Abstract

Abstract: This research tries to find important strategies in improving the quality of accreditation of study programs at the Sharia Faculty of UIN Antasari in 2019-2024. The method used in this study is a field study with a qualitative approach and analyzed using SWOT. The findings in this study are that in 2021-2022 it is rather difficult to achieve Superior accreditation, due to the many deficiencies in improving standard 9 accreditation achievements. So it needs to be addressed until 2024 to achieve excellent criteria by BAN-PT Abstrak: Penelitian ini mencoba untuk mencari strategi penting dalam peningkatan kualitas akreditasi program studi di Fakultas Syariah UIN Antasari pada tahun 2019-2024. Metode yang digunakan dalam penelitian ini adalah kajian lapangan dengan pendekatan kualitatif  dan dianlisis menggunakan SWOT. Temuan dalam penelitian ini adalah bahwa pada tahun 2021-2022 agak sulit untuk mencapai akreditasi Unggul, karena banyaknya kekurangan dalam peningkatan capaian akreditasi standar 9. Maka perlu dibenahi hingga tahun 2024 untuk mencapai kriteria unggul oleh BAN-PT

Abstract

Abstract. This research examines the habits of the people in Pindahan Baru village when the month of Dzulhijjah (Eid al-Adha) comes every year the people in Pindahan Baru village hold a social gathering where the money from the arisan buys sacrificial animals for the seven members of the arisan, and this is done automatically, rotate every year. This needs to be discussed and studied to find out the legal basis, because most of the arisan activities are attended by wealthy people who actually can afford to buy sacrificial animals in cash using their own money (cash) without having to join the arisan. The research method used in this research is empirical research method, which is a research method that uses empirical facts taken from human behavior, both verbal behavior obtained from observation and real behavior carried out through direct experience. From this study, it can be concluded that the sacrificial arisan is basically mubah or permissible, however, according to K.H Kholil Dahlan, sacrificial arisan for people who can afford it cannot be classified as a sacrifice and this is categorized as an act that is not commendable. Penelitian ini mengkaji tentang kebiasaan masyarakat di desa Pindahan Baru ketika datang bulan dzulhijjah (hari raya idul adha) masyarakat di desa Pindahan Baru setiap tahunnya mengadakan arisan yang mana uang hasil arisan tersebut dibelikan hewan kurban untuk tujuh orang anggota arisan tersebut, dan hal ini dilakukan secara bergiliran setiap tahunnya. Hal ini perlu dibahas dan dikaji untuk mengetahui dasar hukumnya, karena kegiatan arisan tersebut kebanyakan diikuti oleh orang yang mampu (orang kaya) yang sebenarnya mereka mampu untuk membeli hewan kurban secara tunai dengan menggunakan uang mereka sendiri (cash) tanpa harus ikut arisan tersebut. Metode penelitian yang digunakan dalam penelitian ini yaitu dengan menggunakan metode penelitian empiris, yaitu suatu metode penelitian yang menggunakan fakta-fakta empiris yang diambil dari perilaku manusia, baik perilaku verbal yang didapat dari observasi maupun perilaku nyata yang dilakukan melalui pengalaman langsung. Dari penelitian ini dapat disimpulkan bahwa arisan kurban pada dasarnya adalah mubah atau boleh, namun arisan kurban bagi orang yang mampu menurut K.H Kholil Dahlan tidak bisa digolongkan sebagai kurban dan hal tersebut dikategorikan perbuatan yang tidak terpuji.

Abstract

Abstract: This research was motivated by the presence of electronic mediation which was carried out at the Barabai Religious Court. The purpose of this study was to find out the opinion of the judges of the Barabai Religious Court on the effectiveness of electronic mediation in the Class 1B Barabai Religious Court. by collecting data from the field. The approach method in this case is the qualitative method. The data obtained are in the form of informant identities, judge opinions and the impact of their use in electronic mediation with data collection techniques by interviews and documentaries. The data was processed and compiled and then analyzed descriptively-qualitatively. The results of research conducted at the Barabai Religious Court, that is the implementation of electronic mediation is carried out through an application that has been approved between the parties, and attended by the mediator judge. According to the Barabai Religious Court judge, electronic mediation was quite effective. Keywords: Judge, Pengadilan Agama Barabai, Electronic Mediation. Abstrak: Penelitian ini dilatarbelakangi dengan adanya mediasi elektronik yang dilaksanakan di Pengadilan Agama Barabai. Tujuan penelitian ini untuk mengetahui pendapat hakim Pengadilan Agama Barabai terhadap efektivitas mediasi secara elektronik di Pengadilan Agama Kelas 1B Barabai.Pada penelitian ini penulis menggunakan jenis penelitian hukum sosiologis atau hukum empiris, yaitu berupa penelitian lapangan (field research) yaitu suatu penelitian yang dilakukan secara sistematis dengan mengambil data yang terdapat di lapangan. Metode pendekatan dalam hal ini ialah dengan metode kualitatif. Data yang diperoleh berupa identitas informan,pendapat hakim serta dampak dari penggunaannya pada mediasi elektronik dengan teknik pengumpulan data dengan wawancara dan dokumenter. Data diolah dan disusun lalu dianalisis secara deskriptif-kualitatif. Hasil penelitian yang dilakukan pada Pengadilan Agama Barabai, bahwa yaitu pelaksanaan mediasi secara elektronik dilakukan melalui aplikasi yang sudah disetujui antar para pihak, dan dihadiri oleh hakim mediator. Menurut hakim Pengadilan Agama Barabai, mediasi secara elektronik sudah cukup efektif.

