Abstract

Fintech P2P Lending has caused many complaints from its consumers. This study discusses how consumer protection regulations can reduce fraud from the P2P Lending platform. This study uses a normative research method using a legal approach and a case approach. The population used in this study were P2P customers. This study analyzes the problem with a legislative concerning consumer protection and financial services authority regulation about information technology borrowing and borrowing services. Data collection used primary legal materials in the form of laws and secondary legal materials obtained from library studies in the form of literature. The researcher applies a qualitative data analysis method. The results of this study are one of the key factors in protecting consumer rights derived from various regulations related to the supervision and supervision system carried out by the government. The government should do more education and outreach to the public regarding the fintech peer to peer lending platform and the formation of the Investment Alert Task Force. The study and formulation of government regulations must be balanced with the speed of technological change and digital transformation by involving practitioners so as not to harm each other. Synergy between stakeholders (collaboration), law, surveillance, and data protection can reduce the risk of illegal P2P platform practices. Coordination and synergy between policy makers and stakeholders will greatly facilitate handling in regulating the P2P Lending platform so as not to cause overlapping regulations that cause new problems.

Abstract

Pesantren is basically an institution that plays a very important role in the era of globalization, namely shaping one's personality. Character education in the current era of globalization really needs character education, because the purpose of character education is to expand spiritual intelligence. The biggest challenge in facing globalization and modernization is where the empowerment of human resources (HR) and the economy in life has changed in every way, especially social and socio-cultural which is very fast and fundamental in every aspect of life. Islamic boarding schools must be able to create people who are IMTAQ (faithful and pious), who are knowledgeable and charitable and form modern humans who are sensitive to contemporary social realities such as "al muhafadotu 'ala qodimish sholih wal akhdu bi Jadidil Ashlah" (maintaining good old things and taking matters into account). For this reason, several strategic steps need to be taken, namely: knowledge, entrepreneurial spirit and work ethic/independence. Islamic boarding schools have developed and won the trust of the community through the implementation of a dormitory system that allows students to receive religious guidance using a reading system or madrasa. In addition to showing the level of diversity, orientation of the pesantren leadership and the independence of the kiai, the high number of Islamic boarding schools indicates that pesantren is a private educational institution that is very independent and is actually a community-based educational practice. The typical leadership of Nyai has a very broad influence on the development of pesantren in society. Based on the analysis of the situation, it is necessary to have an effort to provide alternative solutions that can increase the entrepreneurial involvement of female students through the leadership of Nyai in Islamic Boarding Schools in Semarang City.

Abstract

Penelitian ini bertujuan untuk menganalisis tata mengelola perlindungan data pribadi di era metaverse. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan metode analisis kualitatif. Penelitian ini menunjukkan bahwa perlindungan data pribadi bersifat mendesak dan hadirnya undang-undang perlindungan data pribadi perlu untuk ditelaah. Lemahnya sistem keamanan dan privasi yang mengakibatkan kebocoran data, interaksi sosial yang tidak ada batasnya melalui teknologi metaverse. Hadirnya undang-undang tentang perlindungan data pribadi menjadi suatu jawaban atas lemahnya perlindungan data pribadi. Perlu keterlibatan dari elemen pelaku industri ekonomi digital dan pemerintah dalam membuat kebijakan aturan pelaksana atau teknis, serta penerapan prinsip perlindungan data.

Abstract

This study discusses the Reformulation of Consumer Protection Legal Policies in the Digital Business Era in Indonesia. The purpose of this study is to understand and analyze the reformulation of consumer protection legal policies in the digital business era in Indonesia. The research method used is descriptive analytical method, normative juridical problem approach, primary and secondary legal materials. Descriptive data analysis qualitative deductive thinking. The result of the study is the current condition of consumer protection in Indonesia is measured through Law Number 8 of 1999 which regulates the behavior of business actors with the ultimate goal of providing protection to consumers. However, there are things that are considered so that this UUPK can be reformulated with the aim of perfecting the law. Consumers need to get protection not only from producers but also from the market place. These rules must be clear and firm so that consumers are truly protected.

Abstract

Perkembangan keuangan digital saat ini harus sejalan dengan peningkatan pengetahuan khususnya masyarakat yang berada di daerah. Untuk itu pengabdian ini dilakukan sebagai salah satu upaya memberikan lierasi keuangan digital. Kegiatan pengabdian dilakukan dengan metode ceramah dan diskusi yang sebelumnya telah dilakukan analisis masalah terlebih dahulu agar materi sosialisasi dapat sesuai dengan apa yang dibutuhkan. Hasil yang dicapai pada kegiatan pengabdian kali ini ada meningkatnya pemahaman tentang perkembangan perusahaan pinjaman daring, aturan hukum tentang pinjaman daring dan risiko yang mungkin muncul dari penggunaan pinjaman daring.

