Abstract

Adoption of children in Islam can adjust to the habits (‘urf) of the community as long as it does not conflict with the principles of syara’. Likewise family life in Indonesian society still implements the habit of breastfeeding children (radhā ‘) to others. One of the Ijtihad ‘A’isyah believes that a child who is close to reaching baligh can become a maḥram with a mother who is breastfeeding him. This opinion must be understood by the principle of ihtiyāṭ (caution). Observing the authority of the Religious Court in determining the status of adopted children who adhere to the principle that between adopted children and adoptive parents is not a muhrim so they must maintain genitalia. Therefore ijtihad ‘A’isyah is an opportunity to be enforced by emphasizing the age limit of adopted children who are allowed to breastfeed, so that adopted children have the status of maḥram.

Abstract

Kegiatan ini merupakan pelatihan tata cara penyelenggaran jenazah yang diadakan dengan tujuan menyatukan pendapat sehingga tidak ada lagi perselisihan yang terjadi di tengah-tengah Masyarakat. Penyelenggaraan jenazah hukumnya fardhu kifayah yang merupakan kewajiban bagi kaum muslimin yang apabila dilakukan oleh Sebagian kecil muslimin itu sudah menyelamatkan kaum muslimin yang lainnya. Banyak Masyarakat yang meragukan tata cara penyelenggaraan jenazah terutama pada bagian memandikan. Kenagarian Panampuang mengadakan pelatihan tata cara penyelenggaraan jenazah untuk menyatukan pendapat tersebut. Kegiatan ini merupakan kegiatan pengabdian Masyarakat yang dilaksanakan oleh dosen STIT Ahlussunnah Bukittinggi yang bertempat di Aula Wali Nagari Panampuang Kecamatan Ampek Angkek. Pelatihan ini diawali dengan pembukaan dari wali nagari dan pemuka Masyarakat, kemudian penjelasan dari narasumber secara teori dan praktek. Setelah penjelasan secara teori, saat sesi tanya jawab banyak bermunculan pertanyaan yang berkaitan dengan memandikan jenazah. Setelah memberikan penjelasan secara teori, lanjut dengan mempraktekkan cara mengafani jenazah yang diselingi oleh pertanyaan peserta. Peserta yang hadir merupakan Ibu-ibu majlis ta’lim yang masih aktif di tengah-tengah Masyarakat Nagari Panampuang. Setelah pelatihan tata cara penyelenggaraan jenazah ini, para peserta menyadari bahwa perbedaan selama ini tidak melanggar syari’at. Selanjutnya setiap menyelenggarakan jenazah sudah bisa memaklumi hal-hal yang berkaitan dengan adat budaya yang tidak mempengaruhi aturan syari’at dalam pelaksanaannya.

Abstract

The development of customs and Islam became a harmonious relationship that should not have any overlap within it, but the theory imposed by the Dutch (Colonial) built the conception that customs and Islam could not be united with each other. So this can be made into a research study by explaining the theories presented by colonialism and evaluating them with the reforms of Islamic law in Indonesia. The goal is to find a bright spot between customs and Islam that has increasingly caused conflicts until now. The research was conducted using a literature study, which involved examining previous studies as primary sources and supplementing them with expert opinions to support existing theories. The results obtained show that customary law and Islamic law are openly stated to be very harmonious, but this is not the case when viewed from the three existing theories. However, the conception used, if revised, will become a renewal that indirectly illustrates that customary law also has Islamic concepts, and Islamic law can be aligned when there are things that contradict Islamic law.

Abstract

Buy Now Pay Later (BNPL) services have gained significant popularity among Indonesian customers, particularly within the younger demographic that values convenience and flexibility in online shopping. This research uses a qualitative approach to examine the applications of Islamic law on the utilization of BNPL inside digital transactions in Indonesia, while also assessing its effects on consumer behavior and economic stability. The findings indicate that although Buy Now Pay Later (BNPL) provides ease and accessibility for consumers, substantial obstacles exist in aligning this practice with maqāṣid sharia principles, especially with usury and consumer protection issues. Factors such as financial literacy, governmental laws, and product transparency significantly impact the adoption of BNPL, shaping customer comprehension and utilization of these services. Islamic financial institutions bear a significant obligation to deliver several itemsthat not only meet the demands of consumers but also sharia compliance. As such, this research contributes to strengthening the integration between digital technology and the financial system, as well as supporting sustainable economic growth that is compliant with Shariah principles.