Abstract

Dayak tribes are often known to people with various traditions. One of the customs that are still preserved is the tradition of Bapalas Bidan. Bapalas Bidan is a mother's gratitude to God for giving birth to a safe and healthy child and a thank you to the midwife who served her, from the womb to the birth of the baby and until the umbilical cord broke. The tradition of bapalas bidan has several stages, the process includes: first bathing the baby, second set foot to the ground, third ritual meayun bayi (swinging baby), fourth ritual batapung tawar and salvation. The research method used in this study is a qualitative research method that is processed by descriptive analysis approach. The Data obtained through interviews with Dayak people who experience or perform the tradition of Bapalas Bidan and from literature studies, namely books, theses and journals which will then be correlated with the views of the Shafi'i school. The results of this study is that the tradition of Bapalas midwives for them Dayak tribe is possible. Meanwhile, according to the Shafi'i school, this tardisi should not be done because it contains shirk which is categorized as ‘urf fasid. However, if the implementation does not contain elements of shirk or signed with the Shari'a, this tradition is categorized as ‘urf Saheeh and the Shafi'i school allows ' ur Saheeh as evidence for the tradition of Bapalas Bidan. This tradition aims as a form of gratitude to God for having been blessed with a healthy and safe child and as a form of appreciation to midwives who have helped all the pregnancy process until delivery. And as a form of preservation of customs that have prevailed since ancient times.

Abstract

This paper has a background in the case of the existenceof the DEPO 04 SAHATI landfill which was built around theeducational facilities of SMP Negeri 3 Sampit, thus disrupting theteaching and learning activities carried out by teachers andstudents due to the odor generated from the temporary shelter. Themethod used is descriptive qualitative field research by conductinginterviews with the clerics of Sampit City. The results obtainedfrom this research are related to the legal determination of theexistence of Temporary Shelters around the SMPN 3 Sampit schooland the need for more intensive management from managers andpublic awareness of the importance of managing waste to minimizethe risks that can interfere with teaching and learning activities.

Abstract

Nira water is a natural resource that is rich in benefits and has high economic potential because it can be made into various kinds of food. In the process of buying and selling nira water in trees carried out by the community, the buyer must pay a certain amount of money to utilize the nira water in the tree without knowing how much nira water he will get. This raises questions about the law of this activity through a review of Islamic law. This research examines the practice of buying and selling nira water in trees with a focus on the aspects of Islamic law. in the tree with a focus on its Islamic legal aspects. Abstract

This study examines the role of the legislative body in safeguarding and maintaining democracy in Indonesia from a constitutional law perspective. The research focuses on how the legislature carries out its functions of legislation, oversight, and budgeting to ensure democratic principles are upheld. It also assesses the legislature's role in holding the government accountable and balancing power with the executive and judiciary branches. The findings show that the legislature plays a significant role in creating transparent, accountable governance aligned with the constitution.

