Abstract

This study aims to analyze how the state regulates the administration of unregistered marriages (nikah sirri) in Muslim minority communities in Jayapura City, with a focus on the practice of mass weddings organized to facilitate the registration of marriages. Unregistered marriages, which are not recorded by the state, are still found among Muslim minorities in Jayapura. Factors influencing the practice of unregistered marriages include economic limitations, lack of awareness about administrative procedures, and difficulty in accessing official marriage registration services. To address these issues, the Jayapura City government, through the Religious Affairs Office (KUA), the Religious Court (PA), and the Directorate General of Population and Civil Registration (DUKCAPIL), has initiated a mass wedding program aimed at simplifying the legalization process for couples who have not yet registered their marriages. This research uses a qualitative approach with interviews and observations of couples participating in the mass wedding program. The findings indicate that this program is effective in raising public awareness about the importance of marriage registration. However, challenges remain in terms of legal understanding and the readiness of couples to comply with the applicable administrative procedures. The study suggests the need for increased education about the importance of marriage administration and strengthening access to marriage registration services to reduce the practice of unregistered marriages. With the mass wedding program, it is hoped that all marriages in Jayapura City can be legally registered according to state law, providing optimal legal protection for married couples

Abstract

The fatwa on the prohibition of inter-religious greetings issued by the Majelis Ulama Indonesia (MUI) in English Indonesian Theologian Council has caused controversy in the context of inter-religious relations in Indonesia. This study aims to evaluate the impact of the fatwa on Islamic family law and social harmony, focusing on the intolerance caused by interfaith interactions. Using a qualitative approach, this study conducted a content analysis of the text of the Indonesian Theologian Council fatwa and literature related to maqashid al-syariah and Islamic family law. Data were obtained through a documentation study of Indonesian Theologian Council fatwas, books, articles, and academic publications. The analysis technique involved identifying the main themes in the fatwa, comparing them with maqashid al-syariah principles, and evaluating their impact on multicultural family relationships and social harmony. The results show that this fatwa, although aimed at protecting Islamic identity, has the potential to cause tension in family relationships that have members with different religious backgrounds and undermine social harmony. The research emphasizes the need for open dialogue between scholars, academics and the community to find a more inclusive and tolerant solution. A more moderate approach is hoped to be adopted to create interfaith harmony and maintain harmony in Indonesia's multicultural society.

Abstract

The MUI fatwa related to interreligious greetings has created polemics in Indonesian society, particularly in the context of Islamic moderation. This fatwa prohibits interreligious greetings which are considered to damage the purity of Islamic teachings that affect social relations, especially in families that have different beliefs. This article aims to analyse the impact of the MUI fatwa on the dynamics of family law in Indonesia, especially on families who have different beliefs and their relevance to the principles of Islamic moderation in the context of family law. This article uses a qualitative approach with an analysis of the content of the MUI fatwa related to greetings in family law, and interviews with family law experts and religious leaders who understand the implications of the fatwa on family relations in interfaith Indonesian society. This article shows that the MUI Fatwa causes tension in families of different beliefs regarding interfaith greetings. This fatwa also shows the tension between maintaining religious identity and maintaining family harmony. In the context of family law, this fatwa affects basic principles such as respect for religious differences and the values of inclusivity in families of different religions. This article offers a new perspective that connects the MUI fatwa related to interfaith greetings with family law in Indonesia.

Abstract

Purpose – This study explores the transformation of zakat distribution principles as outlined in Nahdlatul Ulama’s Fatwa Bahtsul Masail and its implications for Indonesia's legal regulations. The goal is to understand how these principles can enhance zakat management by addressing social inequality and poverty alleviation.Methodology – A normative juridical approach was used, with a descriptive analytical study based on a literature review. The research focuses on four main aspects: analyzing zakat distribution principles in the context of Indonesian law, examining the legal reasoning (istinbath hukum) behind these principles, identifying factors driving and hindering the transformation, and assessing the significance of implementing these principles in Indonesian legal frameworks.Findings – This study identifies three main principles—justice, equality, and regionality—that should be integrated into regulatory frameworks. It also highlights challenges, including a lack of public participation in zakat distribution through official institutions, such as NU CARE-LAZISNU.Implications – The findings suggest the need for increased socialization of zakat management principles by the National Amil Zakat Agency (Badan Amil Zakat Nasional, BAZNAS), based on both Sharia and secure legal regulations, to enhance the effectiveness of zakat management in Indonesia.Originality – This research provides valuable insights into the evolving principles of zakat distribution and their integration into legal frameworks, contributing to the adaptation of zakat management practices to contemporary challenges in Indonesia.

