamental principle that guides judges and legal practitioners in interpreting legal rules and deciding cases. In common law, legal maxims develop through precedent and jurisprudence. In contrast, in Islamic law, this rule comes from religious texts such as the Qur'an and Hadith, as well as the development of law by scholars. The normative-comparative approach method is used to analyze the similarities and differences of the maxim legal in both legal systems. This method helps identify important points of similarity and differences and reveals ways in which the two legal systems can complement each other. This comparative study concludes that Common Law and Islamic Law originate from different foundations, secular precedent versus divine revelation; they share a fundamental commitment to justice, embodied in maxims like "no punishment without law." Their paths diverge in methodology: Common Law prioritizes legal certainty through precedent, while Islamic Law seeks balance through moral objectives (maqasid-al-shari'ah). Significantly, in pluralistic systems like Indonesia, these traditions converge pragmatically. Courts creatively blend principles, merging pacta sunt servanda with al-`ādatu muhakkamatun to deliver legally sound and contextually just rulings. This demonstrates that the future of effective dispute resolution lies not in choosing between systems, but in their thoughtful integration to achieve substantive justice.

Abstract

The rapid development of digital technology has enabled new forms of child sexual exploitation, including sexual grooming conducted through live-streaming platforms. This phenomenon demonstrates not only the heightened vulnerability of children in cyberspace but also the limitations of national legal frameworks in addressing crime patterns characterized by anonymity and online financial transactions. This study employs a combined normative and empirical juridical approach to provide a comprehensive understanding of online grooming cases in Indonesia. The normative component analyzes statutory provisions, child protection laws, and digital platform regulations to identify the intended legal protections for children. The empirical component complements this by collecting first-hand insights through semi-structured interviews with law enforcement officers, representatives of the Indonesian Child Protection Commission (KPAI), digital platform operators, and victim support companions. The integration of these approaches reveals gaps between legal norms and enforcement practices, particularly regarding institutional constraints, reporting mechanisms, and socio-technical challenges faced in case handling. The findings show that grooming through live streaming involves complex psychological manipulation facilitated by platform features that allow perpetrators to maintain anonymity. Current regulations do not explicitly recognize online grooming as a distinct criminal offense, nor do they adequately address anonymous electronic transactions commonly used in this crime. Court decisions also illustrate inconsistencies in legal application due to the absence of specific norms governing technology-based grooming. These findings highlight the urgency of reformulating national legal policies by introducing explicit criminal norms on digital grooming, strengthening penalties for online media–based sexual crimes, and regulating anonymous online transactions. The study further recommends enhancing the role of digital financial institutions and technology platforms in prevention, monitoring, and reporting mechanisms. In addition, community-based education and preventive interventions are essential to complement law enforcement efforts and create a safer digital environment for children.