Abstract

Qashar shalat adalah memendekkan rakaat shalat yang berjumlah empat rakaat menjadi dua rakaat saja. Shalat yang bisa dipendekkan, menurut kesepapakatan ulama, yaitu shalat yang berjumlah empat rakaat saja, seperti Zhuhur, Ashar, dan Isya, bukan shalat Subuh dan Maghrib. shalat tidak sah bila dilakukan tidak sesuai dengan tata cara dan waktu yang ditentukan. Namun demikian dalam kondisi-kondisi tertentu Allah memberikan rukhshah (keringanan) bagi orang-orang yang mengalami kesulitan untuk mengerjakan shalat sesuai dengan ketentuan dasar tersebut. Tujuan Allah memberikan rukhshah (keringanan) adalah untuk menghilangkan kesulitan dan kesusahan. Dalam makalah ini penulis akan mengkaji bagaimana hukumnya mengqashar shalat dan menjama’shalat dengan alasan macet dan kesibukan.

Abstract

I’adah (repeating prayer) is to repeat the implementation of an obligation in time according to the provisions of the sharak for the second time due to the occurrence of shortages or aging in the implementation of the first obligation. In the matter of repeating this prayer, the existence of the traditions of the Prophet Muhammad explained about the ability to repeat prayers in congregation, meaning someone who had prayed at his house, then he went to the mosque and found a congregation who would pray, he was allowed to repeat pray by joining the congregation. However, in other traditions, indications of prohibition were found to repeat the same prayer on one day even with congregations. The two versions of the hadith appear to be textually contradictory, but as Imam Shafi'i's statement states that the traditions of the Prophet Muhammad will not be contradictory, a solution can be found so that a proper understanding of the traditions that appear to be contradictory can be found. Therefore, it is necessary to analyze a complete understanding of the traditions of repeating prayers in congregation so that the law can be repeated in congregation.

Abstract

One of the topics of debate between the old and the young at the beginning of the 20th century was the question of talaffuzh intention. The discourse on talaffuzh intention does not only involve the scholars who are in the country, but also involves the Minangkabau cleric who lives in Mecca al Mukarramah, namely Sheikh Ahmad Khatib al-Minangkabawi. The thoughts he put forward often lead to polemics with scholars in the archipelago. One of them is about talaffuzh intention. In this article the author examines how Ahmad Khatib thinks about talaffuzh intentions and how the legal istinbâth method he uses. The purpose of this study is to explain Ahmad Khatib's thoughts about talaffuzh intentions and the legal istinbâth method he uses. This type of research is library research. The collected data were analyzed using content analysis method. Based on the research conducted, it can be concluded: according to Ahmad Khatib, the law of reciting intentions is sunnah. The legal istinbâth method he uses in this problem is the qiyâs method.Salah satu topik perdebatan antara kaum tua dan kaum muda pada awal abad ke-20 adalah persoalan talaffuzh niat. Diskursus tentang talaffuzh niat tidak hanya melibatkan para ulama yamg berada di tanah air, tapi juga melibatkan ulama Minangkabau yang bermukim di Mekah al Mukarramah yaitu Syekh Ahmad Khatib al-Minangkabawi. Pemikiran yang dikemukakannya tidak jarang menimbulkan polemik dengan ulama di Nusantara. Salah satunya adalah mengenai talaffuzh niat. Dalam artikel ini penulis meneliti bagaimana pemikiran Ahmad Khatib tentang talaffuzh niat dan bagaimana metode istinbâth hukum yang digunakannya. Adapun tujuan penelitian ini adalah untuk menjelaskan pemikiran Ahmad Khatib tentang talaffuzh niat dan metode istinbâth hukum yang digunakannya. Jenis penelitian ini adalah penelitian kepustakaan. Data yang terkumpul dianalisa dengan menggunakan metode content analysis. Berdasarkan penelitian yang dilakukan dapat disimpulkan: menurut Ahmad Khatib, hukum melafalkan niat adalah sunnah. Metode istinbâth hukum yang digunakannya dalam masalah ini adalan metode qiyâs.

Abstract

Indonesia merupakan negara berbhinneka, beragam agama, suku, adat dan budaya, bahasa. Setiap daerah mempunyai ciri khas budaya dan bahasa yang berbeda satu sama lain. Keberagaman itulah yang membuat Indonesia menjadi indah, bukan sebaliknya membuat kita menjadi terpecah. Setiap suku dan adat mempunyai sejarah ciri khas tersendiri. Minangkabau yang merupakan salah satu suku bangsa mempunyai budaya dan bahasa yang berbeda dari daerah lainnya. Minangkabau dikenal sebagai salah satu suku bangsa yang kental dengan keIslamannya. Penelitian ini bermaksud untuk menjelaskan bagaimana nilai-nilai Islam mempengaruhi adat di Minangkabau ditinjau dari perspektif sejarah. Hal ini penting supaya tidak ada kesalahpahaman dalam mengenal Islam dan adat Minangkabau. Metode pencarian data yang digunakan adalah studi kepustakaan  serta diuraikan dengan cara deskriptif analitis. Inti dari gagasan penelitian ini adalah jangan sampai ada yang gagal paham dalam memahami sejarah.