Abstract

This study examines the practice of qardhul hasan funded by zakat through the perspective of maqasid sharia, focusing on case studies in Indonesia and Malaysia. Qardhul hasan, defined as an interest-free loan, presents a promising method for effectively utilizing zakat funds; however, its implementation within the framework of Islamic law remains a subject of ongoing debate. A qualitative approach was employed, including content analysis and semi-structured interviews with experts in zakat and Islamic law. The findings indicate that maqasid sharia provides a strong foundation for implementing qardhul hasan, particularly in supporting post-pandemic economic recovery. It is crucial to establish clear parameters and guidelines to ensure that qardhul hasan practices adhere to sharia principles and achieve the goal of social justice. This research advances the current understanding of qardhul hasan by highlighting its potential impact on zakat management and economic recovery. Additionally, it encourages zakat policymakers and practitioners to focus on developing effective systems aligned with maqasid sharia and emphasizes the need for ongoing evaluation and trials to enhance zakat's role in societal welfare.

Abstract

Abstract: Fairness in inheritance distribution between men and women in Indonesia is still an exciting topic to discuss. It is proven that classical Islamic thought says that men’s and women’s portions in inheritance distribution are final, as stated in the Qur'an Surat an-Nisa verse 11. However, contemporary Islamic thought sees it as a rule that needs to be contextualized to current situations. This progressive thinking about inheritance distribution was pioneered by gender activists who saw that Fiqh Mawaris has a gender bias and discrimination. Therefore, the application of the "gender-friendly justice" concept in the inheritance distribution in Indonesia needs to be put forward. This research analyses the "gender-friendly justice" concept in inheritance law and its application in Indonesia. This study uses Sigmund Freud's gender theory, with an analytic descriptive method focusing on the problem of inheritance distribution in Indonesia. The research results prove that the concept of "gender-friendly justice" in the inheritance distribution refers to the agreement principle and the gender equity principle, where the application is carried out based on the fairness principle. The gender equality principle is implemented by prioritizing the concept of rahmatan lil'alamin, namely equality as servants and caliph of Allah, equality in receiving primordial agreements and cosmic drama events, and reaching achievements.Abstrak: Keadilan pembagian harta waris di Indonesia antara laki-laki dan perempuan masih menjadi bahan diskusi yang menarik. Pemikiran Islam klasik menyatakan bahwa pembagian harta warisan bagi laki-laki dan perempuan sudah dianggap final, sebagaimana disinggung dalam Al-Qur’an surah an-Nisa ayat 11. Namun, pemikiran Islam kontemporer melihat hal tersebut sebagai aturan yang perlu dikontekstualisasikan sesuai per­kem­bangan zaman. Pemikiran progresif tentang pembagian waris ini dipelopori oleh para pegiat gender yang melihat fiqih mawaris masih bersifat bias gender yang dapat menimbulkan diskriminasi gender, sehingga penerapan konsep “keadilan ramah gender” dalam pembagian harta waris di Indonesia perlu dikedepankan. Tujuan penelitian ini adalah untuk menganalisis konsep “keadilan ramah gender” dalam hukum waris dan penerapannya di Indonesia. Penelitian ini menggunakan teori gender Sigmund Freud, dengan metode deskriptif analitik yang memusatkan perhatian pada masalah pembagian waris di Indonesia. Hasil riset membuktikan bahwa konsep “keadilan ramah gender” dalam pembagian harta waris mengacu pada prinsip kesepakatan dan prinsip keadilan gender bagi anak laki-laki dan perempuan, dimana penerapannya dilakukan berdasarkan atas asas keadilan. Penerapan prinsip kesetaraan gender ini diterapkan dengan menge­depankan konsep rahmatan lil’alamin yakni penyetaraan sebagai hamba dan khalifah Allah, penyetaraan menerima perjanjian primordial, penyetaraan dalam peristiwa drama kosmis, dan penyetaraan dalam meraih prestasi.

