Abstract

Legal protection against money laundering crimes occurring in the context of taxation in Indonesia. Money laundering involving the tax sector is a serious issue that can disrupt economic stability and national revenue. This study explains the legal framework governing efforts to prevent and combat money laundering, particularly those related to taxation practices, and also identifies weaknesses and challenges in its implementation. The definition of tax crimes includes tax evasion thru forgery committed by individuals or by people working within a legal entity, usually involving collaboration between taxpayers and tax officials for personal gain. Criminal policies related to money laundering in handling tax crimes demonstrate a strong connection between source crimes, such as crimes in the tax sector considered predicate crimes, and money laundering offenses, which can be seen as their derivative. The obstacles and challenges in resolving tax crimes thru the anti-money laundering system are related to weaknesses in the existing evidence system in Indonesian criminal law.

Abstract

Penelitian ini bertujuan untuk menganalisis pertanggungjawaban pidana terhadap pelaku tindak pidana contempt of court, penerapan sanksi dalam sistem hukum Indonesia, serta kendala dan upaya penanggulangannya dalam menjaga kewibawaan lembaga peradilan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan empiris melalui studi terhadap peraturan perundang-undangan dan wawancara dengan aparat penegak hukum serta masyarakat. Hasil penelitian menunjukkan bahwa contempt of court merupakan perbuatan yang dapat dimintai pertanggungjawaban pidana apabila memenuhi unsur tindak pidana, yaitu perbuatan melawan hukum, kesalahan, dan kemampuan bertanggung jawab. Meskipun kebebasan berpendapat dijamin oleh konstitusi, pelaksanaannya tidak bersifat absolut dan memiliki batasan hukum. Namun demikian, penegakkan hukum terhadap contempt of court masih belum optimal karena belum adanya pengaturan khusus pada saat KUHP lama, oleh karena itu pengaturannya belum komprehensi. Oleh karena itu, diperlukan peninjauan ulang terhadap pasal yang multitafsir dalam KUHP Baru, pemerintah perlu memfasilitasi terhadap peraturan baru di KUHP Baru mengenai contempt of court, serta penegakkan hukum yang konsisten.

Abstract

The discourse on revising Law Number 31 of 1997 concerning Military Justice is gaining momentum. Various opinions have emerged, presenting compelling reasons for the law's amendment. The Law on Military Justice was enacted during the New Order regime, which was rife with the political interests of the ruling elite. Furthermore, the substance of the law is no longer in line with legal developments in society, particularly regarding the authority of military courts, which are considered too absolute. The revision of this law must emphasize the implementation of military justice based on internal military violations. Crimes classified as general crimes, including war crimes, corruption, and human rights violations, must be tried in general courts. Keywords: urgency, change, military justice, Indonesian National Armed Forces.

Abstract

The post-truth era creates uncertainty in the search for absolute truth, where objective facts are less influential in shaping public opinion than emotions and personal beliefs. This phenomenon has a negative impact on the democratic process, public perception of democratic institutions, and legal justice. The challenge of distinguishing facts from fabricated opinions affects law enforcement and the integrity of the democratic process. The research method used in this article is normative legal research that examines law as norms or rules that apply in society, focusing on document analysis and the use of legal sources. This research aims to find legal norms that are relevant in answering certain legal challenges or problems, as well as to produce arguments and theories as guidelines in resolving legal cases using secondary data (library research or document studies). In the post-truth era, law remains an important foundation in maintaining justice and order. Although challenges to political correctness can shake public confidence, the roots of law remain strong. The post-truth phenomenon is an irrational phenomenon, while legal truth (ontologically, epistemologically, and axiologically) is related to rational things, so it is quite difficult to debate and bring these two things together. Therefore, it is important to position the two different things in a position where we can find the most basic thing, both philosophically and legally.