Abstract

The policy proposal linking social assistance to vasectomy has sparked considerable debate due to its complex relationship with reproductive rights, ethical issues, and religious beliefs. This study addresses the topic through the framework of Maqasid al-Shari‘ah, focusing on two primary objectives: ḥifẓ al-nasl (protection of lineage) and hifz al-mal (protection of wealth), while also considering gender equality. Using a qualitative library research approach, the study explores a variety of sources related to Maqasid al-Shari‘ah, gender equality, population control, and the allocation of social welfare. The findings suggest that vasectomy is traditionally viewed as conflicting with ḥifẓ al-nasl because it directly impacts reproductive capacity. Reproductive decisions traditionally emphasize the preservation of lineage, and any action that impairs fertility is often seen as contrary to this objective. However, under the principle of necessity (ḍarūrah), there is room for exceptions, where actions like vasectomy may be justified if they lead to greater public welfare (maṣlaḥah), especially in cases of overpopulation or when the financial resources required for raising children exceed the capacity of families or the state. From a Maqasid perspective, vasectomy could contribute positively by improving the quality of future generations through more sustainable family planning. Additionally, involving men in contraceptive responsibility aligns with gender equality, fostering a more equitable distribution of reproductive duties between men and women. This approach promotes justice by reducing the disproportionate burden placed on women and encouraging shared responsibility in population control efforts, which are critical for maintaining the long-term effectiveness of social welfare programs.

Abstract

The prohibition of marriage between residents of Nagari Singkarak and Nagari Saniangbaka is a social tradition that remains strong to this day. This prohibition stems from the historical belief that the ancestors of both nagari came from the same father, albeit different mothers, and are therefore considered to be closely related. This study aims to examine the factors that cause this prohibition to remain in place and analyze them from the perspective of saddu al-dzari'ah, a concept in Islamic law that aims to prevent harm. This study uses a qualitative method with a normative-sociological approach through interviews with various parties from the local community, supported by reference data from relevant books and articles. The results show that this marriage prohibition persists because of the witnesses required for violators and its relevance to the principle of saddu al-dzari'ah, as it aims to prevent things that can cause social and moral harm, such as kinship conflicts, social tensions, and violations of the sanctity of blood relations. The community's determination to uphold this prohibition reflects the resilience of traditions combined with Minangkabau religious and cultural values. Although some people feel disappointed because the prohibition limits their freedom to choose a life partner, in general, the community considers that this provision brings mutual benefit. Thus, the prohibition of marriage between residents of Singkarak and Saniangbaka can be understood as an implementation of the principle of saddu al-dzari'ah in a socio-cultural context that aims to maintain the honor, friendship, and social stability of the community. Larangan perkawinan antarawarga nagari Singkarak dengan warga nagari Saniangbaka merupakan tradisi sosial yang masih bertahan kuat hingga kini. Larangan ini berakar dari keyakinan sejarah bahwa nenek moyang kedua nagari tersebut berasal dari ayah yang sama, meskipun berbeda ibu, sehingga dianggap memiliki hubungan kekerabatan dekat. Penelitian ini bertujuan untuk melihat faktor-faktor penyebab bertahannya aturan larangan tersebut dan menganilisisnya dalam perspektif saddu al-dzari‘ah, yakni konsep dalam hukum Islam yang bertujuan menutup jalan menuju kemudaratan. Penelitian ini menggunakan metode kualitatif dengan pendekatan normatif-sosiologis melalui wawancara dengan berbagai pihak dari masyarakat setempat, serta didukung dengan data referensi dari kitab, artikel dan sumber-sumber yang relevan. Hasil penelitian menunjukkan bahwa larangan perkawinan ini tetap bertahan karena adanya saksi yang diterapkan bagi pihak pelanggar dan memiliki dasar hukum yaitu prinsip saddu al-dzari‘ah, karena bertujuan mencegah terjadinya hal-hal yang dapat menimbulkan kemudaratan sosial dan moral, seperti konflik kekerabatan, ketegangan sosial, dan pelanggaran terhadap nilai-nilai kesucian hubungan darah. Keteguhan masyarakat dalam mempertahankan larangan ini mencerminkan adanya resiliensi tradisi yang berpadu dengan nilai-nilai keagamaan dan adat Minangkabau. Meskipun terdapat sebagian pihak yang merasa kecewa karena larangan tersebut membatasi kebebasan dalam memilih pasangan hidup, namun secara umum masyarakat menilai bahwa ketentuan ini membawa kemaslahatan bersama. Dengan demikian, larangan perkawinan antar warga nagari Singkarak dan Saniangbaka dapat dipahami sebagai bentuk implementasi prinsip saddu al-dzari‘ah dalam konteks sosial budaya yang bertujuan menjaga kehormatan, silaturahmi dan stabilitas sosial masyarakat.
