Abstract

Dalam konteks perlindungan konsumen terhadap produk berkualitas rendah, terdapat beberapa atensi utama seperti halnya tidak adanya definisi secara rinci mengenai produk berkualitas rendah. Hal tersebut dapat menyebabkan interpretasi yang beragam dan kesulitan dalam menentukan apakah suatu produk dapat dianggap berkualitas rendah atau tidak karena dalam ketentuan Undang Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen hanya menjelaskan mengenai produk cacat atau rusak tanpa adanya penjelasan secara rinci mengenai kualitas suatu produk yang rendah. Menjelang penghujung tahun 2023 banyak keluhan yang muncul dari konsumen khususnya pengguna motor Honda di media sosial. Keluhan tersebut muncul didasari oleh maraknya kasus rangka eSAF skutik motor Honda yang berkarat dan mudah patah. Tak sedikit yang menyuarakan bila Astra Honda Motor (AHM) perlu melakukan kampanye recall atau perbaikan unit bila memang ditemukan kesalahan produksi yang berkaitan dengan aspek keselamatan. Penelitian ini akan mengulas isu hukum tersebut dengan menggunakan perspektif yuridis disertai perlindungan hukumnya bagi konsumen di Indonesia.

Abstract

The development of information and communication technology in Indonesia has grown rapidly. This development is reflected in activities such as online buying and selling. Nowadays, there are various forms of online transactions, including those that do not require stock, such as dropshipping. However, this system still causes many issues that lead to unlawful actions. This study uses a juridical-normative approach, referring to the Indonesian Civil Code (KUHPer) and the Consumer Protection Law (UUPK). The research reveals that illegal dropshipping often occurs due to the misuse of information and digital transaction systems, resulting in harm to consumers and the original product owners. The conclusion emphasizes the importance of legal measures, both litigation and non-litigation, to protect the rights of consumers and business actors who are harmed.

Abstract

Proper disposal of medical waste is one of the most important things in dealing with the Covid 19 pandemic. Over the last two years, the large number of Covid-19 cases caused by Delta and Omnicron variants has also led to an increase in medical waste generated by the use of masks and other personal protective equipment. This leaves homework for all of us, not just the government. This medical waste is generated not only in medical facilities but also in communities and homes. The waste in this pandemic is classified as Hazardous Waste and Toxic Waste (B3) and may be classified as Infectious Waste. The purpose of this study is to study the management of medical waste related to Covid19 from an ecological point of view so that it can effectively reduce the accumulation of waste that may have a natural impact on health promotion. Is to do. This investigation is a doctrinal/normative legal investigation that uses a legal approach. The data was collected through literature reviews and qualitatively analyzed. As a result of this study, the management of COVID-19 medical waste is regulated, and the treatment of medical facility waste and household waste is different. The purpose of this regulation is to reduce the increase in the amount of waste that can affect the environment and public health.

Abstract

Currently, waste management is a big problem, not only in Indonesia but also throughout the world. Especially after the People's Republic of China (PRC) changed its solid waste import policy on July 18, 2017. The issuance of the National Sword policy aims to limit and tighten imports of plastic waste. The impact of the PRC's policy change is an increase in the flow of waste imports to Indonesia, thus placing Indonesia as a "Plastic Waste Emergency" country. To overcome this problem, Indonesia already has several regulations and laws related to waste imports. The application of waste import rules that are not strict causes losses for local communities in East Java and Surabaya. This study then aims to find out that the import of waste has an impact not only on the environment but also on the political economy and the efforts made by the local government to overcome it. This study uses social research methods based on a qualitative descriptive approach. This study also uses field research methods to obtain data directly from the research object area. There are four data collection techniques, namely observation, questionnaires, Focus Group Discussion (FGD), and documentation. The research subjects chosen were the people of Bangun Village, Mojokerto, and several regional (local) policy-making bodies in Surabaya and East Java. This study will also use a non-random sampling technique, with the selection of samples using purposive sampling. Field data collection will be carried out using interviews conducted directly with the informants using interview guidelines.

Abstract

On-site inspections are a supporting instrument of evidence that allows judges to see the subject matter of the case firsthand. In practice, these inspections are not only applied to civil lawsuits, but also to guardianship cases. The purpose of guardianship is to protect the civil rights of adults who are deemed legally incompetent. One example is case No. 156/Pdt.P/2024/PN Mlg. Although the applicant had fulfilled the evidence requirements under Article 164 of the HIR and Article 1866 of the Civil Code, the judge still recommended an on-site inspection because the available evidence was deemed insufficient to form a legal conviction. This study uses an empirical method through interviews with judges and court clerks at the Malang Class IA District Court. The results of the study show that on-site inspections serve to directly confirm the facts of the prospective ward's condition and strengthen the written evidence. These findings confirm that although it is not classified as formal evidence, on-site inspections play an important role in ensuring the objectivity of guardianship appointments and protecting vulnerable groups in accordance with the principles of justice and legal certainty.

Abstract

Technological advances and globalization have increased interactions between Indonesian citizens (WNI) and foreign nationals (WNA), including those in unmarried relationships. This study analyzes legal protection for Indonesian citizens in disputes over joint property ownership with unmarried foreign nationals, as examined through Batam District Court Decision Number 129/Pdt.G/2021/PN Btm. The research method used is normative juridical, with case, statutory, and conceptual approaches. The results indicate that the Defendant's (WNI) actions do not legally meet the elements of an Unlawful Act (PMH) under Article 1365 of the Civil Code, even though the Plaintiff (WNA) has already entered into a sale and purchase transaction for the house. This dispute is more appropriately classified as a gift without legal basis (onverschuldigde betaling). Legal protection for Indonesian citizens can be provided preventively through written agreements and avoiding nominee practices, as well as repressively by filing an appeal to restore ownership rights based on the certificate.
