Abstract

Qanun No. 6 of 2014 serves as a key instrument in the enforcement of Islamic law (sharia) in Aceh, established under the framework of regional autonomy as stipulated in Law No. 11 of 2006 concerning the Government of Aceh. This study aims to evaluate the implementation of Qanun Aceh No. 6 of 2014 on Jinayat Law by Wilayatul Hisbah (WH) in preventing violations of Islamic law in Banda Aceh City. The research employs a qualitative method with a descriptive approach. The findings indicate that the enforcement of the qanun has been carried out through various mechanisms, including routine patrols, public outreach, and legal action. However, its effectiveness remains hindered by several challenges such as limited human resources, inadequate infrastructure, uneven public understanding, and social resistance to the application of sharia-based legal sanctions. The study highlights the importance of adopting a persuasive approach, strengthening inter-agency coordination, and enhancing the capacity of WH personnel to improve the effectiveness of the qanun’s implementation. Based on George C. Edwards III’s policy implementation theory, key factors such as communication, resources, disposition of implementers, and bureaucratic structure significantly influence the success of the policy. Through integrated and collaborative strategies, the implementation of the qanun is expected to be more effective in fostering social order in accordance with Islamic values in Banda Aceh.   ABSTRAKQanun No. 6 Tahun 2014 menjadi instrumen penting dalam penegakan syariat Islam di Aceh, yang diatur secara khusus melalui otonomi daerah berdasarkan Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh. Penelitian ini bertujuan untuk mengevaluasi implementasi Qanun Aceh Nomor 6 Tahun 2014 tentang Hukum Jinayat oleh Wilayatul Hisbah (WH) dalam pencegahan pelanggaran syariat Islam di Kota Banda Aceh. Penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif analitis. Hasil penelitian menunjukkan bahwa pelaksanaan qanun ini telah dilakukan melalui berbagai mekanisme seperti patroli rutin, sosialisasi, serta tindakan hukum. Namun, efektivitas pelaksanaan masih menghadapi berbagai kendala, seperti keterbatasan sumber daya manusia, infrastruktur, pemahaman masyarakat yang belum merata, serta resistensi sosial terhadap penegakan hukum berbasis syariat. Penelitian ini juga menekankan pentingnya pendekatan persuasif, penguatan koordinasi antar instansi, serta peningkatan kapasitas aparat WH dalam meningkatkan efektivitas implementasi qanun. Berdasarkan teori implementasi kebijakan George C. Edwards III, aspek komunikasi, sumber daya, disposisi pelaksana, dan struktur birokrasi menjadi faktor penentu dalam keberhasilan kebijakan ini. Dengan strategi yang terintegrasi dan kolaboratif, implementasi qanun diharapkan dapat berjalan lebih optimal dalam menciptakan ketertiban sosial sesuai nilai-nilai syariat Islam di Banda Aceh.

Abstract

The process of legislation on the Qanun by the Aceh People's Representative Council (DPRA) is a unique legal mechanism in the Indonesian government system, because it is closely related to the implementation of Islamic sharia in Aceh. This study aims to see the relevance of the Qanun legislation process in Aceh from the perspective of the concept of Islamic politics put forward by Imam Al-Mawardi, a classical Islamic thinker who discusses a lot of Islamic government theory and law. This research uses a qualitative approach with descriptive analysis methods and literature studies on Al-Mawardi's thoughts in the book Al-Ahkam As-Sultaniyyah. The results of the study show that in the Qanun legislation process, the DPRA plays a role as a legislative body that has the authority to formulate regional regulations based on Islamic law. However, in practice, there are still challenges such as local political dynamics, the interests of various actors, and synchronization with national law. So, how does the DPRA use the concept of Islam in the Qanonic legislation process? And in the legislative process, the DPRA prioritizes certain political interests over the interests of the people? Al-Mawardi's perspective provides insight that good legislation must pay attention to the balance between Islamic law and the benefit of the ummah, and avoid political interests that can hinder the ideal implementation of sharia. Thus, this research contributes to the understanding of the Qanun legislation process from an Islamic political perspective and offers recommendations so that the DPRA can carry out its duties more optimally following the principles of ideal Islamic governance according to Al-Mawardi.

