Abstract

This study explores the legal implications of the postponement of the halal certification requirement in Indonesia's tourism sector until 2026, focusing on strengthening the authority of the Halal Product Assurance Agency (BPJPH) in supervising and enforcing halal standards. This postponement creates significant challenges in the application of the Lex Superior Derogat Legi Inferiori principle and results in a legal vacuum (rechtsvacuum) that could undermine legal certainty. The study employs a descriptive approach with qualitative analysis involving in-depth interviews with BPJPH officials and constitutional law academics, as well as a review of documents related to halal regulations. The findings indicate that the postponement of halal certification negatively impacts regulatory compliance, damages Indonesia's image as a halal tourism destination, and necessitates strict legal measures to address the legal vacuum and strengthen BPJPH's authority. Practical recommendations are provided to enhance oversight and law enforcement to maintain the integrity of halal standards in Indonesia during this postponement period.

Abstract

The halal trading industry is showing rapid growth, in line with the increasing demand among Muslims for services that comply with Sharia principles. In Indonesia, many hotels comply with sharia, but do not have adequate certification and supervision facilities. This phenomenon occurs incongruence between branding demands and operational practices, which creates reputational risks. Therefore, an in-depth assessment of the regulations and implementation of sharia risk management in this sector is necessary. This study uses a qualitative, normative-empirical approach, using literature review, field observations, and in-depth interviews with Sharia hotel administrators in Bogor and Jakarta. Analysis is carried out by examining regulations and identifying gaps between norms and practice. The results show that the current legal framework does not yet provide clear sectoral standards for Sharia hotels, and business entrepreneurs still have not implemented a comprehensive Halal Product Guarantee System. Various operational dilemmas, unwilling human resources, and weak internal oversight, such as the absence of halal supervisors and internal audits, have been identified. A "Muslim-friendly" branding strategy without official certification contributes to increased reputational risk. This situation threatens user trust and the sustainability of the tourist and halal industry in Indonesia

Law plays a crucial role in regulating social behavior and enforcing rules in society. Indonesia is a nation based on the rule of law and expects its citizens to comply with it for the sake of harmony and collective prosperity. However, there are specific concerns regarding the juvenile justice system in Indonesia which is yet to be optimized. Social environmental factors, such as family dynamics and economic conditions, can influence the involvement of children in criminal acts. This research aims to explore the impact of the social environment on juvenile delinquency and seek preventive solutions. The methodology employed is a qualitative approach, gathering data through literature study observations. Abstract

The era of globalization brings numerous challenges to human rights violations worldwide, including in Indonesia. The human rights issue in Papua, known for its rich natural resources and cultural diversity, has become a controversial topic. Papua faces various problems, including friction between indigenous communities and non-Papuan immigrants, disinformation campaigns, and reports of human rights violations by the Indonesian security forces. Factors adding to the complexity of the situation in Papua include its colonial background, local power dynamics, and advancements in communication technology. The principle of legality plays a crucial role in this context, ensuring every government action is based on existing laws. This qualitative research explores the application of the legality principle concerning human rights violations by the Armed Criminal Group (KKB) in Papua, focusing on the protection of human rights for Papuans. The research results show that the legality principle emphasizes the importance of government actions being based on existing laws and the need for consistent application of laws that do not conflict with human rights. The conflict in Papua requires a holistic solution approach, considering political, social, and cultural elements and strengthening education about human rights and the development of social infrastructure.

Abstract

In the modern era, air transportation has become a necessity for society, especially with the growth of the middle class in Indonesia. Although it brings advantages in terms of speed and comfort, the aviation industry also faces infrastructure and air traffic management challenges. On October 29 2018, the Lion Air JT610 crash tragedy occurred, killing all passengers and crew members. An in-depth analysis of this accident highlights issues of corporate responsibility and criminal law, demonstrating the complexity of responsibility in the aviation sector. This study applies a qualitative descriptive approach, which means this study describes the findings in a narrative format. From the competition between Boeing and Airbus to limited access to information resulting from investigations, this case highlights the importance of transparency, accountability and prioritizing safety in the aviation industry. The findings from the investigation should serve as a basis for improving and implementing more stringent safety standards in related industries. It is hoped that the lessons learned from this incident can avoid similar tragic incidents in the future.