Abstract

Abstract: This research examines the two marriage witnesses who witnessed the marriage contract procession taking place must fulfill certain pillars and conditions, one of which must be fair, so that this becomes a difference contained in Kitab an-Nikah by Sheikh Muhammad Arsyad al-Banjari and Kitab al-Mughni by Ibn Qudamah which specifically defines fair witnesses in marriage variously. This study aims to determine the differences in the meaning of a fair witness in Kitab an-Nikah and al-Mughni. This research is library research, which examines the main ideas of Muhammad Arsyad al-Banjari in the book of an-Nikah and Ibn Qudamah in the book of al-Mughni about fair marriage witnesses. This research is content analysis which is used to obtain information from the two books. The results of the study that in the Book of an-Nikah has a relationship with the opinion of Imam Syafi'i in al-Mughni which states that the witness must be fair based on the meaning of the Hadith about two witnesses must be fair even though the fairness is only at the time of the marriage contract. Meanwhile, according to Imam Hanafi in al-Mughni that justice is not a condition of a witness, which means that a just person or a wicked person does not affect the validity of witnessing a marriage contract. Ulama in requiring fair witnesses vary, so that the statement can take whichever opinion is chosen regarding the requirements for a witness in marriage, as well as a form of prudence by referring to the Hadith about fair witnesses even when the status is only in the marriage contract. In the current era, the procedure for determining a fair marriage witness is by looking at the physical zahirnya (outside). This fair concept is also difficult to apply in society, because the average human being is inseparable from committing small and big sins. Then there is an option before carrying out the marriage contract so that the witnesses and attendees present in one place read istighfar and shahada three times so that their faith is renewed. Keywords: Al-Mughni; Fairness; Kitab an-Nikah; Nikah Witnesses Abstrak:Penelitian ini meneliti terhadap dua orang saksi nikah yang menyaksikan prosesi akad nikah dilangsungkan harus memenuhi rukun dan syaratnya tertentu yaitu salah satunya harus adil, sehingga hal ini menjadi perbedaan yang termuat dalam Kitab an-Nikah karya Syekh Muhammad Arsyad al-Banjari dan kitab al-Mughni karya Ibnu Qudamah yang secara spesifik mendefinisikan saksi yang adil dalam pernikahan dengan beragam. Penelitian ini bertujuan untuk mengetahui perbedaan dari pemaknaan saksi yang adil dalam Kitab an-Nikah dan al-Mughni. Penelitian ini merupakan penelitian kepustakaan (library research), yaitu mengkaji pokok pemikiran Muhammad Arsyad al-Banjari dalam kitab an-Nikah dan Ibnu Qudamah dalam kitab al-Mughni tentang saksi nikah yang adil. Penelitian ini bersifat analisis isi (content analysis) yang digunakan untuk memperoleh keterangan dari kedua kitab. Hasil penelitian bahwa dalam Kitab an-Nikah memiliki relasi dengan pendapat Imam Syafi’i dalam kitab al-Mughni yang menyatakan bahwa saksi itu harus adil berdasarkan makna Hadis tentang dua orang saksi harus adil yang meskipun adilnya itu hanya pada waktu akad nikah saja. Sedangkan menurut Imam Hanafi dalam al-Mughni bahwa keadilan bukanlah syarat dari suatu persaksian, yang berarti orang adil maupun orang fasik tidak mempengaruhi sahnya persaksian akad nikah. Ulama dalam mensyaratkan saksi yang adil dengan beragam, sehingga adanya pernyataan tersebut dapat mengambil pendapat mana yang dipilih berkenaan dengan syarat seorang saksi dalam pernikahan, juga sebagai bentuk kehati-hatian dengan merujuk kepada Hadis tentang saksi yang adil meskipun ketika statusnya dalam akad nikah saja. Di era sekarang juga dalam prosedur penentuan saksi nikah yang adil yaitu dengan melihat kepada zahirnya (luar) fisiknya. Konsep adil ini juga sulit diaplikasikan di tengah masyarakat, karena rata-rata manusia tidak terlepas dari melakukan dosa kecil maupun besar. Kemudian adanya opsi sebelum melangsungkan akad nikah itu agar saksi maupun hadirin yang hadir pada satu tempat tersebut membaca istighfar dan syahadat sebanyak tiga kali agar imannya terperbaharui. Abstract

Penelitian ini membahas tafsir QS. At-Taubah ayat 60 dan 103 serta implementasinya terhadap ekonomi pengelolaan zakat di Indonesia. QS. At-Taubah: 60 menegaskan bahwa zakat wajib didistribusikan kepada delapan golongan mustahik, yaitu fakir, miskin, amil, mualaf, hamba sahaya, gharim (orang berutang), fisabilillah, dan ibnu sabil, dengan penjelasan mendalam mengenai karakteristik masing-masing kelompok menurut Tafsir Al Munir karya Syeikh Wahbah Az Zuhaili. QS. At-Taubah: 103 menegaskan fungsi zakat sebagai sarana pensucian jiwa dan penebusan dosa, serta menegaskan kewajiban pengambilan zakat oleh otoritas yang berwenang. Implementasi kedua ayat ini dalam sistem ekonomi modern di Indonesia diwujudkan melalui pembentukan lembaga pengelola zakat seperti BAZNAS dan LAZ, serta penguatan regulasi melalui Undang-Undang Nomor 23 Tahun 2011. Pengelolaan zakat di Indonesia menekankan prinsip transparansi, efisiensi, dan efektivitas, serta penerapan fungsi manajemen dalam perencanaan, pengorganisasian, pengarahan, dan pengawasan distribusi zakat. Dengan demikian, zakat berperan strategis dalam menciptakan keadilan sosial dan pengentasan kemiskinan di Indonesia melalui sistem pengelolaan yang terstruktur dan terintegrasi.