Abstract

The enactment of the Aceh Governance Law (UUPA) allows the state’s intervention to the nature of Islamic boarding schools in Aceh, which is originally connected to Aceh’s socio-cultural system into the formality of the State’s administrative structure. This article utilized a triangulation methodology, which involved the integration of document analysis, observation, and in-depth interviews. The study generated data from participants located within the dayah, including 2 teungku chik (leadership), 2 teachers, and 5 students; and participants located outside the dayah, including 2 academics, 2 social figures, and a director of Department of Dayah Education. The findings of our study indicated that the institutional frameworks of dayah had undergone modernization, with significant improvements in infrastructure, integration of curricula, enhancement of human resources (teungku-teacher and santri-student), and expansion of collaborations and networks. This modification granted the dayah of Aceh a more favorable standing within the Acehnese social hierarchy. This study highlighted that dayah institutions retained their cultural foundation as centers of Islamic instruction despite the changes they experienced. Instead, the incorporation of State action has led to the establishment of institutional and intellectual prosperity; it appeared that state intervention was more of an opportunity than a threat.

Abstract

Article 2 of Law Number 7 of 2008 concerning Political Parties jo. Article 173 Paragraph 2 of Law Number 7 of 2018 concerning General Elections mandates that political parties must include at least 30% women in their management and establishment; however, the practice of this target is not being met. The problem of this research focuses on the low participation of women in politics, both according to positive law and Islamic law, as well as the involvement of women in politics in the Nagan Raya DPRK through a fiqh siyasah analysis. This study aims to identify the level of women's political participation from the perspective of law and Islamic law and to explore the factors influencing women's political involvement in Nagan Raya. The research uses a qualitative descriptive method with a statutory approach and descriptive analysis. The research findings indicate that women's participation and position in politics are critical to the effectiveness of their role in policy formulation and decision-making within public institutions. The lack of women's participation in politics is due to the deeply ingrained patriarchal culture in society, which results in gender inequality between men and women. Women's representation in parliament to advocate for their rights and interests in decision-making or policy formulation remains very low. The contribution of this research is to provide insights into the importance of women's involvement in politics and its impact on creating more inclusive policies. This study also highlights the need to address social and cultural barriers to increasing women's political participation in Indonesia. .

Abstract

Discriminatory treatment and gender stereotypes against women in the justice system are directly related to women's accessibility to justice. The more women experience discrimination and negative stereotypes, the more limited their access to justice becomes. The implementation of Supreme Court Regulation (PERMA) No. 3 of 2017 concerning Guidelines for Adjudicating Cases Involving Women in Conflict with the Law has not been effectively carried out. For instance, some judges in the trial process have not adhered to the guidelines set out in PERMA No. 3 of 2017. In reality, there are still judges who make belittling, blaming, intimidating statements, and use loud voices against women in conflict with the law, which can undermine women's mentality in court. In response to these conditions, the Supreme Court, as the highest judicial institution in Indonesia, has initiated steps to gradually eliminate discriminatory treatment against women in conflict with the law in judicial practices in Indonesia. This study aims to examine the efforts made by judges in implementing PERMA No. 3 of 2017 at the Banda Aceh Sharia Court and to explore the perspectives of Sharia Court judges regarding the implementation of PERMA No. 3 of 2017. The research uses a qualitative method with a field research approach. This study indicates that there are still challenges in implementing PERMA No. 3 of 2017 at the Banda Aceh Sharia Court. However, efforts are being made to reduce discrimination and negative stereotypes against women in conflict with the law. This research contributes to providing insights into the importance of implementing guidelines to reduce discriminatory treatment and offering recommendations to improve the effectiveness of PERMA No. 3 of 2017 in addressing gender discrimination issues in Indonesian courts.

Abstract

There are two reasons why Tjokroaminoto maintained a cooperative attitude toward the Dutch. First, he was more inspired by the fear of government retaliation than by conviction; at that time, based on Article 111 of the ordinance of 1854, the Dutch government forbade any political association. Second, this attitude could not be separated from the political environment created by the Dutch government. Abstract

This research aims to analyze the factors that influence non-Muslim customers interest in saving at the Bank Syariah Indonesia BandaAceh Branch. With a background as a province with a majority Muslim population and the implementation of sharia law, Aceh provides its own challenges for non-Muslim customers in choosing financial institutions. This research covers factors such as regulatory policies, social norms, and the availability of Islamic banking services that influence the decision of non-Muslim customers to choose Bank Syariah Indonesia. The research method used is qualitative through the preparation and distribution of questionnaires distributed to non-Muslims as customers of Bank Syariah Indonesia. The results of this study there are several factors that cause non-Muslim customers to choose Bank Syariah Indonesia over other Islamic banks, namely non-Muslim customers in Banda Aceh tend to prefer Bank Syariah Indonesia (BSI) because of the affordability of location, attractive product promotions, quality service, and aspects forced by government regulations. These factors influence the decision of non-Muslim customers in choosing BSI as the first choice for their banking needs in the area.