Abstract

This study examines the welfare issues of private university lecturers in Indonesia who receive substandard wages, by analyzing them through the perspectives of Islamic law and positive law. The objective of this paper is to explore the alignment between the principles of wage justice in Islamic law and the wage regulations within the national legal framework, especially concerning employment in the private higher education sector. The methodology employed is normative juridical with a qualitative analysis of legal documents and Islamic legal literature. The findings indicate that private lecturers are employed under contractual agreements subject to labor regulations, which often fail to provide adequate welfare guarantees. On the other hand, Islamic law emphasizes justice, fairness, and certainty in wage distribution as part of workers' rights protection. The main novelty of this study lies in identifying the gap between the normative ideals of Islamic law and the practical enforcement of positive law in the higher education context. The impact of this research is to propose an integrative legal approach that incorporates Islamic ethical values into wage regulation policies, aiming to improve the socio-economic well-being of academic professionals in Indonesia. Abstrak: Penelitian ini mengkaji permasalahan kesejahteraan dosen perguruan tinggi swasta (PTS) di Indonesia yang menerima upah di bawah standar, dengan meninjau dari perspektif hukum Islam dan hukum positif. Tujuan dari studi ini adalah untuk menggali kesesuaian prinsip-prinsip keadilan upah dalam hukum Islam dengan pengaturan pengupahan dalam sistem hukum nasional, khususnya terhadap tenaga kerja di sektor pendidikan tinggi swasta. Metodologi yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif dengan analisis kualitatif terhadap dokumen hukum dan literatur keislaman. Hasil kajian menunjukkan bahwa dosen PTS memiliki status hubungan kerja berdasarkan perjanjian kerja yang tunduk pada aturan ketenagakerjaan, yang dalam praktiknya belum memberikan jaminan kesejahteraan yang memadai. Sementara itu, hukum Islam menekankan keadilan, kelayakan, dan kepastian dalam pemberian upah sebagai bagian dari perlindungan hak pekerja. Temuan utama dari penelitian ini menunjukkan adanya kesenjangan antara idealisme hukum Islam dan implementasi hukum positif di sektor pendidikan tinggi. Studi ini memberikan kontribusi dengan menawarkan pendekatan integratif antara hukum Islam dan hukum ketenagakerjaan untuk mendorong formulasi kebijakan pengupahan yang lebih adil dan berorientasi pada kesejahteraan akademisi di Indonesia. Abstract

Fenomena fatherless atau ketiadaan peran ayah dalam kehidupan anak meningkat akibat perceraian, kematian, ketidakhadiran emosional, dan budaya patriarki. Ini berdampak pada kriminalitas, ekonomi keluarga, dan pendidikan di Indonesia. Penelitian ini meneliti bagaimana kisah Nabi Ibrahim dan Ismail dalam al-Qur’an bisa memberikan solusi untuk mengatasi masalah fatherless dan dampak patriarki terhadap peran ayah. enelitian ini menggunakan metode kualitatif dengan library research, menganalisis buku, jurnal, dan dokumentasi terkait. Pendekatan Qur’ani digunakan untuk menganalisis kisah Nabi Ibrahim dan Ismail. Hasilnya menunjukkan bahwa komunikasi yang baik dan penuh kasih sayang antara ayah dan anak, seperti yang dicontohkan Nabi Ibrahim dan Ismail, bisa mengurangi dampak negatif fatherless. Al-Qur’an menawarkan model pengasuhan ayah yang efektif dan menyarankan penghapusan patriarki untuk mendukung peran aktif ayah.

Abstract

Bagi umat Islam adanya sertifikasi halal dapat lebih meyakinkan konsumen terhadap produk yang dikonsumsi. Dalam pelaksanaan pengabdian ini kami mengedukasi dan memperkenalkan kepada masyarakat terkait sertifikasi halal terhadap produk UMK dan UMKM. Dalam Undang-Undang mengenai Cipta Kerja yang menimbulkan implikasi terhadap aturan jaminan produk halal bagi pelaku usaha. Dengan adanya label halal dari Majelis Ulama Indonesia (MUI) pada produk pangan akan menjamin keamanan dan kualitas dari produk itu sendiri dan dunia telah menjadikan konsep halal ini sebagai tolak ukur atas kebersihan, keamanan dan kualitas dari produk. Pemerintah masih melaksanakan program Sehati untuk mempercepat proses sertifikasi halal produk-produk UMK. Namun pendampingan PPH (Proses Produk Halal) belum dapat mencapai target. Oleh karena itu, melalui program pengabdian kepada Masyarakat dengan diadakannya kegiatan sosialisasi dan pendampingan PPH dapat membantu dalam tercapainya target yang diharapkan.