Abstract

People's lack of understanding of digital media results in misuse which has consequences for personal and social life. Social media is present as part of internet development. Its presence offers easy and new ways of interacting, communicating, and socializing with the support of interesting features. The number of social media users in Indonesia is dominated by teenagers, so the impact is felt by teenagers. Good use can improve achievement, whereas bad use can have negative consequences for children and adolescents. We need to respond to technological developments that are bringing us to the Industrial Revolution 4.0 wisely. This is what makes Digital Literacy very necessary. Self-understanding of digital technology movements requires us to learn more deeply about material related to digital literacy. To be able to use the internet well, everyone, including students, must have good digital literacy. To be able to use the internet well, it is necessary to strengthen the literacy of students. Apart from that, there needs to be protection so that the internet is used only for good, and teachers must direct students to filter negative things from the internet. After learning about Digital Literacy and Humanity, Santri will be given training on how to prepare PowerPoint as a learning medium. Improving skills in preparing learning media based on digital literacy is an important thing for students to develop.

Abstract

This research aims to analyze differences in legal protection for consumers based on the type of contract in business transactions. Primary data was obtained through unstructured interviews with 385 respondents, and secondary data was collected from various related sources. Data analysis was carried out using the ANOVA test to evaluate the average difference in legal protection between sales, rental, and service contracts. Analysis results ANOVA shows a significant difference in legal protection for consumers based on contract type. Is known that sales and purchase contracts provide significantly higher legal protection compared to rental and service contracts. These findings indicate that the type of contract has a significant impact on the level of legal protection received by consumers. The implication of this research is the need for special attention to regulations and legal protection standards in rental and service contracts to ensure fairness for consumers.

Abstract

Sebagai negara kepulauan yang kaya akan keanekaragaman, Indonesia berada dalam kondisi rentan terjadinya konflik sosial. Konflik tersebut menjadi ancaman serius karena menimbulkan dampak negatif yang sangat signifikan, terutama bagi perempuan dan anak-anak. Oleh karena itu, diperlukan sebuah resolusi yang efektif untuk melindungi kelompok rentan ini. Artikel ini akan membahas mengenai upaya pemerintah dalam melindungi perempuan dan anak yang sering kali menjadi korban utama dalam konflik sosial, dengan fokus utamanya pada kebijakan RAN P3AKS (Rencana Aksi Nasional Perlindungan dan Pemberdayaan Perempuan dan Anak dalam konflik sosial). Tujuan penelitian ini yaitu untuk menggali upaya konkret pemerintah dalam melindungi perempuan dan anak-anak dalam konflik sosial. Metodologi yang digunakan yaitu metode penelitian hukum normatif dengan pendekatan perundang-undangan (Statue Approach). Dari hasil penelitian ini, disimpulkan bahwa Kebijakan RAN P3AKS dapat dijadikan sebagai langkah resolusi yang efektif untuk melindungi perempuan dan anak selama konflik, dengan mererapkan dari beberapa program yakni: pencegahan, penanganan, pemberdayaan, dan partisipasi.

Abstract

Pembelian barang melalui sistem online telah mencapai tingkat signifikan dan menjadi inti dari perdagangan modern. Dalam era digital ini, peran merek menjadi lebih esensial daripada sebelumnya dalam memengaruhi perilaku konsumen. Merek yang dikenal luas atau well-known mark memainkan peran sentral dalam membentuk preferensi pembeli. Artikel ini menjelaskan secara rinci kedudukan hukum merek well-known mark dalam pembelian barang melalui sistem online, dengan fokus pada perlindungan yang diberikan dan kompleksitas yang terlibat. Berbicara tentang transaksi bisnis secara online di Indonesia, pengaturannya dilakukan melalui Undang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Dengan pertumbuhan pesat praktik transaksi produk barang bermerek terkenal melalui sistem online, penting untuk memahami ketentuan hukum guna melindungi pemilik merek terkenal dan konsumen, terutama remaja siswa-siswi yang cenderung adaptif terhadap perubahan tren baru. Perlunya memahami ketentuan hukum tentang merek dan informasi teknologi yang diatur dalam Undang-Undang No. 15 Tahun 2001 dan Undang-Undang No. 11 Tahun 2008, serta Peraturan Pemerintah No. 82 Tahun 2012. Dengan pemahaman yang baik mengenai peraturan ini, pemilik merek terkenal dan konsumen dapat melindungi hak-hak mereka dalam transaksi bisnis online yang melibatkan merek terkenal.

Abstract

Consumer protection law in Indonesia, primarily governed by Law No. 8 of 1999, aims to safeguard consumer rights amidst the complexities of a growing economy. While this law has helped address power imbalances between consumers and businesses, it faces limitations in dealing with challenges arising from the digital economy, particularly in the realms of e-commerce and data privacy. The main objective of this study is to evaluate the effectiveness of Indonesia’s consumer protection framework in the context of these modern challenges. Using a juridical-normative approach, the research analyzes relevant legal provisions through qualitative techniques, focusing on the applicability of existing laws to digital transactions. The study reveals significant gaps, particularly in the protection of personal data, cybersecurity, and privacy in e-commerce. Although various regulations, such as the Electronic Information and Transactions Law and the Trade Law, provide some safeguards, they remain insufficient in fully addressing the risks posed by rapid technological advancements. The enforcement mechanisms are also weak, leaving consumers vulnerable to issues like fraud and data breaches. The study concludes that Indonesia’s consumer protection laws must be revised to address these new challenges, with a more comprehensive and centralized framework that aligns with international standards on data protection and digital transactions.