Abstract

Hakim Mahkamah Syar’iyah Aceh melalui putusannya Nomor 07/JN/2016/MS.Aceh membatalkan putusan Hakim Mahkamah Syar’iyah Langsa yang menjatuhkan hukuman cambuk bagi pelaku pelecehan seksual kepada anak. Putusan Mahkamah Syar’iyah berbeda dengan tuntutan Jaksa Penuntut Umum yang menuntut ‘uqubat (hukuman) penjara selama 90 bulan kepada pelaku karena melakukan pelanggaran terhadap Pasal 47 Qanun Aceh Nomor 6 Tahun 2014 tentang Hukum Jinayat. Penelitian ini bertujuan untuk mengetahui pertimbangan hakim membatalkan hukuman cambuk bagi pelaku pelecehan seksual kepada anak dan mengkaji putusan Nomor 07/JN/2016/MS.Aceh terkait terpenuhi kepentingan terbaik kepada anak atau tidak. Kajian ini termasuk penelitian yuridis normatif yang mengkaji tentang asas-asas, kaidah-kaidah hukum sesuai teori-teori yang terdapat dalam ilmu hukum. Hasil penelitian menunjukkan bahwa pertimbangan hakim membatalkan hukuman cambuk dalam putusan Nomor 07/JN/2016/MS.Aceh dikarenakan putusan MS Langsa belum memberikan efek jera kepada pelaku, supaya anak tidak berjumpa dengan pelaku karenanya hakim tinggi menghukum dengan hukuman penjara, mementingkan kepentingan terbaik bagi anak dan membuatkan pelaku menjadi insaf manakala berada di dalam penjara. Putusan hakim telah memperhatikan kepentingan terbaik bagi anak, karena membuat pelaku insaf, menjauhkannya dari anak, sesuai dengan konsep mashlahah murshalah dan adanya pengakuan secara aturan hukum berdasarkan Qanun Aceh Nomor 7 Tahun 2013 tentang Hukum Acara Jinayat dan Qanun Aceh Nomor 6 Tahun 2014 tentang Hukum Jinayat. Diharapkan kepada hakim yang mengadili kasus pelecehan seksual, dan pemerkosaan pada anak supaya memperberat hukumannya dan mengutamakan kepentingan terbaik bagi anak (the best interest of the child) dan masa depannya.Judge of the Court of Syar'iyah of Aceh through its verdict Number 07 / JN / 2016 / MS.Aceh annulled the verdict of the Court of Justice of Syar'iyah Langsa which imposed a whip for the perpetrators of child sexual abuse. The decision of the Court of Syar'iyah is different from that of the Public Prosecutor demanding 'uqubat (punishment) of imprisonment for 90 months to the perpetrator for violating Article 47 Qanun Aceh Number 6 Year 2014 on Jinayat Law. This study aims to determine the judge's consideration of cancellation of punishment for child abuse perpetrators and review the decision No. 07 / JN / 2016 / MS.Aceh related to the best interests of the child or not. This study includes normative juridical research that examines the principles, legal rules according to theories contained in the science of law. The result of the research shows that judge consideration cancels the caning punishment in decision No. 07 / JN / 2016 / MS.Aceh because the decision of MS Langsa has not given deterrent effect to the perpetrator, so that children do not meet with the perpetrator because high judge punish by prison sentence, and make the perpetrator become converted when in prison. The judge's decision has taken into account the best interests of the child, for making the perpetrators convert them away from the children, in accordance with the concept of masshlahah murshalah and the recognition of the rule of law based on Qanun Aceh Number 7 of 2013 on the Law of Jinayat and Qanun Aceh No. 6 of 2014 on Jinayat Law. It is expected that the judge who hears cases of sexual harassment, and rape on the child in order to aggravate the sentence and prioritize the best interest of the child and the future.

Abstract

The Job Creation Law has caused controversy from various circles of society, both in terms of the procedure for its formation and the contents, especially the labor cluster. Many materials in the Job Creation Law reduce workers’ rights by creating a flexible working relationship. The relationship is more in favor of the interests of employers, thus raising the issue of legalizing modern slavery, which is contrary to human rights. This study analyzes changes in workers’ rights, especially regarding wages, specific worktime agreements, outsourcing, and severance pay from a human rights perspective. This research was normative legal research, namely on the substance of workers’ rights after the Job Creation Law from a human rights perspective, with a statutory approach and a conceptual approach. The analysis revealed that the job creation law policy is an effort to create the broadest possible employment opportunities and attract greater investment to Indonesia. In addition, it is to realize the human rights of workers who have not worked. The changes in the Job Creation Law and its implementing regulations that abolish and reduce workers’ rights and make work relations more flexible can violate workers’ human rights. On the other hand, the Government is trying to strike a balance by creating new and fair workers’ rights.
